Williams , Director of Environmental Services Re: PROPOSED I-S ZONE (INDUSTRIAL SERVICE) The attached draft copy of the proposed I-S Zone District is provided for your review and consideration. This matter is scheduled for discussion at your meeting of November 4th, at which time further clarification and modification can be provided. Action at that time can then be made to (1) make additional revisions , (2) set a hearing for a later date . PAW/kcw attach. I-S (INDUSTRIAL SERVICE) SECTION INTENT & PURPOSE This zoning category is intended to allow for the manu- facture, distribution and service thereof of products intended primarily for local usage within Palm Desert , its Sphere of In- fluence, and surrounding Cove "Communities . (Volume of business extended outside of the aforementioned areas should not exceed 20% of total volume with Artisan works exempted. ) In keeping with the primary residential/resort/recreational nature of this community, the purpose of the aforementioned restrictions is to insure for the proper development and maintenance of the community, to preserve its intended character, and to prevent undue industrialization from occuring at the expense of the former. Development within these district zones shall be compatible with the residential/resort/recreational nature of this community. SECTION PRINCIPAL USES & FACILITIES PERMITTED The following uses and structures shall be permitted in the I-S Zone Districts subject to their compliance to all pto- visions of this article and all other requirements of the zon- ing ordinance : (a) 1. Support facilities for local construction, reno- vation and installation of related equipment . 2 . Vehicle service facilities . 3 . Maintenance facilities (bulk laundering, jani- torial , etc . ) . 4. Pest control facilities . 5 . Warehouse or storage facilities . 6. Utility installations . 7 . Production of home and office furnishing and accessories . 8. Preparation of foodstuffs (no processing) e. g. , baking, bottling, etc . -2- 9 . Equipment maintenance facilities . (b) Uses customarily related to any of the above uses . Accessory buildings permitted. (c) The Planning Commission may, by resolution, permit other uses which are similar and no more objection- able than those enumerated in this section. SECTION CONDITIONAL USES AND STRUCTURES The following uses and structures may be established in the I-S Zone District only by first securing a Conditional Use Permit as provided in Section 18 . 28 of the Zoning Ordinance : (a) Automobile service station (b) Heliports (c) Other retail and commercial service uses necessary to serve the other uses in the I-S Zone District . (d) Veterinarian hospitals including kennel facilities . SECTION USES AND STRUCTURES PROHIBITED The following uses and structures shall be prohibited in the I-S Zone District : (a) Dwelling units (b) Other uses and structures which the Director of En- vironmental Services determines do not fall within the intent and purpose of this Zone District . SECTION RESTRICTIONS ON USE Uses permitted by this article shall comply with the fol- lowing standards : (a) SOUND, shall be muffled so as not to become objection- able due to intermittance, beat frequency or shrillness . The measurements of sound shall be measured at the lot lines and shall be measured to decibels with a sound level meter and associated octave band filter, manu- factured according to standards prescribed by the American Standards Association. Maximum permissible sound pressure levels shall comply with the following standards : I -3- Maximum Sound Pressure Level in Decibels 0. 002 Dynes per Square Centimeter Octave Bank in Adjacent Residential Lot Line of Use Cycles-Second District Boundaries in the I-P Zone 0- 75 72 79 75- 150 59 74 150- 300 52 66 300- 600 46 59 600-1200 42 53 1200-2400 39 47 2400-4800 34 41 Above 4800 32 39 (b) TOXIC GASES OR MATTER, shall not be emitted which can cause any damage to health, to animals or vegetation, or other forms of property, or which can cause any excessive soiling beyond the lot lines of the use . (c) VIBRATION, from any machine , operation or process which can cause a displacement of . 003 of one inch as meas- ured at the lot lines of the use shall be prohibited. Shock absorbers or similar mounting shall be allowed which will reduce vibration below . 003 of one inch as measured at the lot lines . (d) GLARE and HEAT, from any source shall not be produced beyond the lot lines of the use. (e) STORAGE of refuse , trash, rubbish or other waste ma- terial outside a permanent building shall be kept in enclosed containers , in areas other than the front and side yards . (f) LIGHTING, including spot lights , flood lights , elec- trical reflectors and other means of illumination for signs , structures , landscaping , parking areas , loading and unloading areas and the like shall be focused, directed, and so arranged as to prevent glare or direct illuminiation on streets or adjoin- ing property. 1 -4- (g) RADIOACTIVE MATERIAL. Unless specific additional uses are permitted by the Certificate of Occupancy the use of radioactive materials within the I-S Zone shall be limited to measuring, guaging and calibra- tion devices , as tracer elements , in X-ray and like apparatus , and in connection with the processing and preservation of foods . In no event shall radioactivity, when measured at each lot line be in excess of 2 . 7 x 10-11 microcuries per milliliter of air at any moment of time. (h) ELECTRICAL and ELECTRONIC devices and equipment shall be suitably wired, shielded and controlled so that in operation they shall not , beyond the lot lines , emit any electrical impulses or waves which will adversely affect the operation and control of . any other electri- cal or electronic devices and equipment . SECTION CONDITION OF USAGE Continuance of usage subject to annual submission of Let- ter by Certified Public Accountant stipulating that annual vol- ume of business extended outside of the intended local service area does not exceed 20% of total volume of business . SECTION DEVELOPMENT STANDARDS The following standards of development shall apply to uses and facilities permitted in the I-S Zone: (a) Lot Area - The minimum lot area shall be 20, 000 sq. ft . Sub areas within larger parcels , intended for "sub lease" shall be not less than 6 , 000 sq. ft. (b) Lot Width - The minimum lot width (and sub areas therein) shall be 100 ft . (c) Front Yard - The minimum front yard setback shall be 30 feet in depth. A 10-foot strip adjacent to the front property line shall be appropriately landscaped and maintained except for designated pedestrian and vehicular accessways . The remainder of the front yard -5- setback may be used for parking purposes . As a part of the consideration of a total subdivision, the Plan- ning Commission may approve variation in the required front yard setbacks to provide for overall improved aesthetic appearance. (d) Side Yard - The minimum side yard setbacks shall be : Adjacent to a Street - Ten feet in depth. On Interior Lots - Side yard of ten feet in depth. Except for direct, designated pedestrian and vehicular accessways across side yards adjacent to a street , all required side yards shall be landscaped. (e) Rear Yard - The minimum required rear yard shall be 25 feet in depth. Said yard may be used for parking purposes and/or for open storage . (f) Perimeter Screening (Alt 1) A masonry wall at a minimum height of 7 ft . shall be provided along all property lines except for those adjacent to public right-of- ways , in which case a setback of 20 feet will be maintained. (Alt 2) An opaque hedge row at a minimum height of 7 feet shall be provided along all property lines except for those adjacent to public right-of-ways , in which case a setback of 20 feet will be maintained. (common Perimeter screeningbetween adjoin- ing ing properties is allowable upon mutual con- sent of the respective owners) (planting materials used for perimeter screen- ing shall be the type which shall within 18 months after property development, provide the intended screening effect) (Alt 3) Perimeter Screening will not be required if deemed unnecessary by the Architectural Re- view Board, based upon their approval of sub- -6- mitted development and landscaping plans which establish to its satisfaction that attractive development will occur in keep- ing with the intended residential/resort/ recreational nature of the community. (g) Required Landscaping - Landscaping within required setback adjacent to public right-of-ways, shall be provided and maintained, subject to the following conditions : (1) A distinct demarcation between asphalt paving and landscaped area shall be provided thru the use of maintained turf, maintained aggregate , or other means of landscaping (plantings , rock walls , etc . ) . (2) At least 1/3 of the total landscaped area will be in vegetation. (3) Berming (undulating or embanked) shall be re- quired with a minimum variation of elevation being 30 inches . (4) An automatic underground sprinkler system for landscaped area shall be provided. (5) No other usage or storage will be permitted within required landscape area. (h) Outside Storage - No outside storage shall exceed the height of actual perimeter screening . (i) Building Height - Structures shall not exceed 30 ft. in height , measured from the grade level five feet from the building . (Depending upon structure height and height of actual perimeter screening, all structures will be positioned in a manner which affords full screening from the pub- lic right-of-ways at eye level within an area immedi- ately in front of the premises and extending along the right-of-way 300 ft. from the intersecting prop- erty lines . ) -7- (j ) Parking Requirements - All parking will be on-site and all provisions of Section 18 . 12 . (k) Loading Requirements - All loading will be on-site , with the following loading spaces being required : Building Area No . of Spaces 0- 3 , 000 0 3 , 000-15 , 000 1 15 , 000-40, 000 2 40, 000 + 3 A loading space shall be a minimum of 12 feet x 40 feet with a minimum vertical clear distance of 14 feet. All loading spaces shall be used exclu- sively for that purpose and are required in addi- tion to the required "parking spaces" . (1) Access - A maximum of two entrances per property will be allowed subject to their conformance with acceptable circulation patterns and traffic control measures . (m) Utilities - All utilities shall be located underground in conformance with municipal ordinance and policies of respective suppliers . (n) Trash Handling - A trash enclosure will be provided for all uses , unless the proposed location of the trash area is completely enclosed by walls or build- ings . The free standing trash enclosure shall be constructed of masonry block. No trash shall be al- lowed to extend above or beyond the enclosure . (o) Signs - All signs shall be in compliance with Article XIX of Ordinance #348, adopted by reference. SECTION SPECIAL DEVELOPMENT STANDARDS In addition to the requirements of Ordinance No . 460 adopted by reference , the following standards shall apply to the development of subdivisions in the I-S Zone : (a) Private Streets - All private streets shall be de- t -$- signed and constructed in compliance to County Road Standards for a general local street. The district is created to implement the general plan by es- tablishing a zone classification that provides an optimum general Je r;11� 4 industrial environment that also allows compatible commercial uses to exist . Said zone is intended to establish and maintain inten- sive commercial activities and industrial service establishments that require a centralized location, within a large urban area. The development within this zone district should be of a design that is compatible to the residential character of the community . (f) LIGHTING, including spot lights , flood lights , electrical reflectors and other means of illumination for signs, structures, landscaping, parking areas, loading and un- loading areas and the like shall be focused, directed, and so arranged as to prevent glare or direct illumination on streets or adjoining property. (g) RADIOACTIVE MATERIAL. Unless specific additional uses are permitted by the Certificate of Occupancy the use of radioactive materials within the I-S Zone shall be limited to measuring, gauging and calibration devices, as tracer elements, in X-ray and like apparatus , and in connection with the processing and preservation of foods. In no event shall radioactivity , when measured at each lot line be in excess of 2. 7 x 10-11 microcuries per milliliter of air at any moment of time. (h) ELECTRICAL AND ELECTRONIC devices and equipment shall be suitably ,wired shielded and controlled so that in operat- tion they shall not , beyond the lot lines , emit any elec- trical impulses or waves which will adversely affect the operation and control of any other electrical or elec- tronic devices and equipment. SECTION DEVEL0PMENT STANDARDS . 1 The following standards of development shall apply to uses and structures permitted in the I-S Zone: ROUGH DRAFT I-S (Industrial Service) -6- (a) Lot Area - The minimum lot area shall be 20, 000 sq. ft . (b) Lot Width - The minimum lot width shall be 100 feet. (c) Front Yard - The minimum front yard setback shall be 30 feet in depth. A 10-foot strip adjacent to the front property line shall be appropriately landscaped and maintained except for designated pedestrian and vehicu- lar accessways. The remainder of the front yard setback may be used for parking purposes. As a part of the con- sideration of a total subdivision, the Planning Commis- sion may approve variation in the required front yard set- backs to provide for overall improved aesthetic appearance. (d) Side Yard - The minimum side yard setbacks shall be : Adjacent to a Street - Ten feet in depth. On Interior Lots - One side yard of ten feet in depth. Except for direct , designated pedestrian and vehicular accessways across side yards adjacent to a street , all required side yards shall be landscaped. (e) Rear Yard - The minimum required rear yard shall be 25 feet in depth. Said yard may be used for parking pur- poses or for open storage. (f) Boundary Treatment - Whenever a lot in the I-S Zone district has a common lot line with any residentially zoned property, a masonary and/or a ten foot wide land- scaped area shall be maintained for the full length of the common property line . The planting materials within the required landscaped area shall be the type which shall within 18 months after installation create a hedge-like effect at a minimum height of six feet . (g) Outside Storage - All outside storage shall be enclosed by an opaque fence, wall or landscaping to the minimum height of 7 feet in a manner acceptable to the Director of Environmental Services. The purpose of this discussion will be to review the various elements of this zone and to determine whether the direction and requirements as written are appropriate. If it is found by the Commission that the draft as written is acceptable, Staff will set the matter for hearing at the first meeting in October. Between now and that time, Staff: will review the proposed ordinance with various members of the community that have a direct in- terest in such a zone , to obtain additional input in the fi- nalization of this zone. The only action required from the Commission is an indication as to whether this zone is appropriate as a starting point . The district is created to implement the general plan by es- tablishing a zone classification that: provides an optimum general industrial environment that also allows compatible commercial uses to exist . The development within this zone district should be of a design that is compatible to the residential character of the community.
