A ORDINANCE OF THE CITY COUNC i L OF THE CITY OF
PALM DESERT, CALIFORNIA APPROVING AN AMENDMENT,,
TO THE ZONING ORDINANCE TEXT RELATING TO HOTEL
DEVELOPMENT STANDARDS.
CASE NO. ZDA 86-3
WHEREAS, the City Clunc11 of the City of Palm Desert, California did on
the 27th day of March, 1�986, hold a du 1 y noticed pub I i c hearing to consider
amendment to the zoning ordinance section 25.56 relating to hotel development
standards.
WHEREAS, the Planning Commission, by Resolution No. 1120, has recommended
approval .
WHEREAS. said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89". in that the director of community development has
determined the amendment to be a class 5 categorical exemption.

' WHEREAS,' at said public hearing, upon hearing and considering all testi-
mony and arguments. 1f any, of all persons desiring to be heard, said city
council did find the following facts and reasons to exist to Justify its
action as described belows'
1 . That the zoning ordinance amendment is consistent with the objectives
of the zoning ordinance.
2. That the zoning ordinance amendment is consistent with the adopted
general plan and affected specific plans.
3. That the zoning ordinance amendment would better serve the public
health, safety and general welfare than the current regulations.
NOW, THEREFORE, 8E IT ORDAINED by the City Council of the City of Palm
Desert, as follows:
1. That the above recitations are true and correct and constitute the
considerations o'f the council in this case.
2. That It does hereby approve ZOA 86-3 as provided in the attached
exhibit, labeled Exhlbit"A".
3. The city clerk is directed to publish this ordinance once in the
Palm Desert Post, a newspaper of general circulation. published and
circulated in the City of Palm Desert, and shall certify to the
passage of adop Ion of this ordinance, and the same shall be in full
force and effect. thirty (30) days after Its adoption.

25.56.500 - Hotel Development Standards
All hotel developments shall comply with the following.
1 . That the minimum guest roan size for any hotel shall be 375 square
feet of clear interior space.
2. That all hotels shall provide a multi-purpose (3 meal ) restaurant
either within the building itself, attached or adjacent to the
building, together with roan service for hotel guests (a continental
breakfast may constitute one of the 3 meals) .

3. That all hotel developments shall utilize central air conditioning
systems or vertical fan coil systems or other specifically approved
systems. Window or wall installed air conditioning systems are
hereby prohibited.

Dear Ms. Gilligan:
The purpose of this letter is to file a formal appeal of a
staff determination concerning the above described develop-
ment. We are requesting a hearing before the City Council
concerning this matter.
The basis of this appeal is the staff ' s application of your
Ordinance No. 459 , and specifically the 375 square feet of
clear space regtuirement. The factual background of this
problem is as follows:
In early 1985 ourl development staff began meetings with your
planning staff and eventually we met with the Committee of the
Year 2000 . At that meeting several changes were discussed and
adopted into our plans, including the size of the individual
rooms. On October 1 , 1985 , the staff report to the Planning
Commission recommended approval of PP 85-28 and PM 20894 and
among other things stated:

"with the new application, all deficiencies noted in the
findings have been corrected. The new hotel complies
with the standards formulated by the commercial Com—
mittee of the Year 2000. Those standards require a
minimum 3751 square foot room size, central air con-
ditioning, interior room entrances and room service. "
The Planning Commission did, therefore, adopt Resolution
#1087 and 1088 unamimously. Among other things Resolution
#1087 approving P 85-28 stated that:

"the development of the property shall conform sub-
stantially with exhibits on file with the Department of
Community Development . "
In our submittals to staff prior to the hearing, we were
required to submit scaled drawings of the interior of the
rooms. Our rooms contained 382 square feet of space when
measured in the traditional wall center line to wall center
line method used by architects and contractors. At no time
during these meetings with staff or in the public hearing was
the word clear attached to the 375 square foot criteria.
We proceeded with the preparation of working drawings and
other work related to the development of this project based
upon the belief and understanding that our project met all
requirements as indicated by the staff report of October 1,
1985. At the Architectural Review Commission hearing on
November 25, 1986 , we were advised that we now were required
to revise our plans because our rooms were only 349. 5 square
feet clear interior space measured from inside of the walls.
We understand that in March of 1986 you adopted Ordinance No.
459 which created-the requirement for a clear 375 square feet.
This, of course, occurred long after our precise plan had been
approved, October' 1 , 1985.
We fully understand the City' s desire to control and insure
quality development in our city. We also believe the project

as now proposed is a quality project and a far superior
project compared , to some others previously developed. We
also believe we have proceeded in good faith in an effort to
meet all of the City' s requirements and have never attempted
to circumvent or side step your ordinances or requirements.
However, we have expended considerable sums of money and
closed escrow on ;the acquisition of the property subsequent
to October 1 , 1985, in reliance on the approved precise plan
and will be forced to make substantial adjustments to our
plans if the new ordinance is applied to this project. Our
rough grading has been completed and water lines, gas lines,
sewer lines and electrical service has been layed out, and is
ready to be installed in accordance with the planned develop-
ment directed bylour precise plan. Any change in the site
layout of the building will , of course, have an effect on
those utility service plans.

We would request, therefore, that our project be exempted
from the 375 clear square foot requirement of Ordinance No.
459 on the grounds that our prior approvals constituted such
exemption. No precedent would be set which would in any way
damage the City, and fairness and reasonableness would pre-
vail

Mr. Smith outlined the salient points of the staff report and
recommended that commercial subcommittee concern #4 be eliminated
and made a policy of the commission.
Commissioner Downs suggested that "adjacent to" be inserted in #2 to
read . .within the building itself, attached or adjacent to the
building, together with room service for hotel guests. "
Commissioner 'Richards expressed agreement with the elimination of
#4, but felt that the commission should look into possible "motel"
structures for along Interstate 10. Chairman Crites asked if an
overlay could be created for that area. Mr. Diaz replied that a
differentiation could be made. Commissioner Richards felt on-going
revenue structures should be considered. Chairman Crites suggested
that staff should be instructed to examine and address this issue.
Mr. Diaz e.pressed concern for allowing cheaper motel/hotel
developments along Interstate 10. Commissioner Wood noted that the
recommendation of the subcommittee seemed to support citizen, council
and staff feelings on this matter.
Mr. Smith noted that a north sphere study would be done and the
consultants could address the "motel standard" issue separately from
the hotel standards. Commission directed staff to bring this matter
to the attention of the consultants for review as part of the north
sphere study.
Commissioner Downs noted that as part of earlier discussions the
committee talked about a motel park for that area. Commissioner
Richards felt that there were specific areas where changes in
standards could be allowed and did not want this possibility
precluded.
Chairman Crites opened the public testimony and asked if anyone
wished to speak in FAVOR or OPPOSITION to the proposed. There being
no one, the public testimony was closed.

adopting an Commission Resolution No. 1120, as amended, and
recommending Ipproval of ZOA 86-3 to city council. Carried 5-0.
A FIVE MINUTE RECESS WAS CALLED AT 8:49 P.M.
A. Continued Case No. PP 85-39 - SANBORN AND RYLEE, Applicant
Mr. Diaz read the proposed condition that stated that in the event
that phase II is not completed within the required 24 months and
phase I has been completed, the developer shall provide 15 affordable
units of conventional senior housing units within phase I: 8 units
for lower income households and seven units for moderate income
households as shown in exhibit 2, until such time as project II is
completed and certified for occupancy.
Mr. Erwin indicated that the condition was acceptable and commission
concurred.

Moved by Commissioner Downs, seconded by Commissioner Erwood,
adopting the findings as presented by staff. Carried 4-1 (Richards
voted no. )
Moved by Commissioner Downs, seconded by Commissioner Erwood,
adopting Planning Commission Resolution No. 1121, approving PP 85-39,

comply with the ordinance, as long as more than a mediocre job was

Commissioner Richards agreed with the process but expressed concern
regarding a limit to what can be asked of the applicant by the city.
He felt a percentage of appraised value or number of square feet
should be used as a guideline, instead of having the subjective
opinions of the architectural commission.
Mr. Diaz explained that the applicant could appeal to the council if
they didn't agree with the decision of the architectural commission.
Chairman Crites opened the public testimony and asked if anyone
present wished to speak in FAVOR or OPPOSITION to the proposed.
MR. ED IARD, Las Palmas Villas and Olive Tree, outlined the
present I situation of those projects, insurance coverage, and
noted that the applicant had final say on whether to upgrade or
not.

REQUEST: Consideration of an amendment to the Palm Desert Zoning
Ordinance Section 25.56 general provisions relating to hotel
developmiert standards.
APPLICANT: CITY OF PALM DESERT
1. BACKGROUND:
The commercial subcommittee to the Year 2000 Committee its tenure
had cause to review several hotel proposals which came before the city.
As a result of thatlthe subcommittee determined that it would be advisable
that the city establish certain minimum requirements for hotels which
wish to develop in the city.
City council in January 1986, adopted a series of recommendations from
the Year 2000 Committee. One of the recommendations included the creation
of minimum hotel standards.
11 . DISCUSSION:
Presently the municipal code has little in the way of specific minimum
standards for hotel development. There are limits on density ( le:
number of units per acre in certain zones) required parking, required
open space and required architectural review.
The purpose of the proposed additions to the zoning ordinance is to
create a set of development standards which would assure quality hotel
developments. Four areas of concern were outlined by the commercial
subcommittee in its July 31 , 1985 letter to Mayor Snyder (copy attached) .
1 . It Is proposed that a minimum room size of 375 square feet of clear
interior space be required.
2. It is proposed that each new hotel be required to include a
multi-purpose (3 meal ) restaurant either within the building itself
or attached to the building, together with nroo service for hotel

3. It is proposed that window or wall Installed air conditioning
systems be prohibited and that central air conditioning or vertical
fan toll systems be permitted. Any other type of system would be
subject to appropriate review and approval .
4. It is propose that access to rooms above the ground floor be from
interior hallways only.

ZOA 86-3 CONTINUED
1I1 . ANALYSIS:
Staff has no concern with items 1 , 2 or 3 above. Staff is concerned with
item 4 in that itIwould prohibit the construction of Marriott's Rancho
Las Palmas Resort in that the second floor units are accessed via exterior
stairways. if th ils provision is made a part of the ordinance then it
will be extremely difficult to allow a hotel , no matter how desirable it
may be unless it has an interior access corridor above the ground floor.
Staff would suggest that if it is determined that this is a desirable
quality control that it be established as a specific policy of planning
commission, by resolution. A policy of this type could be waived by
planning commission as a part of the precise plan review if it is determi-
ned that the hotel by complying with all the other development standards
is one which the c i ty wishes to permit notwithstanding that it may not
have an interior access corridor above the ground floor.
IV. ENVIRONMENTAL REVIEW:
The director of community development has determined that the request
is a class 5 categorical exemption and no further review is deemed
necessary.
V. RECOMMENDATION:
Staff feels that the amendment as it relates to minimum room size, room
service and air conditioning systems is acceptable and will provide the
city with the nec�e� ssar��yhotel development standards. Therefore, staff

The Commercial/Resort/Industrial Subcommittee of the 2000-Committee has
recently become aware of a significant gap in our commercial zoning
ordinances: Currently, there are no provisions which impose minimum
standards on new hotels.' Thus, the Planning Commission is deprived of
a valuable tool; the developer is deprived of necessary guidance;
and--most of all--Palm Desert citizens are deprived of a guarantee
that new hotels will be of the quality which they have every right to
expect.
We, therefore, respectfully recommend that the Council initiate action
to close this zoning gap. Should the Council so decide, it may wish
to instruct Staff Co consider, among others, provisions which address
the following issues:
1. ROOM SIZE: We suggest that a reasonable minimum standard
would be 375 square feet clear per bedroom/bathroom module
(or bay). This is sufficient to allow at least two double
beds, plus adequate seating area, closet and bathroom.
2. SERVICES: We suggest that each new hotel be required to in-
elude a multi-purpose (3 meal) restaurant either within the
building itself or attached to the building, together with
room service for the hotel guests.
3. AIR CONDITIONING SYSTEMS: We suggest a clause which (a) ex-
plicitly ep 'rmlts either central air conditioning, or a so-
called 'vertical fan coil A/C system' ; (b) explicitly forbids
window or wall A/C systems; and (c) requires that any other
system be Subject to approval.

4. ROOM ACCESS: Ve suggest a clause which requires that access
to rooms above the ground floor be from interior hallways.
The Subcommittee believes that the above provisions, collectively,
would guarantee minimum qualitative standards in future Palm Desert Hotels.
In any case, we hope that the Council will address this general subject
as a matter of some urgency.

REQUEST: Consideration of an amendment to the Palm Desert Zoning
Ordinance Section 25.56 general provisions relating to hotel
development standards.
APPLICANT: CITY OF PALM DESERT
I. BAC(GROUND:
The commercial subcommittee to the Year 2000 Committee its tenure
had cause to review several hotel proposals which came before the city.
As a result of thatlthe subcommittee determined that it would be advisable
that the city est6lish certain minimum requirements for hotels which
wish to develop in the city.
City council in January 1986, adopted a series of recommendations from
the Year 2000 Committee. One of the recommendations included the creation
of minimum hotel standards.
II. DISCUSSION:
Presently the municipal code has little in the way .of specific minimum
standards for hotel development. There are limits on density Ile:
number of units per acre in certain zones) required parking, required
open space and required architectural review.

The purpose of the proposed additions to the zoning ordinance is to
create a set of development standards which would assure quality hotel
developments. Four areas of concern were outlined by the commercial
subcommittee in its July 31 , 1985 letter to Mayor Snyder (copy attached) .
1 . It is proposed that a minimum room size of 375 square feet of clear
interior space be required.
2. It is proposed that each new hotel be required to Include a
multi-purpose (3 meal ) restaurant either within the building itself
or attached td the building, together with room service for hotel
guests.
3. It is proposed that window or wall installed air conditioning
systems be prohibited and that central air conditioning or vertical
fan coil systems be permitted. Any other type of system would be
subject to appli
review and approval .
4. It is proposed that access to rooms above the ground floor be from
interior hallways only.

III. ANALYSIS:
Staff has no concer with items 1 , 2 or 3 above. Staff is concerned with
item 4 in that it ,would prohibit the construction of Marriott's Rancho
Las Palmas Resort in that the second floor units are accessed via exterior
stairways. If thi� provision is made a part of the ordinance then it
will be extremely difficult to allow a hotel , no matter how desirable it
may be unless it has an interior access corridor above the ground floor.
Staff would suggest that if it is determined that this is a desirable
quality control that it be established as a specific policy of planning
commission, by resolution. A policy of this type could be waived by
planning commission as a part of the precise plan review if it is determi-
ned that the hotel by complying with all the other development standards
is one which the city wishes to permit notwithstanding that it may not
have an interior access corridor above the ground floor.

IV. ENVIRONMENTAL REVIEW:
The director of community development has determined that the request
is a class 5 categorical exemption and no further review is deemed
necessary.
V. RECOMMENDATION:
Staff feels that tfie amendment as it relates to minimum room size, room
service and air conditioning systems is acceptable and will provide the
city with the necessary hotel development standards. Therefore, staff
recommends:
A. Adoption of Planning Commission Resolution No. recommending
approval of ZOp 86-3 to city council .
