ADJOURNED/REGULAR PALM DESERT CITY COUNCIL MEETING DECEMBER 19, 1985
Mayor Kelly declared the public hearing closed .
Counctlmember Benson stated she felt the proposed project
was commendable but that the Council must consider the

desires of the community as a whole and she would ,
therefore , have to vote against it .
Counctlmember Jackson stated she felt It would be best to
have timeshares in residential zones and include the
restrictions to the amendment to the ordinance .
Councilman Wilson stated he felt that this type of
Proposed development under the PR-4 zoning was much more
desirable than motel rooms .
Councilman Snyder stated he had mixed emotions about this
type of development and felt the Council should take a
good, long look at timeshares in general .
Mayor Kelly agreed with Councilman Snyder and stated he
did not feel that timeshares would enhance the community .
Counctlmember Benson moved to deny timeshares In the PR zone .
Motion was seconded by Kelly and carried by a 3-2 vote of the Council ,
with Councilmembers Jackson and Wilson voting NO.
Councilmember Wilson moved to amend Ordinance No . 441 amending
the zoning ordinance to establish standards of development for timeshare
developments in the PC-4 and commercial zones and approving the fi I ing '
of a Negative Declaration of Environmental Impact . Motion was seconded
by Jackson and carried by unanimous vote of the Council .

A . CITY MANAGER
1 . FRINGE-TOED LiZARD HABITAT CONSERVATION PLAN
Mr . Altman reported that the City of Palm Desert was
the last city to sign this agreement and that there
had been no major changes since the Council last :
considered the plan .
Counctlmember Benson moved to, by Minute Motion , authorize
the Mayor to execute the Implementation Agreement for the Fringe—Toed
Lizard Habitat Conservation Plan . Motion was seconded by Jackson and
carried by unanimous vote of the Council .

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
PALM' DESERT. CALIFORNIA APPROVING ZONING
ORDINANCE AMENDMENTS RELATING TO TRAFFIC SIGHT
OBSTRUCTIONS.
CASE ND: ZOA 87-4
WHEREAS. the City Council of the City of Palm Desert. California did on
the 12th day of November hold a duly noticed public hearing to consider
amendment to zoning ordinance section 25.56.200 relating to corner traffic
siaht obstructions.
WHEREAS. said amendment has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89". in that the director of community development has
determined the amendment to be a class 5 categorical exemption.
WHEREAS. at said public hearing, upon hearing and considering all
testimony and arguments. if any. of all persons desiring to be heard. said
city council did find the following facts and reasons to exist to grant
approval of a zoning ordinance text amendment.
I . The proposed amendment is consistent with the Intent of the zoning
ordinance and protects the community health, safety and general
welfare.
NOW. THEREFORE. BE IT ORDAINED by the City Council of the City of Pa 1 m
Desert. as follows:
I . That the above recitations are true and correct and constitute the
considerations of the council in this case.
2. That it does hereby approve ZOA 87-4 provided In the attached

A. STAFF RECOMMENDATION:
Waive further reading and pass to second reading.
B. DISCUSSION:
The amendment involves the code section regulating site obstructions
within triangular areas at street corners. Curb lines would replace
property liens as the reference point for determining the obstruction-free
triangle. Curb lines bear a constant relationship to the actual travel
lane sight geometry while property lines vary according to the parkway
width. The current ordinance based on property lines results in
inadequate visibility triangles when parkways are narrow and excessive
and when parkways are unusually wide.

property twenty five feet from the intersection of the projection of the

grade at the edge of the street pavement on plans approved by the director of
community development or the existing pavement or traveled way if plans have
not been approved.

REQUEST: Review of amendment to Palm Desert Zoning Ordinance Section

I. BACKGROUND:
This item was before the planning commission in August of 1985 and
unanimously recommended for approval . Inadvertently it was never
forwarded to city council for final action. Due to the two year delay it
is again being brought before you for review before council action.
The amendment involves the code section regulating site obstructions
within triangular areas at street corners. Curb lines would replace
property lines as the reference point for determining the obstruction-free
