A. STAFF RECOMMENDATION:
Waive further reading and pass Ordinance No. 452 to second reading.
B. DISCUSSION:
Council in December, 1985, appointed two new members to the architectural
review commission. At that time an alternate member was also appointed.
The city attorney has prepared a code amendment to provide for this
alternate position.
Planning Commission agreed that an alternate member position should be
created, however, it was suggested that in the future more than one
alternate may be necessary. Accordingly commission amended the draft
ordinance to read "Architectural Commission shall consist of one or more
alternates appointed by city council ."
The amended motion was approved on a 3-0 vote with commissioners Richards
and Erwood absent.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO
THE CITY COUNCIL APPROVAL OF A ZONING ORDINANCE
AMENDMENT RELATING TO THE ARCHITECTURAL
COMMISSION.
CASE NO. ZOA 86-1
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 21st day of January, 1986, hold a duly noticed public hearing to
consider an amendment to the zoning ordinance providing for the position of
alternate member of the architectural review commission; and
WHEREAS, said amendment has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-8911 , in that the director of community development has
determined the amendment to be a class 8 categorical exemption:
1 . The proposed amendment will allow the architectural review commission
to better serve the city.
NOW, THEREFORE, BE IT RESOLVED by. the Planning Commission of the City of
Palm Desert, as follows:
1 . That the above recitations are true and correct and constitute the
findings of the commission in this case;
2. That the planri`F,ng commission does hereby recommend to the city
council approva* of a Zoning Ordinance Amendment 86-1 as provided in
the attached exhibit labeled Exhibit "A."

EXHIBIT "A"
Section I . That Section 25.70.020 be, and the same is hereby amended,
to read as follows:
"Section 25. 70.020 Membership. The architectural commission shall
consist of five members and one or more alternates appointed by city
council ; three of them shall be architects, if available. The alternate
member shall serve as a voting member when any one of the five regular
members is absent from the meeting."
Section 2. That Section 25.70.030 be, and the same is hereby amended,
to read as follows:
"Section 25.70.030. Appointment and Term of Office. The voting
members and the alternate member of the architectural commission shall be
appointed by the city council . The first voting members of the commission
shall be appointed for the following terms:
A. Two shall serve for a term of four years;
B. One shall serve for a term of three years;
C. One shall serve for a term of two years; and
D. One shall serve for a term of one year.
Thereafter, the term of office for voting members and alternates shall be
four years.
If a member is unable to serve for three consecutive regular meetings,
the chairman or acting chairman shall declare the office of such member
vacant. The secretary shall immediately thereafter inform the city council .

Request for approval of a zoning ordinance
amendment allowing for an alternate member to
the architectural commission.
Mr. Smith explained the proQosed cnange to ordinance and indicated
that staff recommended apgrovai .
Commissioner Downs suggested that there be two alternate members.
one that is an architect and one that is from the general public.
Chairman Crites noted that being a second alternate would put a
person in a position where he would be waiting in the wings for a
call . He asked if the alternate would attend all meetings.
Mr. Smith explained that the alternate wouid attend all studv
sessions, then if his vote was needed at the meeting he would be
counted as a voting member. He would also offer his suggestions in
study session. Chairman Crites suggested that the ordinance state
"one or more alternates, what ever is necessary".
Commissioner Wood asked if there had been difficulty getting a
quorum at the meetings. Mr. Diaz stated that at times there was
difficulty but indicated that this has been resolved by adding two
laymen. Commissioner Wood thought that having laymen on the
commission would help when a commissioner has a case on the agenda

which he must abstain from.
Chairman Crites opened the public hearing and asked if anyone from
the audience wished to speak on this matter. Hearing no one the
public hearing was closed.
Chairman Crites indicated that Exhibit A should be amended to read
"Architectural commission shall consist of one or more alternates
appointed by city council ".
Action:
Moved by Commissioner Wood, seconded by Commissioner Downs, adopting_
the findings as presented by staff. Carried 3-0.
Moved by Commissioner Wood, seconded by Commissioner Downs, adopting
Planning Commission Resolution No. 1112, recommending approval of ZOA
86-I to the city council , as amended. Carried 3-0.

WHEREAS, the City Council of the City of Palm Desert, California, did on

WHEREAS, at said public hearing, upon hearing and considering all
testimony arguments, if any, of all interested persons desiring to be heard,
said city council did find the following facts to justify its action as
described below:
1 . That the zoning ordinance amendment is consistent with the objectives
of the zoning ordinance.
2. That the zoning ordinance amendment is consistent with the adopted
general plan and affected specific plans.
3. That the zoning ordinance amendment would better serve the public
health, safety, and general welfare than the current regulations.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Palm
Desert, as follows:
1 . That the above recitations are true and correct and constitute the
consideration of the council in this case.
2. That it does hereby approve a Zoning Ordinance Text Amendment, as
provided in the attached exhibit, labeled Exhibit "A," to amend
Municipal Code sections 25.70.020 and 25.70.030.
3. The City Clerk of the City of Palm Desert, California, is hereby
directed to publish this ordinance in the Palm Desert Post, a
newspaper of general circulation, published and circulated in the
City of Palm Desert, California, and shall be In full force and
effective thirty (30) days after its adoption.

SUBJECT: Architectural commission alternate member.
I . BACKGROUND:
City council at its December 12. 1985 meer.inp aooninted two new members
to the arcnitectural commission. In adoition it was derrideo to appoinr
an alternate member to substitute for any member unable to attend. This
should assure that the commission can always have a quorum which has
been difficult in the past.
11 . DISCUSSION:
The zoning ordinance, chapter 70, establishes the architectural
commission, its duties and its membership makeup. In accordance with city
council directive the city attorney has prepared the appropriate code
changes to establish the position of alternate member. The draft
ordinance is attached.
111 . RECOMMENDATION:
Approve the findinas and adopt Planning Commission Resolution No.
recommending approval of ZOA 86-1 to city council .

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA, AMENDING
SECTIONS 25. 70. 020 and 25 . 70. 030 RELATING
TO THE ARCHITECTURAL COMMISSION
The City Council of the City of Palm Desert,
California, DOES HEREBY ORDAIN as follows:
Section 1 . That Section 25. 70. 020 be, and the same
is hereby amended, to read as follows:
"Section 25 . 70. 020. Membership. The architectural
commission shall consist of five members and one
alternate appointed by the City Council; three of them
shall be architects, if available. The alternate
member shall serve as a voting member when any one of
the five regular members is absent from the meeting. "
Section 2 . That Section 25 . 70. 030 be, and the same
is hereby amended, to read as follows:
"Section 25 . 70. 030. Appointment and Term of Office.
The voting members and the alternate member of the
Architectural Commission shall be appointed by the City
Council . The first voting members of the Commission
shall be appointed for the following terms:
A. Two shall serve for a term of four years;
B. One shall serve for a term of three years;
C. One shall serve for a term of two years; and
D. One shall serve for a term of one years.
Thereafter, the term of office for voting members
and alternate shall be four years.
if a member is unable to serve for three
consecutive regular meetings, the chairman or acting
chairman shall declare the office of such member
vacant. The secretary shall immediately thereafter
inform the City Council . (Ord. 326 [part] , 1983 . ) "

Section 3 . The City Clerk shall certify to the
passage and adoption of this ordinance and shall cause the
same to be published once in the Palm Desert Post, a
newspaper of general circulation, printed, published and
circulated within said City and the same shall be in full
force and effect thirty (30) days after its adoption.
Section 4. The foregoing was introduced at a
meeting of the City Council of the City of Palm Desert,
California, held on 1985, and adopted at a
meeting held on 1985, by the following

SUBJECT: Architectural commission alternate member.
1 . BACKGROUND:
City council at its December 12, 1985 meeting appointed two new members
to the architectural commission. In addition It was decided to appoint
an alternate member to substitute for any member unable to attend. This
should assure that the commission can always have a quorum which has
been difficult in the past.
11 . DISCUSSION:
The zoning ordinance, chapter 70, establishes the architectural
commission, its duties and its membership makeup. In accordance with city
council directive the city attorney has prepared the appropriate code
changes to establish the position of alternate member. The draft
ordinance is attached.
111 . RECOMMENDATION:
Approve the findings and adopt Planning Commission Resolution No. ,
recommending approval of ZOA 86-1 to city council .

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO
THE CITY COUNCIL APPROVAL OF A ZONING ORDINANCE
AMENDMENT RELATING TO THE ARCHITECTURAL
COMMISSION.
CASE NO. ZOA 86-1
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 21st day of January, 1986, hold a duly noticed public hearing to
consider an amendment to the zoning ordinance providing for the position of
alternate member of the architectural review commission; and
WHEREAS, said amendment has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of community development has
determined the amendment to be a class 8 categorical exemption:
1 . The proposed amendment will allow the architectural review commission
to better serve the city.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1 . That the above recitations are true and correct and constitute the
findings of the commission in this case;
2. That the planning commission does hereby recommend to the city
council approval of a Zoning Ordinance Amendment 86-1 as provided in
the attached exhibit labeled Exhibit "A."
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 21st day of January, 1986, by the following
