It was so unlike the metropolitan areas of much of Orange County where we lived. . We were attracted to Palm Desert by the beauty of the downtown and surrounding areas. For over a year we have been permanent residents of the city . There was a period, however, in the late 60's when it .Looked as if PD was going the way of countless other small, but rapidly growing cities. Suddenly, or so it seemed to us, along Highway III and adjacent areas a hodge-podge of advertising signs was popping up Indeed, it looked for awhile as if PD was fast becoming another "honky-tonk" type town with a jumble of "big is better" signs everywhere. Then gradually we could see that the city was withstanding the pressures that come to all growing cities and was encouraging stores and businesses to landscape, beautify and to use imagination and creativity in their signs rather than just bigness and flashing lights to sell products and services. May we say "hang in there?" We both were involved in citizen in-put committees in writing several ordinances for the city of San Juan Capistrano. Happily, not one business in San Juan that opposed the sign ordinance, claiming that such an ordinance would "Take�_'way the right for a man to make a living'y' .Lost his .living because of the sign limitations imposed on him by the city of San Juan Capistrano. Most large chain-store-type businesses such as : Marie Calendar, MacDonalds, Kentucky Fried Chicken and most major gas stations, long ago learned that it was good business to design their signs to the setting a town was striving to convey. By conforming to a city's idea of beauty it always seemed to enhance their community relation- ship instead of diminishing their business in anyway. Recently we returned to the desert from a three week vacation and saw the SOB signs spread out from Cathedral to Palm Desert (signs which we first interpreted as "Save Our Billboards") . These -more- -2- siens seem so unnecessary because nothing advertises better than quality products, good service and a pleasant person with whom to do business. i Unlike most cities that have just grown Like "Topsy", Palm Desert stiLL has a chance to benefit by making the city a unique place in which to shop and to do business. Be- cause of this possibility, the Council is presently working with representatives of the business and environmental community to develop the following sign code regulations that can enhance environ- mental needs and still assure business growth in your city. The Sign Users Council of California therefore proposes the follow- ing guidelines for your Community, as an effort to assist in the development of a workable and realistic sign ordinance, an ordinance that businessmen will agree to comply with and assist the community in enforcing, SERVING THE COMMUNITY SIGN USERS COUNCIL OF CALIFORNIA Regulations - Definitions Guidelines SECTION I DEFINITIONS Animated Sign sign with action or motion, flashing, color changes requiring electrical energy, electronic or manufactured sources of supply, but not including wind actuated elements such as flags, banners, or specialty items. This definition does not include public service signs such as time and temperature units. Architectural Projection Shall mean any projection which is not intended for occupancy and which extends beyond the face of an exterior wall of a building, but shall not include signs. Building Facade I'liat portion of any exterior elevation of a building extending from grade to the top of the parapet wall or eaves and the entire width of the building elevation. Building Facade Facing resur acing o an existing facade with approved material illuminated or non- illuminated. Background Area of Sign e en ie r ac ground area of a sign upon which copy could be placed. In com- puting area of sign background, only that face or faces which can be seen from any one direction at one time shall be counted. Changeable Copy Sign sign w is is characterized by changeable copy, regardless of method of attachment. Copy Area of Sign e actua area of the sign copy applied to any background. In computing copy area, straight lines drawn closest to copy extremities encompassing individual letters or words shall be used. Directional Signs n premise incidental signs designed to guide or direct pedestrian or vehicular traffic. Free Standing Sign sign wfiieyis supported by one or more columns, uprights or braces in or upon the ground. Sign Ordinance Recommendations from Sign Users Council of California - 1 - Illuminated Sign sign ign in which a source of light is used in order to make readable the message. This definition shall include internally and externally lighted signs and reflectorized, glowing, or radiating signs. Marquee -`-`Marquee is a permanent roofed structure attached to, and supported by the building and projecting over public property. Marquee Sign — Any sign attached to or constructed in a marquee. Multiple Copy Sign sign which advertises other than the name of the business and the princi- pal product or service. On Premise Sign sign which carries only advertisements strictly incidental to a lawful use of the premises on which it is located, including signs or sign devices indicating the business transacted at, services rendered, goods sold or produced on the premises, name of the business, name of the person, firm or corporation occupy- ing the premises. Projecting Double-Faced Building Sign ou ataced sign w is projects more than IV over public property, and which uses a building wall as its main source of support. Revolving Sign sign which revolves 3600 but does not exceed 8 rpm. Roof Sign Ass'ign erected upon or above a roof or parapet wall of a building and which is wholly or partially supported by said building. Sign Any sign or device and all parts thereof which are used to advertise products, goods, services or otherwise promote the sale of objects or identify objects for sale. Sign Structure ny structure which supports or is capable of supporting any sign as defined in this code. A sign structure may be a single pole or may or may not be an inte- gral part of the building. Temporary Sign sign -w ich is intended to advertise community or civic projects, construction projects, real estate for sale or lease, or other special events on a temporary basis. Under Marquee Sign lighted or un ighted display attached to the underside of a marquee protruding over public or private sidewalks or right-of-way. t Ordinance Recommen a io s Siin d t' n from Sign Users Council of California _ 2 _ Public Service 3 i SignR—fin e ectr! ly controlled message center containing public service messages, i. e. : Time and Temperature, etc. Uniform Building Code 1 e current edition of the Uniform Building Code as has been officially adopted by the municipality and becomes related to these guidelines as regard- ing construction standards, approved materials, and projection standards unless otherwise specified herein. Uniform Sign Code e current edition of the Uniform Sign Code as published by the International Council of Building Officials. Wall Siggnn A sign which is in any manner affixed to any exterior wall of a building or structure and which projects not more than 18" from the building or structure wall and which does not extend more than 6' above the parapet, eaves or building facade of the building on which it is located. Zoning or Land Use mean t eland use district established by the authorized legislative body. SECTION II GENERAL PROVISIONS 1. No animated signs shall be erected or maintained in any residential land use district. 2. No animated signs shall be erected or maintained closer than 75' from any residential land use district on which there exist structures used for residential purposes. 3. Marquee signs may be placed on, attached to, or constructed in a marquee. For purposes of determining height, projection and clearance, tables as specified in the Uniform Building Code for marquees shall govern. 4. Copy area of a building facade facing shall not exceed 40 percent of the background facing to which it is applied. 5. Background area of wall signs shall not exceed 30 percent of the building facade or 4 square feet per lineal foot of the elevation upon which they are placed, whichever is greater. Sign Ordinance Recommendations from Sign Users Council of California - 3 - 6, a. Copy area of multiple copy signs not to exceed 40% of background to which applied. (Multiple copy sign is one which advertises other than the name of the business and the principal product or service. ) b. Principal identification sign is a sign which identifies only the name of the business and the principal product or service. These signs are not subject to any limitation of copy area to background. SECTION III SPECIAL PROVISIONS 1. Height Regulations Limited Commercial Zones In no case shall the height of a free-standing sign as otherwise permitted by this section exceed the distance in feet and inches measured from the center line of the street fronting upon its location, to the column or columns nearest the street front. Said height shall be measured vertically from the average grade at the base of the sign column or columns to the uppermost point of the said sign, but in no case will this height exceed 40' to the top of the sign. NOTE: Superficial. ornamentation, trim, column or column covers or symbol type appendages of non-message bearing character shall not be included in determining height. Roof signs shall in no case exceed a height above the roof equal to a dis- tance of the height of the elevation of the building upon which sign is lo- cated. The height above the roof may be equal to the height from grade to the top of a parapet wall, ridge line of the highest point of a roof, but in no case will the height of the sign exceed Z01 from this point to the top of the sign. NOTE: Superficial ornamentation, trim, column or column covers or symbol type appendages of non-message bearing character shall not be included in determining height. General Commercial and Planned Shopping Center Zones In no case shall the height of a free-standing sign as otherwise permitted by this section, exceed a height equal to one and one-half (1 1/2) feet for each foot of setback, said measurements shall be computed from the center line of the street upon which the sign is located and measured to the column or columns nearest the street front. The height shall be measured verti- cally from the average grade nearest the supporting columns to the highest point of said sign, but in no case will this height exceed 50' to the top of the sign. Sign Ordinance Recommendations from Sign Users Council of California 4 - NOTE: Superficial ornamentation, trim, column or column covers or symbol type appendages of a non-message bearing character 'shall not be included in determining height. Roof signs shall in no case exceed a height above the roof equal to a distance of the height of the elevation of the building upon which such sign is located. The height above the roof may be equal to the height from grade to the top of a parapet wall, ridge line or the highest point of a roof, but in no case will this height exceed 30' from this point to the top of the sign. NOTE: Superficial ornamentation, trim, column or column covers or symbol type appendages of non-message bearing character shall not be included in determining height. Industrial Zones In no case shall the height of a free-standing sign as otherwise per- mitted by this section, exceed a height equal to one and one-half (1 1/2) feet for each foot of setback, said measurements shall be computed from the center line of the street upon which the sign is located and measured to the column or columns nearest the street front. The height shall be measured vertically from the average grade nearest the support- ing column (s) to the highest point of said sign, but in no case will this height exceed 70' to the top of the sign. NOTE: Superficial ornamentation, trim, column or column covers or symbol type appendages of a non-message bearing character shall not be included in determining height. Roof signs shall in no case exceed a height above the roof equal to a dis- tance of the height of the elevation of the building upon which such sign is located. The height above the roof may be equal to the height from grade to the top of a parapet wall, ridge line or the highest point of a roof, but in no case will this height exceed 30' from this point to the top of the sign. Freeway Signs Signs intended to be viewed from a freeway and which identify freeway oriented businesses (i. e. Service Stations, Restaurants, Hotels) shall have the height computed from a base point equal to the level of the closest main traveled freeway roadbed. Ratio and maximum height shall be determined by zone. 2. Animated Signs Animated signs as defined will be allowed only as follows: (a) Commercial and industrial zones. (b) Must be at least 75' from any resi dential zone. Computing Background Area of Sign In computing background area in square feet, standard mathematical formulas for known or common shapes will be used. In the case of irregular shapes, straight lines drawn closest to the extremities of the shape will be used. On signs with more than one face or faces visible from any one direction at one time will be counted. 4. Computing Copy Area In computing copy area, straight lines drawn closest to copy extremities encompassing individual letters or words shall be used. 5. Revolving Signs No sign may revolve more than 8 rpm. 6. Projecting Signs Free- standing signs and roof signs may project over the property lines as outlined in the Uniform Sign Code. Other types of signs may project only as set forth herein. 7. Signs Restricted - Requiring Special Use Permits Portable signs, folding signs and similar movable signs shall not be permitted unless such signs are first approved by the proper authority. The same shall apply to flags, banners and streamers or special feature items. Exception: In case of special feature window signs, in no case shall more than twenty (20) percent of a window of a commercial business be used for the display of temporary window feature signs. 8. Non-conforming Clause Abatement provisions for signs not conforming to specifications in these recommended guidelines may be incorporated in new or amended sign ordinances providing for complete removal or rehabilitation of the sign to conformity within ten (10) years after enactment date of any such ordinance, new or amended. 9. Roof Sign Supports The supporting members of a roof sign shall appear to be free of any extra bracing, angle iron, guy wires, cables, etc. The supports shall appear to be an architectural and integral part of the building. Supporting columns of round, square or shaped steel members may be erected if required bracing, visible to the public, is minimized or covered. Sign Ordinance Recommendations from Sign Users Council of California - 6 - 10. Quality and Maintenance of On. Premise Signs Only materials as permitted by the Uniform Sign Code governing structur- al requirements shall be used in the manufacture and erection of on premise signs. All electrically energized signs shall bear the seal of approv�Toxxaan approved testing laboratory. Every sign as permitted by this section shall be kept in good condition as to maintenance and repair. SECTION IV SIGN USES FOR SPECIFIED ZONES Single and Limited Multiple Family Residential Zones 1. Temporary Sign - One sign unlighted, not exceeding 12 square feet in area nor 61 in overa 1 height and advertising only the following: (a) Property for sale or lease and pertinent information regarding sale or lease. (b) Construction information, providing this sign is removed prior to final building inspection. 2. Signs Required by Law - Shall include legal notices or advertisement prescribed y aw or posted by any lawful officer or agent. Multiple Family Units and Apartment Complex Development Zones 1. Temporary Sign - Same as residential zones. 2. Signs Required by Law - Shall include legal notices or advertisement prescribedyFiTw or posted by any lawful officer or agent. 3. Free-Standing Sign or Wall Sion - Lighted or Unlighted - total aggregate square ootage o sign accgroun o all signs may not exceed 40 square feet for each principal building. Signs may advertise only the name and address of the building it identifies and the name, address and services offered by professions allowed in this land use district. Residential Professional Services Zones 1. Temporary Sign- Same as residential zones. 2. Signs Required by Law - Shall include legal notices or advertisement prescribed y aw or posted by any lawful officer or agent. Limited Commercial Zones Special commercial zone allowing service type stores in residential neighbor- ri 3 zones. 1. Temporary Sign - For each frontage on street, one sign not exceeding square teeMn background area, nor over 15 feet in overall height. 2. Signs Required by Law - Shall include legal notices or advertisement prescribed y aw or posted by any lawful officer or agent. 3. Free-Standing Sign - One sign for each business located on the property with ac groun area of sign not exceeding 3 square feet per lineal foot of property frontage which the business occupies. (Second street frontage to be allowed equal sign area. ) 4. Wall Si n - One sign for each business located on the property, with ac ground area of sign not to exceed 30 percent of the building facade to which it is applied, or 3 square feet per lineal foot of business frontage, whichever is greater. (a) Where a business has a main entrance on more than one elevation of the building such secondary frontage may contain a wall sign of the same limitations as prescribed for the primary frontage. (b) Where a business has a secondary frontage, but does not have a main entrance to the secondary frontage, such frontage may con- tain a wall sign not to exceed 20 percent of the surface of the build- ing facade to which it is applied, or 2 square feet per lineal foot of business frontage, whichever is greater. 5. Buildinp� Facade Facing - Copy area shall not exceed 40 percent of the iuTding facade-facing to which it is applied, G. Signs Required by Law - Shall include legal notices or advertisement prescribed y law or posted by any lawful officer or agent. 3. Free-Standing Sign - One sign for each business located on the property with ac groun area of sign or signs attached to structure not to exceed 4 square feet per lineal foot of property frontage which this business occupies. * Maximum area of sign per business shall not exceed 600 square feet whether on individual free-standing sign or on a free-stand- ing sign identifying more than one business concern. 4. Wall Sign - One sign for each business located on the property with back- grou�nc area or sign not to exceed 30 percent of the building facade to which it is applied, or 4 square feet per lineal foot of building elevation, whichever is greater. 5. LEGISLATIVE COUNSEL'S DIGEST SB 59, as amended, Moscone. Price sign advertising. There is presently no provision of law which requires a gasoline service station or other facility to post the price per gallon of motor vehicle fuels offered for sale. General Provisions Add 25.38-16.15: "No sign or sign structure shall be erected in such a manner that any portion of its surface or supports shall be within six feet horizontally of, or twelve feet vertically of, overhead electric conductors which are energized in excess of 750 volts." Reason: These distances are a requirement of General Order 95 which is part of the Electrical Safety Orders of the Division of Industrial Relations, State of California. These Electrical Safety Orders set the standards of safety which are followed by the Edison Company. 25-38-17.06 Political Sign Regulations Change the first sentence to include the work "affixed to" 2 in relation to public utility poles as follows: "(5) Such signs shall not be nailed to trees, fence posts or affixed to public utility poles . . . right of way." In providing these recommendations it is Edison's intention to provide the city of Palm Desert with suitable legislation to protect our employees who climb poles, provide for the safety of others, and to maintain a clean environment. (a) This will dilute the advertising capabilities of the locgl. business- man man without controlling competitive businesses from out of the city. (b) City-based businesses will. not have compettttive advertising impact when their vehicles are operating in areas out of the City of Palm Descrt. (c) Those who violate the spirit of the ordinance §.y parking their vehicles with display material in front of their place of business on a continuing basis can be controlled by other means, e.g. section 11.02 of this ordinance which prohibits signs in the public right- of-way. ;ection 38.3 Sign Permit Procedure (Pg.3) It i:: suggested that the pros)gdures for obtaining sign permits regtjirc much more detail., more paper work, and a greater expense than is necessary. This is particularly true, since most signs will be covered by the $500.00 minimum valuation called for in the ordinance. (a) The $500.00 minimum which rel.agates any sign to the Design Review process is not realistic. Consideration should be given to raising this mi.nimwn requirement. (b) Consideration might also be given to the simplification of the Pg. 2 whole sign permit procedure, as some of the information may not be be needed for all signs being considered. (c) Application fees should not be considered as a source of income for the City, but as a fee for services rendered in processing the application. There should be no arbitrarily assigned costs added to the license fee if such costs will vary greatly from one app- lication to another. Section 3 (Pg. 3) The ordinance suggests that a permit e required for maintanance of signs. . A permit should be requi.reIF the maintenance results in alteration of the sign. Hot,*ever, maintenance, as such, means only that an existing sign be kept in working order or repair, and in no way im- plies that changes will be made. The word should be deleted from the section as being inappropriate and meaningless in the manner used. Section 11.08 (Pg. 6) Roof Signs Roof signs should not be arbitrarily prohibited. While the ordinance does permit certain exemptions, there is no specific mention of those structures where the area above the eaves may be the only space appro- priate for proper store identification. This situation will occur with many of the existing signs in the City, and should be explored in detail. Section 12 (Pg. 6) Permitted signs-purpose There is no argument with the purposes of the ordinance relating to "permitted signs" However, it is noted that the deviations from the specific standards allowed under the ordinance are entirely subjective. I rg. 3 For example, one of the goals is "compatible design, simplicity, and sign effectiveness" In other sections of the proposal, we find vague references to compatible.colors,. and. the desire to "preserve and enhance the visual nature of the City's streets and highways" Again, there is no criticism of the goal of the proposal, but only the agreement that there will be occasions where the sign owner and the City staff and/or the Design Review Board will not agree as to whether a given sign will "enhance the visual nature of the City"s streets" Therefore, we suggest that the Council incorporate into the ordinance a provision for a board of arbitration for such dusputes. This could be the same panel as proposed for the Ad Hoe sign amortization committee, or one similarly constituted. Section 14.05(Page 9) Free standing signs, as in the section relating to roof signs, should be given a more t4ough examination. The regulations will involve many signs now in existance, and the guidelines for their control should spelled out in some detail., as opposed to the proposal as it now stalids. Sections 15.06 and 15.07 (page 12) It was the opinion of all of the retail merchants consulted that there should be no regulation of price displays or promotional material shown behin& shop windows. (a) There is no standardization of such material, and it could constitute a burden to the businessman to conform to guidelines relating to the size of prices and letters. (b) the two sections would, in essence, prohibit the use of pricing and display material furnished to the local business by his suppliers. Often, Page 4 this is the only professionally prepared advertising material. ccvai"Lc3blr., (c) The ordinance would deny the local merchant the opportunity to tie- in his local promotion to -the National advertising for products which he carries. The use of pricing and promotional material supplied by the advertisers could not he used unless it conformed to the details of the ordinance. Section 15.08 (Page 12) Sale Signs Sale signs are essential to the success of many businesses where such things as changing styles, limited shelf-life, or Summer closing require a rapid turn-over or reduction in inventory. The ordinance is overly restrictive and should be reviewed, Section 16.06 (Page 15) Colors allowed A number of comments were to the effect that there should be no restric- tion as to the number of colors used. . Section 16.07 (page 16) Size reduction due to type of illumination There was unanimous and strong feeling against the restriction of sign size, based simply on the fact of its being illuminated internally rather than being externally lit, or unlit. If the "glare factor" is of prime consideration, this can be controlled by other means including the wattage of bulbs used or the type of fluorescent tube. Otherwise, the require- ment that internally lit signs be half the size of any other seems arbitrary. l Page 5 Section 18.04 Pa.ffe 19) Removal and Amortization Period There was comment that the amortization and removal periods, as set forth, are discriminatory. That is, the man with a, $500.00 sign may find it just as difficult financially to replace his sign as does the owner of a sign costing $5000.00 Yet the first man has only one year to replace his sign, and the other has five years. This continent has certain merit, and it might be reasonable to consider giving all sign owners an equal period of time to reach conformity, regardless of the initial cost of the sign. The following are general, and personal, comments about the proposed sign ordinance and its effects of the businesses of the City. (].) It should be recognized that each retail outlet has its own specific need for identification, and that this need will vary with the location of the business within the city. Some businesses need very little on-site identification. To others, store and product identification is essential to the life of the business. (2) Sales are a legitimate function of the business community, and are of direct benefit to the businessman, the local consumer, and to the City. (3) The businesses of Palm Desert are in direct competition with those in other cities in the Valley. To stay v4rile in a competitive situation, good store identification, product identity, and the ability to promote goods and services is an absolute necessity. (4) The thrust of the sign ordinance will weaken and dilute the ability of local business to stay competitive. There are compromises which must be made by businesses for the good of the community, and I do not find any opinions to the contrary. However, the present proposal will lead to conformity, uniformity, and sameness. I hope that the Council will take time to examine the true goals of the City in formulating this proposal, and will take a long look at the end results that may turn up if any area of the business community is too closely regulated. General Provisions Add 25.38-16.15: "No sign or sign structure shall be erected in such a manner that any portion of its surface or supports shall be within six feet horizontally of, or twelve feet vertically of, overhead electric conductors which are energized in excess of 750 volts." Reason: These distances are a requirement of General Order 95 which is part of the Electrical Safety Orders of the Division of Industrial Relations, State of California. These Electrical Safety Orders set the standards of safety which are followed by the Edison Company. 25-38-17.06 Political Sign Regulations Change the first sentence to include the work "affixed to" - 2 in relation to public utility poles as follows: "(5) Such signs shall not be nailed to trees, fence posts or affixed to public utility poles . . . right of way." In providing these reccmmendations it is Edison's intention to provide the city of Palm Desert with suitable legislation to protect our employees who climb poles, provide for the safety of others, and to maintain a clean environment. We feel that all buildings with emphasis on single family dwellings should have a sign indicating street address . This sign should be readily visible, during day or night, to the operator of any emergency vehicle on the street.
