Chairperson Campbell noted they were talking about Jensen's and asked about
the proposed size.
Mr. Green said it would be approximately 4,000 square feet.
Commissioner Fernandez asked the City Attorney if this would be a conflict of
interest for him. Mr. Hargreaves didn't believe there was a conflict of interest
nor a foreseeable economic impact on his employer.
Commissioner Beaty said he didn't have a problem with the proposal because
the area has changed so much and those uses would be welcome. Mr. Drell
felt the direction would be for staff to initiate as part of a precise plan an
appropriate commercial zone for the project being described. Commissioner
Beaty noted that could apply to both sides of Cook Street. Mr. Drell agreed
that theoretically it could.
Commissioner Finerty said she was in agreement with Commissioner Beaty.
Action:
It was moved by Commissioner Beaty, seconded by Commissioner Finerty,
directing staff to initiate the appropriate change of zone in conjunction with an
�application for a precise plan. Motion carried 4-0.
Continued Case No. ZOA 97-6 - CITY OF PALM DESERT, Applicant
Request for consideration of an amendment to Chapter
25.56,500 of the Municipal Code (Hotel Development
Standards).
Mr. Drell explained that this was a case number created when the code was
going to be amended for the hotel standards and when the recent Marriott
proposal was processed it was given another case number and staff just
wanted to table this one.
Action:
It was moved by Commissioner Finerty, seconded by Commissioner Fernandez,
accepting withdrawal of Case No. ZOA 97-6 by minute motion. Carried 4-0.

Hotel Development Standards)
I. BACKGROUND:
This matter was before the Planning Commission as a public hearing item on
September 16, 1997. At that time Commission continued the case to a date
uncertain. It would be readvertised for public hearing after applications for proposed
new hotels were received.
When hotel plans were submitted by PDH ASSOCIATES, the associated zoning
ordinance amendment to the hotel development standards was inadvertently given
a new case number (ZOA 98-2, which was given final approval by City Council on
April 29, 1998).
Staff is requesting a housekeeping action by the Planning Commission to terminate
continued Case No. ZOA 97-6.
II. RECOMMENDATION:
That Planning Commission, by minute motion, accept the withdrawal of Case No.
ZOA 97-6.

SEPTEMBER 16, 1997
H. Case No. ZOA 97-6 - CITY OF PALM DESERT, Applicant
Request for consideration of an amendment to Chapter 25.56.500 of the
Municipal code (Hotel Development Standards).
Mr. Smith informed commission that in the near future we would be receiving the
hotel proposals at the Frank Sinatra/Cook Street corner. He indicated that there
would be certain amendments to our current development standards for our
hotels that would be necessary in order to move those applications along. Staff
thought they knew what they were, but learned there might be more. Mr. Smith
requested a continuance to a date uncertain and staff would schedule it
concurrent with the processing of those applications when they are submitted.
Chairperson Ferguson opened the public hearing and asked if anyone wished to
speak in FAVOR or OPPOSITION to the proposal. There was no one.
Chairperson Ferguson closed the public hearing since it would be continued to
a date uncertain and asked for commission comments.
Action:
It was moved by Commissioner Jonathan, seconded by Commissioner Beaty,
continuing Case No. ZOA 97-6 to a date uncertain by minute motion. Motion
carried 5-0.
IX. MISCELLANEOUS
A. CONTINUED DISCUSSION OF COMPLIANCE WITH CONDITIONS OF
APPROVAL FOR CASE NO. CUP 91-8 - SOUTHWEST COMMUNITY
CHURCH.
Mr. Smith noted that this item was continued to this evening in that there was
some consideration that Planning Commission might reconsider the conditional
use permit for Southwest Community Church. Through the Director they had
been given 30 days to indicate that they can operate in a fashion that was
favorably received by the community around them. Mr. Smith said he had an
opportunity to talk with Mr. Richards who had brought forth some complaints
through the summer. He indicated that recently the situation had been very good
and felt that his conversations and discussions with Roger Phillips of Southwest
Church had been very responsive. They took care of the shininess of the roof
and put some mat finish on it to darken it down. He said there had been a few
problems with band practice and he mentioned that Thursday, September 11 he
or one of his neighbors went over there and there wasn't any adult supervision
in evidence. He felt that basically there had been improvement.
Chairperson Ferguson asked if Mr. Richards would like to address the
commission.

REQUEST: Consideration of an amendment to Chapter 25.56.500 of the Municipal
Code (Hotel Development Standards).
APPLICANT: City of Palm Desert
I. BACKGROUND:
The city expects to receive plans for two hotel projects at the southwest corner of
Frank Sinatra Drive and Cook Street in the near future. Based on a preliminary review
several code amendments appeared to be needed to accommodate the project.
We expected to have the applications in hand at this time but we do not. As a result
we may not be aware of certain other amendments which may be necessary.
II. CONCLUSION:
Rather than go through this code amendment process possibly twice, we are
recommending that this request be continued at this time to a date uncertain. We
will reschedule and re-notice this matter concurrent with the processing of these
projects.
III. RECOMMENDATION:
That this case be continued to a date uncertain.

PALM DESERT, CALIFORNIA APPROVING AN AMENDMENT
TO THE ZONING ORDINANCE TEXT RELATING TO HOTEL
DEVELOPMENT STANDARDS.
CASE NO. ZDA 86-3
WHEREAS, the City Council of the City of Palm Desert, California did on
the 27th day of March, 1986, hold a du l y not 1 ced pub l 1 c hearing to consider
amendment to the zoning ordinance section 25.56 relating to hotel development
standards.
WHEREAS, the Planning Commission, by Resolution No. 1120, has recommended
approval .
WHEREAS, said application has compiled with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89". in that the director of community development has
determined the amendment to be a class 5 categorical exemption.
WHEREAS, at said public hearing, upon hearing and considering all testi-
mony and arguments. If any, of all persons desiring to be heard, said city
council did find the following facts and reasons to exist to Justify its
action as described below:
1 . That the zoning ordinance amendment is consistent with the objectives
of the zoning ordinance.
2. That the zoning ordinance amendment is consistent with the adopted
general plan and affected specific plans.
3. That the zoning ordinance amendment would better serve the public
health, safety and general welfare than the current regulations.
NOW. THEREFORE, BE iT ORDAINED by the City Counci 1 of the City of Palm
Desert. as follows:
1. That the above recitations are true and correct and constitute the
considerations of the council in this case.
2. That it does hereby approve ZOA 86-3 as provided in the attached
exhibit. labeled Exhibit"A".
3. The city clerk Is directed to publish this ordinance once in the

All hotel developments shall comply with the following.
1 . That the minimum guest roam size for any hotel shall be 375 square
feet of clear interior space.
2. That all hotels shall provide a multi-purpose (3 meal ) restaurant
either within the building itself. attached or adJacent to the
building. together with roam service for hotel guests (a continental
breakfast may constitute one of the 3 meals).
3. That all hotel developments shall utilize central air conditioning
systems or vertical fan toll systems or other specifically approved
systems. Window or wall installed air conditioning systems are
hereby prohibited.

Commission to consider amending Chapter 25.56.500 of the Municipal Code (Hotel
Development Standards) to permit averaging of room sizes to comply with the 375 square
foot minimum room size requirement.
SAID public hearing will be held on Tuesday, September 16, 1997, at 7:00 p.m. in the
Council Chamber at the Palm Desert Civic Center, 73-510 Fred Waring Drive, Palm Desert,
California, at which time and place all interested persons are invited to attend and be heard.
Written comments concerning all items covered by this public hearing notice shall be
accepted up to the date of the hearing. Information concerning the proposed project and/or
negative declaration is available for review in the Department of Community Development
