HomeMy WebLinkAboutZOA 00-02 ARC MEMBERSHIP 2000 ORDINANCE NO. 934 AN ORDINANCE OF THE CITY OF PALM DESERT, CALIFORNIA AMENDING CHAPTER 25.70 DEALING WITH THE ARCHITECTURAL. COMMISSION AND DECLARE AN URGENCY THEREFORE The City Council of the City of Palm Desert does hereby ordain as follows: Section 1. That Section 25.70.020 of the Code of the City of Palm Desert, California, being the same is hereby amended to read as follows: "25.70.020 Membership. The Architectural Commission shall consist of seven members appointed by the City Council who shall all be voting members." Section 2. That Section 25.70.030 of the Code of the City of Palm Desert, California, being the same is hereby amended to read as follows: 1125.70.030 Appointment and Term of Office. The voting members of the Architectural Commission shall be appointed by the City Council. The first voting members of the Commission shall be appointed for the following terms: A. Two shall serve for a term of four years, B. One shall serve for a term of three years; C. One shall serve for a term of two years; and D. One shall serve for a term of one year. Thereafter, the term of office for voting members shall be four years. If a member is unable to serve for three consecutive regular meetings, the chairman or acting chairman shall declare the office of such member vacant. The secretary shall immediately thereafter inform the City Council. Section 3. That Section 25.70.060 of the Code of the City of Palm Desert, California, being the same is hereby amended to read as follows: RMPUBOM161793 126100 15:05 Ordinance No. 934 1125.70.060 Rules. The Architectural Commission shall adopt rules and regulations for the conduct of its business. Four voting members shall constitute a quorum. The affirmative or negative vote of the majority of the members present shall be sufficient for it to take action." Section 4. The City Council does hereby find and determine that there is a compelling need to revise the membership of the architectural commission and such needs to be done at the present time to assure the orderly and timely processing of applications within said City and further declare the need for this Ordinance to be effective immediately. Section 5. The City Clerk shall certify the passage and adoption hereof and the same shall be in full force and affect upon its passage. CASE NO. ZOA 00-02 WHEREAS, the City Council of the City of Palm Desert, California, did on the 13th day of April, 2000, hold a duly noticed public hearing to consider an amendment to the Palm Desert Municipal Code, Chapter 25.70, Architectural Commission Goals/Policies/ Procedures; and WHEREAS, the Planning Commission by its Resolution No. 1979 has recommended approval; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 00-24," in that the Director of Community Development has determined that the project is a Class 5 Categorical Exemption; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said City Council did find the following facts and reasons to exist to justify its action as described below: 1 . That the Zoning Ordinance amendment is consistent with the objectives of the Zoning Ordinance; 2. That the Zoning Ordinance amendment is consistent with the adopted General Plan and affected specific plans; and 3. That the Zoning Ordinance amendment would better serve the public health, safety and general welfare than the current regulations. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Palm Desert, California, as follows: 1 . That the above recitations are true and correct and constitute the findings of the Council in this case. 2. That ZOA 00-02 as delineated in the attached Exhibit "A" is hereby ordained. BACKGROUND January 27 2000 the City Council adopted Ordinance No. 934 which was an urgency ordinance increasing the number of members of the Architectural Review Commission from five members and one or more alternates to seven full members and sets a quorum at four (4). These sections are part of the Zoning Ordinance. Amendments to the Zoning Ordinance generally are adopted only after a public hearing at Planning Commission, a recommendation by the Planning Commission and a subsequent public hearing at the City Council. The City Attorney has suggested that the amendments be adopted again following the usual public hearing process. CITY COUNCIL STAFF F._rORT ordinance No. 942 I CASE NO. ZOA 00-02 APRIL 13, 2000 Zoning Ordinance Review Committee reviewed this proposed amendment at its February 17, 2000 meeting and supported its implementation with revisions. ZORC noted that in the draft ordinance Section 2 of the total number of members only came to five. This section has been amended to recognize the existing situation of terms at this time. ZORC also noted that Section 2 would provide for removal from office any member who misses three consecutive meetings. ARC meets twice monthly and its permitted absences should be consistent with other commissions that meet twice monthly per Ordinance No. 899. This part.of'Section 2 has been amended to read: "Five unexcused absences in any one year (January 1 through December 31) shall constitute an automatic resignation of any Architectural Review Commission member." March 7, 2000 the Planning Commission held a public hearing. There was no public input. Planning Commission by its Resolution No. 1979 recommended approval of the amendment as recommended by ZORC on a 4-0 vote (Commissioner Lopez was absent). 2. CEQA REVIEW The proposed amendment is a Class 5 categorical exemption for purposes of CEQA and no further documentation is necessary. Motion carried 4-0. G. Case No. ZOA 00-2 - CITY OF PALM DESERT, Applicant Request for approval of an amendment to the Zoning Ordinance, Chapter 25.70, Architectural Commission Goals/Policies/ Procedures. Mr. Smith explained that the City Council adopted a similar document by urgency ordinance back in January. Essentially what they were doing was increasing the number of members on the Architectural Review Commission from five to seven. The former five membership also included one or more alternates and now they were just going with a flat seven members and were declaring a quorum at four. Chairperson Beaty opened the public hearing and asked if anyone wished to speak in FAVOR or OPPOSITION to the proposal. There was no one and the public hearing was closed. Chairperson Beaty asked for commission comments or action. Action: It was moved by Commissioner Finerty, seconded by Commissioner Campbell, approving the findings as presented by staff. Motion carried 4-0. It was moved by Commissioner Finerty, seconded by Commissioner Campbell, adopting Planning Commission Resolution No. 1979, recommending to City Council approval of ZOA 00-2. Case No. TT 27055 - MAINIERO, SMITH & ASSOCIATES, INC., for AMERICAN REALTY TRUST, Applicant Request for reconsideration of a request for a one-year time extension for Tentative Tract Map 27055. Mr. Smith noted that staff had a routine request for a one-year time extension for this tentative tract map. The Architectural Commission shall consist of seven members appointed by the City Council who shall all be voting members." Section 2 That Section 25.70.030 of the Code of the City of Palm Desert, California, being the same is hereby amended to read as follows: "25.70.030 Appointment and Term of Office. The voting members of the Architectural Commission shall be appointed by the City Council. The first voting members of the Commission shall be appointed for the following terms: A. Three shall serve for a term of four years; B. Three shall serve for a term of two years; and C. One shall serve for a term of one year. Thereafter, the term of office for voting members shall be four years. Five unexcused absences in any one year (January 1 through December 31 ) shall constitute an automatic resignation of any Architectural Review Commission member and the chairman or acting chairman shall declare the office of such member vacant. The secretary shall immediately thereafter inform the City Council. The Architectural Commission shall adopt rules and regulations for the conduct of its business. Four voting members shall constitute a quorum. The affirmative or negative vote of the majority of the members present shall be sufficient for it to take action." 3 ORDINANCE NO. 899 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, RESCINDING ORDINANCE NO. 784 .AND AMENDING SECTIONS 2.34.010 AND 2.34.020 OF THE MUNICIPAL CODE RELATIVE TO COMMITTEE/COMMISSION MEMBER REQUIREMENTS. WHEREAS, the City Council adopted Ordinance No. 784 on September 14, 1995, amending Ordinance No. 569, relative to absences from City Committee and Commission members; and WHEREAS, the City Council adopted Resolution No. 9743 on June 26, 1997, revising the appointment date for all City Committee and Commission members and establishing a residence policy for Committee/Commission appointees; and WHEREAS, the City Council adopted Resolution No. 98-22 on March 12, 1998, changing the terms of office to four years for all City Committee and Commission members; and WHEREAS, it is desirable to have all standard regulations for Committee/Commission imembers within one document. BE IT HEREBY ORDAINED -that in effort to continue to attain consistency and efficiency on all of the City's boards, the following will apply: 1. The beginning dates for all terms of appointment to any City Committee or Commission will commence January 1st and end on December 31st. 2. Palm Desert residency shall be a requirement for appointment to a City Committee or Commission except in cases where the City Council deems it appropriate to appoint a non-resident to a board which is in need of specific expertise the non-resident offers. 3.
