Request: That the Planning Commission recommend to the City Council. approval of the tentative tract map for a 96-unit tract of single family residences. II. Staff Recommendation: That it be moved by Resolution No. that the Planning Commission approve the tentative map subject to the attached conditions. Justification is based upon: 1. Conformance of the proposed development to all requirements of the Zoning Ordinance and General Plan. 2 . The proposed development does insure the protection of the public health, safety, and general welfare. 3. Compatibility of the proposed development to the existing and proposed development in the area. III. Background: A. Description - Portion of NZ of NW4 of Section 21, Township 5 South, Range 6E, SBB&M. B. Location - West side of Deep Canyon Road, approxi- mately 340 feet south of Avenue 44 . C. Size - 28. 3 acres (26 . 8 acres residential and 1. 5 acres park) . D. Total No. of Units - 96 single-family residences. E. Density - 3. 58dwelling unit/acre (excluding park site) . F. EIR Finding - This project was reviewed under the Environmental Assessment Review form, resulting in a finding of Negative Declaration - that the project would not have a signi-ficant effect upon the en- vironment. The appeal period has expired and no further EIR considerations are required. G. Existing Zoning - R--1 H. Adjacent Zoning - North - R-1 South - R-1 East - R-1 - 10, 000 West - R-1 I. General Plan Commitment - The. Cove Communities General Plan indicates the 'property to be potential low density residential (3-5 dwelling units per acre) . This development conforms to this designation. J. Utilities - Gas - Southern California Gas Electric - Southern California Edison Water - Palm Desert Community Services District Sewage - Coachella Valley County Water District Telephone - General Telephone K. Previous Actions - None IV. Discussion of Tentative Map Elements The subject 'tract encompasses 28 . 3 acres of land with a frontage of 950 feet on Deep Canyon Road and extending 1296 feet. westerly. The site" is 343 feet south of Avenue 44 . Immediately to the north is an existing tract of single-family homes. South of the project are also located single-family residences , namely Palma Village Unit No. 9 and other units, which extend as far south as State Highway 111 . There is a date grove from the west boundary of the site to Portola Avenue. The land on the east side of. Deep Canyon Road is almost exclusively date grove. The project site itself is a date grove consisting of 1 ,380 trees. The land has no other distinguishing natural or man-made features , including historical or archaeological sites. There are no rare or endangered species of plant life, nor any en- dangered fish or wildlife in the area. The parcel would be a Class "A" subdivision divided into 96 lots with an average size of 9, 000 square feet. Access to lots within the project would be provided by approximately 4 , 200 lineal feet of interior road system, , which would be dedicated to the City. The 950 feet of Deep Canyon Road which front the property will be expanded to a half-width right-of-way of 44 feet, with curb, gutter, and tie-in paving at 32 feet from centerline of 'road. The various responsible agencies have agreed to provide the necessary utility service to the project. All utilities will be underground. An existing water line already runs along Deep Canyon Road and therefore only connecting lines would be needed . A gas main is within 75 feet of the project boundary and could easily be extended. A sewer main has been installed "along Avenue 44 and this line would have to be brought down to the project, which is approximately a distance of " 340 feet. It is anticipated that the homes built in this development will add 220 children of differing school ages to the community. The school district has not indicated that this would place an undue burden on their facilities. Applicant has indicated that a 'minimum of 35% of the date trees would remain on the site even after construction. Those that must be removed will be offered to various local civic organizations for re-planting in other areas. As part of the conditions for approval, the applicant has offered to dedicate to the City a 1. 5 acre park, situated on Deep Canyon Road, which would be equipped with 2 tennis courts. TRACT NO. 6197 1. All improvements shall conform with County Subdivision Standards Schedule A unless modified by these conditions. 2. a. All street improvements shall be designed and constructed in conformance with Riverside County Road Improvement Standards. 1) Deep Canyon Road shall be dedicated and improved to County Road De- partment Standards on the basis of a 44 foot half-width right-of-way for the full length of subject property. b. 1) In dip sections, culverts of adequate size to accommodate the 10- year storm shall be installed. In dip sections where runoff ex- ceeding the 10-year storm is permitted to overtop the roadway Port- land cement concrete paving shall be constructed with adequate slope protection to accommodate the 100-year storm. 2) Standard cul-dejsacs and knuckles shall be constructed throughout the subdivision. 3) Corner cut backs shall be shown on the final map. 3. If the subdivider does any lot grading he shall submit one reproducible brownline and four prints of a comprehensive grading plan to the Riverside County Surveyor's Office. Prints of the grading plan will subsequently be transmitted from the Surveyor's Office to the Flood Control District and Department of Building and Safety for review and approval and shall be in compliance with the Uniform Building Code, Chapter 70, as amended by Ordin- ance 457. 4. The subdivider shall submit for approval a sails report for stability and geological study to the Riverside County Surveyor's Office, prior to re- cordation of the final map, unless waived by the Director of Environmental Services. 5. Street names for the proposed subdivision shall be subject to approval by the :City`REngineer-.wand==the:'DVi-rector of Environmental Services.. 6. A water and sewer system' (and domestic sewage disposal for individual lots) shall be installed in accordance with the provisions set forth in the River- side County Health Department letters dated August 2 and August 19, 1974, copies of which are enclosed. 7. Prior to recordation .of the final subdivision map the applicant shall sub- mit to the Commission the following documents which shall demonstrate to the satisfaction of the Commission that the total project will be developed and maintained in accordance with the intent and purposes of the approval: a. The document to convey title. b. Covenants and restrictions to be recorded. The approved documents shall be recorded at the same time that the subdivi- sion map is recorded. 8. Provide':,;easements for roadway slopes, drainage facilities, utilities, etc. , and dedicate on the final map if within tract boundary. 9. In regard to flood control protection, the following requirements as out- lined in the C.V.C.W.D. letter dated August 9, 1974 shall apply (see attached copy) 3 10. The subdivider shall provide Schedule "A" fire protection. The California Division of Forestry shall review and approve the water plan map relative to location, setting, spacing and installation of fire hydrants prior to recordation of the final subdivision map. TRACT NO. 6197 -2- 11. An application shall be processed through L.A.F.C. for a new County Service Area or for annexation to an existing service area if street lighting is required. 12. Pursuant to City Council approval, the applicant shall dedicate the 1.5 acre park indicated on the tentative map to the City. Park shall be com- pleted with all street improvements and with two tennis courts installed in a manner acceptable to the Director of Environmental Services. Such improvements shall be made a part of construction and shall be completed before the issuance of any Certificate_o'f Occupancy. If the park site is not accepted by the City Council, the lots shall be recorded as shown on the tentative map. 13. All interior streets and road rights-of-way shall be dedicated to the City and improved according to County of Riverside Road Department Standards. 14. All requirements of any applicable law, ordinance, or regulation of the State of California, City of Palm Desert, and any other applicable govern- mental entity shall be complied with as a part of construction. Tract 6197 WHEREAS, the Planning Commission of the City of Palm Desert, did receive a verified application from Bell and Nussbaum requesting approval of a 96-unit single-family tract subdivision on 28 . 3 acres of land, located in the R-1 zone and situated on the west of Deep Canyon Road and 343 feet south of Avenue 44 , more particularly described as: A portion of the N z of the NW 4 of Section 21, Township 5 South, Range 6 Ease, S.B.B. & M. Comments received from these organizations, plus field investigations by the Planning Division staff, indicate that the proposed project would not have a significant effect on the environment if implemented as shown on the plan. Justification: Tract would be in an area generally surrounded by existing residential development and shown as potential residential on the General Plan. At least 35% of the trees from the ekisting date grove will remain on-site; while the rest will be offered to local civic organizations for replanting elsewhere. Previous Actions - None IV. Discussion of Tentative Map Elements The subject tract encompasses 28. 3 acres of land with a frontage of 950 feet on Deep Canyon Road and extending 1296 feet westerly. The site is 343 feet south of Avenue 44 . immediately to the north is an existing tract of single-family homes. South of the project are also located single-family residences, namely Palma Village Unit No. 9 and other units, which extend as far south as State Highway 111. There is a date grove from the west boundary of the site to Portola Avenue. The land on the east side of Deep Canyon Road is almost exclusively date grove. The project site itself is a date grove consisting of 1,380 trees. The land has no other, distinguishing natural or man-made features, including historical or archaeological sites. There are no rare or endangered species of plant life, nor any en- dangered fish or wildlife in the area. The parcel would be a Class "A"subdivision divided into 96 lots with an average size of 9, 000 square feet. Access to lots within the project would be provided by approximately 4 , 200 lineal feet of interior road system, which would be dedicated to the City. The 950 feet of Deep Canyon Road which front the property will be expanded to a half-width right-of-way of 44 feet, with curb, gutter, and tie-in paving at 32 feet from centerline of road. The various responsible agencies have agreed to provide the necessary utility service to the project. All utilities will be underground. An existing water line already runs along Deep Canyon .Road and therefore only connecting lines would be needed. A gas main is within 75 feet of the project boundary and could easily be extended. A sewer main has been installed along Avenue 44 and this line would have to be brought down to the project, which is approximately a distance of 340 feet. It is anticipated that the homes built in this development will add 220 children of differing school ages to the community. The school district has not indicated that this would place an undue burden on their facilities . Applicant has indicated that a minimum of 350 of the date trees would remain on the site even after construction. Those that must be removed will be offered to various local civic organizations for re-planting in other areas. As part of the conditions for approval, the applicant has offered to dedicate to the City a 1. 5 acre park, situated on Deep Canyon Road, which would be equipped with 2 tennis courts.
