REQUEST: Amendment to the R-2 (7) zone to allow parking as a conditional
use when adjacent to office professional zone and consistent
with recommendations of a specific plan.
APPLICANT: City of Palm Desert
I. DISCUSSION•
The Palma Village Specific Plan provides for professional office
development along perimeter streets. The intent has been to rezone lots
to O.P. and design projects with parking in the rear. It has become a
concern of the planning department that, should a project be of two lot
depth, a rezone of the back lot may not produce the result intended by the
specific plan. Specifically, offices may be built on a lot that
originally was intended for parking. To remedy this situation, staff
recommends the above zone ordinance amendment which would allow the
parking and only the front lots would be rezoned. Should an approved
project then not be built, the R-2 zoning would remain in place.

Approve the findings and adopt Resolution No. recommending approval
of ZOA 90-2 to city council.

A RESOLUTION OF THE PLANNING OUVMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY
COUNCIL APPROVAL OF A ZONING ORDINANCE AMENDMENT TO
SECTION 25.18.030 TO ALLOW OFFICE PARKING LOTS AS A
CONDITIONAL USE WITHIN THE R-2 (7) ZONE WHEN ADJACENT TO
OFFICE PROFESSIONAL ZONES AND CONSISTENT WITH
RECOMMENIDATIONS OF A SPECIFIC PLAN.
CASE NO. ZOA 90-2
WHEREAS, the planning Commission of the City of Palm Desert,
California, did on the 19th day of June, 1990, hold a duly noticed public
hearing to consider amendment of zoning ordinance amendment to Section
25.18.030 to allow office parking lots as a conditional use within the R-2
(7) zone when adjacent to office professional zones and consistent with
recam endations of a specific plan; and
WHEREAS, said amendment has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental
Quality Act, Resolution No. 80-89, " in that the director of community
development has determined the amendment to be a class 5 categorical
exemption; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, said
planning axmnission did find the following facts and reasons to exist to
recommend approval of a zoning ordinance text amendment:
1. The proposed amendment implements specific recommendations of the
Palma Village Specific Plan.
2. The proposed amendment will be consistent with the intent of the
zoning ordinance and will not threaten the public health, safety
or general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That it does hereby recommend approval of ZOA 90-2 as provided in
the attached exhibit labeled Exhibit "A".

B. DISCUSSION:
The Palma Village Plan provides for office uses on Fred Waring Drive and
Monterey to utilize rear R-2 parcels for parking. The planning ocmission
felt that where possible this parking should be approved via a conditional
use permit instead of a zone change. The conditional use permit allows
the city to tie the parking use to a specific approved project. If the
project dies, the parking approval would the with it. The city,
therefore, retains a greater degree of long-term control.

Mr. Joy outlined the salient points of the staff report and
recommended approval. He noted that the applicant was requesting a
continuance.
Chairperson Whitlock opened the public testimony and asked if the
applicant wished to address the commission.
MR. TIM ENSIGN, Westinghouse, stated that he was present to
request a continuance to allow discussion relating to conditions
of approval and lot lines.
It was determined that a continuance to August 21, 1990 would be
acceptable.
Action:
Moved by Commissioner Downs, seconded by Cammissioner Jonathan,
continuing TT 26018 to August 21, 1990. Carried 5-0.
H. Case No. ZOA 90-2 - CITY OF PALM DESERT, Applicant
Request for approval of an amendment to the R-2
(7) zone to allow parking as a conditional use
when adjacent to an office professional zone and
consistent with recommendations of a specific
plan.
Mr. Drell outlined the salient points of the staff report and
recommended approval of ZOA 90-2. He noted that the next two public
hearing items incorporated this amendment.

Chairperson Whitlock opened the public testimony and asked if anyone
wished to address the commission either in FAVOR or OPPOSITION to the
poposal. There was no one and the public testimony was closed.
Action:
Moved by Commissioner Jonathan, seconded by Commissioner Downs,
approving the findings as presented by staff. Carried 5-0.
Moved by Commissioner Jonathan, seconded by Commissioner Downs,
adopting Planning Commission Resolution No. 1448, recommending to
city council approval of ZOA 90-2. Carried 5-0.

Request for approval of a precise plan of
design/conditional use permit, negative
declaration of environmental impact and parcel
map waiver to allow construction of a 13,000
square foot office project on the southeast
corner of Fred .Waring Drive and San Anselmo
Avenue.
Mr. Drell outlined the salient points of the staff report.
Chairperson Whitlock asked if the proposal had received architectural
commission approval and Mr. Drell replied no.
Chairperson Whitlock reminded commission and the applicant that the
previous testimony by Mr. Watson, Mr. Parker, Mr. Lester and Ms.
Batkin was pertinent to this project.
Chairperson Whitlock opened the public testimony and asked if the
applicant wished to address the commission.
MR. RICK HOLDEN, architect, stated that he was a member of the
Palma Village Committee, described the project, and indicated
that no landscape plan was ready because they were awaiting the
council decision on the parking lot amendment.
Commissioner Dawns asked if Mr. Holden had a problem with closing off
access on Santa Rosa and Mr. Holden replied that he had no problem,
but indicated that the director of community development was against
creating dead-end parking. Upon further questioning, Mr. Drell

California, did on the 19th day of June, 1990, hold a duly noticed public
hearing to consider amendment of zoning ordinance amendment to Section
25.18.030 to allow office parking lots as a conditional use within the R-2

recommendations of a specific plan; and
WHEREAS, said amendment has complied with the requirements of the "City

Quality Act, Resolution No. 80-89, " in that the director of community
development has determined the amendment to be a class 5 categorical
exemption; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, said
planning commission did find the following facts and reasons to exist to
recommend approval of a zoning ordinance text amendment:
1. The proposed amendment implements specific recommendations of the
Palma Village Specific Plan.
2. The proposed amendment will be consistent with the intent of the
zoning ordinance and will not threaten the public health, safety
or general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.

I. DISQUSSICN:
The Palma Village Specific Plan provides for professional office
development along perimeter streets. The intent has been to rezone lots
to O.P. and design projects with parking in the rear. It has became a
ooncem of the planning department that, should a project be of two lot
depth, a rezone of the back lot may not produce the result intended by the
specific plan. Specifically, offices may be built on a lot that
originally was intended for parking. To remedy this situation, staff
recommends the above zone ordinance amendment which would allow the
parking and only the front lots would be rezoned. Should an approved
project then not be built, the R-2 zoning would remain in place.
II. REC OMMD ATICN:
Approve the findings and adopt Resolution No. recommending approval
of ZOA 90-2 to city council.
