HomeMy WebLinkAboutZOA 85-7 RV PARKS 1985 PLANNING COMMISSION RESOLUTION NO. 1098 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA RECOMMENDING TO THE C I TY COUNCIL APPROVAL OF A ZON I NG ORDINANCE AMENDMENT ADDING RECREATIONAL VEHICLE PARKS AS A CONDITIONAL USE TO THE PR AND R-1-M ZONES. CASE NO.(�ZOA 85-� �_ WHEREAS, the Planning Commission of the City of Palm Desert, California did on the 15th day of October and continued on November 5, 1985, hold a duly noticed public hearing to consider amendment to the zoning ordinance adding recreational vehicle parks to chapter 25.22 R-I-M (single family/mobile home residential district) and PR (planned residential district) . WHEREAS, said amendment has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of community development has determined the amendment to be a class 5 categorical exemption. WHEREAS, at said public hearing, upon hearing and considering all testi- mony and arguments, If any, of all persons desiring to be heard, said planning commission did find the following facts and reasons to exist to recommend approval of a zoning ordinance text amendment: I . The proposed amendment would allow limited development of recreational vehicle parks consistent with intent and purpose of the zoning ordinance and Palm Desert General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1 . That the above recitations are true and correct and constitute the considerations of the commission in this case. 2. That it does hereby recommend approval of ZOA 85-6 as provided in the attached exhibit, labeled Exhibit"A". PASSED, APPROVED and ADOPTED at a regular meeting of the Palm. Minimum project size of 5 acres. 2. Maximum density of 12 spaces per acre. 3. Minimum space area of 1500 square feet, minimum dimension 30' X 50' . 4. Minimum 40% common open space/recreation area. 5. Front project setback adjacent to public street of 25 feet with combination of six foot masonry wall and landscaping to screen all recreation vehicles. 6. Interior property lines to be bounded by 6 foot masonry wall and at least 10 feet of landscaping. 7. Projects may be single use or developed as part of a larger resort or residential development. 8. Continued Case No. ZOA CITY OF PALM DESERT, Applicant Zoning ordinance amendment listing recreational vehicle parks as a conditional use in the R-I-M and PR zones and establishing minimum standards for their development. Mr. Drell outlined the standards in the report and recommended approval . i Commissioner Wood clarified that the amendment would allow for recreational vehicle park plans to be submitted to the city for consideration. Chairman Crites asked if it could be required that large canopy shade trees be provided. Mr. Drell replied yes. Mr. Smith suggested this be applied at the architectural review level . Chairman Crites opened the public testimony and asked if anyone present wished to speak in FAVOR or OPPOSITION to the case. There being no one, the Chairman Crites closed the public testimony. Commissioner Wood noted that there was no harm in having this amendment and it also provided safe guards. Action: Moved by Commissioner Wood, seconded by Commissioner Downs, adopting the findings as presented by staff. Carried 4-0-1 (Commissioner Erwood abstained due to absence of previous meeting discussion. ) Moved by Commissioner Wood, seconded by Commissioner Downs, adopting Planning Commission Resolution No. 1098, recommending approval of ZOA 85-7 to city council . Carried 4-0-1 (Commissioner Erwood abstained due to absence of previous meeting discussion. ) D. Case No. PP 85-33 - R.K. DEVELOPMENT, Applicant Request for approval of a 44,000 square foot office/industrial complex located in a service industrial zone in the Cook Street Industrial Park at the corner of Beacon Hill and Sego Lane. 11 i I .M < MINUTES PALM DESERT PLANNING COMMISSION OCTOBER 15, 1985 i Chairman Crites commented that a special meeting could be called 24 hours prior to the meeting if they wished to meet there. Action: Moved by Commissioner Wood, seconded by Commissioner Richards, continuing this case to November 19, 1985. Carried 4-0. i F. Case No ZOA 85-7 CITY OF PALM DESERT, Applicant Zoning ordinance amendment listing recreational vehicle parks as a conditional use in the R-1-M and PR zones and establishing minimum standards for their development. Mr. Diaz and Mr. Drell outlined the request. Chairman Crites asked if staff was preparing a specific plan for the whole north side area. Mr. Diaz replied that it was scheduled for November 5 to preplan the area that will be annexed. Mr. Drell explained that this does not deal with any particular area. He stated that without this amendment, this type of use cannot be used anywhere in the city. Commissioner Wood asked what was behind the request. Mr. Drell explained that a property owner interested in annexation would like this option on his property and that with a conditional use permit and compliance with all standards it would be possible. Commissioner Wood felt that it had not been popular with citizens and asked the opinion of the other commissioners. Commissioner Richards stated that the only time he had ever seen discussion for recreational vehicles were for mobile home parks and noted that this is the first time for an RV park. Commissioner Richards asked for clarification regarding the PR zone and R-1-11. Mr. Drell explained that it was for manufactured housing zone. Commissioner Wood asked about a hearing for neighbors. Mr. Drell explained that this is not a specific request, it is only to allow this to be requested. Commissioner Downs asked about how the section numbers were listed. Mr. Drell explained that it was for two different code sections: the PR zone and the R-1-M. 1 Chairman Crites felt that while it might be appropriate in the R-1-11 zone he had concerns about it being allowed in the PR zone even with 16 i 1 MINUTES PALM DESERT PLANNING COMMISSION OCTOBER 15, 1985 a conditional use permit and noted that manufactured housing developments are not allowed in the PR zone. Mr. Drell replied that If it was determined that it was appropriate it could be allowed. Chairman Crites stated that the issue was whether or not to give someone the right to ask for that use. Commissioner Downs asked about the 1500 square foot and suggested that he go to the nine other such sites in the valley and find out exactly what space is allowed. Mr. Drell explained that was where this area standard was obtained and suggested that commission could stipulate minimum width and depth. Commissioner Downs felt that the figures from the other RV parks be shown to the commission to allow them to effectively evaluate the request. He felt that the 1500 square feet was to much because it would allow them to live there year round. Commissioner Richards stated that some are being sold as timeshare and stated that he would like more discussion in general . Chairman Crites felt that since RV parks generally attract people with children and suggested an automatic requirement for playground equipment. Mr. Drell indicated that at council study session it was discussed that a highly detailed ordinance not be established so as not to encourage RV's and that they be dealt with on a very limited basis as they came in and reviewed individually. Chairman Crites felt that it should be stated specifically what would be required. Commissioner Downs felt a pool , laundry facility, and grocery store should be part of those standards. Chairman Crites opened the public testimony. MR. BOB ROBERTS, 5 Lafayette Rancho Mirage, explained that the parcel in question is in the county and could be developed in the county standards. His intent was to use a small portion of the property for RV parking in conjunction with manufactured homes such as Suncrest exclusively for retired citizens with a golf course and all amenities. He felt that by tying them together it would make it a successful venture. He noted that It would be under close scrutiny through the conditional use process and felt that it should be developed under the guidelines of the City of Palm Desert. He stated that a small segment of the property is directly north of Palm Valley, Del Safari to the further north boundary of Del Safari and Frank Sinatra. Chairman Crites stated that any ordinance adopted would apply to 17 .� MINUTES PALM DESERT PLANNING COMMISSION OCTOBER 15, 1985 People aside from Mr. Roberts. Mr. Roberts replied that the point was well taken. Chairman Crites asked if anyone else wished to testify. Commissioner Downs stated that he would like to add two conditions relating to provision of a pool and a grocery store which would give the city the protection it would need. Mr. Diaz replied that if a grocery store was required, it would be an economic decision; they would provide one if it was feasible. Commissioner Downs clarified that he did not mean a full-fledged grocery store. Commissioner Richards felt that it was time for a motion of continuance to allow further study. Chairman Crites noted that Mr. Roberts was asking for the use "in conjunction with" and stated that it could be required that the use be in conjunction with another facility. Mr. Drell replied that under number 7 that issue was dealt with and could be developed very easily. Mr. Drell explained that if it was a good idea in conjunction, why not as a single project and stated that these are issues to be decided. Commissioner Wood indicated that he had concerns about whether or not the City of Palm Desert was ready for RV and manufactured homes. Commissioner Richards stated that it is part of the north sphere and there could be some use for that area and something should be in the ordinance. Action: Moved by Commissioner Richards, seconded by Commissioner Wood, continuing this case to November 5, 1985. Carried 4-0. I VIII. MISCELLANEOUS A. The minimum area of 1, 500 sq. ft• is satisfactory; however, the 30 ft. x 50 ft. minimum dimensions seem overly restrictive. RVs come in a variety of lengths, and the required area could be better utilized. For example, a site designed for shorter RVs may better utilize the area alongside the RV, for a larger outdoor living/patio area and allow for more screening between the units. I would suggest that the minimum area of 1 , 500 sq. ft. remain, the minimum dimension for the width remain, and the minimum dimension for the depth be reduced to 45 feet. DISCUSSION: At the November 15 Dublic hearing the commission expressed some concern regarding the level of detail in the proposed ordinance. Attached is the Cathedral City ordinance which represents the most detailed reaulation in the valley. When the city council initiated the ordinance. staff was instructed to prepare basic standards with details beina approved via the conditional use permit Process for each individual proiect. The PR and R- 1-M zones are planned development zones which presently do not contain detailed standards for many of the listed uses. The Planned Residential zone was included as eligible zone since nearly all the city's potential sites are presently zoned PR. The conditional use permit process would determine which specific sites were appropriate. We have used essentially the same procedure to approve such diverse uses as hotels. schools. convalescent hospitals and country clubs in the PR zone. The five acre proiect minimum would allow for adequate perimeter landscapinq to insure compatibility. The ultimate goal of the standards would be to allow a limited number resort type parks with extensive landscaping and common recreation facilities . The 1500 square foot space minimum. and 40% open space requirements are designed to avoid the RV oarkina lot look of many Projects. A 30' by 50' minimum space dimension has been added allowing room for a 25 foot trailer Plus towing vehicle with sufficient setbacks for landscaping and Privacy. Also a section on recreational and commercial accessory uses has been added. Enforcement of the city's transient occupancy tax would be no more complex than for a hotel . Purpose This division is to provide For- the proper development of short term occupancy recreational vehicle park5y as mobile opposed to semi-permanent or permanent occupancy home parks , and to provide a reasonable compatibility with adjoining properties while allowing a diversity of uses . Section 2 . Definitions In this diviMipn , unless the context otherwise requires : a , "Recreational Vehicle" means as that term is defined in California Health and Safety Code Section 15215 .5 . b , "Recreational Vehicle Park" means a parcel of land under single ownership , where one or more spaces are rented or leased or held out for rent or lease to persons for occupancy of recreational vehicles , whether or not a Fee is charged For the use of the space . c , "Recreational Vehicle Space" means that part of a recreational vehicle park rented for the exclusive use of the occupants of a single recreational vehicle . The recreational vehicle space shall include the exclusive adjoining parking space and the required open space around the recreational vehicle . Section 3 . Permitted Districts A recreational vehicle park - is permitted in the RR Suche and CTR districts by Conditional Use P-.rmit . usa is not permitted in any other district . All Mutt parks muse be located to- provide reasonable access tc federal and state highways , or major local travelways . Section 4. Permitted Accessory Uses The following accessory uses which are incidental an( subordinate to a recreational vehicle park ar permitted . a. Mobile Homes Not. more than three mobile home spaces may be provided to accommodate mobile homes to be occucied by the owner , the manager , or employees in the operation of the park . Such mobile home spaces and mobile homes shall comply with all requirements and definitions set forth in Mobile Home Park Standards (Division D of this article ) . b . Single Family Residancs One single family residence For. the owner or manager of a recreational vehicle park . The yard requirements for this single family residence in this zone shall be the same as provided in the R 1- 7. 2 Residential district . The minimum area requirement for this residence shall be 6000 square feet . The residence may include office space for use in connection with the park operation - C . Social and Recreational Canter with Components Component uses will be permitted in a recreation or social center complex provided : ( 1 ) That there shall be no wholesale activity ; (2) That no merchandise or supplies shall be stored or displayed outside the completely enclosed building ; (3 ) That there shall be no exterior advertising or sign except as permitted for accessary uses only; (4) That component uses shall not be in a buildinc which is less than L00 Feet from any properc� line of the park site ; (5) The component uses permitted are : (a) Oelicatessen , snack bar without on-sat; consumption of alcoholic beverages , food store ; and (b ) Oay nursery and child care center . d , Private recreation uses for the use of th occupants of the park and their guests , such a swimming pool , putting greens and shuffleboar courts . 121 - e.
