A. STAFF RECOMMENDATION:

to second reading.
B. DISCUSSION:
This amendment would add churches to the limited list of uses presently permitted
by a conditional use permit in the office professional (O.P.) zone. Staff feels that a
church use would fit the buffer category the office professional zone is intended to
be.
This amendment was initiated after the Greek Orthodox Church of the Desert
inquired about the use of the old public works building in the office professional
zone at Larrea Street and Lantana Avenue as a church.
At the planning commission meeting of July 19, 1983, there was no audience
participation or comments from the planning commission other than a planning
commission concern that only churches and not 'other religious institutes" be
permitted. The planning commission thereafter voted 5-0 to recommend approval
of this amendment as amended to allow churches as a conditional use in the office
professional zone.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, AMENDING THE
ZONING ORDINANCE TEXT TO PERMIT CHURCHES AS A
CONDITIONAL USE IN THE OFFICE PROFESSIONAL
ZONE.
CASE NO. ZOA 06-83
WHEREAS, the City Council of the City of Palm Desert, California, did on the
day of , , hold a duly noticed public hearing to consider a
proposed amendment to the municipal code relating to conditional uses in the office
professional (O.P.) zone.
WHEREAS, the Palm Desert Planning Commission, by Resolution No. 867, has
recommended approval; and,
WHEREAS, said application has complied with requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined the
project is a Class 5 categorical exemption; and,
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all persons desiring to be heard, said City Council did find the
following facts and reasons to exist to approve a zoning ordinance text amendment.
1. That the zoning ordinance amendment is consistent
with the objectives of the zoning ordinance.
2. That the zoning ordinance amendment is consistent
with the adopted general plan.
3. That the zoning ordinance amendment would better
serve the public health, safety, and general welfare,
than the current regulations.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute
the considerations of the council in this case.
2. That it does hereby approve a zoning ordinance text
amendment, as provided in the attached exhibit, labeled
Exhibit "A".
3. The city clerk is directed to publish this ordinance once in the
Desert Post, a newspaper of general circulation, published
and circulated in the City of Palm Desert, and shall certify to
the passage of adoption of this ordinance, and the same shall be
in full force and effect thirty (30) days after its adoption.

Request for consideration of a modification of permitted uses
subject to a conditional use permit in the office professional
(O.P.) zone.
Mr. Joy reviewed the staff report and recommended approval.
Commissioner Crites asked for the meaning of the term "and other religious
institutes". Mr. Joy responded that it meant the same thing as churches.
It was noted to amend Item G of Exhibit A, deleting the words "and other religious
institutions".
Chairman Wood opened the public hearing and asked if anyone present wished to
speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was
closed.
Moved by Commissioner Crites, seconded by Commissioner Downs, to adopt
Planning Commission Resolution No. 867, recommending approval of Case No. ZOA 06-83,
as amended; carried unanimously 5-0.

PROPOSED AMENDMENT:
Modification of permitted uses subject to a conditional use
permit in the office professional zone.
INITIATED BY: City of Palm Desert
I. BACKGROUND:
The office professional zone was created in October of 1981 to implement a land
use designated on the city's general plan. The new zone was established to provide
a buffer between commercial and residential uses.
II. DISCUSSION:
When the office professional zone was established, the issue of permitted uses
arose. At that time it was staff's intention to limit uses in this area to those listed
to retain the buffer ideology. When this was done, a church use was inadvertently
left off the list of uses subject to a conditional use permit.
When the Greek Orthodox Church of the Desert expressed interest in the building
formerly occupied by the city public works department, it was discovered that
churches- were omitted from the list of uses. In this case, the only other two
buildings along the south side of Larrea between Portola and Lantana are used as
churches, although one, the Church of Religious Science is approved to move per
Conditional Use Permit 08-83.
A church is a conditional use in the single-family residential zone. This use would
fit into a buffer type use classification in that there is some noise and traffic
generation but not enough on a daily basis to be objectionable. This type of use can
also have building elevations that can blend with residential developments (i.e. sign
area is not a critical factor with this use).
III. STAFF RECOMMENDATION:
Staff recommends adoption of Planning Commission Resolution No. ,
recommending to the city council approval of ZOA 06-83 amending Section
25.25.014to permit a church as a conditional use in the office professional zone.

approval of the city, therefore, time is of the essence.

NOTICE IS HEREBY GIVEN that a public hearing will be held before the Palm Desert
Planning Commission to consider a request by the CITY OF PALM DESERT for an
amendment to Section 25.25.014, Permitted uses subject to a conditional use permit.
SAID public hearing will be held on July 19, 1983, 2:00 p.m. in the council chambers in the
Palm Desert City Hall, 45-275 Prickly Pear Lane, Palm Desert, California, at which time
and place all interested persons are invited to attend and be heard.

Dear Sirs :
On behalf of the Greek Orthodox Church of the
Desert , please be advised that the subject property is
in escrow at the present time for the purpose of using
this property as a Greek Orthodox Church.
Since it is impossible to do this without the
permission or approval of the City of Palm Desert ,
there is a contingency in this escrow requiring the
approval of the city, therefore, time is of the essence .
We are herewith, requesting the city to amend section
25 . 25 . 014 to permit a church on this property with a
conditional use permit .
