CASE NO. ZOA 05-81 a j WHEREAS, the City Council of the City of Palm Desert, California, did on the 28th, day of January, 1982, hold a duly noticed Public Hearing, to consider an addition to the Municipal Code concerning a trash handling alternative. WHEREAS, the Planning Commission, by Resolution No. 772 has recommended approval; and, WHEREAS, said application has complied with requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined the project is a Class 5 Categorical Exemption; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to approve its action as described below: 1. That the Zoning Ordinance Amendment is consistent with the objectives of the Zoning Ordinance. 2. That the Zoning Ordinance Amendment is consistent with the adopted General Plan. 3. That the Zoning Ordinance Amendment would better serve the public health, safety, and general welfare, than the current regulations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the considerations of the Council in this case. 2. That it does hereby aprove a Zoning Ordinance Text Amendment, as provided in the attached exhibit, labeled Exhibit "A", to add Municipal Code Section 25.56.480 adding a trash handling alternative. 3. DISCUSSION: This amendment was initiated by a request from George Ritter to Staff to consider a new design for trash enclosures. This matter was before the Planning Commission on February 18, 1981 and April 15, 1981, but was continued to allow Staff to study it further. It then came before the Planning Commission again at its January 5, 1982, meeting. At that time, no one spoke in favor or in opposition to the proposed amendment. Planning Commission then approved the proposed amendment unanimously (5-0). The proposed amendment will allow for the installation of an alternative form of trash enclosure. This new enclosure is submerged in the ground. A modified trash bin ,is then lowered and raised into the pit by the trash truck. Carried unanimously 5-0. Moved by Commissioner Wood, seconded by Commissioner Miller, to waive further reading and adopt Planning Commission Resolution No. 771, as amended, approving CUP 11-81 and a Negative Declaration of Environmental Impact. Carried unanimously 5-0. CHAIRMAN KRYDER CALLED A 10 MINUTE RECESS - MEETING RECONVENED AT 9:05 P.M. D. Case No. ZOA 05-81 - CITY OF PALM DESERT, Applicants Consideration of a Zoning Ordinance Amendment pertaining to trash handling alternatives. Mr. Joy reviewed the staff report noting that this matter was continued for a period of 6 months in order to give staff an opportunity to study the new design in the President's Plaza. Staff recommended allowing the placement of a trash bin in a concrete pit as an alternative to a trash enclosure. Chairman Kryder stated that previously it was found that trash had been thrown around the pit and asked if this was still a problem. Mr. Joy replied that the problem had been resolved. Commissioner Crites asked for comments from the Disposal Service. Mr. Joy stated that the Disposal Service identified problems with cars being parked so that bins could not be easily reached in President's Plaza. Therefore, approval from the Disposal Service on the placement of all trash bins would be required to avoid this problem. Commissioner Wood asked how construction of the pits would occur. Mr. Diaz replied that they would probably be constructed as development occurs. Chairman Kryder opened the public testimony and asked if anyone wished to speak in FAVOR or OPPOSITION to this case. There being none, the public testimony was closed. Moved by Commissioner Richards, seconded by Commissioner Wood, to adopt findings as recommended by staff. Carried unanimously 5-0. Moved by Commissioner Richards, seconded by Commissioner Wood, to waive further reading and adopt Planning Commission Resolution No. 772, recommending approval of ZOA 05-81. Carried unanimously 5-0. Carried unanimously 5-0. -5- City of palm Desert Staff Report TO: Planning Commission DATE: January 5, 1982 CASE NO: ZOA 05-81 PROPOSED AMENDMENT: Create Section 25.56.480 to read: Trash Handling Alternative - An alternative to a trash enclosure shall include the placement of a trash bin in a concrete pit. Use, location and design of the trash handling facility shall be reviewed and approved by the local Disposal Service and the City of Palm Desert. INITIATED BY: This amendment was initiated by a request from George Ritter to Staff to consider a new design for trash enclosures. I. DISCUSSION: The proposed amendment previously was set for Public Hearing on February 18, 1981 and April 15, 1981, but was continued for six months in order for Staff to study the long-term ramifications of the new design in Presidents Plaza. The system generally consists of a concrete pit with a modified trash bin which is lowered and raised into the pit by the trash truck. The system has various advantages and disadvantages. Because the trash bin is lower than a bin at normal ground level, it can be hidden relatively easily by adjacent landscaping and would not require a block wall enclosure. The reduced height improves the aesthetics by not allowing one's view to be obstructed to the degree that it would be by the taller trash enclosure. The concrete pit is the only space required for the trash bin while a trash bin placed at ground level requires enough space to be enclosed by a block wall. The lower trash bin is also easier to use since it is more accessible. The disadvantage of the shorter bin is that it is placed in a concrete pit and therefore is immobile. This proves to be a hindrance while attempting to position a trash truck to unload the bin. The reasons for this are that obstacles such as parked cars make it difficult for the driver of the truck to position the truck properly. Staff feels that careful placement of the concrete pit for a trash bin can eliminate any problems for the trash truck. This is achieved through getting approval from the Disposal Service on the placement of all trash bins, a standard policy during design review. The bins used in Presidents Plaza still look very much like a line of transformers. II. ENVIRONMENTAL FINDINGS: The Director of Environmental Services has determined that the proposed amendment is a Class 5, Categorical Exemption for purposes of CEQA. III. DP 02-81, DP 0 81 and PM 17474 by Planning Commission Resolution Nos. 700, 701 and 702, subject to nditions. Carried unanimously (5-0). Case No. ZOA 05-81 - CITY OF PALM DESERT and RITTER AND ASSOCIATES, Applicants Mr. Sawa presented this case reviewing the request and stated that staff would like a six month trial period to see how it worked in the Presidents' Plaza parking lot. Commissioner Kryder asked if staff observed any problems so far. Mr. Sawa noted that trash was being put on the ground around the bins. Motion was made by Commissioner Berkey, seconded by Commissioner Kryder, to continue this case for six months. Mr. Diaz reviewed the staff report stating that the amendment would delete the r uirement of a Public Hearing for time extensions. He noted that public input i the past had been very minimal . Staff suggested that future time exten- sions be andled as part of the consent calendar. We wish to have this design be a City approved alternate to the current City stag, "Concrete Block Bunker design for trash enclosures. Our recessed design has many advantages over the City design.The profile minimizes the aesthetic impact of the container, it does not block the view, it may be partially screened by planting, and the low height design eases the filling of the container. The recess installation provides a permanent location for the trash container and prevents its relocation except by the disposal company. The installation costs less initially and the only maintenance is the repair and painting of the containers by the disposal company. We feel this container installation is superior to the existing City standards and should be an acceptable alternate to the "Concrete Block Bunker" design. We request that the ordinances be modified to allow this type of installation. Enclosed are 44-* photos and a plan of the Jacques Building installation for your information. Staff has been approached by George Ritter, a local architect, with a design for a new trash disposal system. The system generally consists of a concrete pit with a modified trash bin lowered and raised into the pit by the trash truck (see attached pictures). The Redevelopment Agency recently used these bins in the Presidents' Plaza Parking lots. The applicant is asking that the Code be amended to allow this system as an alter- native to the normal concrete block trash enclosure. Staff will fully analyze this system should the Planning Commission set the matter to Public Hearing. STAFF RECOMMENDATION: Determine whether there is sufficient merit to amend the Municipal Code. REQUEST: Consideration of a Zoning Ordinance Amendment pertaining to trash bin enclosures. II . BACKGROUND: This Ordinance amendment was set for public hearing at the meeting of February 18, 1981. The system has just recently been put into large scale use in the Presidents ' Plaza parking lot. Staff feels that while the system appears to have merit, the long term rami- fications are not known yet. Before allowing city-wide use, we would like to allow a six (6) month trial period to see how the system works in the Presi- dents' Plaza parking lot. Staff will publish the amendment when rescheduled. One observation we can now make is that the trash bins used in the parking lot look very much like utility boxes or transformers. III. STAFF RECOMMENDATION: Continue consideration of Zoning Ordinance amendment for six (6) months.
