AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING A ZONING ORDINANCE
AMENDMENT RELATING TO SIGNS.
CASE NO. ZOA 90-3
WHEREAS, the City Council of the City of Palm Desert, California,
did on the 13th day of December, 1990, hold a duly noticed public
hearing to consider amendment of zoning ordinance amendment to Section
25. 68 relating to signs; and
WHEREAS, said amendment has complied with the requirements of the
"City of Palm Desert Procedure for Implementation of the California
Environmental Quality Act, Resolution No. 80-89, " in that the director
of community development has determined the amendment to be a class 5
categorical exemption; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard,
said city council did find the following facts and reasons to exist to
approve a zoning ordinance text amendment:
1. The proposed amendment relating to signs is consistent with
the intent of the zoning ordinance and protects the community
health, safety and general welfare.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute
the findings of the council in this case.
2. That it does hereby approve ZOA 90-3 as provided in the
attached exhibit labeled Exhibit "A" .
PASSED, APPROVED AND ADOPTED at a regular meeting of the Palm
Desert City Council, held on this loth day of January, 1991, by the
following vote, to wit:

Section 1: That Section 25. 68.090 of the Palm Desert Municipal
Code be amended to add subsections I and J, which will read as follows:
"I . Business and identifications signs that mention more than
two (2 ) goods or services sold on the premises.
J. Business and identification signs that employ slogans,
sayings, or mottos. "
Section 2: That Section 25. 68.440 of the Palm Desert Municipal
Code be amended to add subsection K, which will read as follows:
"K. That the quantity of information displayed in a propose..,
sign does not cause visual clutter. "

NOVEMBER 20, 1990
MR. GIL CHAPMAN AND MS. CLAUDIA HAMBURGER, Applicants,
were present to discuss the project. Mr. Chapman
explained that they would be offering between 700 to
1, 000 international and domestic magazine and newspaper
titles. He explained that the newsstand would be placed
against the wall as a freestanding structure under the
awning. He also noted that this would take approximately
two and a half feet from the existing nine to nine and
a half feet of sidewalk.
Mr. Gaugush of the public works department indicated that was
sufficient clearance.
Upon questioning by Commissioner Erwood, Mr. Chapman
explained that the newsstand would be secured and locked
to look solid, similar to restaurants.
Following further discussion, commission expressed concern
regarding the proposed location, ingress and egress from San
Pablo, and lack of two-way traffic. Commission felt an area
on E1 Paseo or a more pedestrian oriented area would be more
suitable. Vice Chairman Richards expressed concern regarding
a percentage of right-of-way being used and the project not
being part of a building. After more discussion with the
applicant, commission determined a continuance would be
appropriate to look at other alternative sites. Mr. Chapman
concurred with a two-week continuance and requested assistance
in selecting a location. Commission directed staff to help
Mr. Chapman in this endeavor.
Action:
Moved by Commissioner Downs, seconded by Commissioner
Jonathan, continuing CUP 90-22 to December 4, 1990. Carried
4-0.

REQUEST: Approval of zoning ordinance amendment relating to signs,
Section 25. 68.
APPLICANT: City of Palm Desert
I . BACKGROUND:
For quite some time the architectural review commission has been
attempting to limit the content of signs. The denial of several
signs with menus of services or products offered by a business
resulted in appeals to the city council . The sign subcommittee was
then convened with the result being the amendment attached hereto.
II. DISCUSSION•
The proposed amendment will allow a business sign to include the
name of the business plus up to two additional goods or services
sold on the premises.
III. ENVIRONMENTAL REVIEW:
An amendment to the ordinance of this nature is a class 5
categorical exemption for the purposes of CEQA.
IV. RECOMMENDATION:
Approve the findings and adopt Resolution No. recommending
approval of ZOA 90-3 to city council.

WHEREAS, business and identification signs that mention more
than two goods or services sold on the premises, or that employ
slogans, sayings, or mottos, are visually cluttered and decrease
the aesthetic appearance of the City.
The City Council of the City of Palm Desert, California, DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1: That Section 25. 68. 090 of the Palm Desert
Municipal Code be amended to add subsections I and J, which will
read as follows:
"I. Business and identifications signs that
mention more than two (2) goods or services
sold on the premises.
J. Business and identification signs that
employ slogans, sayings, or mottos.
Section 2 : That Section 25. 68 . 440 of the Palm Desert
Municipal Code be amended to add subsection 2, which will read as
follows:
II K That the quantity of information

Section 3 : The City Clerk shall certify as to the passage and
adoption of this ordinance and shall cause the same to be published
once in the Palm Desert Post, a newspaper Of general circulation,

and the same shall be in force and effect thirty (30) days after
its adoption.

AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF PALM DESERT, CALIFORNIA,
AMENDING SECTION 25.68.090 AND
SECTION 25. 68.440 OF THE PALM DESERT
MUNICIPAL CODE, RELATING TO SIGNS.
WHEREAS, business and identification signs that mention more
than two goods or services sold on the premises, or that employ
slogans, sayings, or mottos, are visually cluttered and decrease
the aesthetic appearance of the City.
The City Council of the City of Palm Desert, California, DOES
HEREBY ORDAIN AS FOLLOWS:

Section 1: That Section 25. 67 . 090 of the Palm Desert
Municipal Code be amended to add subsections I and J, which will
read as follows:
"I. Business and identifications signs that
mention more than two (2) goods or services
sold on the premises.
J. Business and identification signs that
employ slogans, sayings, or mottos.
Section 2 : That Section 25. 68 . 440 of the Palm Desert
Municipal Code be amended to add subsection J, which will read as
follows:
"J. That the quantity of information
displayed in a proposed sign does not cause
visual clutter. "
Section 3 : The City Clerk shall certify as to the passage and
adoption of this ordinance and shall cause the same to be published
once in the Palm Desert Post, a newspaper of general circulation,
printed, published, and circulated within the City of Palm Desert,
and the same shall be in force and effect thirty (30) days after
its adoption.

Re: Recommendations as they relate to the Palm Desert Sign Ordinance
Approved Revisions and Policies and Procedures
Dear Friends:
The Palm Desert Business Community Sign Ordinance Task Force respectfully requests
the implementation of the following recommendations as they relate to the Palm Desert
Sign Ordinance Approved Revisions and Policies and Procedures:
1. The City of Palm Desert provide a "What To Do About Your Business Signage"
publication at the time a business applies for a business license and at the
time of renewal. The Palm Desert Chamber of Commerce offers to assist in its
creation, compilation, promotion and distribution.
2. Give City Staff the ability to consistently approve basic signage at the
'counter' with established guidelines. It is also recommended that one person
from the Planning Department Staff be identified for this responsibility.
3. Establish a Signage Advisory Committee which would provide its perspective,
input and recommendations to a business about its proposed signage at the
beginning of the approval process. This opportunity would be optional to the
business and would be provided by the Palm Desert Chamber of Commerce Business
and Economic Development Committee.
4. In addition to the business name on its signage, include up to three descriptive
words which would relate to what the business includes in its products and/or
services. The inclusion of this information about the business in its signage
would assist in the fulfillment of both the needs of the business and the
consumer. The Task Force stresses its agreement with the City of Palm Desert
that signage clutter is unwanted in Palm Desert and can be dangerous. However,
this proposal would not contribute to either.

The Palm Desert Business Community Sign Ordinance Task Force
respectfully recommends the following actions regarding:
1 . Awnings - Remove the current language in the ordinance.
J 0 Replace it with: "Awnings should and will be evaluated
on a case by case basis by the Archetectual Review Commission. "
2. Colors - Remove current language and replace it with: "Sign
programs for a commercial complex should not be restricted
to a pre-determined number. The burden should be on the
developer to prove the program' s viability, acceptability
and compatibility. This will provide the business the
opportunity to present its own case regarding the .color
usage within the overall design of the development. "
3 . Definitions - The Task Force recommends the State Wide
Definitions be adopted by the City of Palm Desert.
4 . Approval Process
a. The City of Palm Desert should provide� "What To Do About Your Business Signage" publication

publication. The City Staff and the A.R.C. would also
inform the business following the Commission ' s ruling. The
City would inform the Chamber, also, and it would call the
business to find out if it wants to meet with this advisory
committee . The Chamber' s established Business and Economic
r b"CLi_.T " Committee, or its selected representatives from its members,
in£n L would serve as the proposed Signage Advisory Committee.
6 . Signage Content - The Task Force recommends an easing
of signage content control . The Task Force believes the
inclusion of descriptive information about the business
in its signage is not only important to the business but
the consumer as well . The Task Force stresses that clutter
is not only unwanted in Palm Desert but its presense on signs
can be dangerous . However, there is a reasonable compromise
and that is what we seek.
The Task Force recommends positive action resulting in the
adoption and implementation of thsese recommendations . Your
