Recommendation
By Minute Motion:
1. Authorize Change Order No. 07 for Contract No. C38840D in the amount
of $372,844.80 to Granite Construction Company of Indio, California, for
the construction of the CV Link Project (Project No. 707-20);
2. Authorize the City Manager or designee to execute Change Order No. 07;
3. Authorize the City Manager or designee to review and approve subsequent
written change order requests for amounts up to $50,000 each up to
$289,912.58 remaining in the contingency previously set aside for
unanticipated conditions, per Section 3.30.170 of the Palm Desert Municipal
Code;
4. Authorize Contract Amendment No. 1 for Contract No. C38840A in the
amount of $190,191.04 to DHS Consulting, LLC of Palm Desert,
California, for construction management and inspection of the CV Link
Project; and
5. Authorize the Mayor to execute Contract Amendment No. 1.
Funds are available in Account No. 2314670-5000202, New Construction Tax.
All City expenditures for construction, and construction management and inspection will
be 100% reimbursed by CVAG per executed cooperative agreement, Contract No.
C38840B.
Strategic Plan
The CV Link Improvements fulfill priorities identified in the City’s Strategic Plan, including

Background Analysis
Change Order No. 07:
At its July 9, 2020 meeting, the City Council awarded the construction of the CV Link
project to Granite Construction in the amount of $5,570,155. With its award of the
construction contract, the City Council also approved $837,278 in contingency, and
authorized the City Manager to approve change orders up to $50,000 per change order
for a total of $500,000 before requiring City Council authorization.
Construction of the CV Link project commenced in September 2020. As of April 2021,
the project is 55 percent complete. Work at the trailhead has been temporarily suspended
to allow the project team and contractor to resolve necessary design changes at the site.
Change Order No. 07 covers those changes, which includes retaining walls and other
concrete work, grading, and fencing due to design deficiencies. The change order also
includes striping modifications due to field changes and coordination with the San Pablo
Phase 2 project. Due to the re-design effort, the contractor will be granted an additional
60 days to complete the project. The new completion date will be July 16, 2021.
To date, the City Manager has approved $180,520.62 in six change orders for this project.
Change Order No. 07 is an increase of $372,844.80 to the contract, for a total change
amount of $553,365.42. This will leave a balance of $289,912.58 in contingency.

In the interest of expedient approvals of future change orders for the CV Link project, staff
is recommending the City Council authorize the City Manager to approve subsequent
change orders up to $50,000 per change order, up to the $289,912.58 remaining in
unused contingency previously set aside by the City Council for the project.
Contract Amendment No. 1:
At its August 22, 2019 meeting, the City Council awarded the construction management
and inspection of the CV Link project to DHS Consulting, LLC in the amount of $453,624.
No contingency was set aside for this contract.
A contract amendment is necessary to:
1. Ensure the construction manager remains on the project through the extended
construction contract completion date;
2. Cover additional and unanticipated costs the construction manager has expended
in coordinating field changes and trailhead re-design; and
3. Reflect increases in prevailing wages since the contract was executed in 2019.
The Consultant has further detailed the justification for the Contract Amendment in the
attached proposal.
Fiscal Analysis
The change order amount will be deducted from the contingency set aside for the
construction contract, and funds for the contract amendment are available in the New
Construction Tax Account. Therefore, there is no need for appropriation and no fiscal
impact to the general fund.
Per the Cooperative Agreement between the City and CVAG, Contract No. C38840B,
CVAG will reimburse the City 100 percent of the project construction cost, including the
construction contract, contingency used, and the construction management services

CVAG concurs to the change order and contract amendment.
Through February 2021, the City has invoiced CVAG for reimbursements totaling
$1,919,935.90.

Subject: Change Order No. 7, CV Link (Project No. 707-20, Contract No. C38840D)
We are requesting your concurrence to a proposed change order for the above-referenced project. The
change order covers the following items of extra work:
TRAILHEAD MODIFICATIONS
Revised Architectural Treatment: The contract documents called for recessed CV Link branding in lower
retaining wall number one approaching the trailhead. The contractor ordered and installed form liner per
the dimension called out on the contract drawings. Prior to the wall being poured, the Resident Engineer
discovered that the form liner did not extend to the entire visible length of the wall, thus not meeting the
known design intent of the architectural treatment. The Resident Engineer discussed with City and CVAG
staff and the decision was made to correct the recessed design. The Resident Engineer provided direction
to the contractor to redo the architectural treatment per the understood design intent. Total increased cost
for this scope of work change is $13,174.37
Revised Footing Elevation Retaining Wall No. 01: The contractor excavated the retaining wall number
one footing to the design elevations. During a field visit the Resident Engineer observed that the top-of -
footing elevation would not have proper coverage per the standard detail. In addition, the elevation would
conflict with the proposed sidewalk improvements. The Resident Engineer provided revised elevations to
the contactor which required additional excavations and re-work by the contractor. Total increased cost for
this scope of work change is $26,131.72.
Delete Retaining Wall No. 02: Once rough grading was complete, the Resident Engineer observed that
the top of wall profile of retaining wall number two did not work with the existing topography. In addition, the
wall footing as designed was not constructible given the easement limits. The Resident Engineer instructed
the contractor to delete retaining wall. As a result of the change, the contractor incurred additional grading
costs totaling $35,615.11. Reduce costs of various bid items totals ($97,620.00). Total decreased cost for
this scope of work change is ($62,004.89).
Caltrans Type 6 Masonry Retaining Wall & Retaining Curb: Various portions of the deleted retaining
wall number two are required to properly tie-in existing grades from the RC track. Additional segments north
of the RC track, near the CVWD well site also require a retaining wall to properly tie in the newly proposed
features. In addition, a 6-inch retaining curb must be installed within the Southern California Edison (SCE)
easement to maintain access to an existing electrical transformer. Total increased cost for this scope of
work change is $88,142.00.
Commercial Driveway Approach: There is an existing access gate to the RC track which was not
accounted for in the proposed design as there was no existing driveway into this access gate. A driveway
approach across the proposed multi-use path will be incorporated into the new design to maintain access
to this existing facility. Total increased cost for this scope of work change is $15,000.00
Add Stadium Seating at Bump & Grind: After the contractor completed the rough grading at the trailhead,
it was observed by the Resident Engineer that the finish grade of the access point would not properly tie
into the existing trailhead. Step and retaining wall construction is required to make up the elevation
difference between the proposed finished grade of the access point and the trailhead within the existing
easement. Re-grading of the access point was not possible since retaining wall number one had already
been constructed and the wall height could not economically be altered. Total increased cost for this scope
of work change is $41,500.00
Addition Gravity Wall & Slope Paving at Bump & Grind: There is an existing concrete lined drainage
channel which parallels the southerly border of the proposed access point improvements. Due to the
variance in elevation, a retaining wall is required to support the existing channel. Concrete slope protection
from the top of the channel to the top of the retaining wall have been proposed to decrease maintenance
costs. Total increased cost for this scope of work change is $38,373.00
Remove & Replace Existing Chain Link Fence and Gate: The existing fence which surrounds the RC
track is in poor condition and would not adequately serve as an allowable barrier along the top of the new
proposed retaining wall. The Resident Engineer suggested to City and CVAG staff that the chain link fence
which divides the RC track property and trailhead improvements be removed and replaced. Total increased
cost for this scope of work change is $25,000.00.
Mobilization, Survey, Delay, and Time-Related-Overhead: Work at the trailhead has been suspended
since late December to allow time for many of the changes incorporated in this change order. As such the
contractor has incurred additional costs for traffic control, security, mobilization, and time-related-overhead.
Total increased cost for this scope of work change is $106,903.80.
Time Impact
A determination of the delay in completion of the contract due to the work specified in change order No. 07
has been made in accordance with the contract documents. The contractor shall be granted an additional
60 calendar days.
STRIPING AND MARKINGS MODIFICATIONS
San Pablo Phase II Integration: At the time of bid, the timing of the San Pablo Phase 2 project was
unknown and therefore design changes had not been integrated into the project plans. CV Link design
specifications had been incorporated into the San Pablo Phase II contract. Due to the timing of the two
projects, it was discussed with the City and CVAG that all CV Link costs associated with San Pablo Phase
II should be removed from that contract and added to this contract due to cost savings as well as
consistency for all materials. Total increased cost for the scope of work change is $26,354.80.
Various Striping Modifications: Throughout various locations on the project, additional removals and
striping changes have been required to remove conflicts and meet striping guidelines set forth by the
California Manual on Uniform Traffic Control Devices (CA MUTCD). In addition, there were multiple
locations where the contract plans missed existing driveways which required additional conflict zone
striping. Total increased cost for the scope of work change is $54,270.00.
With its award of the construction contract on July 9, 2020, the City Council approved $837,278.00 in
contingency, and authorized the City Manager to approve change orders up to $50,000 per change order
for a total of $500,000 before requiring City Council authorization.
To date, the City Manager has approved $180,520.62 in change orders for this project. This change order
is an increase of $372,844.80 to the contract, for a total change amount of $553,365.42. This will leave a
balance of $289,912.58 in contingency. The construction manager is maintaining extensive documentation
of the work to support the change order, which is available upon request.

This Change Order covers changes to the subject contract as described herein. The Contractor shall construct, furnish
equipment and materials, and perform all work as necessary or required to complete the Change Order items for time
and materials and/or a lump sum price agreed upon between the Contractor and the City of Palm Desert, otherwise
referred to as Owner.

Dear Mr. Bowman,
Anser Advisory, LLC (previously DHS Consulting, LLC) respectfully requests a change order to Contract No. C38840A
– Construction Management Services for the CV Link Project (Project No. 707-20) for the following reasons:
Increased Construction Duration
Our original proposal assumed a construction duration of 135 working days (approximately 6.5 months). The final
contract duration was awarded with a construction duration of 240 calendar days (8 months). In addition, Granite
CCO No. 07 will extend the contractor contract duration by 60 calendar days.
Additional Constructability Review Scope and Design Challenges
During the initial constructability review phase, it was anticipated that we would be reviewing existing plans and
specifications. Anser spent additional time assisting in preparing the contract documents and specifications, which
was not in the original scope of work.
During construction there have been numerous design challenges, mostly related to existing elevations busts that
were unforeseeable during a constructability review. These challenges have required a substantial amount of
additional time by the Resident Engineer to revise construction drawings to work with existing field conditions.
Increased Salary Costs
There was a prevailing wage increase in July 2020 and another which will take place in July 2021. To date, Anser as
absorbed all salary adjustments since the signing of our contract, however we would request a 4% increase to our
previously agreed upon rates for the Resident Engineer and Prevailing Wage Inspector to account fo r increased
salaries due to the extended duration of our contract.
Anser respectfully requests an additional $190,191.04 to complete the project. A detail cost breakdown is attached.

LETIGATION STATEMENT
Anser Advisary is currently named in a claim and iawsuit filed by FosS Maritime Company against the Port ot Long
Beach. Foss Maritime has named all entities involved in the project including but not limited to lensen Maritime and
Anser Advisory. Anser Advisory pravided project controls and grant compliance services as a subconsultant to Jensen

Segments 4B and 5 and is currently providing inspection services for RCTD on various roadway project5. During his
#ime on Bayshare Bikeway, Mr. Chavez was able to quickfy identify several criticaf errars that the contractor had
made in their layouts and cor�struction methods. This helped not only the contractor, but the �roject as well by saving
on cost[y rework and schedule irnpacts. In additian to the civil work, the Bayshore Bikeway alsa included traffic signal

PROJECT UNDERSTANDING
The larger CV Link project is an ambitious, multi-modal facility that creates
alternative transportation through the entire Coachella Valley. The Palm
Desert portian of the CV Link is a criticaf campanent to the core alignment.
In addition io ihe new Class IV bikeway, this project also adds a
neighborhaod electric vehicle (NEV) path alang the western edge af the
Toscana County Club.
DH5 Cansulting has �een invalved in canstructing bike paths of similar
work over �he past four years for various public agencies. Our experience
and IesSons learned bring a curren# awareness of the challenges and successes of managing a regional bike pa#h
project. in addition to our pa5t experiences, we have performed numerous site �isits to the proposed route of the
of the CV Link pro�ect through Palm Desert and are already prepared for the challenges that this project may face.

PR4JECT APPROACH
Constructabitity Re�iew - Immediately following the City's notice to proceed, DHS will begin our constructability
review of the project plans and specifications. To complete this ta5k, DH5 will utilize Bluebeam Revu software to
provide all comments on the project plans and specifitations. DHS will mark up a set af plans an the PDF editor a5
shown in the example drawing in Figure 1. Tf�ere are twa benefits with this software which can improve efficiency
and reduce review times between the project team. First, we can place the drawings in a cloud-based s�rver
where multiple team members can comment directly on the PDF. This will allow simultaneous reviews rather than
back and forth commenting be�r►veen the team. Secorid, ance all the comments are campiled an tne marked-up
PDF set, the software can export a review sheet (Figure 2) w[�ich clearly identifies the page number, comment and
most impor�antly a picture of the item being discussed. This report is to supplement or replace th� excel
spreadsheet typically issued as the tracking log far tne constructability comment5. When reviewing comments,
there is no need for a set of plans and excel sheet. Tf�is repart wilI combine both and make for more effitient,
productive meetings with the team. Additional sketches and drawing d�tails containing recommendatians for
package improvements will be provided to supplement the comment log to ensure clarity. The comment/respons�
log will be supplemented witf� full-size sheet plan5 with markups for ea�h projett.

Bidding/Award/Other �re-Construction Services - Once our constructability review is complete, DHS will then assist
the City with putting out a bid package. In collaboration with the design engineer, we will assist the City in answering
any questions which may arise from poten�ia� contractors during that protess. Once the contract has been awarded,
Tyson wi[I kick off the project with a Pre-Construction meeting with the contractor, City, design engineer, and all
other applicable stakeholders to discuss the project. Meeting minutes, which will detail all actian items and
responsible parties for each will be distributed within 24 hours of this meeting completion.
Priar to the first working day, we will begin our documentatian of the existing conditions ,
with a pre-construction photo/video survey. We will capture the existi�g conditions with a
special em�hasis on features and facilities that will need to be removed and reinstalled.
DHS is at the forefront of new inspection technology and has teamed with �penSpace AI
to document field conditions. Similar to Google Street View, we can gea-reference the �
plans with exact photospher� dacumentation of the existing site conditions. A smali

Pu61ic Relations / Communication Plan - The CV Link partion thr�ugh the City of Palm DeSert is the second in a
series of high-prafile bikEway projects tocated within the Coachella Valley. We view ihis project as an opportunity for
the City and partners such as CVAG to effectively communicate and builc# trust within the community prior to the
next project in the master plan.
O�r team's Resid�nt Engineer, Tyson Atwood, is very experienced with projects which involve the publit. TySon
was the Resident �ngineer �or the County of 5an Diego Asphalt Overlay - 5egment `C' project, which paved roads at
o�er 120 locations, a majority of which were in residential �eighborhoods, but also dire�tly in front of a number of
schools. Part af Tyson's roles and responsibilities as Resident Engineer, was to act as the main liaison to the public an
behalf of the Coun#y. Tyson fielded call5 almo5t daily from the public which ranged fram concerns over future
�onstruction activities, requests for additional impro�ements, and praises for paving long deteriorated neighborhood
roads. Tyson maintained a public relations log of all communications, which ensured that lacal resident's concerns
were addressed, #hus establi5hing a positive relationship with the public for the duration of the praject.

At the start af construction, Tyson will work with the City to hel� develop the community outreach program.
Tyson will work closely with the City throughou# the project discussing work schedules, traffic detours, closures,
and any other impacts that may arise to the comm�nity.
Public Safety, Traffic Control & Access - Public safety is paramaunt for all DHS managed projects. This project will
impact resid�ntial, comm�rcial, and school zon�s; each of
which will have their own unique challenges. DH5 will
enforce that the Contractor's number one priority is clear,
unobstructed, safe access for public traffic through
the area. This includes ensuring that ADA compliance is always maintained. Traffic control plans will be stringently
monitored daily to comply with the CA MU7CD standards and any work hour restrictions required by working
around schoof zanes. If a traffic cantrol issue is presented, DHS will direct the Contractor to rectify the situation
immediately. We will not authorize work ihat is unplanned and could cause a safety risk to the public. If an
incident were to occur, we would immediately ensure the safety of the area and natify the City. We will document
and inves#igaie the incident and develap a root cause to ensure the incident is not repeated.
Engineering and �nspection - Our work plan is ta eliminate surprises
to the City by being proactive in workir�g with the Contractor to
identify and resolve deficiencies or problems as quickly as possible at
the lowest le�el. Our inspector will utilize the CPM schedule to
properly advance the con5truction effort by looking ahead, and by
as5isting the Contractor in resolving issues before they became
problems. All work will be inspected for canformance with contract
plans, specifications, and current sp�cifi�d and standards. Inspection
documentation, processes, materials testing, and quality assurance will all he in accordance with t�e City's
preferred methodolagy. Comprehensi�e and accura�e daily records of fiefd acti�ities 6ecome �he go-to do�ument
when a dispute comes to light.

Early recognition of an issue allows added oppartunities for resolutian. If extra work is required, accurate
documentation i5 critical to determine the actual costs incurred and come to an accurate evaluation af cost. When
disputed work is not resolved by change order, it must cantinue under a potential claim. In thi5 case, the DH5
Team will create a file number to track the Contractor's effort with added scrutiny. Accurate documentatian of
manpower, equipment, and materials will allow us to disallow or minimize the cost of disputed extra work.

LESS�NS LEARNED
Lesson's Learned: DHS maintai�s a comprEh�nsive library of lesson'S learned from each
project we work on. DHS welcomes opportunities to share the lesson's learned witn
clients at the end of each project. Early verification that design elevations will properly
tie inta existing topograpf�y is o�e of the most applicable lessons learned we bring from
our exp�rienc� on the Bayshor� Bikeway 4B/5 project. With both Tysan and Javier �a�ing experience working on
survey crews, the DH5 team brings extensive knowledge of survey controls and practices. Once construction stakes
are set, the DHS team will go out a minimum of two days ahead of the Contractor's planned ac#ivities to ensure
design feasibiEity. Minor adjustments can 6e made by the Resident Engineer in the field to ensure the intent of the
design is being met. Staying well ahead of the Contractor will help mitigate �roject delays and costs associated
with extra work due to design omissioris.
Storm Water, Air Quafity Management, & Environmental - Construction acti�ities are ever changing for various
rea5ans throughout a project, thus the reasons for continuous monitoring on a project. Knowing the appropriate
BMP's far various construction activities is key to properly implementing a SWPPP/WPCP and Dust Control Plan,
especially on a project with so many working (ocations. Our team is extremely experienced in both Storm Water
and Air Quality as Tyson i5 a Qualified SWPPP Developer's (Q5D) and i5 al5o SCAQMD Caachella Valley Fugitive
Dust Cantrol certified.
The Cantractor's first abligation will be to obtain a WDID number fram the State Water Resources Control
Board (SWRCB). Gi�en the location and anticipated construction duration of this project, it is highly likely that ihis
project will qualify far an Erosivity Wai�er. In addition to obtaining a WDID, the contractor will alsa be required to
submit a Dus# Cantrol Plan to AQMD.

Prior to any grading activities, Tyson wifl ensure that all proper cfust contral signage and necessary BMPs are
implemented to properly prevent dust and protect M54 inlets and any streams nearby that are threatened by
sedimen�. Due ta various grading activities and roadway and sidewalk remo�al, ihere will be a significant amount
of dirt that trucks will be accessing. We will ensure that the Contractor maintains properly permitted dust levels,
as well as minimizes project track out from the site. Every location will require new concrete sidewalk, curb and
gutter, so our inspectors will ensure the Con�ractor has washouts set up to rinse out the trucks. Tyson will
continually monitor the site far comp[iance and strictly enforce that al� mitigation measures described in the Dust
Control Plan and/or SWPPP (if applicable) are being implemented and documented on a daily basis.
Dacument Cantrol - Accurate praject records are important to any project, but necessary to maintain and receive
praject funding. Without adequate, concise, and searchable documen#ation, potential prajet� research will be
r�early impossil�le. Based on final pr�ject level complexity, we will likely implement ihe Caitrans 63 Category fifing
system. DHS will maintain all fiies on a cloud-based system. By using a secure login, all project fiies will be availabie
to City staff in real time.
Meetings - Documentation of project communication is critical to avoiding any misunderstandings during the
project duration. Verbal discussions in the field, phone conversatians, e-mail messages, mini-memos, formal
letters, and meeting notes are all forms of communication that comprise the bady of understanding that devetops
over the course of the project. In order to manage the flow af information and keep the focus on the impor�ant
issues, Tyson will institute weekly Contractor progress meetings where all stake�olders will be invited to attend.
Minutes of i5sues, discussions, statements, and commitments w�ll be recarded and distributed within 24 hours of
every meeting.
Submittals, RFI's, and Material Acceptance - Proper documentation and management of the status of material
aaeptan�e, �ontra�tar submittals, and requests for information are critical to the sutcess af a prajett. Status logs
are used to track tF�e life of each of tFrese items from inception ta acceptanc� so that no issues are aEEowed to "slip
through the cracks." These logs will be reviewed in detail at each weekly progress meeting held with the
contractar. Our Field Inspe�tor wil[ have access to approved submittals to ensure complian�e wi�h pla�ed product.

CoSt Control and Payment Monitoring - At th� heginning of the praject, our Resident �ngineer wili set up a
master spreadsheet which tracks payment quanti�ies af each bid item, as weli as total payment amo�ant5 each
month to the cantractor. These updated spreadsheets will be provided as part of the monthly reporting for each
progress pay estimate. At the end of each pay period, our inspector will prepare Quantity Sheets that clearly and
accurately calcu�aie the quantity of work completed in the pa5t month. The quantity sheets wilf sF�ow calculations
or field m�asur�ments to justify proper payment to the Contractor. Upon completion by the Field Ir�spector, the
Resident Engineer will checK the Q-Shee�s for accuracy and final payment approval.
With multiple lo�ations and various 5ite �onditions on this project, it is possible that some items may experience
quantity overru�s. The DHS team will closely monitar each it�m of wark and laok for trends early in the operation
that could raise red flags of an overrun. If that does happen, Tyson will immediately bring it ta the City's attention
and begin to form mitigation ideas in order ta save project costs. Tyson has ha� great past success managing cost
o�erruns. While ser�ing as Resident Engineer on the County of San Diego AC Overlay project, Tyson accuraiely
forecasted that the asphalt concrete (AC) quantity was going to be severely overrun. Due to this, the design
engineer was able to revi5e originally proposed treatment types from mill and inlay to overlay, saving on AC
tonnage. Ultimately all planned roadways were comple�ed wi�h an AC treatment and the project finished slightly
under budget.
Change Orders - If a change does arise, our team is we11 versed in the c�ange order process. At first notice of a
change, we will notify the City of the reason for ihe change and justify the cost impacts �o the project. Tyson wil!
perform an Independent Gost Estimate (ICE) prior to receiving the Contractor's estimate. This ICE will be the basis
of the contractor negotiations for the change order. Tyson and the Contractor will review the scope ar�d agree to a
Iump sum cost for �he change. ff the scope cannot be ctearly defined, or if Tyson cannot agree to a cost with the
Cantractor, then a Fflrce Account CCO wil! be issued. Tentative agreements will be issued daiIy by our inspec#or to
the contractor for all work which is being tracked under force account, for any work which may later be disputed.

Our Resident Engineer will ensure that RFI's are fully resalved to the satisfactian of all parties. Should these RFI's
will analyze both bid i�ems and CCOs to estimate th� total contingency used. As discussed in the Cost Control
section, it is imperati�e to communicate the project's budget with the City so that project mitigation measures can
be made and/or additional contingency funds can be secured.
Project Schedule - Minimizing impacts to the traveling public, residents, businesses, and schools will be critical to
the succe5s of this project. As such, careful consideration and clarification will need to be provided to the
contractor during the bid process. As shawn on the following page, DHS has developed a critical path method
(CPM) construction schedule which shows how we anticipate a contractor will tomplete this project. During the
pre-construction services phase, DHS will revise this CPM schedule based on revi5ed scopes of work provide by the
City. By completing tF�e sthedule ahead of time, manipulation of various scenarios can be analyzed very quickly by
the CM team. This information will help the City have a better understanding of how changes to the plans and
shortened work windows may affect the overall project schedule. This will be vital when reviewing work in schaol
zones.
We will ensure that the Con�ractor is camplying with the re�uirements of the monthly schedule updates and
clasely monitor the critical path to avoid delays and disruptions whenever passible. Our unique approach involves
analysis of the Contractor's schedules on a weekly basis, using the infarmation from our inspectors' daily diaries,
meeting minutes, submittal logs, Weekly Stat�ment of Working Days, and other project records. 7his schedule
analysis approach is extremeiy proactive and provides the City with notice of any potential delays. We believe the
project schedu�e is a critical tool for managing project completion, when fully ir�tegrated into th� praject's
requiremen�s. Our experience indicates tF�at a proactive scheduling approach with clear specifications and
effective administration is a pro�en method to reduce risk and liability on the successful completion of �he project
for both the City and the Contractar. We have experience dealing with various sched�fe types, and specific
analytical approaches, including CPM, fragnets, move in schedules and contemporaneous period ana[ysis as an
effective method of characterizing and guantifying delays.

Labor Comp�iance & EEO Monitoring - Labor compliance is one of the most common items audited on
PROl�CT RISK & MITIGATIDN MEASURES
ADA Compliance - public safety upgrades are a key component of this project. One aspect of safe#y improvements
is the constructian of new ADA pedestrian ramp5 to meet new guidelines. These improvement5 add truncated
domes, reduce slopes, ar�d fix flow issues during rain events. Inspection of each of t�ese ramps is critical to ensure
each ramp is built per 5trict tolerances. Our inspection team will document the measurements of each ramp using
tape measures to a 1/16" of an inch and smart levels ta the tenth of a degree to ensure ramp5 do not exceed the
maximum allowable 5lopes/dimensions. If a ramp is found to be ou� of tolerance, the Cantractor will be notified,
and a repair plan requested. The Contractor will not be compensated far the work until the ramp meets project
requirements.

Construction at Monterey Ave and Parkview Drive poses a unique
challenge in that a concrete cross gutter is to be instal�ed across the
main entrance to the College of the Desert which leads to a traffic
�ir��e. DHS will a5sist tF�e City and work with the school in #he
development of a traffic control plan which will shift both directions of
traffic onto an side of the median, whife still maintaining the
functionality of the traffic circle. In order to increase safety, each half
of this work should take place over a weekend, utilizing rapid set
con�rete, so that traffic control de�ices are not required while school is in 5ession. As an alternative �o the
we�k�nd, the work could also be scheduled w�ile the schaol is out of session. As shown in our CPM schedule, we
do not believe that the contractor will be mobilized during the 2019 winter break, whic� means the ideal time to

construction of three detention basins totaling over two acres in size. Project included aver 11,000 SF of new CMU

DHS is at the forefront of new inspection technology and record keeping
�ar construction prfljects. DH5 is teaming with O�enSpace to document
field pragress. OpenSpace AI is a cloud-based program that creates a
digital "Google Maps 5treet View" of each canstruc#ion project. A DHS
field inspector walks the project with a 360-camera mounted to a hard hat
(Figure 3j during their daily inspection. The images are uploaded #a the
OpenS�ace website and the software creates an interactive, 360-degree
view of the inspectors walk. The photographs are GPS tagged and the geo-
tagging is overlaid on a project plan, af�awing the end user ta select any
area along the inspection walk and view that area (similar ta Google Street
View). As shown in Figure 4, a praject can do sicle-by-side comparis�ns

For field and laboratory technicians and special inspectors, overtime rates at 1.5 times the regu�ar rates will be charged for
work performed in excess of 8 hours in ane day Monday through Friday and all day on Saturday. Rates at twice the regular
rates will be charged for all wark in excess of 12 hours in one day, all day 5urtday and an holidays.
Field technician and special inspection hours are charged at a 4-hour minimum, and 8-hour minirrEum for hours exceeding
4 hours.
Invoices are payable upon receipt. A service �harge of 1.5 percent per manth may be charged on accounks nat paid within
30 days.
Our rates will be adjusted in conjunction with the increase in the Prevailing Wage Determination during the life of the
project, as applicable.

AMENDMENT NO. 01 TO THE PROFESSIONAL CONSULTANT SERVICES AGREEMENT
BETWEEN THE CITY OF PALM DESERT AND DHS CONSULTING , LLC

1. Parties and Date.
This Amendment No. 01 to the PROFESSIONAL CONSULTANT SERVICES AGREEMENT
is made and entered into as of this 22nd day of April, 2021, by and between the City of Palm Desert
(“City”) and DHS Consulting, LLC (dba Anser Advisory Management, LLC), a Limited Liability
Corporation with its principal place of business at 73-710 Fred Waring Drive, Suite 102, Palm
Desert, CA 92260. City and DHS Consulting, LLC (dba Anser Advisory Management, LLC) are
sometimes individually referred to as “Party” and collectively as “Parties.”
2. Recitals.
2.1 Agreement. The City and DHS Consulting, LLC (dba Anser Advisory
Management, LLC) have entered into an agreement entitled “PROFESSIONAL CONSULTANT
SERVICES AGREEMENT” dated August 27, 2020 (“Agreement” or “Contract”) for the purpose of
retaining the services of Contractor to provide TRAFFIC SIGNAL PREVENTIVE MAINTENANCE
AND EMERGENCY ON-CALL SERVICES.
2.2 Amendment. The City and DHS Consulting, LLC (dba Anser Advisory
Management, LLC) desire to amend the Agreement for ADDITIONAL COMPENSATION.
2.3 Amendment Authority. This Amendment No. 01 is authorized pursuant to Section
3.3.4 of the Agreement.
3. Terms.
3.1 3.3 Fees and Payments. Section 3.3.1 of the Agreement is hereby amended in its
entirety to read as follows:
3.3.1 Compensation. Contractor shall receive compensation,
including authorized reimbursements, for all Services rendered under
this Agreement at the rates set forth in Exhibit “A” attached hereto and
incorporated herein by reference. The total compensation shall not
exceed Six Hundred Forty Three Eight Hundred Fifteen and 04/100
Dollars ($643,815.04) without written approval of the City Council or City
Manager, as applicable, per the Palm Desert Municipal Code. Extra
Work may be authorized, as described below, and if authorized, will be
compensated at the rates and manner set forth in this Agreement and
as Amended by the Parties.
3.2 Continuing Effect of Agreement. Except as amended by this Amendment No. 01 , all
other provisions of the Agreement remain in full force and effect and shall govern the actions of the
parties under this Amendment No. 01. From and after the date of this Amendment No. 01, whenever
the term “Agreement” or “Contract” appears in the Agreement, it shall mean the Agreement as
amended by this Amendment No. 01.
3.3 Adequate Consideration. The Parties hereto irrevocably stipulate and agree that they
have each received adequate and independent consideration for the performance of the obligations

3.4 Severability. If any portion of this Amendment No. 01 is declared invalid, illegal, or

of which is deemed to be an original, but when taken together shall constitute but one and the same
instrument.

Hello Randy,
Please accept this email as concurrence with the following:
Contract Change Order No. 07 to Contract No. C38840D with Granite
Construction Company in the amount of $372,844.80, and with an additional 60
calendar days.
Contract Amendment No. 1 to Contract No. C38840A with DHS Consulting, LLC
(dba Anser Advisory Management, LLC) in the amount of $190,191.04.
I respectfully request the City of Palm Desert City Council authorize these actions on
April 22, 2021 so the construction of the trailhead improvements at the Bump and
Grind may resume and be completed in July, 2021.
Per executed cooperative agreement, Contract No. C38840B, all construction and
construction management and inspection costs incurred by the City of Palm Desert
will be reimbursed 100% by CVAG.
