Stayner, for the sale of the Miles C. Bates House, located at 73-697 Santa
Rosa Way, Palm Desert, California (APN 627-102-024), and authorize the
execution of related documents
Recommendation
By Minute Motion, adopt Resolution to:
Authorize acceptance of the bid of $360,000, from Gilbert A. Stayner and
Christian A. Stayner, for the Miles C. Bates House, located at 73-697 Santa
Rosa Way, Palm Desert, California, (APN 627-102-024);
2. Authorize the execution of the Purchase and Sale Agreement, the Grant Deed
and other necessary or appropriate documents by the Chair, Vice Chair or the
Executive Director to complete the transaction.
Strateqic Plan Obiective
This action will further the goals set in Envision Palm Desert under the Land Use, Housing
and Open Space section, by selling a vacant house in a multi-family residential area, and
provide an opportunity for the restoration of a Palm Desert historic landmark.
Backqround Analvsis
The property located at 73-697 Santa Rosa Way, Palm Desert, identified as property 2(b)
on the Long Range Property Management Plan ("LRPMP"), is currently owned by the
Successor Agency to the Palm Desert Redevelopment Agency ("SARDA") and must be
sold according to the disposition strategy approved on the LRPMP.
In January 2017, an appraisal was done for the property using two hypothetical situations,
one being in an "as is" condition, and one being a hypothetical value for the property if it
were granted historical designation. The appraised value of the property in an "as is"
condition was $320,000. With a historical designation, the value increased to $340,000.

Recognizing the historic significance of this unique house to the community, as well as
the modernism movement, City staff met with members of the Historical Society of Palm
Desert and representatives of 2018 Modernism Week to discuss the potential of
partnering in a collaborative effort to market the Miles C. Bates House. Such a
partnership appeared to have the greatest potential to reach a buyer sympathetic to the
modernism movement and who would have the desire to restore the property.
On October 21-22, 2017, during 2018 Modernism Pre-view Week, the property was
opened to the public. A second public open house was held February 17-18, 2018. The
following weekend, February 24, 2018, a live public auction took place at the University
of California at R'iverside Palm Desert Campus Auditorium. A tdtal of five bidders
registered. The high bid received was from Gilbert A. Stayner and Christian A. Stayner,
a father and son architectural team from Sherman Oaks, California, in the amount of
$360,000.
Analvsis
Staff recommends accepting the bid which is $20,000 above the appraised value.
Fiscal Analvsis
The City will realize its portion of the revenue distributed to the various taxing entities.

The UNDERSIGNED, "CONTRACTOR", having carefully examined the site and the
Contract Documents for the purchase of the MILES C BATES HOUSE, 73697 Santa
Rosa Way, Palm Desert, CA , 92260, hereby submits a bid to purchase the property in
accordance with the Contract Documents, including Addenda No(s). 2 for the
amount stated in this Bid.
By submitting this Bid, the undersigned agrees with the Agency:
This Bid constitutes an irrevocable offer for n i n e t y( 9 0) calendar days
after that date.
2. The Agency has the right to reject any or all Bids and to waive any irregularities or
informalities contained in a Bid.
3. That the sale of the property shall be awarded only by the governing bodies of the
Agency. A Purchase and Sale Agreement shall be entered into only
after approval by the Board of the Successor Agency to the Palm
Desert Redevelopment Agency (SARDA), the Oversight Board of
the Successor Agency to the Palm Desert Redevelopment Agency
(OB), and the State of California Department of Finance (DOF).
4. That the accompanying cash, certified or cashier's check or other security deemed
acceptable to the SARDA constitutes a guarantee that if a bid is accepted by the
above referenced parties, the bidder will execute the Purchase and Sale
Agreement and deliver all documents required by SARDA, sufficient to open
escrow, within 10 days after notice of award. If bidder fails to execute and
deliver said documents, the cash, check or s e c u r i t y shall be retained by the
Agency, and is declared forfeited by the bidder.

RESOLUTION NO. SA-RDA 070
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE SUCCESSOR
AGENCY TO THE PALM DESERT REDEVELOPMENT AGENCY
AUTHORIZING ACCEPTANCE OF A BID FOR THE MILES C. BATES
HOUSE LOCATED AT 73697 SANTA ROSA WAY, PALM DESERT, CA
(APN 627-102-024) PURSUANT TO THE LONG RANGE PROPERTY
MANAGEMENT PLAN AND TAKING RELATED ACTIONS
RECITALS:
A. Pursuant to AB X1 26 (enacted in June 2011) and the California Supreme
Court's decision in California Redeve/opment Association, et al. v. Ana Matosantos, et
al., 53 Cal. 4th 231 (2011), the former Palm Desert Redevelopment Agency (the "Former
Agency") was dissolved as of February 1, 2012, the Successor Agency to the Palm
Desert Redevelopment Agency (the "Successor Agency"), as the successor entity to the
Former Agency, was constituted, and an oversight board of the Successor Agency (the
"Oversight Board") was established.
B. AB X1 26 added Part 1.8 (commencing with Section 34161) and Part 1.85
(commencing with Section 34170) to Division 24 of the California Health and Safety Code
("HSC") (such Parts 1.8 and 1.85, including amendments and supplements enacted after
AB X1 26, being referred to herein as the "Dissolution Act").
C. Pursuant to the Dissolution Act, the Successor Agency is tasked with winding
down the affairs of the Former Agency.
D. Pursuant to HSC Section 34175(b), all real properties of the Former Agency
transferred to the control of the Successor Agency by operation of law.
E. On May 5, 2014, the Oversight Board adopted Resolution No. OB-073,
approving a Long-Range Property Management Plan (the "Original LRPMP") which
addresses the disposition of the real properties owned by the Successor Agency.
F. On June 2, 2014, the State Department of Finance (the "DOF") approved the
Original LRPMP.
G. On September 21, 2015, the Oversight Board approved an amendment to
Original LRPMP (the "LRPMP AmendmenY'), allowing the Miles C. Bates House -- Property
2(b) of the LRPMP (APN 627-102-024) (the "Miles C. Bates House Propert�') -- to be sold
on the open market. (The Original LRPMP, as amended by the LRPMP Amendment, is
referred to herein as the "LRPMP.")
H. On December 9, 2015, the DOF approved the LRPMP, as amended.

I. Pursuant to HSC Section 34191.3, the DOF-approved LRPMP shall govern,
and supersede all other provisions of the Dissolution Act relating to, the disposition and use
of the real property assets of the Former Agency.
J. In January 2018, the Successor Agency released a Notice Inviting Bids
regarding the Miles C. Bates House Property for receipt of bids at a public auction.
K. The materials made available to the potential bidders included the form of a
Purchase and Sale Agreement, to be executed by the Successor Agency and the winning
bidder, subject to changes to reflect the terms of the winning bid.
L. Per the result of the public auction conducted on February 24, 2018, the
winning bid was in the amount of $360,000 (the "Winning Bid"), received from Gilbert A.
Stayner and Christian A. Stayner (the "Winning Bidders").
M. The Successor Agency Board is adopting this Resolution to authorize the
acceptance of the Winning Bid and the sale of the Miles C. Bates House Property to the
Winning Bidders.
NOW, THEREFORE, THE BOARD OF THE SUCCESSOR AGENCY TO THE PALM
DESERT REDEVELOPMENT AGENCY DOES HEREBY RESOLVE, DETERMINE AND
ORDER AS FOLLOWS:
Section 1. The above recitals, and each of them, are true and correct.
Section 2. The Successor Agency Board hereby authorizes and directs staff to
accept the Winning Bid, upon the Oversight Board's approval of the sale of the Miles C. Bates
House Property to the Winning Bidders. Each of the Chair, the Vice Chair and the Executive
Director, acting individually, is hereby authorized to execute, for and in the name of the
Successor Agency, the related Purchase and Sale Agreement, the Grant Deed and any other
document necessary or appropriate to consummate the sale of the Miles C. Bates House
Property to the Winning Bidders.
Section 3. The members of the Successor Agency Board and staff of the
Successor Agency and the staff of the City of Palm Desert are hereby authorized and
directed, jointly and severally, to do any and all things which they may deem necessary or
advisable to effectuate this Resolution and the Purchase and Sale Agreement, and to
consummate the sale of the Miles C. Bates House Property to the Winning Bidders.
