A. STAFF RECOMMENDATION:
Waive further reading and pass Ordinance No. to second reading.
B. DISCUSSION:
On July 22, 1999, the City Council adopted Ordinance No. 922 which was an
urgency ordinance to define "bar or lounge," "nightclub" and "restaurant."
These definitions are part of the Zoning Ordinance. Amendments to the Zoning
Ordinance generally are adopted only after a public hearing at Planning Commission,
a recommendation by the Planning Commission and a subsequent public hearing at
City Council.
The City Attorney, in a memo dated October 22, 1999, suggests that the definitions
be adopted again following the usual public hearing process.
The Planning Commission recommended approval of this case in a 5-0 vote.

ORDINANCE NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO
CHAPTER 25.04 DEFINITIONS, ADDING DEFINITIONS FOR 'BAR
OR LOUNGE," "NIGHTCLUB," AND "RESTAURANT."
CASE NO. ZOA 99-2
WHEREAS, the City Council of the City of Palm Desert, California, did on the 13th
day of January, 2000, hold a duly noticed public hearing to consider an amendment to the
Palm Desert Municipal Code, Chapter 25.04, concerning definitions; and
WHEREAS, the Planning Commission by its Resolution No. 1962 has recommended
approval of Case No. ZOA 99-2; and
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the California Environmental Quality Act, Resolution
No. 97-18," in that the Director of Community Development has determined that the project
is a Class 5 Categorical Exemption; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said City Council did find
the following facts and reasons to exist to justify its action as described below:
1 . That the Zoning Ordinance amendment is consistent with the objectives of the
Zoning Ordinance;
2. That the Zoning Ordinance amendment is consistent with the adopted General
Plan and affected specific plans; and
3. That the Zoning Ordinance amendment would better serve the public health,
safety and general welfare than the current regulations.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Palm Desert,
California, as follows:
1 . That the above recitations are true and correct and constitute the findings of
the Council in this case.
2. That it does hereby approve a Zoning Ordinance text amendment as provided
in the attached Exhibit "A" to amend Municipal Code Chapter 25.04.113,
25.04.572 and 25.04.683.
3. That the City Clerk of the City of Palm Desert, California, is hereby directed.to
publish this ordinance in the Desert Sun, a newspaper of general circulation,
published and circulated in the City of Palm Desert, California, and shall be in
full force and effect thirty (30) days after its adoption.

Section 1
That Section 25.04.113 be added as follows:
Bar or lounge means any use where the on-site sale and consumption of
alcoholic beverages equals or exceeds 50% of gross sales of food and beverages
from that location.
Section 2
That Section 25.04.572 be added as follows:
Nightclub means a place of business open after 10:00 p.m. which provides for
the on-site consumption of food or alcoholic beverages with entertainment which
includes, but is not limited to, music, dancing comedy and karaoke.
Section 3
That Section 25.04.683 be added as follows:
Restaurant means any use providing for the preparation, retail sale, and on-site
consumption of food and beverages. Restaurants include, but are not limited to,
cafes, coffee shops, sandwich shops, ice cream parlors, fast food take-out and drive-
through stores, and places of business with similar uses. The term restaurant may
include the licensed sale of alcoholic beverages for consumption on the premises,
provided that the sales of food and non-alcoholic beverages equals or exceeds 51 %
of gross sales of food and beverages. Businesses where the sales of food and non-
alcoholic beverages do not exceed 51 % of gross sales of food and beverages shall
be deemed a bar or lounge pursuant to Section 25.04.113.

PALM DESERT PLANNING COMMISSION
DECEMBER 7, 1999
It was moved by Commissioner Finerty, seconded by Commissioner Lopez,
adopting Planning Commission Resolution No. 1961 approving an amendment
to CUP 93-7 to extend the business hours to 9:00 a.m. until 11 :00 p.m. daily
and to permit two non-amplified acoustical guitar players/singers between the
hours of 5:00 p.m. and 9:00 p.m. daily. Motion carried 5-0.
C. Case No. ZOA 99-2 - CITY OF PALM DESERT, Applicant
Request for recommendation of approval to the City Council of an
amendment to Chapter 25.04 adding definitions for "bar or lounge,"
"nightclub," and "restaurant."
Mr. Smith stated that the definitions were enacted in July as an urgency
ordinance. The City Attorney in a memo dated October 22 suggested that the
definitions be adopted following a public hearing, so the matter was scheduled
tonight. The matter was a Class 5 Categorical Exemption for purposes of
CEQA and staff recommended that the Planning Commission recommend to
the City Council approval of the amendment.
Chairperson Jonathan opened the public hearing and asked if anyone wished
to address the commission in FAVOR or OPPOSITION to the amendment.
There was no one and the public hearing was closed. Chairperson Jonathan
asked for commission comments.
Action:
It was moved by Commissioner Campbell, seconded by Commissioner Beaty,
approving the findings as presented by staff. Motion carried 5-0.

adopting Planning Commission Resolution No. 1962, recommending to the
City Council approval of an amendment to Chapter 25.04 adding definitions

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO
CHAPTER 25.04 DEFINITIONS, ADDING DEFINITIONS FOR 'BAR
OR LOUNGE," "NIGHTCLUB," AND "RESTAURANT."
CASE NO. ZOA 99-2
WHEREAS, the City Council of the City of Palm Desert, California, did on the 13th
day of January, 2000, hold a duly noticed public hearing to consider an amendment to the
Palm Desert Municipal Code, Chapter 25.04, concerning definitions; and
WHEREAS, the Planning Commission by its Resolution No. 1962 has recommended
approval of Case No. ZOA 99-2; and
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the California Environmental Quality Act, Resolution
No. 97-18," in that the Director of Community Development has determined that the project
is a Class 5 Categorical Exemption; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said City Council did find
the following facts and reasons to exist to justify its action as described below:
1 . That the Zoning Ordinance amendment is consistent with the objectives of the
Zoning Ordinance;
2. That the Zoning Ordinance amendment is consistent with the adopted General
Plan and affected specific plans; and
3. That the Zoning Ordinance amendment would better serve the public health,
safety and general welfare than the current regulations.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Palm Desert,
California, as follows:
1 That the above recitations -are true and correct and constitute the findings of
the Council in this case.
2. That it does hereby approve a Zoning Ordinance text amendment as provided
in the attached Exhibit "A" to amend Municipal Code Chapter 25.04.113,
25.04.572 and 25.04.683.
3. That the City Clerk of the City of Palm Desert, California, is hereby directed to
publish this ordinance in the Desert Sun, a newspaper of general circulation,
published and circulated in the City of Palm Desert, California, and shall be in
full force and effect thirty (30) days after its adoption.

EXHIBIT "A"
Section 1
That Section 25.04.1 13 be added as follows:
Bar or lounge means any use where the on-site sale and consumption of
alcoholic beverages equals or exceeds 50% of gross sales of food and beverages
from that location.
Section 2
That Section 25.04.572 be added as follows:
Nightclub means a place of business open after 10:00 p.m. which provides for
the on-site consumption of food or alcoholic beverages with entertainment which
includes, but is not limited to, music, dancing comedy and karaoke.
Section 3
That Section 25.04.683 be added as follows:
Restaurant means any use providing for the preparation, retail sale, and on-site
consumption of food and beverages. Restaurants include, but are not limited to,
cafes, coffee shops, sandwich shops, ice cream parlors, fast food take-out and drive-
through stores, and places of business with similar uses. The term restaurant may
include the licensed sale of alcoholic beverages for consumption on the premises,
provided that the sales of food and non-alcoholic beverages equals or exceeds 51 %
of gross sales of food and beverages. Businesses where the sales of food and non-
alcoholic beverages do not exceed 51 % of gross sales of food and beverages shall
be deemed a bar or lounge pursuant to Section 25.04.113.

A. STAFF RECOMMENDATION:
Waive further reading and pass Ordinance No. 933 to second reading.
B. DISCUSSION:
On July 22, 1999, the City Council adopted Ordinance No. 922 which was an
urgency ordinance to define "bar or lounge," "nightclub" and "restaurant."
These definitions are part of the Zoning Ordinance. Amendments to the Zoning
Ordinance generally are adopted only after a public hearing at Planning Commission,
a recommendation by the Planning Commission and a subsequent public hearing at
City Council.
The City Attorney, in a memo dated October 22, 1999, suggests that the definitions
be adopted again following the usual public hearing process.
The Planning Commission recommended approval of this case in a 5-0 vote.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, RECOMMENDING THAT THE
CITY COUNCIL APPROVE AN AMENDMENT TO CHAPTER 25.04
DEFINITIONS, ADDING DEFINITIONS FOR "BAR OR LOUNGE,"
"NIGHTCLUB," AND "RESTAURANT."
CASE NO. ZOA 99-2
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 7th day of December 1999, hold a duly noticed public hearing to consider an
amendment to the Palm Desert Municipal Code, Chapter 25.04, concerning definitions; and
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the California Environmental Quality Act, Resolution
No. 97-18," in that the Director of Community Development has determined that the project
is a Class 5 Categorical Exemption; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
did find the following facts and reasons to exist to justify its recommendation as described
below:
1 . That the Zoning Ordinance amendment is consistent with the objectives of the
Zoning Ordinance;
2. That the Zoning Ordinance amendment is consistent with the adopted General
Plan and affected specific plans; and
3. That the Zoning Ordinance amehdment would better serve the public health,
safety and general welfare than the current regulations.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm
Desert, California, as follows:
1 . That the above recitations are true and correct and constitute the findings of
the Commission in this case.
2. That the Planning Commission does hereby recommend to the City Council
approval of a Zoning Ordinance text amendment as provided in the attached
Exhibit "A" to amend Municipal Code Chapter 25.04.113, 25.04.572 and
25.04.683.

EXHIBIT "A"
Section 1
That Section 25.04.1 13 be added as follows:
Bar or lounge means any use where the on-site sale and consumption of
alcoholic beverages equals or exceeds 50% of gross sales of food and beverages
from that location.
Section 2
That Section 25.04.572 be added as follows:
Nightclub means a place of business open after 10:00 p.m. which provides for
the on-site consumption of food or alcoholic beverages with entertainment which
includes, but is not limited to, music, dancing comedy and karaoke.
Section 3
That Section 25.04.683 be added as follows:
Restaurant means any use providing for the preparation, retail sale, and on-site
consumption of food and beverages. Restaurants include, but are not limited to,
cafes, coffee shops, sandwich shops, ice cream parlors, fast food take-out and drive-
through stores, and places of business with similar uses. The term restaurant may
include the licensed sale of alcoholic beverages for consumption on the premises,
provided that the sales of food and non-alcoholic beverages equals or exceeds 51 %
of gross sales of food and beverages. Businesses where the sales of food and non-
alcoholic beverages do not exceed 51 % of gross sales of food and beverages shall
be deemed a bar or lounge pursuant to Section 25.04.113.

DECEMBER 7, 1999
It was moved by Commissioner Finerty, seconded by Commissioner Lopez,
adopting Planning Commission Resolution No. 1961 approving an amendment
to CUP 93-7 to extend the business hours to 9:00 a.m. until 1 1 :00 p.m. daily
and to permit two non-amplified acoustical guitar players/singers between the
hours of 5:00 p.m. and 9:00 p.m. daily. Motion carried 5-0.
C. Case No. ZOA 99-2 - CITY OF PALM DESERT, Applicant
Request for recommendation of approval to the City Council of an
amendment to Chapter 25.04 adding definitions for "bar or lounge,"
"nightclub," and "restaurant."
Mr. Smith stated that the definitions were enacted in July as an urgency
ordinance. The City Attorney in a memo dated October 22.suggested that the
definitions be adopted following a public hearing, so the matter was scheduled
tonight. The matter was a Class 5 Categorical Exemption for purposes of
CEQA and staff recommended that the Planning Commission recommend to
the City Council approval of the amendment.
Chairperson Jonathan opened the public hearing and asked if anyone wished
to address the commission in FAVOR or OPPOSITION to the amendment.
There was no one and the public hearing was closed. Chairperson Jonathan
asked for commission comments.
Action:
It was moved by Commissioner Campbell, seconded by Commissioner Beaty,
approving the findings as presented by staff. Motion carried 5-0.
It was moved by Commissioner Campbell, seconded by Commissioner Beaty,
adopting Planning Commission Resolution No. 1962, recommending to the
City Council approval of an amendment to Chapter 25.04 adding definitions
for "bar or lounge," "nightclub," and "restaurant." Motion carried 5-0.

I. BACKGROUND:
On July 22, 1999, the City Council adopted Ordinance #922, which was an urgency
ordinance to define "bar or lounge," "nightclub," and "restaurant."
These definitions are part of the Zoning Ordinance. Amendments to the Zoning
Ordinance generally are adopted only after a public hearing at Planning
Commission, a recommendation by the Planning Commission and a subsequent
public hearing at the City Council.
The City Attorney, in a memo dated October 22, 1999, suggests that the definitions
be adopted again following the usual public hearing process.
IL CEQA REVIEW:
The proposed amendment is a Class 5 categorical exemption for purposes of
CEQA, and no further documentation is necessary.

ORDINANCE NO. 922
AN URGENCY ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF PALM DESERT, CALIFORNIA, AMENDING
THE MUNICIPAL CODE TO ADD DEFINITIONS OF BARS,
LOUNGES, NIGHTCLUBS, OR RESTAURANTS
WHEREAS, Government Code § 36937 (B) authorizes the City
Council to adopt an urgency ordinance for the immediate
preservation of the public peace, health or safety so long as the
ordinance contains a declaration of the facts constituting the
urgency, and so long as the ordinance is passed by a four-fifths
vote of the City Council; and
WHEREAS, in order to protect the public safety, health and
welfare, the City desires to amend the Municipal Code to add
definitions of the following terms : bar, lounge, nightclub, and
restaurant; and
WHEREAS, there is a current and immediate threat to the public
health, safety or welfare in that approval of bars, lounges,
nightclubs, or restaurants without appropriate conditions imposed
pursuant to a Conditional Use Permit would result in a threat to
the public health, safety or welfare; and
WHEREAS, the Municipal Code does not currently specifically
define the terms bar, lounge, nightclub, or restaurant;
NOW, THEREFORE, the City Council of the City of Palm Desert,
California, does hereby ordain as follows :
Section 1 . That the Recitals set forth above are true and
correct and are incorporated herein by this reference .
Section 2 . That the following sections are added to the
Palm Desert Municipal Code:
A. Section 25 . 04 . 113 be added to read as follows :
"Bar or lounge means any use where the on site
sale and consumption of alcoholic beverages
equals or exceeds 4996 of gross sales from that
location. "
B. Section 25 . 04 . 572 be added as follows :
"Nightclub means a place of business open

passage by a 4/5 vote of the City Council of the City of Palm
Desert, California, pursuant to Government Code, Section 36934 .
