AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT
TO THE ZONING ORDINANCE TEXT, RELATIVE TO OPEN
HOUSE DIRECTIONAL SIGNS.
CASE NO. ZOA 03-80
WHEREAS, the City Council of the City of Palm Desert, California, did
on the 26th day of June, 1980, hold a duly noticed Public Hearing, to consider
an amendment of the Zoning Ordinance relative to open house directional signs ;
and,
WHEREAS, the Planning Commission, by Resolution No. 606 has recommended
approval ; and,
WHEREAS, said amendment has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the
subject project has not been found to present an adverse impact on the environment
and a Negative Declaration has been prepared; and,
WHEREAS, at said Public Hearing, upon hearing and considering all testi-
mony and arguments, if any, of all persons desiring to be heard, said City Council
did find the following facts and reasons to exist to approve a Zoning Ordinance
Text Amendment:
1. That the Zoning Ordinance Amendment is consistent with
the objectives of the Zoning Ordinance.
2. That the Zoning Ordinance Amendment is consistent with
the adopted General Plan.
3. That the Zoning Ordinance Amendment would better serve
the public health, safety, and general welfare, than
l the current regulations.
J NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, as follows :
1. That the above recitations are true and correct and
constitute the considerations of the Council in this
case.
2. That it does hereby approve a Zoning Ordinance Text
Amendment, as provided in the attached exhibit, labeled
Exhibit "A" , to amend Municipal Code Section 25.68. 150,
specifying regulations for Real Estate Open House Signs,
and other matters relating thereto.
3. The City Clerk is directed to publish this ordinance
once in the Palm Desert Post, a newspaper of general
circulation., published and circulated in the City of
Palm Desert, and shall certify to the passage and adop-
tion of this ordinance, and the same shall be in full
force and effect thirty (30) days after its adoption.

25.68. 150 Open House Signs. During the period under which real
estate is offered for sale or lease and while a salesperson is
physically present on the premises, a sign indicating open house
shall be permitted. The sign shall not exceed three square feet
in area; and, if located on a pole, no part of the sign or pole
area shall exceed four feet above ground level . Off-site directional
signs may be permitted for an open house, subject to the following
provisions:
A. Each sign shall not exceed three square feet;
B. No flags or banners shall be used;
C. To be located on private property onty, .unless, prior written
approval for unique circumstances is obtained from the Director of
Environmental Services.
D. Limited to two signs unless prior written approval for
unique circumstances is obtained from the Director of
Environmental Services.

CORRESPONDENCE FROM HARRY HOYT
I. BACKGROUND:
Attached is a letter addressed to the Council on the subject matter. It
appears appropriate to transmit the letter from Mr. Hoyt with a further
definition of the issues involved. While Mr. Hoyt has generally touched
on the interpretive problem of the newly revised Sign Ordinance Section
(dealing with open house direction signs) , specific comments in the letter
need to be clarified by a recap of the office conversation with Mr. Hoyt.
In his contact with the Planning Division, Mr. Hoyt explained :that a
Realtor had contacted him regarding an administrative denial of additional
directional signs. He felt that the request, as explained to him, was
consistent with his obejctive in having the Sign Ordinance revised.
Mr. Hoyt was advised by Staff that the new section providing for approval
of more than two open house signs for "unique circumstances", did provide
a problem for administrative interpretation, but that the matter had been
reviewed with the City Planning Conmission for clarification.
In the Planning Commission discussion it was noted that most of the resi-
dential sections of the City are bounded by major thoroughfares. . . .
therefore, as an example, it is not unusual that a residential subdivision
lies east of Hwy 74. The Commission indicated that they felt it to be an
unusual circumstance when the property being offered for sale was located
in the interior of a subdivision which had a complex and confusing street
pattern requiring numerous turns to finally locate the property within the
tract.
Staff explained to Mr. Hoyt that it had only received one other request for
additional signs, and in this situation the requesting party cited their
unusual circumstnace being that the property was located in the residential
section of the City located east of Hwy 74, therefore, they needed a sign
on Highway 111 to turn motorists south up Hwy 74. Mr. Hoyt did not have
knowledge of this request when Staff advised him of its denial .
Mr. Hoyt explained to Staff that the real estate industry is suffering at
the present time due to many factors including interest rates. He said
at one time Realtors could just stay in their office and take orders for
continued. . .

properties,. but now very few prospective clients come to their office.
He indicated that they needed open house directional sign oriented to
the "general public" (rather than a motorist seeking the specific property) ,
because most of their new customer contacts were made at open houses and
it was really immaterial whether the person stopping in was interested in
that particular property, because they would have other properties to show
the prospective client once the business contact had been made. He des-
cribed his objective in seeking to have the Sign Ordinance changed, as an
attraction/attention gaining device for casual motorists, rather than a
directional aid to clients (who had previously been given the particulars
on the open house property) who were driving to that location for purposes
of inspection.
Staff again noted that it felt it was implementing the new revision in
general consistency with the reading of intent it obtained from the
Planning Commission, but for final resolution of the interpretation of
"unusual circumstances" , Staff suggested that Mr. Hoyt might state, in
the form of a letter addressed to the Council ; what had just beenrdiscussed
in the office, outlining his objective for the Sign Ordinance change and
requesting that they state their legislative intent in approving the
revision. Rather than correspondence for the purpose suggested, it appears
that the Council is receiving a "complaint" letter.
II. DISCUSSION:
The new Sign Ordinance revision (attached) does contain the interpretive
provision "unique circumstance", as the criterion for approval of more
than two open house signs. It would be helpful for purposes of adminis-
tration, if the Council would offer their legislative intent in approving
the revision and state what they feel to be unique circumstances.
III. RECOMMENDATION:
It is recommended that the Council give formal direction on the intent of
this provision for additional open house signs, so Staff may properly
implement their wishes. Also, Staff should be requested to transmit the
consensus of the Council on this matter to Mr. Hoyt and the Board President
so it will receive the broadest dissemination.

A. STAFF RECOMMENDATION:
Waive further reading and pass to second reading.
B. DISCUSSION:
The City Council referred a letter from the Palm Desert Board of Realtors, Inc. ,
relating to real estate open house signs to the Planning Commission for considera-
tion. The Planning Commission at their meeting of June 3, 1980, considered an
amendment to the Sign Ordinance.
The present Municipal Code allows one off-site directional sign. This sign must
be located on private property. The Board of Realtors , in their letter dated
April 17, 1980, requested that they be allowed an exemption to the allowable
number of signs and exemption from the public property rule.
The Planning Commission reviewed the staff-prepared ordinance amendment pertaining
to open house signs (see attached Planning Commission Staff Report) . After some
audience participation and discussion among themselves, the Commission moved to
approve an amendment which would allow signs on public property for unique circum-
stances if prior written approval is obtained from the Director of Environmental
Services and would limit open house signs to two (2) signs unless prior written
approval for unique circumstances is obtained from the Director of Environmental
Services.
Attached is a draft Ordinance which is based upon the recommendation of the Plan-
ning Commission.

Consideration of an amendment t Chapter 25.68 of the
Municipal Code (Zoning Ordina e) of the City of Palm
Desert, California relating o Directional Signs for
commercial buildings with ourtyard or plaza tenants.
Mr. Crump presented this c e explaining that the Municipal Code did not
provide for pedestrian directio signs for commercial buildings with courtyard
or plaza tenants. He reviewe the draft amendment (Exhibit A) and recommended
approval .
Commissioner Kryd pointed out that the sentence in Exhibit A which reads:
which groups the names f businesses or principal services--should read: "which
groups the names of b sinesses and/or principal services. . . "
Mr. Willia also noted that Item (b) should state 11-, sq. ft, instead of
one sq. ft.
Commis loner Richards asked if the signs still needed to go to Design Review
Board befor approval . Mr. Williams stated that they would as a part of the
projects r iew.
C airman Miller opened the Public Hearing asking if anyone wished to speak
in FAV or OPPOSITION to this case.
PHYLLIS JACKSON, ORB member, pointed out that Item (d) should be revised
to ven feet maximum height, instead of six.
Chairman Miller closed the Public Hearing.
Motion was made by Commissioner Kryder, seconded by Commissioner Berkey,
o approve this case, by adoption of Planning Commission Resolution No. 605,
as amended. Carried unanimously (5-0) .
K. Case No. ZOA 03-80, CITY OF PALM DESERT, Applicant
Consideration of an amendment to Section 15. 68.150 of the
Municipal Code (Zoning Ordinance) of the City of Palm Desert,
California, relating to real estate open house signs.
Mr. Williams presented this case stating that the Board of Realtors had
requested two changes to the ordinance (a) Exemption from the public property
restrictions and, (b) exemption to the allowable number of signs. Mr. Williams
stated that staff surveyed the Coachella Valley and based on that survey staff
recommended some minor revisions shown in Exhibit A of the resolution.
Chairman Miller opened the Public Hearing asking if anyone wished to speak
in FAVOR or OPPOSITION to this case.
HARRY HOYT, Representative of the Palm Desert Board of Realtors, 49-305
Hwy 111, explained why they were requesting the revisions to the ordinance stating
that the present provisions hinders sales. He believed that one sign on a corner
of public property would be acceptable.
RUTH RANAMINE, Real Estate Agent, stated that two signs would not be enough.
Chairman Miller closed the Public Hearing.
Commissioner Kryder indicated that he needed a clarification of the
maximum allowable signs. He felt that it would be appropriate to make some exceptions.
After Commission discussion it was agreed to revise the draft resolution as
follows: First paragraph, second sentence, delete "maximum of two off-site";
Item C, add "unless prior written approval for unique circumstances is obtained
from the Director of Envirnmental Services"; Item D, replace "one" to "two" and
delete "for a second sign".
Commissioner Richards suggested that staff report to the Commission after
a one year period for any necessary revisions.

L. Case No. ZOA 04-80, CITY OF PALM DESERT, Applicant

ration of an amendment to Chapter 25.30 of the Municipal
oning Ordinance) of the City of Palm Desert, California,
to permitted uses in the PC (4) zone district.
Mms stated that this request has been discussed on two previous
occasiont that if the wording of the ordinance was more consistant with
the wording of th Redevelopment Plan it would resolve the problems. . He explained
the difference bets en the related uses to Hotel versus the related uses for
Restaurants. He re 'ewed the recommended uses shown as Exhibit "A".
Commissioner Be ey questioned Item D, he suggested a revision to read:
The Commission may per 't other uses which it may determine to be similar to
thos listed above".
Commissioner Kryder It that in Item B, "Professional Offices" should be
expanded to "General Offices The Commission concurred, therefore, making the uses
Accounting services, General dical Care and Services, and Secretarial Services
to be listed under the General ffices.
Chairman Miller opened the Public Hearing asking if anyone wished to speak
in FAVOR or OPPOSITION to this cas .
MR. BOB GILROY, PDR Associate , stated that he reviewed the proposed list of uses
and still had some questions relative to his list of proposed uses for the Las Sombras
project.
Commissionler Richards asked Mr. Wi liams to clarify these uses for Mr. Gilroy.
Mr. Williams clarified the matter to Mr. 'lroy's satisfaction.
Commissioner Richards stated that th e might be a problem with the financial
institutions in terms of banks, being that i was not listed on the Exhibit.
Commissioner Berkey explained that Item D wou d determine that use.
Mr. Gilroy then gave a brief presentatio on proposed uses for the Las
Sombras project.
MR. FRED ARBUCKLE, stated he needed a bette clarification in terms of
ancillary uses. He asked if a restaurant and hotel could be on the same project.
Mr. Williams replied that it depended on the ize of the project. He added
that a principle use would have to be declared and if it were an 8 acre project it
could declare two uses, noting the minimum development site in the PC(4) Zone is
four acres.
After a brief discussion the Public Hearing was c osed and motion was made
by Commissioner Berkey, seconded by Commissioner Kryder, o approve the amendment
by adoption of Planning Commission Resolution No. 607, as mended. Carried unanimously
(5-0).

I. REQUEST
Request for consideration of an amendment to Section 15.68.150 of the
Municipal Code (Zoning Ordinance) of the City of Palm Desert,
California, relating to real estate open house signs.
II. BACKGROUND
The City Council referred a letter from Palm Desert Board of Realtors ,
Inc. , relating to real estate open house signs , to the Planning
Commission for consideration. The subject amendment was initiated by
the Planning Commission on April 29, 1980 (Res. No. 595) pursuant
to the provisions of Section 25.82.020, of the Municipal Code which

III . DISCUSSION
Section 25.68.150 of the Municipal Code presently allows one off-site
directional sign subject to size and location regulations . It was
found that for unique circumstances , such as location of house, this
restriction may. be inappropriate. The Board of Realtors , in their
letter dated April 17, 1980, requested two changes to said section -
(a) exemption from the public property rule and, (b) exemption to the
allowable number of signs.
Staff feels that allowing off-site directional signs on public
.property, such as major roads, will be in violation of the intent
and purpose of the Sign Ordinance, the Zoning Ordinance, and the
General Plan (particularly the Urban Design and Scenic Highway
Elements) . The appearance of reny directional signs from many realty
companies could make neighborhoods take on a cluttered and depressed
appearance.
Staff surveyed the other Coachella Valley cities concerning the
allowable number of off-site directional signs. It was found that
the present ordinance is more flexible than other Valley communities;
the results are indicated in Table 1 at the end of this report.
The redrafted Zoning Ordinance is amended to read as follows :
25.68.150 Open house signs. During the period under which real
estate is uffered for sale or lease and while a salesman is physically
present on the premises , a sign indicating open house shall be '
permitted. The sign shall not exceed three square feet in area; and
if located on a pole, no part of the sign or pole area shall exceed
four feet above ground level . A maximum of two off-site directional
signs may be permitted for an open house, subject to the following
provisions:
a. Each sign shall not exceed three square feet;
b. No flags or banners shall be used;
c. To be located on private property only;
d. Limited to one sign unless prior written approval for unique
circumstances is obtained from the Director of Environmental Services

WHEREAS - In the opinion of the Realtors, the Palm Desert City
sign ordinance discriminates against them and the
property owners, in that builders and developers
and others are allowed signs more than 3 sq. ft. in
size, in excess of four feet high,and at least one sign
on Highway 74 (cove) has four riders on it - and
Realtors are allowed only one.
WHERAS - The ordinance actually keeps the Realtor from making
a normal livelihood and reduces his sales, due to the
public property rule and the off site one directional
sign rule. In some places like Highway 74 if signs
were not placed on the frontage road, the motorist
could not see them and the open house would fail.
Also on hard to find houses where it takes more than
one turn to get there, again one directional sign is
not sufficient, and the open house would fail.
THEREFORE BE IT RESOLVED: That Paragraph 25-68-150 of the
Sign Ordinance be amended to read: On the cardinal
days of Saturday and Sunday and 'holidays between the
hours of 1:00 P. M. and 5:0b P.M. at which time the
signs are to be removed, the Realtors be exempt
from the public property rule and the one off site
sign rule. That Realtors be allowed to place signs
on public property when necessary to get the greatest
exposure to his open house. Also on hard to find houses
where it is necessary for more than one off site sign,
the Realtor shall apply for a use permit. He shall show
how many signs are needed and the location as to where
the signs are needed and the location as to where the
sign is to be placed. This use permit to be good on
the same days (Saturday and Sundays and holidays)
and good until the listing is sold,. expired or transferred
another broker.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL
OF AN AMENDMENT TO THE ZONING ORDINANCE TEXT, RELATING TO
OPEN HOUSE DIRECTIONAL SIGNS.

WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 3rd day of June, 1980, hold a duly noticed Public Hearing, to consider
amendment of the Zoning Ordinance relative to open house directional signs;
WHEREAS, said amendment has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution No. 78-32," in that the
subject project has not been found to present an adverse impact on the environment
and a Negative Declaration has been prepared; and,
WHEREAS, at said Public Hearing, upon hearing and considering all testi-
mony and arguments , if any, of all persons desiring to be heard, said Planning
Commission did find the following facts and reasons to exist to recommend approval
of a modified Zoning Ordinance Text Amendment:
1. That the Modified Zoning Ordinance Amendement is consistent with the
objectives of the Zoning Ordinance.
2. That the Modified Zoning Ordinance Amendement is consistent with the
adopted General Plan.
3. That the Modified Zoning Ordinance Amendment would better serve the
public health, safety and general welfare than the current applicable
regulations.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the
findings of the Commission in this case.
2. That it does hereby recommend a Modified Zoning Ordinance Text Amendment,
as provided in the attached Exhibit, labeled Exhibit "A", to amend
Municipal Code, Section 25.68. 150, specifying regulations for Real Estate

unicipal Code (Zoning Ordinance) of the City of Palm

Mr. Crump pre nted this case explaining that the Municipal Code did not
provide for pedestrian irectional signs for commercial buildings with courtyard
or plaza tenants. He rev' wed the draft amendment (Exhibit A) and recommended
approval .
Commissioner Kryder point d out that the sentence in Exhibit A which reads:
which groups the names of busines ;be or principal services--should read: "which
groups the names of businesses and principal services. . . "
Mr. Williams also noted that Item b) should state 12 sq. ft, instead of
one sq. ft.
Commissioner Richards asked if the sign still needed to go to Design Review
Board before approval . Mr. Williams stated tha\aki

projects review.
Chairman Miller opened the Public Hearin •g if anyone wished to speak
in FAVOR or OPPOSITION to this case.
PHYLLIS JACKSON, ORB member, pointed out that Item '(d) should be revised
to seven feet maximum height, instead of six.

K. Case No ZOA 03-80, CITY OF PALM DESERT, Applicant
Consideration of an amendment to Section 15.68.150 of the
Municipal Code (Zoning Ordinance) of the City of Palm Desert,
California, relating to real estate open house signs.
Mr. Williams presented this case stating that the Board of Realtors had
requested two changes to the ordinance (a) Exemption from the public property
restrictions and, (b) exemption to the allowable number of signs. Mr. Williams
stated that staff surveyed the Coachella Valley and based on that survey staff
recommended some minor revisions shown in Exhibit A of the resolution.
Chairman Miller opened the Public Hearing asking if anyone wished to speak
in FAVOR or OPPOSITION to this case.
HARRY HOYT, Representative of the Palm Desert Board of Realtors, 49-305
Hwy 111, explained why they were requesting the revisions to the ordinance stating
that the present provisions hinders sales. He believed that one sign on a corner
of public property would be acceptable.
RUTH RANAMINE, Real Estate Agent, stated that two signs would not be enough.
Chairman Miller closed the Public Hearing.
Commissioner Kryder indicated that he needed a clarification of the
maximum allowable signs. He felt that it would be appropriate to make some exceptions.
After Commission discussion it was agreed to revise the draft resolution as
follows: First paragraph, second sentence, delete "maximum of two off-site";
Item C, add "unless prior written approval for unique circumstances is obtained
from the Director of Envirnmental Services"; Item D, replace 'one" to "two" and
delete "for a second sign".
Commissioner Richards suggested that staff report to the Commission after
a one year period for any necessary revisions.

L. Case No. ZOA 04-80, CITY OF PALM DESERT, Applicant
Consideration of an amendment to Chapter 25.30 of the Municipal
Code (Zoning Ordinance) of the City of Palm Desert, California,
ating to permitted uses in the PC (4) zone district.
Mr. Wi liams stated that this request has been discussed on two previous
occasions. He felt that if the wording of the ordinance was more consistant with
the wording of the Redevelopment Plan it would resolve the problems. He explained
the difference between the related uses to Hotel versus the related uses for
Restaurants. He reviewed the recommended uses shown as Exhibit "A".
Commissione\Berkey questioned Item D, he suggested a revision to read:
"The Commission may permit other uses which it may determine to be similar to
those listed above".
Commissioner Kryder felt that in Item B, "Professional Offices" should be
expanded to "General Offices". The Commission concurred, therefore, making the uses
Accounting services, General Medical Care and Services, and Secretarial Services
to be listed under the General Offices.
Chairman Miller opened the Public Hearing asking if anyone wished to speak
in FAVOR or OPPOSITION to this case.
MR. BOB GILROY, PDR Associates, stated that he reviewed the proposed list of uses
and still had some questions relative to his list of proposed uses for the Las Sombras
project.
Commissioner Richards asked Mr. Williams to clarify these uses for Mr. Gilroy.
Mr. Williams clarified the matter to Mr"\ilroy's satisfaction.
Commissioner Richards stated that there might be a problem with the financial
institutions in terms of banks, being that\it was not listed on the Exhibit.
Commissioner Berkey explained that Item D would determine that use.
Mr. Gilroy then gave a brief presentation on proposed uses for the Las
Sombras project.
MR. FRED ARBUCKLE, stated he needed a better clarification in terms of
ancillary uses. He asked if a restaurant and hotel\could be on the same project.
Mr. Williams replied that it depended on the size of the project. He added
that a principle use would have to be declared and if it were an 8 acre project it
could declare two uses, noting the minimum development site in the PC(4) Zone is
four acres.
After a brief discussion the Public Hearing was closed and motion was made
by Commissioner Berkey, seconded by Commissioner Kryder, to \approve the amendment
by adoption of Planning Commission Resolution No. 607, as amended. Carried unanimously
(5-0). \

Planning Commission to consider an initiation by the PALM DESERT PLANNING COMMIS-
SION of an Amendment to Municipal Code, Section 25.68.150, Palm Desert Zoning
Ordinance, regarding real estate "open house" signs.
SAID Public Hearing will be held on Tuesday, June 3, 1980, at 7:00 p.m. in the
Council Chambers in the Palm Desert City Hall , 45-275 Prickly Pear Lane, Palm
Desert, California, at which time and place all interested persons are invited
to attend and be heard. This request, if approved, will amend the Zoning Ordinance

WHEREAS, the Zoning Ordinance Text (Municipal Code, Title 25)
contain specific regulations for real estate "open house" signs (Chapter
25.68, Sign Ordinance) ; and,
WHEREAS, the Planning Commission deems it necessary to consider
said Chapter (Sign Ordinance) for possible recommendation of amendment rela-
tive to the regulation of real estate "open house" signs.
NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City
of Palm Desert, California, as follows:
1. The above recitations are true and correct and constitute
the considerations of the Commission in this matter.
2. That the Secretary to the Commission is hereby requested
to schedule a Public Hearing on June 3, 1980, for consid-
