HomeMy WebLinkAboutZOA 02-05 UTILITY WELL SITES 2002 ORDINANCE NO.1030 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF I PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO CHAPTER 25.56 GENERAL PROVISIONS REGULATING THE CONVERSION OF ABANDONED PUBLIC UTILITY WELL SITES TO PRIVATE WATER EXPORT IRRIGATION WELL SITES. CASE NO. ZOA 02-05 WHEREAS, the City Council of the City of Palm Desert, California, did on the 12th day of December 2002, hold a duly noticed public hearing to consider an amendment to the Palm Desert Municipal Code, Chapter 25.56 as described above; and WHEREAS, the Planning Commission has adopted, its resolution No. 2166 recommending approval of the proposed amendment; and WHEREAS,said application has complied with the requirements of the"City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No.02-60,"in thatthe Director of Community Development has determined that l the project is a Class 5 Categorical Exemption; and I WHEREAS, at said public hearing, upon hearing and considering all testimony and 111 arguments, if any, of all interested persons desiring to be heard, said City Council did find the following facts and reasons to exist to justify its recommendation as described below: 1. That the Zoning Ordinance amendment is consistent with the objectives of the Zoning Ordinance; 2. That the Zoning Ordinance amendment is consistent with the adopted General Plan; 3. Thatthe Zoning Ordinance amendmentwould better serve the public health, safety and general welfare than the current regulations. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the consideration of the City Council in this case. 2. DISCUSSION: The development and maintenance of golf courses along the southern edge of the City requires significant irrigation waterwhich is not available from on-site wells. To provide this water, several developments have purchased old CVWD wells south of Highway 111 which no longer provide potable water due to nitrate contamination. A recent letter from CVWD, copy attached, indicates that using this water from these closed well sites may have a positive impact on potable water sources by ..removing nitrate nitrogen from the groundwater basin". While these wells were permitted within residential zones as public utility facilities, there are no zoning provisions allowing conversion to private use for off-site export. 1 ORDIANCE NO. 1030 STAFF REPORT CASE NO. ZOA 02-05 DECEMBER 12, 2002 If these abandoned wells carinot be used, irrigation water will be drawn from CVWD's potable water domestic system. The proposed amendment would allow, as a conditional use, the conversion of existing CVWD wells for private irrigation water export provided there is no resulting increase in ambient noise levels. All new physical site improvements would be subject to applicable zoning standards and be subject to normal architectural review. The Planning Commission on a 5-0 vote recommended approval of this amendment. PROPOSED CODE SECTION: It is proposed that Section 25.56.510 be added to read: Conversion of Abandoned Public Utility Well Sites: Abandoned public utility well site may be approved for conversion to a private water export irrigation well site subject to approval of a conditional use permit. Commissioner Jonathan stated that it was a great project. He liked the design and thought the traffic flow made sense. All standards were met and he was ready to move for approval. Commissioner Campbell concurred and said she would second that if it was a motion. Commissioner Jonathan said he would make it a motion. Commissioner Tschopp said that the current plan took into consideration some of the concerns he had with the last building and the drive-up and addressed them. He thought it was a nice project. Commissioner Lopez concurred. Chairperson Finerty stated that she was opposed to the project, mainly because of the tower element. She didn't feel there should be an exception for the tower element right at the Desert Willow golf course. The view would be obstructed to a certain extent from Desert Willow. and rr she knew the City spent a lot of time and effort trying to construct a beautiful golf course. She thought it was an inappropriate location for the tower element and for that reason she was opposed. Action: It was moved by Commissioner Jonathan, seconded by Commissioner Campbell, approving the findings as presented by staff. Motion carried 4-1 (Chairperson Finerty voted no). It was moved by Commissioner Jonathan, seconded by Commissioner Campbell, adopting Planning Commission Resolution No. 2165, recommending to City Council approval of Case No. PP 01-02 Amendment #1 , subject to conditions. Motion carried 4-1 (Chairperson Finerty voted no). J. Chairperson Finerty oogened the public hearing and asked if anyone wished to speak in FAVOR or OPPOSITION to the proposal. There was no one and the public hearing was closed. Chairperson Finerty asked for commission comments. Action: It was moved by Commissioner Campbell, seconded by Commissioner Lopez, approving the findings as presented by staff. Motion carried 5-0. Motion carried 5-0. IX. MISCELLANEOUS - A. Case No. TT 30738 - GHA PALOMA GROUP, LLC, Applicant Referral by City Council to have Planning Commission reconsider applicant's appeal requesting an amendment to Planning Commission Resolution No. 2160 Condition of Approval No. 9 to amend the required side yard setbacks from 14 feet combined to 12 feet combined for 16 lots, amend the 20-foot front yard setback to a 20-foot average with a 16-foot minimum, and increase the maximum height from 18 feet to 20 feet. Mr. Drell noted that at the last hearing at the end of a very long night the Planning Commission denied the applicant's request for this exception. Subsequently, the applicant submitted actual architectural plans, siting, and plotting to the Architectural Commission. APPLICANT: City of Palm Desert (initiated by Planning Commission on October 1, 2002) I. DISCUSSION: The development and maintenance of golf courses along the southern edge of the City requires significant irrigation waterwhich is not available from on-site wells. To provide this water, several developments have purchased old CVWD wells south of Highway 111 which no longer provide potable water due to nitrate contamination. While these wells were permitted within residential zones as public utility facilities, there are no zoning provisions allowing conversion to private use for off-site export. If these abandoned wells cannot be used, irrigation water will be drawn from CVWD's potable water domestic system. The proposed amendment would allow. as a conditional use the conversion of existing CVWD wells for private irrigation water export provided there is no resulting increase in ambient noise levels. All new physical site improvements would be subject to applicable zoning standards and be subject to normal architectural review. II.
