CASE NO. TRACT NO. 4442. WHEREAS, the City Council of the City of Palm Desert did receive a verified application from ENVIRONMENTAL DEVELOPMENT COMPANY, requesting a 12 month extension on a 209-unit condominium project on 33.6 acres of land, located in the R-2-7000 zone and situated 1 .5 miles south of State Highway 111 , on the west side of Highway 74, more 'particularly described as: being a portion of government lot 1 in the NW-, of Section 31 , and a portion of the WZ of the NE4 of Section 31 , T5S, R6E, SBB & M. WHEREAS, said application was exempt from the requirements of the "City of Palm Desert Environmental Qual.ity Procedure Resolution Number 74-14" , in that the project was initiated prior to the effective date of the- California Environmental Quality Act and is therefore considered to be exempt as an ongoing project, and; WHEREAS, the City Council did take into consideration the Tentative Map as submitted, and the reports of the various reviewing agencies, and; WHEREAS, the City Council did find that the subject Tentative Map does substantially comply with the City of Palm Desert Code(County Ordinance Number 460) , and the State of California Subdivision Map Act, as amended; WHEREAS, the City Council did find that the subject Tentative Map does comply with the adopted General Plan, and; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert as follows: 1 . That the above recitations are true and correct and constitute the findings of the Council in this case. 2. That it does hereby approve said extension of the above described { Tentative Map No. 4442, subject to fulfillment of the conditions as attached. All improvements shall conform with County Subdivision Standards Schedule "A" unless modified by these conditions. 2. a. All street improvements shall be designed and constructed in confor- mance with Riverside County Road Improvement Standards. Street i.mprovcr.:cnts and requirements shall be as follows: 1) State 74 shall be improved with asphalt concrete paving and concrete curb and gutter located 38 feet from the centerline within a 50 foot half width dedicated right of way. 2) Access onto Highway 74 shall be restricted and so noted on the final map. 3. If the subdivider does any lot- grading he shall submit one reproducible broi:nline and four prints of a comprehensive grading plan to the Riverside County Surveyor's Office. Prints of the.grading plan will subsequently be transmitted from the Surveyor' s Office to the Flood Control District and Department of Building and Safety for review and approval and shall be in compliance with the Uniform Building Code, Chapter 70, as amended by Ordin- ance 457. 4. The subdivider shall submit for approval a soils report for stability and geological study to the Riverside County Surveyor' s Office, prior to recor- da.tion of the final map, unless ?waived by the Director of Building and Safety. He then re- ferred to a letter received from the Coachella Valley County Water District requesting that Condition #9 be changed to require wet sewers as a result of sewers now being available to the area. Commissioner Berkey asked for clarification of City Council policy regarding a bond in lieu of paving. Discussion then ensued between staff and the Commissioners ` regarding the alternative of paving 1/2 the alley and how the f remainder of the alley would be paved in the future. LLOYD MOUNT, Walker & Lee, Palm Desert , spoke in favor of the project . He advised that the applicant ' s request for paving 1/2 of the alley specifically referred to 1/2 long.not wide. Mr. Mount ' s primary concern was that if the applicant was required to pave the full 180' he would be financially penalized due to the fact that he only owned 90' of the two parcels. Therefore, he requested relief for the applicant to only pay for improvements on his frontage. He felt it was preferable for a bond to be posted and to install the improvements at the same time when the rest of the street was done since this was mostly undeveloped property along Palm Desert Drive. After a lengthy discussion, Commissioner Mullins moved that Planning Commission Resolution No. 73 be approved with the 10 con- ditions as written. Commissioner Berkey seconded the motion which carried unanimously. Chairman Seidler abstained from voting. Commissioner Berkey commented that his vote was on the basis that this was a policy matter and that the final decision of changes to the conditions should be made by the City Council . Commissioner Berkey stressed the fact that he felt Dr. Prock should only improve the alley for the full length of his parcel which was 901 ; or have the option of posting a cash bond for the value of the proposed construction where immediate installation was infeasible. Commissioner Mullins agreed with Commissioner Berkey and recommended by minute motion that the Planning Commission recommend to the City Council, that condition #4 be modified to require paving for 1/2 of the alley (90 ' ) ; and that the applicant be permitted the option of posting a cash bond .in lieu of paving. Street names for the proposed subdivision shall be subject to approval by the City Engineer and Director of Environmental Services. 6. As a part of construction, new units shall be connected to the sewer sys- tem in a manner acceptable to the Coachella Valley County Water District. 7. Prior to recordation of the final subdivision map the applicant shall sub- mit to the Director of Environmental Services the following documents whit', shall demonstrate to the satisfaction of the Director of Environmental Ser- vices that the total project will be developed and maintained in accordance with the intent and purposes of the approval: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the owners of the units of the project. The approved documents shall be recorded prior to occupancy of any dwelling unit. 8. A Home Owners Assn. with the unqualified right to assess the owners of the individual units for reasonable maintenance costs shall be established and continuously maintained. The Home Owners Assn. shall have the right to . lien the units of the owners who default in the payment of their assessments. Such lien shall not be subordinate to any encumbrance other than a first deed of trust provided such deed of trust is made in good faith and for value and is of record prior to the lien of the Home Owners Assn. 9. Provide easements for drainage facilities and utilities and dedicate on the final map if within tract boundary. 10. The subdivider shall provide Schedule "A" fire protection. The California Division of Forestry shall review and approve the water plan map relative to location, setting, spacing-and installation of fire hydrants prior to recordation of the final subdivision map. Applicant: Environmental Development Company for Mountainback W. REQUEST; That the Planning Commission approve a revised tentative tract map for the third and final phase of the Mountainback project. This phase would contain 209 condominium,,units on 33.6 acres of land. The first two phases consisted of 101 dwelling units. II. STAFF RECOMMENDATION: That it be moved by Resolution No. 9 that the Planning Commission recommend to the City Council the approval of the tentative map subject to the attached conditions: Justification is based upon: 1% Conformance of the proposed development to all requirements of the Zoning Ordinance and the Cove Communities General Plan. 2. The proposed development does insure the protection of the public health, safety, and general welfare. 3. Compatibility of the proposed development to the existing and pro- posed development in the area. III. BACKGROUND: A. Description - The subject property is known as Tract 4442 and is a portion of government lot'. 1 in the northwest 1/4 of section 31 and a portion of the west, 1/2 of the northeast 1/4 of section 31, T5S, R6E, S.B.B.&M. B. Location - The subject tract is located approximately 1.5 miles south of State Highway 111, on the west side of State Highway 74. C. Size - 33.6 acres. D. Total Number of Units - 209 units. E. Density - 6.22 dwelling units per acre. F. Coverage - 40% of the area will be covered by structure or paving. G. EIR Finding - Project was initiated prior to the effective date of the California Environmental Quality Act and is there- fore considered to be exempt as an on-going project. H. Existing Zoning - R-2-7000. I. Adjacent Zoning - North - W-17 R-2 South - R-T East -,R-2-7000,, R-2-5000 West - W-1 J. General Plan Commitment - The Cove .Communities General Plan indicates the property to be potential medium den- sity residential with 5-10 dwelling units per acre. This development conforms to this designation. Staff Report -2- Tract 4442 K. Utilities - Water & Sewer - Coachella Valley County Water District Power - Southern California Edison Gas - Southern California Gas Telephone - General Telephone L. Parking - 2.69 spaces per dwelling unit. M. Previous Actions - The tentative map for Tract No. 4442 was pre- sented before the Palm Desert Planning Commission on July 1, 1974. At that time, the tentative map had been based on the previous zoning for the property and contained a density of 9.3 d.u./acre. The applicant was granted an extension to make the necessary changes and is now submitting the revised map which conforms to the reduced density mandated by the existing zoning ordinance. IV. DISCUSSION OF TENTATIVE TRACT MAP ELEMENTS The subject tract contains 33.61 acres and is proposed to have 209 dwel- ling units, which is a density of 6.22 units/acre. This is the third and final phase of a total development of 310 units on approximately 40 acres, which is 7.75 units/acre. The interior road system will consist entirely of private streets, most of which are wide enough to permit street parking on at least one side and will be maintained by the property owners association. The appli- cant proposes to install curb and gutter 38 feet from the centerline of State Highway 74, which lies along the eastern edge of the parcel. Part of this work has already been completed in the first two phases. Water and sewer service will be supplied to this project by the Coach- ella Valley County Water District. All utilities will be underground. Parking will be provided by one off-site covered space per unit, one off-site uncovered space per unit, and approximately 145 spaces on the private roads. The tract will be' developed in five phases. Each phase will have its own share of the projected recreational amenities. Eleven swimming pools have been planned for the 209 units, which is a ratio of 19 units for each pool. In addition, 5 tennis courts will also be built. All improvements shall conform with County Subdivision Standards Schedule "A" unless modified by these conditions. 2. a. All street improvements shall be designed and constructed in conformance with Riverside County Road Improvement Standards. Street improvements and requirements shall be as follows: 1. State Highway 74 shall be improved with asphalt concrete paving and concrete curb and gutter located 38 feet from the centerline within a 50 foot half width dedicated right of way. 2. Access onto Highway 74 shall be restricted and so noted on the final map. 3. If the subdivider does any lot grading he shall submit one reproducible brownline and four prints of a comprehensive grading plan to the Riverside County Surveyor's Office. Prints of the grading plan will subsequently be transmitted from the Surveyor's Office to the Flood Control District and Department of Building and Safety for review and approval and shall be in compliance with the Uniform Building Code, Chapter 70, as amended by Ordinance .457. 4. The subdivider shall submit for approval a soils report for stability and geological study to the Riverside County Surveyor's Office, prior to recordation of the final map, unless waived by the Director of Building and Safety. 5• Street names for the proposed subdivision shall be subject to approval by the County Road Commissioner. 6. A water and domestic sewage disposal for individual lots shall be installed in accordance with the provisions set forth in the Riverside County Health Department letter dated December 20, 1971, a copy of which &s enclosed. 7. Prior to recordation of the final subdivision map the applicant shall submit to the Commission the following documents which shall demonstrate to the satisfaction of the Commission that the total project will be developed and maintained in accordance with the intent and purposes of the approval: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the owners of the units of the project'. The approved documents shall be recorded at the same time that the subdivision map is recorded. 8. A management company with the unqualified right to assess the owners of the individual units for reasonable maintenance costs shall be established and continuously maintained. The management company shall have the right to lien the units of the owners who default in the payment of their assessments. Such lien shall not be subordinate to any encumbrance other than a first deed of trust provided such deed of trust is made in good faith and for value and is of record prior to the lien of the management company. . f CONDITIONS OF APPROVAL TRACT im. 4442 rye -2- 9. Provide easements for drainage facilities and utilities and dedicate on the final map if within tract boundary. 10. The subdivider shall provide Schedule "A" fire protection. The California Division of Forestry shall review and approve the water plan map relative to location, setting, . spacing and installation of fire hydrants prior to recordation of the final subdivision map, 11. A valid variance shall be in effect .at the time of recordation of the final map. . 12. A valid conditional use case conforming to the approved tentative map shall be in effect at the time of recordation of the final map. 13. In regard to flood control protection the Coachella Valley County Water District letter dated December 9, 1971, states that this tract may be considered safe from stormwater flows except in rare instances. 14. An application should be processed through L.A.F.C. for a new County Service.
