HomeMy WebLinkAboutZOA 16-8 HEIGHT/LIGHT STANDARDS 1982 ORDINANCE NO: 285 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, INCREASING THE MAXIMUM HEIGHT OF LIGHT STANDARDS. CASE NO. ZOA 16-81 WHEREAS, the City Council of the City of Palm Desert, California, did on the IIth, day of February, 1982, hold a duly noticed Public Hearing, to consider an amendment to Section 25.58.150 concerning light standard height limits in off-street parking and loading areas. WHEREAS, the Planning Commission, by Resolution No. 775 has recommended approval; and WHEREAS, said application has complied with requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined the project is a Class 5 Categorical Exemption; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts to justify its action as described below: 1. That the Zoning Ordinance Amendment is consistent with the objectives of the Zoning Ordinance. 2. That the Zoning Ordinance Amendment is consistent with the adopted General Plan. 3. That the Zoning Ordinance Amendment would better serve the public health, safety, and general welfare, than the current regulations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the considerations of the Council in this case. 2. That it does hereby aprove a Zoning Ordinance Text Amendment, as provided in the attached exhibit, labeled Exhibit "A", to amend Municipal Code Section 25.58.150. 3. The City Clerk is directed to publish this Ordinance once in the Palm Desert Post, a newspaper of general circulation, published and circulated in the City of Palm Desert, and shall certify to the passage of adoption of this Ordinance, and the same shall be in full force and effect thirty (30) days after its adoption. Lighting used to illuminate the parking area shall be designed and located to confine direct rays to the premises. STAFF RECOMMENDATION: Waive further reading and pass Ordinance No. , to second reading. B. DISCUSSION: The present Municipal Code provisions limit the height of light standards to ten (10) feet. The proposed revision was initiated as a result of complaints received by Staff. The current 10 foot limit does not allow for an effective or efficient lighting plan. The proposed revision would increase the maximum light standard height to 30 feet in commercial areas and 20 feet in multiple residential districts. In recent years lighting technology has been improved so that problems related to "spillover" have been reduced or eliminated. At the Planning Commission hearing, no member of the public spoke in favor or_in opposition to the proposed revision. The Planning Commission voted 3-1 (Crites nay Richards absent) to recommend approval of the proposed revision to the City Council. The reason for Commissioner Crite's vote, was that he objected to the increased amount of light visible from a distance. Attached is the staff report prepared by Staff supporting the need for a change to the permitted light pole heights. /pa MINUTES PALM DESERT PLANNING COMMISSION JANUARY 19, 1982 motion died for lack of a second. Commissioner's Miller and Kryder felt that Condition No. 1, which read "Hours of operation for the arcade area to be same as those for restaurant" was adequate rather than specifying the hours, but agreed to amend Condition No. 2 to 6 months. Commissioner Crites suggested adding Condition No. 4 to read: "Security personnel shall be present on the premises at all times." Commission agreed. Moved by Chairman Kryder, seconded by Commissioner Crites, to waive further reading and adopt Planning Commission Resolution No. 774, with Condition No. 2 amended and Condition No. 4 added, approving an amendment to CUP 09-78. Carried 3-1 (Wood voting Nay). T C. Case No. ZOA 16-81 - CITY OF PALM DESERT, Applicants Consideration of an amendment to increase the height limit for light standards in off-street parking and loading areas. Mr. Joy reviewed the staff report recommending approval. Chairman Kryder expressed a concern for the height limit for commercial uses adjacent to residential areas. Mr. Diaz explained that any spillover could be controlled through careful review of plans prior to approval. Commissiner Crites felt that increasing the height limit to 30 feet would create increased light visibility. Mr. Diaz explained that this would reduce the number of lighting standards, therefore, making it more energy efficient. Chairman Kryder opened the public testimony and asked if anyone wished to speak in FAVOR or OPPOSITION to this request; there being none, the public testimony was closed. Moved by Commissioner Wood, seconded by Chairman Kryder, to waive further reading and adopt Planning Commission Resolution No. 775, recommending to the City Council an increase in the height limit for light standards. Carried 3-1 (Crites voting Nay). THERE WAS A 10 MINUTE RECESS - MEETING RECONVENED AT 3:45 P.M. VIQ. DESIGN REVIEW BOARD ITEMS Preliminary plan approvals by the Design Review Board at its meeting of January 12, 1982, requiring Planning Commission confirmation. A. Case No. 159 C - T.G.I. FRIDAYS, INC. - Request for preliminary approval of plans for a restaurant building including usage of red and white awnings for property at Palms to Pines West, Phase II on Hwy III and El Paseo (west). B. Case No. 160 C - MILLARD ARCHULETA ASSOCIATES for BONWIT TELLER - Request for approval of preliminary plans for a department store at the Palm Desert Town Center on Hwy 111. Mr. Smith briefly reviewed these cases and recommended approval of the Design Review Board's actions. In reviewing the plans for T.G.I. FRIDAYS, INC., Commission expressed concern for the red and white awnings. After some discussion, it was the consensus of the Commission to further study the matter prior to approval. DIAZ, Secretary /pa City of Palm Desert Staff Report TO: Planning Commission DATE: January 14, 1982 CASE NO: ZOA 16-81 PROPOSED AMENDMENT:To permit installation of light standards in parking and loading areas. INITIATED BY: City of Palm Desert I. DISCUSSION: The proposed revision was initiated after complaints concerning present parking and lighting standards arose. The current lighting height limit of ten feet for parking lot lights does not permit commercial areas to light their parking areas in an effective or efficient manner. The present lighting height limits were established with consideration being given to the appearance of light fixtures and not the level of lighting in public parking areas. There was also concern raised relating to lighting spillover outside the parking area. In recent years, parking and lighting technology has been improved so that problems related to spillover have been reduced or eliminated. The design of fixtures have also been improved aesthetically. It is not possible for commercial parking areas to achieve an acceptable level of lighting U foot candle average illumination) using the ten foot high standard without having a forest of light fixtures and an energy inefficient system. According to Phil Bescos of Southern California Edison, it is more energy efficient to achieve a given lighting level using fixtures above the height of ten feet than at ten feet or below. The one concern which is always raised relating to parking lot lighting is the impact on adjacent properties. The City's current standards require that: "Any lights provided to illuminate any public parking area and semi-public parking area shall be arranged so as to reflect the light away from any premises upon which a dwelling is located. Any lighting "spillover" shall not exceed 0.1 foot candles at any point on such premises." This coupled with the City's review procedure assures that any potential spillover problem can be mitigated. The next question is what should the height limit be? Staff would recommend a height of 30 feet in commercial areas and 20 feet in multiple residential districts. This height is based on existing building height limits and tennis court lighting height limits. The proposed revisions would amend the current code as follows: 25.58.150 Lighting Requirements. Lighting used to illuminate the parking area shall be designed and located to confine direct rays to the premises. Light standards shall be a maximum of thirty feet in height in non residential areas and twenty feet in height in multiple residential areas. II. ENVIRONMENTAL FINDINGS: The Director of Environmental Services has determined that the proposed amendment is a Class 5, Categorical Exemption for purposes of CEQA. III.
