REQUEST: That the City Council approve a 12-month time extension of the tentative map for Tract 5795 in the Ironwood Country Club. II. STAFF RECOMMENDATION: That the City Council uphold the finding of the Planning .Commission and approve Resolution No. 76-2, subject to the attached conditions. Justificaiton is based upon: 1. The project does conform to existing and proposed development in the area. 2. The project does conform to the.. proposed Palm Desert Zoning Ordinance. and Subdivision Map Act. 3. The project does ensure the protection of the public health, safety, and general welfare. III. BACKGROUND: A. Location: South of Portola Avenue and east of Mariposa Drive B. Size: 11 acres C. No. of Units: 37 units D. Density: 3.36 dwelling units per acre E. Type of Units: This project will contain 37 condominium dwelling units in a cluster design with 2 or 3 units per structure. Architecturally they will be similar in size and design to those located in Tract 5554 on the west side of Mariposa. Colored elevations of the units will be provided at the meeting. F. EIR Finding: The provisions of CEQA have been complied with, and there has been no substantial change in either the project or the circumstances under which the project is ;to be undertaken. G. Existing Zoning: R-2-8000 H. Adjacent Zoning: R-2-8000 I. Proposed Zoning: PR-7 J. General Plan: The Palm Desert General Plan indicates this area to be potential medium density residential (5-7 du/ac. ) K. Parking: Each dwelling unit would have an .attached 2-car garage. Additional parking would be provided on the private streets. L. Previous Actions: Tentative Map approved by the City Council on June 27, 1974. Map will expire December 27, 1975. IV. DISCUSSION: In reviewing the request for the time extension, staff was particularly concerned with how well the tract map compared to the design standards contained in the proposed PR-7 zoning designation for this project. The staff has found that, with only some minor exceptions this project does comply. As shown i.n item K, the parking will be provided by a 2-car attached garage and on-sstreet=-parking en pri-4tte roads. The 50% common open space requirement has been achieved- ii=``� site, although the intent of the PR district requires that this figure should be calculated on the basis of the total development site. ,1/2/76 S'4aff Report Cont �d -2- Jovember 25, 1975 TRACT 5795 Most discrepancies occur >as the result of upgraded setback requirremeents. ments. Section 25. 14-7 requires a 32-foot setback from arterial streets, which is violated by unit 31. Section 25. 14-6.02 (7) requires a 20-foot separation between sides of buildings; this has become a problem in only 2 or 3 areas. In all these cases, the differences amount to only a few feet and could be solved by minor lot adjustments. A final area of concern with this tract involves the requirement of at least 320 square feet in separate private yard area adjacent to each dwelling unit. The design of all of the proposed units includes several private patio areas adjacent to each unit which provide the required yard area and which are fully or partially enclosed. The Planning Commission may wish to refer this matter to the Design Review Board for specific review. Colored elevations and floor plans will be available at the meeting if required. In summary, the staff review has not found any major discrepancies in the design of this tract that would conflict with the future zoning requirements. The existing problems are minor, easily resolved, and should not prevent the applicant from proceeding. r RESOLUTION NO. 76-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALL DESERT, CALIFORNIA, SETTINF FORTH ITS FINDINGS AND APPROVING A 12- MONTH TIME EXTENSION FOR A TENTATIVE MAP TO ALLOW FOR DEVELOPMENT OF A 37-UNIT PLANNED RESIDENTIAL DEVELOPMENT SUBDIVISION ON 11 ACRES OF LAND, GENERALLY LOCATED SOUTH OF PORTOLA AVENUE AND EAST OF MARIPOSA DRIVE. CASE NO. TRACT 5795. WHEREAS, the City Council of the City of Palm Desert did recieve a verified application from SILVER SPUR ASSOCIATES, requesting approval of a 12-month time extension of the tentative map for a planned residential development on 11 acres of -land, located in the R-2-8000 zone and situated south of Portola Avenue and east of Mariposa Drive, more particularly described as: a portion of the NE 1/4 of Section 32, Township 5 South, Range 6 East, SBB & M; and a portion of Lot B, Tract 4685 WHEREAS, said application had complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that an Environmental Assessment form was submitted and a Negative Declaration was made by the Director of Environmental Services on November 21 , 1975, and the appeal period has .expired; and -- WHEREAS, the City.Council did take into consideration the Tentative Map as .submitted; and the reports of the various reviewing agencies; and WHEREAS, the City Council did find that the subject Tentative Map does substantially comply with the City of Palm Desert Code (County Ordinance Number 460) , and the State of California Subdivision Map Act, as amended; and WHEREAS, the City Council did find that the subject Tentative Map does comply with the adopted General Plan; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert as follows:' (1 ) that the above recitations are true and correct and constitute the findings of the Council in this case; (2) that it does hereby approve the above described Tentative Map No. 5795, subject to ful- fillment of the attached conditions. All improvements shall conform with County Subdivision Standards Schedule A unless modified by these conditions. 2. All street improvements shall be designed and constructed- in conformance with Riverside County Road Improvement Standards. a. Interior drives shall. not be dedicated. 'b. Curb, gutter and tie-in paving shall be installed along Mariposa Drive at a grade and alignment subject to approval by the County Road Commissioner. 3. If the subdivider does any lot grading, he shall submit one reproducible brownline and four prints of a comprehensive grading plan to the Riverside County Surveyor's :--.Office. Prints of the grading plan will subsequently be transmitted from the Surveyor's Office to the Flood Control District and Department of Building and Safety for review and approval and shall be in compliance with the Uniform Building Code, Chapter 70, as amended by Ordinance 457. 4. The subdivider shall submit for approval a soils report for stability and geological study to the Riverside County Surveyor's Office prior to recordation of the final map. 5. Street names for the proposed subdivision shall be subject to approval by the Director of Environmental Services. 6. A water and sewer system shall be installed in accordance with the provisions set forth in the Riverside County Health Department letter dated May 13, 1974, a copy of which is enclosed. 7. Prior to recordation of the final subdivision map, the applicant shall submit to the Commission the following documents which shall demonstrate to the satisfaction of -the Commission that the total project will be developed and maintained in accord- ance with the intent and purpose of the approval : a. The document to convey title. b. Covenants and restrictions to be recorded. c.` Management and maintenance agreement .to be entered into with the owners of the units of the project. 8. The approved documents shall be recorded at the same time that the subdivision -map is recorded. 1. A management company with the unqualified right to. assess the owners of the individual units for reasonable maintenance costs shall be established and :continuously maintained. The management company shall have the right to lien the units of the owners who default in the payment of their assessments. Such lien shall not be subordinate to any encumbrance other than a first deed of .trust provided such deed of trust is made in good faith and for value and is of record prior to the lien of the management company. 10. Provide easements for roadway slopes, drainage facilities; utilities, etc. and dedicate on the final map if within tract boundary. 11 . In regard to flood control protection, the Coachella Valley County Water District letter dated May 8, 1974 shall apply. '12. ' In regard to fire protection, requirements of CUP 1382 shall apply. In order to provide reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with .required fire flows shall . be installed as recommended by the County Fire Department. 15.1 The improvement plans to be submitted shall reflect this information shown on this tentative map and shall also show the following: a. Grading quantities in excess of 300 yards are normal for projects of this size and type. Dust and noise may normally be expected during the grading and construction phase of construction projects of this size and type. Construction related nuisances to adjacent residents will generally be confined to those new residences within previously constructed units of the project. The nearest residences to. the north are separated by approximately 300 feet from the construction areas. Permits for use and/or construction will be acquired from all public agencies normally required for processing of subdivisions. Construction of the .project will include the extension of Portola Avenue westerly to Silver Spur Trail , thus providing a continuous paved traffic lane from Highway 74 to the developed area of Palm Desert via Portola Avenue. Project re-sidents will likely make use of electric golf carts within the project, which includes golf course facilities. No dune buggies, .trail bikes, and the like are anticipated within the. project.
