A. STAFF RECOMMENDATION:
Waive further reading and pass Ordinance No. , to second reading.
B. DISCUSSION:
This amendment would delete the access restriction in the planned commercial
(PC) zone requirements, which states:
"A maximum of two entrances per property will be allowed subject to
their conformance with acceptable circulation patterns and traffic-
control measures."
Staff feels that there is no need to retain this restriction because the city has
complete design control through the planning commission review process.
Additionally, with properties that have wide frontages it is not always practical or
necessary to restrict access.
At the planning commission hearing no one spoke in favor or opposition to the
proposed amendment. Planning commission unanimously adopted Resolution No.
911 recommending approval to the City Council of Case No. ZOA 09-83.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, APPROVING AN
AMENDMENT TO THE ZONING ORDINANCE TEXT,
REGARDING VEHICULAR ACCESS FOR PROJECTS IN
PLANNED COMMERCIAL ZONES.
CASE NO. ZOA 09-83
WHEREAS, the City Council of the City of Palm Desert, California, did on the
12th day of January, 1984, hold a duly noticed public hearing, to consider a zoning
ordinance text amendment relating to driveway access for projects in the planned
commercial (PC) zones.
WHEREAS, the planning commission by Resolution No. 911 has recommended
approval;
WHEREAS, said application has complied with requirements of the "City of Palm
Desert Procedures to Implement the California Environmental Quality Act, Resolution
No. 80-8911, in that the director of environmental services has determined the project is a
Class 5, categorical exemption and therefore no further documentation is deemed
necessary.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said City Council did find the
following facts to justify its action as described below:
1. That the zoning ordinance amendment is consistent with the objectives
of the zoning ordinance.
2. That the zoning ordinance amendment is consistent with the adopted
general plan.
3. That the zoning ordinance amendment would better serve the public
health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, as follows:
1. That the above recitations are true and correct and constitute the
considerations of the council in this case.
2. That it does hereby approve a zoning ordinance text amendment
deleting Section 25.30.170.
3. The city clerk of the City of Palm Desert, California, is hereby
directed to publish this ordinance in the Desert Post, a newspaper
of general circulation, published and circulated in the City of
Palm Desert, California, and shall be in full force and effect
thirty (30) days after its adoption.

This matter was briefly reviewed by Commissioner Richards for the benefit of the
audience.
Chairman Wood opened the public hearing and asked if anyone present wished to
speak in FAVOR or OPPOSITION to this case. There being none, the public hearing
was closed.
Moved by Commissioner Downs, seconded by Commissioner Crites, to adopt
Planning Commission Resolution No. 911, recommending approval to the city
council of ZOA 09-83. Carried unanimously 5-0.

PROPOSED AMENDMENT:
Consideration of an amendment to the Palm Desert Zoning Ordinance

I. GENERAL•
This amendment would delete the access restriction in the Planned Commercial
(PC) zone requirements, which states:
"A maximum of two entrances per property will be allowed
subject to their conformance with acceptable circulation
patterns and traffic-control measures."
Staff feels that there is no need to retain this restriction since the city has
complete design control through the planning commission review process.
Additionally, with properties that have wide frontages it is not always practicable
or necessary to restrict access.
II. ENVIRONMENTAL REVIEW:
The director of environmental services has determined that the proposed
amendment is a Class 5 exemption and no further documentation is deemed
necessary.
III. STAFF RECOMMENDATION:
Staff feels this amendment is acceptable and desirable. It will provide flexibility,
while the city will retain adequate design control. Therefore, staff recommends:
Adoption of Planning Commission Resolution No. recommending
approval of ZOA 09-83.

PROPOSED AMENDMENT:
Consideration of an amendment to the Palm Desert Zoning Ordinance
Section 25.30.170 regarding vehicular access for projects in planned
commercial zones.
INITIATED BY:
CITY OF PALM DESERT
I. GENERAL:
This amendment would delete the access restriction in the Planned Commercial
(PC) zone requirements, which states:
"A maximum of two entrances per property will be allowed
subject to their conformance with acceptable circulation
patterns and traffic-control measures."
Staff feels that there is no need to retain this restriction since the city has
complete design control through the planning commission review process.
Additionally, with properties that have wide frontages it is not always practicable
or necessary to restrict access.
H. ENVIRONMENTAL REVIEW:
The director of environmental services has determined that the proposed
amendment is a Class 5 exemption and no further documentation is deemed
necessary.
III. STAFF RECOMMENDATION:
Staff feels this amendment is acceptable and desirable. It will provide flexibility,
while the city will retain adequate design control. Therefore, staff recommends:
Adoption of Planning Commission Resolution No. , recommending
approval of ZOA 09-83.
"A Resolution Of the Planning Commission of the City of
Palm Desert, California, recommending approval to the
City Council of an amendment to the Palm Desert Zoning
Ordinance Section 25.30.170."

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA,
RECOMMENDING APPROVAL TO THE CITY COUNCIL
OF AN AMENDMENT TO THE ZONING ORDINANCE
TEXT, REGARDING VEHICULAR ACCESS FOR
PROJECTS IN PLANNED COMMERCIAL ZONES.
CASE NO. ZOA 09-83
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 6th day of December, 1983, hold a duly noticed public hearing to consider a zoning
ordinance text amendment relating to driveway access for projects in the Planned
Commercial (PC) zones.
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project is a Class 5, categorical exemption and therefore no further documentation is
deemed necessary.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said planning commission did find
the following facts and reasons to exist to recommend approval of a zoning ordinance text
amendment:
1. That the Zoning Ordinance Amendment is consistent with the objectives of
the zoning ordinance.
2. That the Zoning Ordinance Amendment is consistent with the adopted
General Plan.
3. That the Zoning Ordinance Amendment would better serve the public health,
safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the
considerations of the commission in this case.
2. That it does hereby recommend a Zoning Ordinance Text Amendment,
deleting Section 25.30.170.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 6th day of December, 1983, by the following vote, to
