ORDINANCE NO. 244 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO THE ZONING ORDINANCE TEXT, PERTAINING TO CONDITIONALLY PERMITTED USES IN THE R-3 (MULTI- FAMILY RESIDENTIAL DISTRICT) ZONE. CASE NO. ZOA 05-80 WHEREAS, the City Council of the City of Palm Desert, California, did on the 12th day of February, 1981 , hold a duly noticed Public Hearing, to consider an amendment of the Zoning Ordinance pertaining to conditionally permitted uses in the R-3 (Multifamily Residential District) zone; and, WHEREAS, the Planning Commission, by Resolution No. 669 has recommended approval ; and, WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89" , in that the Director of Environmental Services has determined that the project will not have a significant adverse impact on the environment and a Negative Declaration has been prepared; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to approve a Zoning Ordinance Text Amendment: 1 . That the Zoning.Ordinance Amendment is consistent with the objectives of the Zoning Ordinance. 2. That the Zoning Ordinance Amendment is consistent with the adopted General Plan. 3. That the Zoning Ordinance Amendment would better serve the public health, safety, and general welfare, than the current regulations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1 . That the above recitations are true and correct and constitute the considerations of the Council in this case. 2. That it does hereby approve a Zoning Ordinance Text Amendment, as provided in the attached exhibit, labeled Exhibit "A" , to amend Municipal Code Section 25.20.030, by adding a new use "N" to conditionally permitted uses in the R-3 (Multifamily Residential District)zone. 3. That said Negative Declaration is hereby approved. 4. The City Clerk is directed to publish this ordinance once in the Palm Desert Post, a newspaper of general circulation, published and circulated in the City of Palm Desert, and shall certify to the passage of 'adop- tion of this ordinance, and the same shall be in full force and effect thirty (30) days after its adoption. Churches, convents, monasteries and other religious institutions; B. Clubs, private; C. Commercial parking lots servicing a commercial establishment within three hundred feet; D. Day nurseries and nursery schools; E. Hospitals. F. Hotels with a maximum of eighteen units to the gross acre; G. Neighborhood governmental offices of less than five thousand square feet of building area; H. DISCUSSION: This amendment was reviewed and unanimously recommended for approval (4-0 with McLachlan absent) , by the Planning Commission at the meeting of December 30, 1980. During the hearing, one person from the audience spoke in favor of the proposed change. Commission discussion followed with it being determined that professional offices be allowed with a Conditional Use Permit when abutting, or across a street or alley from commercially zoned property, rather than only when abutting a PC (3) zone or existing office use as originally proposed. Staff sees this amendment as an interim measure, and not a permanent provision. The General Plan Update will include a designation for profes- sional office uses which will coincide with those areas this amendment is intended for. Chairman MilVailshops, - ewed the added Special Conditions, which were as follows: 12. Height of wif retail shops, adjacent to Hidden Palms shall be limited to 6 feet above grade. "13. Height of re adjacent to Hidden Palms shall be a maximum of 18 feet. " The Comm ion agreed to these additions. Motion was made by Commissioner Richards, seconded by Commissioner Kryder, to recommend approval to the City Council of a Change of Zone and certification of the EIR as it relates thereto, by adoption of PlanningeCommission Resolution No. 667; and, approve Development Plan and Conditional Use Permit and certification of the EIR as it relates thereto, by adoption of Planning Commission Resolution No. 668, subject to conditions as amended. Carried unani ously (4-0). 7 The Commission informed the public that the hearing for the Change of Zone would go before the City Counci on the 22nd of January, 1981. C. Continued Case Nog. ZOA 05-80 and ZOA 06-80 CITY OF PALM DESERT, Applicant Amendment to Municipal Code, Chapter 25.20, regarding conditionally permitted uses in the R-3 zone (Multifamily Residential District). Amendment to Municipal Code, Chapter 25.18, regarding conditionally permitted uses in the R-2 zone (Single Family Residential District). Mr. Diaz reviewed the staff report and recommended approval- - to the City Council . Chairman Miller opened the Public Hearing and asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. Mr. Dean Cole, 73-144 Catalina, gave the present zones in his area and stated he would eventually like to convert his home into an office. He encouraged approval . There was dicussion on the matter of the properties abutting the proposed regional center on Monterey, since the properties also abutted R-1. Mr. Diaz indicated that as long as a parcel abutted the regional commercial zone it could apply for a conditional use permit for office purposes. Additional discussion occurred concerning property zoned R-3 or R-2 which are across a street or alley. from commercially zoned property and the Commission concluded that such parcels could also have the right to apply fora conditional use permit for office uses. ''.Therefore, the Resolution, Exhibit "A" , were amended as follows: ZOA 05-80 - (N) Professional offices, provided property to be developed is abutting, across street, or alley, from a PC (3) zone or existing professional office use; residential development standards to be used to insure compatibility. ZOA 06-80 - (K) Professional offices, provided property to be developed is abutting, across street, or alley, from a PC (3) zone or existing professional office use; residential development standards to be used to insure .compatibility. Chairman Miller closed the Public Hearing. Motion was made by Commissioner Berkey, seconded by Commissioner Richards, to recommend approval to the City Council , by adoption of Planning Commission Resolution Nos. 669 and 670, as amended. Carried unanimously (4-0). VII. OLD BUSINESS - NONE PLANNING COMMISSION RESOLUTION NO. 669 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF P.'.: " DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF AN AMENDMENT TO THE ZONING ORDINANCE TEXT, PERTAINING TO CONDITIONALLY PERMITTED USES IN THE R-3 (MULTIFAMILY RESIDENTIAL DISTRICT) ZONE. CASE NO. J� III d— I CITY OF PALM DESERT STAFF REPORT TO: Planning Commission REPORT ON: Zoning Ordinance Amendment APPLICANT: CITY OF PALM DESERT CASE NO: ZOA 05-80 DATE: December 30, 1980, continued from December 2, & November 19, 1980. I. REQUEST: Amendment to Municipal Code,. Chapter 25.20, regarding conditionally permitted uses in the R-3 zone (Multifamily Residential District). II. BACKGROUND: A. CASE INITIATION: This amendment was initiated by the Planning Commission on August, 20, 1980, by adoption of Planning Commission Resolution No. 626. B. ENVIRONMENTAL ASSESSMENT: The Director of Environmental Services has determined that the proposed project will not have a significant adverse impact on the environment and a Negative Declaration has been prepared. III. DISCUSSION: This case was continued from the December 2, 1980, meeting. At that time, Staff noted that controls are necessary to insure that professional office uses are compatible with adjacent uses. In order to achieve this compatibility, development standards of the zone regarding setbacks, site coverage, etc. , should be applied to office uses. Additionally, a one story height limit should be applied to insure compati- bility with adjacent residential zones and uses. Further, location of any such use should be limited to areas adjacent to commercial zones or existing office uses. Using these safeguards will insure that the uses will be low intensity and compatible with residential uses since it would be a transi- tional use between residential and commercial . Staff sees this amendment as an interim measure and not a permanent provision. The General Plan Update will include a designation for professional office uses which will coincide with those areas this amendment will apply to. IV. Continued Case No. ZOA 05-80 - CITY OF PALM DESERT, Applicant Request for initiation of an Amendment to Municipal Code Chapter 25.20, regarding conditionally permitted uses in the R-3 (Multifamily Residential District) zone or other zone. Mr. Diaz presented this case explaining that it was continued from the last meeting for further study. He stated Staff's recommendation was to amend the R-2 and R-3 zones to allow offices with conditional use permits. Mr. Diaz stated it would be necessary to readvertise, therefore, requested a Public Hearing on this amendment for December 30, 1980. (Single Family Residential , one unit per 4,000 sq.ft. of. lot area, Scenic Preservation Overlay) zone to R-3, S.P. (Multifamily Residential , one unit per 2,500 sq.ft. of lot area, Scenic Preservation Overlay) or other zone deemed appropriate on the west side of Monterey Avenue between Rancho Grande and Park View Drive. Mr. iaz presented this case statin that Staff was recommending withdrawal indefinitel for the following reasons: 1� Possible modification of proposed ZOA 05-80; 2 Rezoning would not change density; 3) General Plan Update might require rezoning. Mr Diaz noted a petition was submitted by Mr. William Wilson, objecting to this zone c ange. There wa a brief discussion on the matter of office/professional zones being considered during the General Plan Update. Chairman Mi ler opened the Public Hearing asking if anyonw wished to speak in FAVOR or OPPOSI ON to this case. MR. BILL WILS 44-144 Acacia, stated he would rather see offices built in this area rather than zone change to R-3. He asked if there could be apartment complexes built in thi area. Mr. Diaz replied hat there could under the present zoning. Chairman Miller clo ed the Public Hearing. Minute Motion was mad by Commissioner Richards, seconded by Commissioner --._.._. CUP 10-77 Amendment) and 139 C - PORTOLA COUNTRY CLUB HOMEOWNERS ASSOCIATIO , Applicants Request for an amendmen to an approved Conditional Use Permit to allow an existing mob le home lot adjacent to the clubhouse of Portola Country Club t be used as a parking lot within the RM (Mobile Home) zone, loc ted on the east side of Sutter Mill Road, 100 ft. north of Quic silver Drive. Mr. Sawa reviewed the staff report and illustrated on the map how the design of the parking would be. He stated .that D sign Review Board did review this case and approved it; Staff recommended approval Chairman Miller opened the Public Hearing and asked for the applicant to make a presentation. MR. JACK LAWSON, 74-376 Gary Avenue, Por la Country Club, requested approval . Commissioner Richards asked Mr. Lawson if had just recognized the need for more parking. Mr. Lawson replied that he did and explained hat the parking was presently very crowded for the residents. Chairman Miller asked if anyone present wished t speak in FAVOR or OPPOSITION to this case. There being none, the Public Hearing was losed. INTEROFFICE MEMORANDUM City of Palm Desert TO: Planning Commission FROM: Principal Planner SUBJECT: CONSIDERATION OF ALTERNATIVE .LAND USES DATE: August 15, 1980 FOR SPECIFIC AREAS PURPOSE: The purposes of this memorandum is to bring to the attention of the Commission that alternative land use treatments. may be available to achieve land use compatibility in various areas of the City. This memorandum describes the current conditions and provides various options to address selected areas should the. Commission deem some alternative treatment is appropriate. SPECIFIC SITES: We have observed that techniques to achieve land use compati- bility are available in those areas adjacent to major thoroughfares and in those areas where there are special considerations for abutting land uses. The first area you may wish to discuss is two segments on the west side of Monterey Avenue. The areas in question are between Rancho Grande and 44th _ - Avenue and between Arboleda and Park View Drive. The current zoning is single family residential with most of the area vacant at this time. The residential lots have direct access onto Monterey Avenue, which is a major thoroughfare. Other land uses, more compatible with direct access onto a major thoroughfare, may be deemed more appropriate. The second area the Commission may wish to discuss is Larrea Street between San Luis Rey Avenue and Lantana Avenue. The area is currently zoned R-3 (Multi-family) and C-1 (Commercial ) and serves as a -transition between commercial and single-family residential uses. Additional uses could be provided to better define the area as a transition between the two aforemen- tioned uses. The third area the Commission may wish to consider is the north side of Alessandro Drive between De Anza Avenue and Deep Canyon Road. The area is zoned R-3 and serves as a transition area between single-family and commercial zones. Existing land uses include a mixture of residential (apartments) and non-residential (i .e. , day care centers, parking lots) uses. Many parcels remain vacant at this time. Additional conditional uses could be provided to better develop the area as a buffer between single-family residential and commercial areas. OPTIONS: Various options are available to address these areas should the Commission deem some alternative land use is appropriate. Some of the options have been mentioned; others are available. A description of each follows: 1. Expand. Conditional Uses: This option permits an expansion of conditional uses allowed in a zone to include other uses, such as office/professional service. It would require an amendment to the Zoning Ordinance. s Planning Commission August 15, 1980 Page Two 2. Transitional Land Use Overlay: This method allows for a buffer between different land uses with mixed or conditional uses therein. 3. Higher Density: This option rezones and redesignates an area from single-family to multi-family residential . This option al.lows for a transition area between different uses, as described above. 4. Office/Professional Zone: This option changes current land use and zoning designations from residential to office/professional services and permits existing residential structures to remain as legal non-conforming uses, as well as, existing dwelling units to be converted to offices. This designation would be intended to -provide a use characterized by law traffic generation. Furthermore, it would be intended to encourage low profile development compatible with surrounding or abutting residential districts. Low profile development is intended to mean that the struc- ture will take on a residential character to its design. Possible office uses could include but are not limited to, accountant, architect and attorney. Should the Commission decide that alternative land use treatment in the afore- mentioned or other areas is appropriate, the chosen option will be implemented as the Commission completes the General Plan Update and/or when the Commission implements the adopted document. One of the implementation programs of the General Plan Update is the revision of the current Zoning Ordinance to achieve consistency between both documents. COMMISSION ACTION: One of two directions could result from this discussion: 1. The Commission could decide that no action is necessary, or 2. The Commission may want to focus on a certain area or areas and arrive at a consensus on appropriate land use treatment. III. DISCUSSION: This case was continued from the December 2, 1980, meeting. At that time, Staff noted that controls are necessary to insure that professional office uses are compatible with adjacent uses. In order to achieve this compatibility, development standards of the zone regarding setbacks, site coverage, etc. , should be applied to office uses. Additionally, a one story height limit should be applied to insure compati- bility with adjacent residential zones and uses. Further, location of any such use should be limited to areas adjacent to commercial zones or existing office uses. Using these safeguards will insure that the uses will be low intensity and compatible with residential uses since it would be a transi- tional use between residential and commercial . Staff sees this amendment as an interim measure and not a permanent provision. The General Plan Update will include a designation for professional office uses which will coincide with those areas this amendment will apply to. IV. Mr. Diaz presented this case explaining that it was continued from the last meeting for further study. He stated Staff's recommendation was to amend the R-2 and R-3 zones to allow offices with conditional use permits. Mr. Diaz stated it would be necessary to readvertise, therefore, requested a Public Hearing on this amendment for December 30, 1980. Mr. Sawa reviewed the staff report and illustrated on the map how the design of the parking would be. There being none, the Public Hearing was losed. x INTEROFFICE MEMORANDUM City of Palm Desert TO: Planning Commission FROM: Principal Planner SUBJECT: CONSIDERATION OF ALTERNATIVE LAND USES DATE: August 15, 1980 FOR SPECIFIC AREAS PURPOSE: The purposes of this memorandum is to bring to the attention of the Commission that alternative land use treatments may be available to achieve land use compatibility in various areas of the City. This memorandum describes the current conditions and provides various options to address selected areas should the Commission deem some alternative treatment is appropriate. SPECIFIC SITES: We have observed that techniques to achieve land use compati- bility are available in those areas adjacent to major thoroughfares and in those areas where there are special considerations for abutting- la'nd uses. The first area you may wish to discuss is two segments on the westside of Monterey Avenue. The areas in question are between Rancho Grande and 44th Avenue and between Arboleda and Park View Drive. The current zoning is single family residential with most of the area vacant at this time. The residential lots have direct access onto Monterey Avenue, which is a major thoroughfare. Other land uses, more compatible with direct access onto a major thoroughfare, may be deemed more appropriate. The second area the Commission may wish to discuss is Larrea Street between San Luis Rey Avenue and Lantana Avenue. The area is currently zoned R-3 (Multi-family) and C-1 (Commercial ) and serves as a transition between commercial and single-family residential uses. Additional uses could be provided to better define the area as a transition between the two aforemen- tioned uses. The third area the Commission may wish to consider is the north side of Alessandro Drive between De Anza Avenue and Deep Canyon Road. The area is zoned R-3 and serves as a transition area between single-family and commercial zones. Existing land uses include a mixture of residential (apartments) and non-residential (i .e. , day care centers, parking lots) uses. Many parcels remain vacant at this time. Additional conditional uses could be provided to better develop the area as a buffer between single-family residential and commercial areas. OPTIONS: Various options are available to address these areas should the Commission deem some alternative land use is appropriate. Some of the options have been mentioned; others are available. A description of each follows: 1. Expand Conditional Uses: This option permits an expansion of conditional uses allowed in a zone to include other uses, such as office/professional service. It would require an amendment to the Zoning Ordinance. Planning Commission August 15, 1980 Page Two 2. Transitional Land Use Overlay: This method allows for a buffer between different land uses with mixed or conditional uses therein. 3. Higher Density: This option rezones and redesignates an area from single-family to multi-family residential . This option allows for a transition area between different uses, as described above. 4. Office/Professional Zone: This option changes current land use and zoning designations from residential to office/professional services and permits existing residential structures to remain as legal non-conforming uses , as well .as, . existing dwelling units to be converted to offices. This designation would be intended. to provide a use characterized by low traffic generation. Furthermore, it would be intended to encourage low profile development compatible with surrounding or abutting residential districts. Low profile development is intended to mean that the struc- ture will take on a residential character to its design. Possible office uses could include but are not limited to, accountant, architect and attorney. Should the Commission decide that alternative land use treatment' in the afore- mentioned or other areas is appropriate, the chosen option will be implemented as the Commission completes the General Plan Update and/or when the Commission implements the adopted document. One of the implementation programs of the General Plan Update is the revision of the current Zoning Ordinance to achieve consistency between both documents. COMMISSION ACTION: One of two directions could result from this discussion: 1. The Commission could decide that no action is necessary, or 2. The Commission may want to focus on a certain area or areas and arrive at a consensus on appropriate land use treatment. Depending on the option chosen by the Commission, Staff will report back at the appropriate time. I understand that a meeting is to be held No%ember 6th and it,was suggested by your office the other day that I refresh your memory with another letter. The property is on the corner of Larrea and Lantana in Palm Desert and is currently leased by the City of Palm Desert for the Public Works Department. The building is used for offices and the fenced lot on the back is used for storing heavy equipment. Althoughthe property is still zoned residential, it has been used for commercial purposes for the last twenty years. I purchased it in the early sixties to house Desert Magazine, which I then owned and edited. We had our editorial offices, our book shop and the mailing room all on the premise. Desert Magazine conducted business there until 1977 when I leased it to Riverside County for a school for retarded children. After one year the " building was in such devastating condition that it cost me w10,000 to put it back in shape to lease to the Public Works Department. At that time, Mr. Williams comsented that the building had been converted to commercial purposes so thoroughly that there was no way it could ever be considered "residential.' Considering that it has been used for commercial purposes for two decates, it seems unreasonable that you should insist upon the property fulfilling an R-3 use for which it is totally unqualified. When youfnew city hall is finished and the present lease on my property has expired, I am considering the idea of replacing the building with a contemporary energy-saving professional office building compatible with the professional buildings directlyacross the street from it. This would be a far greater asset to the beauty of our community th* would be an empty, obsolete, rundown structure -- which it will have to remain if I am not per- mitted to make a practical, financially remunerative use of the property. I. REQUEST: Initiation of an Amendment to Municipal Code, Chapter 25.20 , regarding conditionally permitted uses in the R-3 (Multifamily Residential District) or other zone. II. BACKGROUND: A. CASE INITIATION: This amendment was initiated by the Planning Commission on August 20, 1980, by adoption of Planning Commission Resolution No. 626. B. ENVIRONMENTAL ASSESSMENT: The Director of Environmental Services has determined that the proposed project will not have a significant adverse impact on the environment and a Negative Declaration has been prepared. III . DISCUSSION: In August of this year, the Commission reviewed a report addressing ways to achieve land use compatibility in selected areas of the City. (see attached report) . The Commission felt expanding the permitted conditional uses in the R-3 zone to include professional office uses would achieve the desired results. Allowing office uses would permit possible legalization of existing uses on Larrea Street and Alessandro Drive. Additionally, the Commission felt it would permit an alternate type of land use on Monterey Avenue (if the frontage is rezoned to R-3) . Staff has reevaluated the proposed amendment and feels there may be undesirable ramifications if professional office uses are permitted in the R-3 zone. Without adequate controls, intermingling of residential and office uses could be detrimental to each other and to adjacent properties. Staff feels if specific areas of the City are not appropriate for residential use a new professional office or similar zone should be developed. The General Plan Update will include a land use designation to be used as a single or dual designation to accomodate a professional office zone. Should the Commission feel it is necessary to provide a vehicle.to allow professional office uses in the interim, it would be possible to conditionally allow such uses in the R-2 or R-3 zone. Such uses should be low intensity and compatible with residential uses since it would be a transitional use between residential and commercial . In order to achieve this compatibility, development standards of the zone regarding setbacks, site coverage, etc. , should be applied to office uses. . Additionally, a one story height limit should be applied to insure compat- ibility with adjacent residential zones and uses. Further, location of any such use should be limited to areas adjacent to commercial zones or existing office uses. Commissioner McLachlan also felt that because of concerns that are not resolved it should be continued. He added that parking could be a critical problem. Further discussion continued regarding what alternatives could be available. Chairman Miller reopened the Public Hearing and motion was made by Commissioner McLachlan, seconded by Commissioner Richards, to continue Case Nos. ZOA 05-80 and C/Z 10-80 to December 2, 1980. Carried 4-0-1 (Commissioner Berkey abstained). VII. OLD BUSINESS A. Review and approval of preliminary plans for 9 acre public park at the northeast corner of Country Club Drive and Monterey Avenue. Mr. Diaz explained that he met with the Representatives and felt that there were a number of concerns that still needed to be evaluated by the Director of Public Works and himself. He requested a continuance until next month. Commissioner McLachlan asked if the tennis courts would be for public use. Mr. Diaz replied that they would. The Commission had no objections for a continuance, therefore, Minute Motion was made by Commissioner McLachlan, seconded by Commissioner Kryder, to continue this matter to December 17, 1980. Carried unanimously (5-0) . VIII. NEW BUSINESS A. 62 C - ROGER FULLER, Applicant - Review of parking lot lights for commercial complex located at the southeast corner of Ocotillo Drive and E1 Paseo. Mr. Diaz explained that Staff did examine the alternate lights and found that they were compatible to the light standards on the building and there was no glare impact on the adjacent residents. Therefore, Staff recommended that if the alternate parking lot lights are approved that the operation of the lights be limited. until 10:00 p.m. The Commission also felt the .present lights being used were compatible and there was no glare problem. Chairman Miller asked if the applicant cared to address the Commission. MRS. BARBARA FULLER, 24 Green Oaks Drive, Atherton, stated they would be willing to shield the lighting if there was a glare problem. Chairman Miller opened the Public Hearing and asked if anyone wished to speak in FAVOR or OPPOSITION to this case. There was none. Case No. DP 03-80 (Amendment) - STEIN-BRIEF/VISTA AND BALLEW-MCFARLAND, Applicants An Amendment of an approved Development Plan to allow the construction of a 6,151 sq.ft. conference facility and 48 additional hotel units on 2.54 acres of a 29.29 acre site on the west side of Highway 111, south of 44th Avenue. Mr. Sawa presented this case indicating that the 2.54 acre site was previously considered as undeveloped and the applicants are now proposing 48 hotel units and a conference facility on this site. He referred to the exhibits pointing out the design of the project with the changes. He explained an additional request by the applicant was to utilize 10% of the hotel units for employees. He stated if Staff determines this is permissable, the applicant can submit a future amendment. Mr. Sawa noted that Staff recommended the 2. 54 acre site to be included as part of Phase I. Commissioner Kryder was concerned about the collection of toom' taxes. He asked how this would be determined. Mr. Sawa replied that the applicant was present and can answer the question. Commissioner Richards felt that there was no justification for 10% of the hotel units to be utilized for employment. Chairman Miller opened the Public Hearing asking if the applicant cared to make a presentation. MR. JIM SMITH, Stein-Brief/Vista, 18071 Fitch Ave. , Irvine, briefly reviewed the background of the project. In describing the conference facility, Mr. Smith stated that it would attract seminar groups, 100 to 300 people. He explained how the redesign of this building created the setback deficiency. Mr. Smith further explained that this part of the project would be part of Phase I. Mr. Smith gave a detailed explanation as to why he requested the hotel units for employees. He stated that they wanted to keep the management personnel for long- term employment in order to be able to operate a quality hotel . He also felt that the housing market would make it impossible for employees to afford housing nearby. He noted that this would require an amendment of one of the original conditions. Commissioner Richards felt that 10% was not needed. Mr. Smith replied that the number of rooms to be used would be determined in the future and that it could be more or less than 10%. Commissioner McLachlan asked for the cost of the units. Mr. Smith stated that a preliminary figure would be about $100,000 to $110,000. Commissioner McLachlan pointed out that housing nearby would probably be available for that amount or less. Case No. CUP 13-80 - JACK KLOTZ and SANDY BAUM, Applicants Approval of a Conditional Use Permit, Associated Parking Variance and Joint Use Parking Agreement to allow a Dinner House to occupy 6,505 sq.ft. of space, in a commercial complex within a C-1, S.P. (General Commercial , Scenic Preservation Overlay) zone located on the east side of San Pablo Avenue, between Highway 111 and El Paseo (73-520 El Paseo) . Mr. Sawa reviewed the site plan and explained that the proposed restaurant would be opened in the evenings only, therefore, the applicant is requesting joint use parking. Mr. Sawa stated that Staff felt the patio area should be cut to one half the proposed size to insure that no parking problems arise. Staff recommended approval . Chairman Miller opened the Public Hearing asking if the applicant wished to make a presentation. MR. Mr. Crump briefly described the project and the property owner's objections. He informed the Commission that the applicant initially contacted the City to deter- mine whether or not a Conditional Use Permit would be required; the City decided to process the item as a design review case since communications have been received. Mr. Crump suggested that the Commission, by minute motion, continue this case and require a Conditional Use Permit. With these opening remarks Mr. Sawa presented the Design Review Board cases for Commission's consideration. 217 MF - Preliminary plans for landscaping of entry for condominium project in Iddian�eT7s located on the south side of Fairway Drive at Cook Street for INDIAN WELLS ASSOCIATES. Mr. Sawa described the project and stated that the ORB granted preliminary approval of landscape plans subject to final plans being submitted for review. He indicated that the property owner' s main objection is that the original plans showed more landscaping and greater separation between the service entry lane and residential structures. Chairman Miller invited the applicant to speak before the Commission. JIM PIERCE, Vintage Properties, briefly explained the scope of the project that is located in Palm Desert. He stated that he supported a continuance to the September 2, 1980, Commission meeting to allow adjacent property owners to provide input. 218 MF - Mr. Sawa presented this case explaining that carport structures were required as a part of the approval for the conversion to co-op ownership. He described the project and indicated that the Design Review Board approved the case with some revisions. He reviewed those revisions. CLYDE BEEBE, Director of Public Works: Commented that this was his last Planning Commission meeting and expressed his appreciation for the past cooperation he received from the Commission during his tenure with the City. There being no other persons wishing to address the Commission, Chairman Miller requested that the Commission return to Item X. X. DISCUSSION ITEMS A. Consideration of Alternative Land Uses for Specific Areas of t.ne City. The Commission originally discussed this matter during the study session which preceded the meeting. At that time, Mr. Crump reviewed the options and various sites for Commission consideration. After a brief discussion the Commission decided to initiate a Change of Zone for specific areas on the west side of Monterey Avenue from R-2, S.P. to R-3 S.P. and to expand conditional use permissable in a R-3 zone. Chairman Miller returned the meeting to Item VIII, NEW BUSINESS, for intro- duction of motions and voting. VIII. NEW BUSINESS A.
