REQUEST: That the City Council approve a 12-month extension for a 43 acre tentative tract map located at the southeast corner of Deep Canyon and Avenue 44. II. STAFF RECOMMENDATION: That the City Council uphold the findings of the Plan- ning Commission and deny the extension by City Council Resolution No. 75-109 III. JUSTIFICATION: l.. The project does not conform to the adopted Palm Desert General Plan. 2. The project does not conform to the adopted or proposed Palm Desert Zoning Ordinance. 3. Circumstances have changed since the project was originally approved, and a more appropriate development plan is now in order. IV. BACKGROUND: A. Location: Southeast corner of Deep Canyon & Avenue 44 B. Size: 43 acres (gross) C. Existing Land Use: Date and citrus grove D. Terrain: Level E. Existing Zoning: R-1-10,000 F. Proposed Zoning: The preliminary zoning map proposes PR-5 G. Density: 4.5 dwelling units per acre H. Surrounding Uses: Date and citrus groves on all sides I. Previous Actions: (1 ) EIR proposed and submitted December 1972 (2) County CU Case 1498-E, February 1973 (3) City of Palm Desert CU Case 01-73, December 1973 (4) Tract Map approved by Council , April , 1974 (5) Time extension approved for Plot Plan, May 1975 (6) Planning Commission denied 12-month extension of tract map V. DISCUSSION: The project was originally approved by the County and has had several reviews with the City. At the present, the Zoning Ordinance would require 378 covered parking spaces and 145. open parking spaces, and 50% of the project in useable open space. The current plan for this project does not meet either of these requirements, however, with certain minor changes , could. The staff has some serious reservations on the amount of useable open space with the proposed plan. CASE NO. TT 5075 WHEREAS, the Planning Commission of the City of Palm Desert, did receive a verified application from M. B. Johnson/Interstate Properties , Inc. , requesting a 12 month extension of a tentative tract on 43 acres of land, located in the R-1 zone and situated at the southeast corner of Deep Canyon and Avenue 44, more particularly described as : ' Assessor' s Parcel No. 625-050-01 , -02 , -03, ­05, -06, -12, -13 , -14 625-100-01, -02 , -03 WHEREAS, .said application had complied with the requirements of the "City of Palm Desert Environmental Quality Procedure, Resolution Number 74-14" , in that an Environmental Assessment form was submitted and a Negative Declaration was made by the Director of Environmental Services and the appeal period has expired, and; WHEREAS , the Planning Commission did take into consideration the. JOHNSON, Applicant: Request for a 12-month extension of a Tentative Map of 189 units on 42 acres at the southeast corner of Deep Canyon and 44th Avenue. Steve Fleshman presented the staff report including a slide presentation of the proposed site. Staff recommended that the Planning Commission deny this request by Resolution No. 89 for the following reasons: 1 . The project does not conform to the adopted Palm Desert General Plan. 2. The project does not conform to the adopted or proposed Palm Desert Zoning Ordinance. 3. The CUP will expire in January if construction has not begun. 4. Circumstances have changed since the project was originally approved, and a more appropriate development plan was now in order. This project was originally approved by the County and has had several reviews with the City. At present, the Zoning Ordinance would require 378 covered parking spaces, 145 open parking spaces, and 50% of the project in useable open space. The current plan for this project did not meet these requirements. Staff had serious reservations on the amount of useable open space with the proposed plan. Further, the General Plan called for pre- servation of the date palms in the area, and the plans presented to date did not reflect this. Chairman Seidler asked for comments from the applicant. MERVIN JOHNSON, 501 Golden Circle, Santa Ana, addressed the commission. He briefly reviewed past approvals and substantial changes which had been made to his plans. Staff's comments regarding the useable open space were well re- ceived. Mr. Johnson asked that the Commission consider the continuance of the tentative map and allow it to expire with the CUP if that was possible. This would allow him more time from a planning point of view to work out an improved development plan. Chairman Seidler advised that if the Commission were to accept Staff's recommendations and deny the extension, they would not be saying that they wished to discourage the applicant from proceeding with plans for development of this property. If the Commission was to approve the 12-month extension, he felt the approval would not mean a thing, due to the fact that there would be some changes in the City's Zoning Ordinance and Zoning Map which would not be reflected in this plan. Commissioner Van de Mark expressed her concern over the preservation of as many date trees as possible in that area in order to preserve the character of Palm Desert. Commissioner Mullins moved that Resolution No. 89 be approved with the deletion of finding #3, recommending denial to the City Council of this ex- tension. Plan proposed to discharge drainage water which now sheet flows across the property to be concentrated and discharged onto ad- joining private property near "M" Street and the proposed dedi- cated street along the. east boundary. I do not believe that should be permitted. 2. I recommend requiring curb and gutters on the 44th. Avenue frontage and also on the frontage on the proposed dedicated street along the east boundary. 3. Care should be exercised to insure against ponding or other nuisance. which may result from drainage discharge where the gutter ends at the east end of 44th. Avenue. If the subdivider is unable to record a final map within the 18 month period, he may file a request with the City Council for a one-year extension at least 20 days prior to the last City Council meeting prior to the expiration date. If he is unable to record a final map within the one-year extension, he may request a second extension of time by following this same procedure. The subdivider is advised by copy of this letter that the sale of any lots in a subdivision until such time as all conditions of the subdivision have been complied with and the subdivision has been recorded, is a violation of Section 11538 through 11540 of the Busi- ness and Professions Code. If the subdivider does any lot grading, he shall submit one reproducible brownline and four prints of a comprehensive grading plan to the Riverside County Surveyor's Office. The approve documents shall be recorded at the same time that the subdivision map is recorded. 8. A management company with the unqualified right to assess the owners of the Individual units for reasonable maintenance costs shall be established and continuously maintained. The management company shall have the right to lien the emits of the owners who default in the payment of their assessments. Such lien shall not be subordinate to any encumbrance other than a first deed of trust, provided such deed of trust is made in good faith and for value and Is of record prior to the lien of the management company,. 9. Provide easements for roadway slopes, drainage facilities, utilities, etc, and dedicate on the final map if within tract boundary. 10. in regard to flood control and water drainage, the following requirements shall apply: a. The interior drainage shall conform to the provisions of the "Compre- hensive Plan for Surface Water Drainage for Palm Desert", approved by the Board of Supervisors in 1968. Planned residential developments shall be constructed in accordance ith :the following standards: - (1) SUBDIVISION MAP. A subdivision map, based substantially upon the V/ approved conditional use permit, shall be recorded pursuant to Riverside County Ordinance-No. 460. (2) yl DENSITY. Not less than 4090 of the net area of a project shall be used for7_6Er__areajor open of recreational facilities. The net area of a project shall be determined by excluding all streets, drives and automobile storage areas. The total number of dwelling units in a project shall not exceed that which would be permitted in the zone in which the project is located. (3) YARD SETBACKS. Building setbacks from a project's exterior streets and boundary lines shall be the same as those prescribed by the zone in which the project is located. In no case shall such building setbacks for any project be -less than those prescribed in the R-3 Zone . (4) INTERIOR DRIVES. (a) Interior drives within a project, which are not part of the street system, shall be installed in accordance with County Road Improvement Standards, including concrete curb and gutters, except that such drives need not exceed the following widths: 24 feet where no parking is permitted on either side of the drive, 32 feet where parking. is permitted on only one side of the drive , 40 feet where parking is permitted on both sides of the drive. (b) • Cul-de-sac drives shall not exceed 400 feet in length and shall terminate with not less than a 35 foot radius turnaround. J (c) Interior drives shall not be permitted in any front yard setback area except for the driveway access to dwelling units. (5) RESIDENTIAL STRUCTURES. The number, of dwelling units in one building shall not exceed two in the R-1 Zone and all other zones that permit planned residential developments as an R-1 use , or eight dwelling units in one building in the R-2 and R-2-A Zones. The number of dwelling units in a building in the R-3 Zone and all other zones that permit planned residential developments as an R-3 use shall not exceed that permitted by the R-3 Zone development standards. Residential buildings shall have a minimum ground. floor area of 1000 square feet, exclusive of porches, patios and automobile storage areas. 2 - (b) RECREATIONAI, BUILDINGS. Recreational, public assembly and similar buildings may be permitted within a project if they are intended for the primary use of persons residing within the project and are located so as not to be detrimental to adjacent properties. (7) MAINTENANCE OF CO'L'2-10N AREAS. A community association with the unqualified right to assess the owners of the dwelling units for all maintenance , operational and other costs of the common areas and facilities and the community association shall be established and continuously maintained. The association shall have the right to lien the units of the owners who default in the payment of their assessments. The association's lien shall not be subordinate to any encumbrance other than a deed of trust or mortgage made in good faith and for value which is of record prior to the recordation of the lien of the association. Prior to recordation of the final sub- division map, the developer shall submit for approval the declaration of covenants, conditions and restrictions for the project. -The approved declaration shall be recorded at the time of the recording of the final subdivision map. (8) TRASH AREAS. Adequate enclosed trash pickup areas, convenient to the residents which they are intended to serve , shall be provided in the project. (9) SCREENING.. A six-foot high masonry wall shall be constructed on any project bounddry line where the adjacent property is zoned for a lower residential density than that zone in which the project is located. (10) WALM-MYS. Five-foot wide paved pedestrian walkways shall be installed between 'the dwelling units and the recreational areas of the project. (11) ACCESS. Vehicular access openings into a project shall be limited to one for each 400 feet of public street frontage ; however, all projects shall be permitted two access drives regardless of the amount of frontage . (12) PARYS NG. Automobile storage space shall be provided as required by Section 18.12 of this ordinance , except that in no event shall there be less than .asps provided entirely within the development for each dwelling unit. He did not have a copy but said that it was not significantly 0 different than the Preliminary General Plan which he sent us for 3 ' our use in setting compatible design parameters. - Rob presented a revised schematic character study of our proposed exhibits clarifying further the siting of dwelling units and-their o relationship to streets, greenbelt, and other units. D The ensuing discussion pointed up requirements we had not met, t' which were not called out in our copy of the Riverside County A Zoning Standards. Section 18.5 dated 3/24/71 and mailed to us at our request on 10/17/72 (see enclosed copy), and which significantly effect our designs. •1 Specifically, the most important requirement is a 10' minimum t set-back required between interior streets and garage.
