DISCUSSION: This amendment to the Sign Ordinance was established because the Municipal Code does not specifically provide for pedestrian directional signs for commercial buildings or complexes with courtyard or plaza tenants. The Planning Commission at its meeting of June 3, 1980, considered this amendment and determined that such a provision is necessary. In reviewing this amendment, the Planning Commission determined that the maximum height be seven (7) feet, with individual tenant signs being allowed up to a maximum of one and a half square feet of area per tenant. Additionally, a two (2) foot square sign at the top directing pedestrians to the courtyard was proposed by the Planning Commission. The Planning Commission determined that the maximum width of these permitted signs, including supports, should be four (4) feet whether wall-mounted or free-standing. The Planning Commission also amended the proposed ordinance change to allow the business name and/.or principal service to be placed on the individual tenant signs. The Planning Commission unanimously approved the proposed Sign Ordinance as amended. I ORDINANCE NO. 225 AN ORDINANCE- OF THE CITY. COUNCIL OF THE CITY OF PALM DESERT, CALFORNIA, APPROVING AN AMENDMENT TO THE ZONING ORDINANCE TEXT, RELATIVE TO DIREC- TIONAL SIGNS FOR COMMERCIAL BUILDINGS WITH COURTYARD OR PLAZA TENANTS. CASE NO. ZOA 02-80 WHEREAS, the City Council of the City of Palm Desert, California, did on the 261:1 day of June, 1980, hold a duly noticed Public Hearing to consider an amendment of Municipal Code Title 25, Chapter 68 (Zoning Ordinance) , containing sign regulations (Sign Ordinance) , relative to directional signs for commercial buildings with courtyard or plaza tenants. WHEREAS, the Planning Commission, by Resolution No. 605 has recommended approval ; and, WHEREAS, said amendment has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32" , in that the subject project has not been found to present an adverse impact on the environ- ment and a Negative Declaration has been prepared; and, WHEREAS, at said Public Hearing, upon hearing and considering all testi- mony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to approve a Zoning Ordinance Text Amendment: 1. That the Zoning Ordinance Amendment is consistent with the objectives of the Zoning Ordinance. 2. That the Zoning Ordinance Amendment is consistent with the adopted General Plan. 3. That the Zoning Ordinance Amendment would better serve the public health, safety, and general welfare, than the current regulations. 4. That the Zoning Ordinance Amendment is necessary to clearly define the signage entitlement for the situation it addresses. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows : 1. That the above recitations are true and correct and consti- tute the considerations of the Council in this case; 2. That it does hereby approve a Zoning Ordinance Text Amendment, as provided in the attached exhibit, labeled Exhibit "A" , to amend Municipal Code Title 25, Chapter 68, by adding a new section relative to directional signs for commercial buildings with courtyard or plaza tenants. GILLIGAN, CITY CLERK CITY OF PALM DESERT, CALIFORNIA r ORDINANCE NO. 225 • Page Two EXHIBIT "A" 25.68.335 Directional Signs for Courtyard or Plaza Buiinesses where commercial buildings or complexes are designed to contain tenant spaces oriented to an interior courtyard or plaza and where the principal business identification sign is located on that courtyard or plaza frontage, the commercial building or complex may be permitted a pedestrian directional sign(s) , which groups the names of businesses and/or principal services to be found in the courtyard or plaza, located at major pedestrian entrances to the plaza or courtyard, as follows: a. Permitted signs shall not encroach into the public right-of-way. b. Permitted signs may be allowed up to a maximum of Iz square feet of sign area for the identification of each individual tenant space. This area may be utilized by individual sign panels grouped together or by one panel containing the aggregrate area of all courtyard or plaza tenants. In addition to the sign area permitted for individual tenants, a permitted sign may be allowed up to a maximum of two square feet of sign area for purposes of directing pedestrians to the court- yard or plaza, by means of graphic symbols and/or lettering. c. Permitted signs may either be wall-mounted or free-standing, if properly integrated into the architectural and landcape design of the building. d. Permitted signs shall have a maximum height of seven feet above the pedestrian walkway, whether wall-mounted or free-standing. e. PUBLIC HEARINGS (continued) J. Case No. ZOA 02-80 - CITY OF PALM DESERT, Applicant Consideration of an amendment to Chapter 25.68 of the Municipal Code (Zoning Ordinance) of the City of Palm Desert, California relating to Directional Signs for commercial buildings with courtyard or plaza tenants. Mr. Crump presented this case explaining that the Municipal Code did not provide for pedestrian directional signs for commercial buildings with courtyard or plaza tenants. He reviewed the draft amendment (Exhibit A) and recommended approval . Commissioner Kryder pointed out that the sentence in Exhibit A which reads: which groups the names of businesses or principal services--should read: "which groups the names of businesses and/or principal services. . . " Mr. Williams also noted that Item (b) should state 1, sq. ft, instead of one sq. ft. Commissioner Richards asked if the signs still needed to go to Design Review Board before approval . Mr. Williams stated that they would as a part of the projects review. Chairman Miller opened the Public Hearing asking if anyone wished to speak in FAVOR or OPPOSITION to this case. PHYLLIS JACKSON, DRB member, pointed out that Item (d) should be revised to seven feet maximum height, instead of six. Chairman Miller closed the Public Hearing. Motion was made by Commissioner Kryder, seconded by Commissioner Berkey, to approve this case, by adoption of Planning Commission Resolution No. 605, as amended. Carried unanimously (5-0). K. ase No. ZOA 03-80, CITY OF PALM DESERT, Applicant Con 'deration of an amendment to Section 15.68.150 of the Munici 1 Code (Zoning Ordinance) of the City of Palm Desert, Californ ' , relating to real estate open house signs. Mr. Williams pres ted this case stating that the Board of Realtors had requested two changes to t ordinance (a) Exemption from the public property restrictions and, (b) exempt' n to the allowable number of signs. Mr. Williams stated that staff surveyed the oachella Valley and based on that survey staff recommended some minor revisions hown in Exhibit A of the resolution. Chairman Miller opened the Pu lic Hearing asking if anyone wished to speak in FAVOR or OPPOSITION to this case. HARRY HOYT, Representative of the lm Desert Board of Realtors, 49-305 Hwy 111, explained why they were requestin the revisions to the ordinance stating that the present provisions hinders sales. believed that one sign on a corner of public property would be acceptable. RUTH RANAMINE, Real Estate Agent, stated at two signs would not be enough. Chairman Miller closed the Public Hearing. Commissioner Kryder indicated that he needed a larification of the maximum allowable signs. He felt that it would be appr riate to make some exceptions. After Commission discussion it was agreed to revise the draft resolution as follows: First paragraph, second sentence, delete "maximum of two off-site"; Item C, add "unless prior written approval for unique circum ances is obtained from the Director of Envirnmental Services"; Item D, replace ' ne" to "two" and delete "for a second sign". Commissioner Richards suggested that staff report to the mmission after a one year period for any necessary revisions. 1 PLANNING COMMISSION RESOLUTION NO. 605 A RESOLUTION OF THE PLANNING COMPASSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF AN AMENDMENT OT THE ZONING ORDINANCE TEXT, RELATIVE TO DIRECTIONAL SIGNS FOR COMMERCIAL BUILDINGS WITH COURTYARD OR PLAZA TENANTS. REQUEST: Consideration of an amendment to Chapter 25.68 of the Municipal Code (Zoning, Ordinance) of the City of Palm Desert California, relating to Directional Signs for commercial buildings with courtyard or plaza tenants. II . BACKGROUND: A. CASE INITIATION: Consideration of Amendment initiated by Planning Commission Resolution No. 589, April 16, 1980. B. ENVIRONMENTAL ASSESSMENT: The Director of Environmental Services has determined that the proposed project will not have a significant adverse impact on the environment and a Negative Declaration has been prepared. III . DISCUSSION: As Staff noted when this Public Hearing date was established on April 16, 1980, the Municipal Code does not specifically provide for pedestrian directional signs for commercial buildings or complexes with courtyard or plaza tenants. Therefore, Staff developed this proposed ordinance. The Commission must determine what size the tenant signs are to be, what size the top directional sign is to be, how tall the permitted sign is to be, and how wide a structure is to be allowed. IV. DESIGN REVIEW BOARD: The Board reviewed the proposed amendment and felt the maximum height should be 7 feet, the top directional sign size should be 2 sq. ft. and tenant sign sizes should be 1 .5 sq. ft. They also voiced a concern about the width of the total structure and the possibility of the double rows of signs (side to side) . V. STAFF RECOMMENDATION: Staff feels there is a need fora specific Code section dealing with directory signs for courtyard or plaza tenants. Therefore, staff recommends approval of ZOA 02-80, to the City Council , by adopting Planning Commission Resolution No. MINUTES DESIGrt-REVIEW BOARD MAY 27, 1980 Page Three Case No. 133 C - POUL MOLLER AND JOHN OUTCAULT - Preliminary approval of plans to add second story to a commercial building located at 72-055 Painters Path; Poul Moller and John outcault were present. The Board reviewed the submitted plans for the second story addition. The applicant submitted a revised plot plan as suggested in staff comment number one. The Board discussed stucco pop=outs around the windows with the applicants agreeing to provide them. On a motion by Holden, seconded by Barton, t e Board granted preliminary approval of the submitted plans, subject o the following revisions: 1. Windows in addition to be framed out 10" from wall . 2. New parking area to be paveCand double striped per City requirements. 3. Final plans to reflect r4isions required by this approval . Carried 5-0 (Barton, Cook, Holden, Jackson, Martin) IV. DISCUSSION ITEMS Case No. CUP ,0 -80, DP 07-80, and C/Z O1-80 - C. ROBERT HUBBARD - Construction of commercial center to include a Supermarket, Retail Spaces , Savings and Loan, and a Hot /condominium complex at the northeast corner of Hwy 111 and Deep Canyon oad. Applicants and Representatives were present. Th oard reviewed the plans on a conceptual basis and felt that based on e Exhibits reviewed the project was architecturally acceptable. Case No. ZOA 02-80� Amendment to Sign Ordinance for courtyard directory The Board reviewed the proposed ordinance and felt that the following would be acceptable: 1. Top sign to be 2 sq. ft. 2. The Board felt that then ept` ly acceptable. They commented on the possibility of flipping bank locations;squaring the commercial complex, and providing underground parking. II . BACKGROUND: A. CASE INITIATION: Consideration of Amendment initiated by Planning Commission Resolution No. 589, April 16, 1980. B. ENVIRONMENTAL ASSESSMENT: The Director of Environmental Services has determined that the proposed project will not have a significant adverse impact on the environment and a Negative Declaration has been prepared. III . DISCUSSION: As Staff noted when this Public Hearing date was established on April 16, 1980, the Municipal Code does not specifically provide for pedestrian directional signs for commercial buildings or complexes with courtyard or plaza tenants. Therefore, Staff developed this proposed ordinance. The Commission must determine what size the tenant signs are to be, what size the top directional sign is to be, how tall the permitted sign is to be, and how wide a structure is to be allowed. IV. DESIGN REVIEW BOARD: The Board reviewed the proposed amendment and felt the maximum height should be 7 feet, the top directional sign size should be 2 sq. ft. and tenant sign sizes should be 1 .5 sq. ft. They also voiced a concern. about the width of the total structure and the possibility of the double rows of signs (side to side) . V. STAFF RECOMMENDATION: Staff feels there is a need fora specific Code section dealing with directory signs for courtyard or plaza tenants. Therefore, staff recommends approval of ZOA 02-80, to the City Council , by adopting Planning Commission Resolution No. r MINUTES DESIGN REVIEW BOARD MAY 27, 1980 Page Three Case No. 133 C - POUL MOLLER AND JOHN OUTCAULT - Preliminary approval of plans to add second story to a commercial building located at 7 -f055 Painters Path; Poul Moller and John Outcault were present. The Board reviewed the submitted plans for the seconds ry addition. The applicant submitted a revised plot plan as sugge ed in staff comment number one. The Board discussed stucco po -outs around the windows with the applicants agreeing to provide em. On a motion by Holden, seconded by Barton, e Board granted preliminary approval of the submitted plans, subject o the following revisions: 1. Windows in addition to be frame out 10" from wall . 2. ROBERT HUBBARD - Construction of Comm erci center to include a Supermarket, Retail Spaces, Savings and Loan, and a Ho ,C and complex at the northeast corner of Hwy 111 and Deep Canyon oad. Applicants and Representatives were present. Th oard reviewed the plans on a conceptual basis and felt that based on e Exhibits reviewed the project was architecturally acceptable. Case No. ZOA 02-80 Amendment to Sign Ordinance for courtyard directory The Board reviewed the proposed ordinance and felt that the following would be acceptable: 1. Top sign to be 2 sq. ft. 2. Tenant signs to be 12 sq. ft. 3. Maximum height to be 71; feet. , DP 06-80 - GERALD CHAZEN - Contruction of commercial center at the intersection o and Hwy 111. The Board felt that the project was c ually acceptable. They commented on the possibility of flipping bank locations, ring the commercial complex, and providing underground parking. WILL AMS, AICP /lr DRAFT FRAMEWORK FOR NEW SIGN ORDINANCE SECTION 25.68.335 Directional Signs for Courtyard or Plaza Businesses where commercial buildings or complexes are designed to contain tenant spaces oriented to an interior courtyard or plaza and where the principal business identification sign is located on that courtyard or plaza frontage, the commercial building or complex may be permitted a pedestrian directional sign(s) , which groups the names of businesses or principal services to be found in the courtyard or plaza, located at major pedestrian entrances to the plaza or courtyard, as follows: a. Permitted signs shall not encroach into the public right-of-way. b. Permitted signs may be allowed up to a maximum of —L—) sq. ft. of sign area for the identification of each individual tenant space. This area may be utilized by individual sign panels grouped together or by one panel containing the aggregrate area of all courtyard or plaza tenants. In addition to the sign area permitted for individual tenants, a permitted sign may be allowed up to a maximum of Cz� sq. ft. of sign area for purposes of directing pedestrians to the courtyard or plaza, by means of graphic symbols and/or lettering.
