SEES. THE BOARD OF GOVERNORS HAS THE RIGHT TO LEVY ASSESSMENTS AGAINST YOU
FOR MAINTENANCE OF THE COMMON AREAS AND OTHER PURPOSES. YOUR CONTROL OF

ADJOINING THE MARRAKESH RESIDENTIAL COMMUNITY. SUCH PRIVILEGES MAY BE OB-
TAINED ONLY THROUGH MEMBERSHIP APPLICATION TO MARRAKESH COUNTRY CLUB AND PAY-
MENT OF THE THEN CURRENT MEMBERSHIP FEE, AND THE PRIVILEGES OF SUCH MEMBER-
SHIP ARE SUBJECT TO THE PROVISIONS OF THE CLUB'S BYLAWS, RULES AND REGULA-

The subdivider has made financial arrangements in the form of a bond ($22, 180) to
assure completion of the common facilities. A list of the common area facilities and
the estimated completion date is set forth in the Planned Construction Statement
attached to the Bond.
MANAGEMENT AND OPERATION: The Board of Governors manages and operates the common areas
in accordance with the Restrictions.
MAINTENANCE AND OPERATIONAL EXPENSES: The subdivider has submitted a budget for the
maintenance and operation of the common areas. You should obtain a copy of this
budget from the subdivider. Under this budget, the monthly assessment against each
subdivision lot will be $140.00.
IF THE BUDGET FURNISHED TO YOU BY THE DEVELOPER SHOWS A MONTHLY ASSESSMENT
FIGURE WHICH VARIES 10% OR MORE FROM THE ASSESSMENT AMOUNT SHOWN IN THIS
PUBLIC REPORT, YOU SHOULD CONTACT THE DEPARTMENT OF REAL ESTATE BEFORE
ENTERING INTO AN AGREEMENT TO PURCHASE.
The association may increase or decrease assessments at any time in accordance with
the procedure prescribed in the CC&R's or Bylaws. In considering the advisability of
a decrease in assessments, care should be taken not to eliminate amounts attributable
to reserves for replacement or major maintenance.
THE INFORMATION INCLUDED IN THIS PUBLIC REPORT IS APPLICABLE AS OF THE
DATE OF ISSUANCE. EXPENSES OF OPERATION ARE DIFFICULT TO PREDICT
ACCURATELY AND EVEN IF ACCURATELY ESTIMATED INITIALLY, MOST EXPENSES
INCREASE WITH THE AGE OF FAVILITIES AND WITH INCREASES IN THE COST OF
LIVING.
Monthly assessments will commence on all lots (numbers 1 through 24) on the first day
of the month after the first assignment of a sublease of a lot. From that time, the
subdivider is required to pay the association a monthly assessment for each lot which
he owns.
The remedies available to the association against owners who are delinquent in the
payment of assessments are set forth in the CC&R's. These remedies are available
against the subdivider as well as against other owners. The subdivider has posted a
bond as partial security for his obligation to pay these assessments. The governing
body of the association should assure itself that the subdivider has satisfied his
obligation to the association with respect to the payment of assessments before
agreeing to a release or exoneration of the security.
EASEMENTS: Easements for utilities and other purposes are shown on the title report.
RESTRICTIONS: This subdivision is subject to restrictions recorded in the Office of
the Riversf-de County Recorder, December 15, 1976, as Instrument No. 192513, which
include, among other provisions, the following:
Each residential lot shall be improved, used and occupied only for private, single-
family dwelling purposes.
Not exceeding two (2) dock, cats or other usual and ordinary household pets may be
kept on any residential lot, provided that such pets shall not be allowed on the
common area except as may be permitted by rules made by the Board of Governors. Except as

herinabove provided, no animals, livestock, birds or poultry shall be brought within the
community or kept on any lot thereof.
No residential lot shall be used in such manner as to obstruct or interfere with the
enjoyment of occupants of other residential lots or annoy them by unreasonable noises
or otherwise, nor shall any nuisance, or immoral or illegal activity be committed or
permitted to occur on any residential lot.
No external antenna for the reception or transmission of radio or television signals
shall be erected or maintained on any residential lot or on the common area.
No laundry, bedding, garment or other items of like nature shall be hung on any resi-
dential lot so as to be visible from another residential lot or from the common area.
No signs shall be erected or displayed on any residential lot except house numbering
devices and signs giving notice that the property is for sale or for lease, which de-
vices and signs shall be approved as to size, style and location by the architectural
committee.
TAX ESTIMATES: (For leasehold interests.) If the subdivider is unable to give you
the current tax information, you may approximate your taxes as follows:
TAKE 25% OF THE SALES PRICE, PLUS 25% OF YOUR POSSESSORY INTEREST*
DIVIDE THE TOTAL BY 100, AND THEN MULTIPLY BY THE TOTAL TAX RATE.
THE TAX RATE FOR THE 1976/77 FISCAL YEAR IS $11 . 160. THE TAX RATE
AND ASSESSED VALUATION MAY CHANCE IN SUBSEQUENT YEARS. FOR EXAMPLE,
.ANY BONDED DEBT OR SPECIAL DISTRICT ASSESSMENT APPROVED AFTER THE
ABOVE TAX RATE HAD BEEN SET COULD INCREASE THE FUTURE RATE.
*NOTE: To calculate your possessory interest, multiply your yearly land .lease payment
by 12-112.
CONDITIONS OF SALE: If your purchase involves financing, a form of deed of trust and
note will be used. These documents contain the following provisions:
An acceleration clause. This means that if you sell or further encumber the property,
the lender may declare the entire unpaid loan balance immediatley due and payable.
A prepayment Penalty. This means that if you wish to pay off your loan in whole oi• in
part before it is due, you may be required to pay an additional amount as a penalty in
accordance with the terms of the loan.
A late ch argre. This means that if you are late in making your monthly loan payment,
you may_have to pay an additional amount as a penalty.
Transfer of the interest to the purchaser will be by sublease. Your rights and respon-
sibilities are governed by the specific terms of such sublease. You should read the
entire sublease. The sublease includes the following provisions:
You cannot encumber your interest without the written approval of the subdivider. This
consent shall not be withheld as to any encumbrances which are reasonable in relation
to the value of your interest, does not bear a rate of interest which is unreasonable in
relation to the interest rates prevailing as to similar loans and is to be amortized
over a period which is reasonable in relation to the expected life of the improvements
on the leased premises.

If you assign or transfer your sublease, ,you must follow the approved sublease form and
pay a transfer fee of $50.
On July 5, 1979, and at five year intervals thereafter, rent shall be adjusted so as
to directly reflect, when compared with the original rent, the percentage increase or
decrease in the United States Department or Labor Consumer Price Index during the
period which has elapsed since the commencement of the lase, provided that in no event
shall the rent be reduced below the original amount.
All buildings and improvements, excluding removable personal property, on the leased
premises shall remain on the property after the termination of the lease and shall
become the property on the lessor.
PURCHASE MONEY HANDLING: The subdivider must impound all funds received from you in
an escrow depository until leasehold interest is delivered to you. (Refer to Sections
11013, 11013.2(a) ,Business and Professions Code.)
If the escrow has not closed on your lot within twelve ( 12) months of the date of your
deposit receipt, you may request return of your deposit.
GEOLOGIC CONDITIONS: THE UNIFORM .BUILDING CODE, CHAPTER 70, PROVIDES FOR LOCAL BUILDING
OFFICIALS TO EXERCISE PREVENTIVE MEASURES DURING GRADING TO ELIMINATE OR MINIMIZE
DAMAGE FROM GEOLOGIC HAZARDS SUCH AS LANDSLIDES, FAULT MOVEMENTS, EARTHQUAKE SHAKING,
RAPID EROSION OR SUBSIDENCE. THIS SUBDIVISION IS LOCATED IN AN AREA WHERE SOME OF
THESE HAZARDS MAY EXIST. SOME C.ALIFORNIA COUNTIES AND CITIES HAVE ADOPTED ORDINANCES
THAT MAY OR MAY NOT BE AS EFFECTIVE IN THE CONTROL OF GRADING AND SITE PREPARATION.
PURCHASERS SHOULD DISCUSS WITH THE DEVELOPER, THE DEVELOPER'S ENGINEER, THE ENGINEERING
GEOLOGIST, AND THE LOCAL BUILDING OFFICIALS TO DETERMINE IF THE ABOVE-MENTIONED HAZPrDS
HAVE BEEN CONSIDERED AND IF THERE HAS BEEN ADEQUATE COMPLIANCE WITH CHAPTER 70 OR AN
EQUIVALENT OR MORE STRINGENT GRADING ORDINANCE DURING THE CONSTRUCTION OF THIS SUBDI-
VISION.
FLOOD AND DRAINAGE: The Coachella Valley County Water District advises that this tract
lies on the Dead Indian Canyon and Deep Canyon debris cone. This area is protected from
storm water flows by a system of channels anddikes built and maintained by this district.
This tract may be considered safe from stormwater flows except in rare instances.
FIRE PROTECTION: Palm Desert County Fire Station will respond with about a six minute
response with two engines and the engines from the City of Palm Desert. Second engines
will arrive from Rancho Mirage with an approximate response time of 12 minutes.
SEWAGE DISPOSAL_ Lots will be subject to a monthly sewer service charge of $5 per lot.
STREETS AND ROADS: The streets within this subdivision are private. The residential
sublease to be used provides that the subdivider will maintain the access road easement
and will provide gate control. There is no assurance that such gate control will be
provided.
Purchasers will be billed by the subdivider for an equal share of expenses for gate
control and road maintenance with each purchaser's share not to exceed 1/400 of the
expenses. Based on current costs, each purchaser's share would be approximately $8.50
per month.

PUBLIC TRANSPORTATION: Regularly scheduled public transportation service is not avail-
able.
SCHOOLS: The Desert Sands Unified School District advises that the location and dis-
tance from the most distant lot in the tract to the nearest schools serving this tract
are as follows:
George Washington Elementary (K-2) , 45-768 Portola, Palm Desert, 0.7 mile;
Abraham Lincoln Intermediate (3-5) , 74-100 Rutledge Way, Palm Desert, 2
miles;
Palm Desert Middle (6-8) , 74-100 Rutledge Way, Palm Desert, 2 miles;
Indio High (9-12) , 81-750 Avenue 46, Indio, 10.4 miles.
Free bus service is available to the aforementioned schools.
NOTE: This school information was provided by the school district prior to issuance of
the public report. Purchasers may contact the local school district offices for any
changes in school assignments, facilities and bus service.
SHOPPING FACILITIES: Shopping facilities are approximately one mile from the subdivision
in downtown Palm Desert.

Gentlemen:
Some months ago you subleased to us the Marrakesh golf course
and club house as well as the maintenance yard lying at the
northeast corner of the Marrakesh Development (being the acre
or two at the southwest corner of Grapevine -and Portola).
In connection with your efforts to obtain approval by the City
of Palm Desert of the final Marrakesh tract, we wrote the City
M a letter dated arch 24, 1977, a copy of which is enclosed.
You have informed us that the City continues to insist that you
complete a drainage ditch along the westerly boundary of the
Marrakesh property, which ditch will debauch its contents on to a new
street (Amir Drive) parallel to Grapevine and thence on to Marra-
kesh Drive. We further understand that the City proposes to require
that a high curbing (15" to 18") be placed starting at the westerly boundary
of Marrakesh and running easterly along the entire length of the
northerly boundary of the Marrakesh Development to the boundary
of the maintenance yard we acquired from you.
It is obvious that these actions will have two effects, (1) they will
materially alter the natural flow of water across the Marrakesh

property, and (2) the water flowing down hill from properties
lying to the south and west of Marrakesh will be channeled
directly onto our maintenance yard.
We hereby formally object to your taking any action which will
have the effect of increasing the flow of surface water over our
maintenance yard. We demand that no such action be taken.
We do not consent to your entering onto the maintenance yard
property for any purpose connected with this drainage problem.
Should you wish, we are willing to discuss with you the possibility
of granting you an easement across our property for a pipeline.
We are sending a copy of this letter to the City of Palm Desert,
accompanited by a further copy of our letter to it dated March 24,
1977. The City i s advised that we continue-to -adhere to the position
stated in our earlier letter.

The undersigned last October purchased from the developers
. . of "Marrakesh" the golf course, the clubhouse, the maintenance.'

We understand that over the objection of the permit appli-
cant the City of Palm Desert proposed to require installation
.of drainage facilities which will alter the natural flow coming
onto Marrakesh of surface water from the south and west across
the Marrakesh property. We further understand that these.
proposals will have the effect of channeling such surface:waters
from properties lying south and particularly west of Marrakesh
directly onto the maintenance yard owned by the undersigned.
;This is to advise you that we object to any condition imposed by
_.; the .City which will have the effect of increasing the exposure
.of our maintenance yard to increased flow of surface water.
This letter will constitute formal notice to you that if our
maintenance yard property sustains damage by reason of the
drainage changes imposed by the City , we shall look to the City
of Palm Desert and its representatives to make good any losses
so sustained by the undersigned.

This tract has been completed except for the approval of the

been completed and I therefore recommend that we exonerate
the bonds.

WHEREAS, the City Council of the City of Palm Desert, California, did
receive a verified application from MARRAKESH LEASEHOLD CORPORATION, requesting
a 12-month extension on a portion of a 100-unit condominium project on 27 acres
of land, located in the PR-3 zone and situated north of Haystack Road on the
west side of Portola Avenue; and,
WHEREAS, said application was exempt from the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution Number 74-14", in that
the project was initiated prior to the effective date of the California Environ-
mental Quality Act and is therefore considered to be exempt as an ongoing pro-
ject; and,
WHEREAS, substantial construction has occurred on the project; and,
WHEREAS, the City Council did find that the subject Tentative Map does
substantially comply with the applicable City of Palm Desert Ordinances and the
State,,of California Subdivision Map Act, as amended; and,
WHEREAS, the C.ity Council.. did find that the subject Tentative Map does
comply with the adopted General Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert as follows:
1. That the above recitations are true and correct .and constitute the
findings of the Council in this case;
2. That it does hereby approve said extension of the above described

I am sorry for the delay in answering your letter, but I was on
vacation.
This past week I personally investigated the areas of concern to you
and found the following:
1. Grass cut-tin.gs .- the homeowners on Haystack Road are dumping their
cuttings across .the street. Any cuttings that we do in that area are
put on a truck and taken to the dump.
Z. Broken concrete and dirt - this is from one of the homeowners on
Haystack Road. If we had done it, it would have gone to the dump.
3. Asphalt - I understand that Coachella Valley Water District repaired
a water line. They are responsible for the debris.
I would suggest that to avoid other situations like this, that you contact
the homeowners directly, telling them that the property belongs to Marrakesh.
For this purpose, I have included a list of those who purchased the property
from .us. On any new sales in your area, we will inform them.

RESOLUTION NO. 75-79
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, ACCEPTING FINAL SUBDIVISION MAP OF TRACT NO. 6229-1
AND APPROVING AGREEMENTS RELATING THERETO. CASE NO. TRACT NO. 6229-1 .
WHEREAS, there has been submitted a final subdivision map of Tract
No. 6229-1 for property located within the City of Palm Desert, California
which complies with the requirements of Ordinance No. 1 of the City of Palm
Desert, California.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Palm Desert as follows
1 . That the final subdivision map of Tract No. 6229-1 in the City
of Palm Desert; California, be and the same is hereby approved as the official
subdivision map of said Tract No. 6229-1 , and the streets and public utility
easements, if any, as shown thereon, are accepted as public streets and public
utility easements.
2. The City Clerk, upon receipt of the fully executed agreements
hereinafter referred to, together with the bonds hereinafter referred to, is
hereby authorized and directed to attest to said map by signing his name
thereto as City Clerk of the City of Palm Desert; and to affix the official
seal of the City thereto.
3. That the certain agreement respecting the improvement of the
water system and surety bonds for the .faithful performance of said agreement
in the sum of $48,000, and surety bond in the sum of $48,000 securing payment
to contractor, his subcontractors and to persons renting equipment or furnishing
labor or materials, are hereby approved.
4. That certain agreement relating to the extension of sewer lines,
and surety bond for the faithful performance of said agreement in the sum of
$28,500, and surety bond in the sum of $28,500 securing payment to contractor,
his subcontractors and to persons renting equipment or furnishing labor or
materials, are hereby approved.
Al 5. That the certain agreement respecting the installation of survey
monuments and surety bonds for the faithful performance of said agreement in
the sum of $2,400 as attached.

6. That the certain agreement respecting the payment of all taxes
and assessments in the amount of $3,200 and a surety bond in the sum of $3,200

I. REQUEST: That the Planning Commission approve a revision to the previously
approved tentative map for the final portion of the Marrakesh planned
residential development. The original map was approved October 16, 1974
and' indicat`-ed that the 100 unit. project would be constructed in two phases,
units 1-18 in Phase I and 19-100 in Phase II. The revised map shows the
project constructed in four phases. No other changes have been made in
the map.
II. STAFF RECOMENDATIONS: That it be moved by Resolution No. 48 that the
Planning Commission recommend to the City Council the approval of the
revised tentative map subject to the attached conditions.
III. DISCUSSION OF MAP REVISION: The only effective change that would occur
from the approval of the revised map would be the change in the number
of phases in which this project shall be completed. Pursuant to Section
4.10 of the Subdivision Ordinance, this approval would annul the previous
map, but would not extend the time within which the final map must be
filed. All previous conditions of approval have been included.

Mr. Dawson stated he expected to bring in sewer service, but
wanted to know if he read Condition No. 11 correctly.
Mr. Williams stated that we were really referring to Condi-
tion No. 7.
Mr. Hamerschlag stated that he would discuss this requirement

Dear Mr. Williams:
Subsequent to our meeting regarding certain proposed conditions
of approval of the subject map, I discussed same with Mr. Daw-
son and Mr. Jones of Marrakesh Country Club,
It was a concensus of opinion that Marrakesh should make all
reasonable provisions to impound nuisance drainage water gener-
ated within the project to minimize its effect downstream and
particularly on Portola Avenue north of Grapevine.
With that in mind, and rather than expend money on,streets front-.
ing other property, it is proposed that we construct a dry well,
to intercept the minor flows from Maxrakesh, Drive at the existing
discharge point on Grapevine, and, if a need is evidenced, another
interceptor on Portola, north of Grapevine. In the latter case,
we propose to conduct a witnessed test of the sprinkler systems
that might cause excess water to discharge onto Portola at our
main entrance.
With regard to the undergrounding of the existing power lines
west of our property line, it is our contention that such a re-
quirement would be onerous and beyond the requirements of exist-
ing regulations. All the proposed units in our development along
the west line face the golf course and, in the opinion of our sales
personnel, will not be affected the the continued existence of the
pole line. We request that any reference to undergrounding these
lines be omitted when the conditions of approval axe finalized.
I am enclosing a copy of a letter from the Edison Company which
has scared us,as you may well believe.

Dear Mr. Williams:
Thank you for the opportunity to comment on the tentative map for
Tract No . 6229 . We have the following comments to offer for your
consideration.
Although this proposed development is removed from the existing
state highway, the impact of the development on transportation
facilities should be assessed. The major access to this area is
provided by State Highway Route 74 and Route 111 which are
operating at approximately 50% and 80% of their respective
capacities .
The impact of this individual development on transportation may
be insignificant; however, consideration should be given to the
cumulative impact of future higher densities which could result
in congestion on the highways serving this area. Our ability to
react and provide improvements as a response to congestion is
quite limited. Major improvement of this route, if required,
may not be possible in a timely manner.

WHEREAS, the Planning Commission of the City of Palm Desert, did receive a

PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS
AND RECOMMENDING TO THE CITY COUNCIL, APPROVAL, OF A TEN-
TATIVE MAP TO ALLOW A 100-UNIT PLANNED RESIDENTIAL
DEVELOPMENT BY TIIE MARRAKESH BUILDING AND COUNTRY CLUB
ON 27 ACRES-OF-LAND, GE ERALLY LOCATED WEST OF PORTOLA,
SOUTH OF GRAPEVINE STREET, AND NORTH OF HAYSTACK ROAD.

WHEREAS , the Planning Commission of the City of Palm Desert ,
did. receive a verified application from MARRAKESH BUILDING AND
COUNTRY' CLUB, requesting; approval of a tentative map for 'a 100-
unit planned residential development on 27 acres of land, located
in the R=1-10, 000 zone and situated west of Portola, south of
Grapevine, and north of Haystack, more particularly described as :
a portion of the SW4 of the NE4 and the
NW4 of the SE4 of Section 29, T5S , R6E ,

WHEREAS, said application had .complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure
Resolution Number 74-14" , in that the project was initiated prior
to the effective date of the California Environmental Quality
Act and is therefore considered to. be exempt as an on-going pro-
ject , and;
WHEREAS, the Planning Commission did take into consider-

various reviewing agencies , and;
WHEREAS, the Planning Commission did find that the subject
Tentative Map does substantially comply with the City of Palm
Desert Code (County Ordinance Number 460) , and the State of
California Subdivision Map Act , as amended;
WHEREAS, the Planning Commission did find that the subject
Tentative Map does comply with the adopted General Plan , and;
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission
of the City of Palm Desert as follows :

CONDITIONS OF APPROVAL
TRACT NO. 6229
1. All improvements shall conform with County Subdivision Stan-
dards Schedule A unless modified by these conditions.
2. a) All street improvements shall_ be designed and constructed
in conformance with Riverside County Road Improvement
Standards.
1) Interior drives shall be platted as driveway ease-
ments ,
2) Improvements shall be required as approved by amended
Variance No. 948 .
b) Other street improvements and requirements shall be as
follows:
1) Haystack Road shall be improved with match-up asphalt
concrete paving and concrete curb -and gutter located
32 feet from the centerline within a 44-foot half-
width dedicated right-of-way , for the full frontage
of the subject property.
2) Lot access shall be restricted on Portola Avenue and
Grapevine Street and so noted on the final map.
3) Corner cutbacks shall be shown on the final map .
3. If the subdivider does any lot grading he shall submit one
reproducible brownline and four prints of a comprehensive,
grading plan to the Riverside County Surveyor' s Office.
Prints of the grading plan will subsequently be transmitted
from the Surveyor' s Office to the Flood Control District and
Division of Building & Safety for review and approval and shall
be in compliance with the Uniform Building Code, Chapter 70, as
amended by Ordinance No. 457 .
4. The subdivider shall submit for approval a soils report for
stability and geological study to the Riverside County Sur-
veyor' s Office prior to recordation of the final map.
5. Street names for the proposed subdivision shall be subject
to approval by the County Road Commissioner and Director of
Environmental Services .
6. A water and sewer system shall be installed in accordance
with the provisions set forth in the Riverside County Health
Department, letter dated August 29, 1974, a copy of which is
enclosed.
7. Prior . to recordation of the final subdivision map, the appli-
cant shall submit to the Commission the following documents
which shall demonstrate to the satisfaction of the Commission
that the total project will be developed and maintained in ac-
cordance with the intent and purposes of the approval:
a. The document to convey title.
b. Covenants and restrictions to be_ recorded.
C. Management and maintenance agreement to be entered into
with the owners of the units of the project .
8. The approved documents shall_ be recorded at the same time that
the subdivision map is recorded.
9. A home owners association with the unqualified right to assess
the owners of the individual units for reasonable maintenance
costs shall be established and 'continuously maintained. The

management company shall have the' right to Lien the units of
the owners who default in the payment of their assessments. Such
lien shall not be subordinate to any encumbrance other than a
first deed of trust provided such deed of trust is made in good
faith and for value and is of record prior to the lien of the

. 10. In regard to flood control protection and sewer service, the
following requirements as outlined in the Coachella Valley
County Water District letter, dated September 19, 1974 , shall
apply:
a. Area shall be annexed to Improvement Districts No. 54
and 80 of the Coachella Valley County Water District for
sanitation service .
b. The interior drainage shall conform to the provisions of
the "Comprehensive Plan for Surface Water Drainage for
Palm Desert" approved by. the Board of Supervisors in 1968.
11. The subdivider shall provide Schedule A fire protection. The
California Division of Forestry shall review and approve the
water plan. map relative to location, setting, spacing, and in-
stallation of fire hydrants prior to recordation of the final
subdivision map.
12. A valid variance shall be in effect at the time of recordation
of the final map.
13. The impact of nuisance water run-off originating on-site shall
be minimized through the use of retention basins or dry wells
in open space areas with one .on Marrakesh Drive at Grapevine
and an interceptor on Portola north of Grapevine. Plans for
such improvements shall be submitted to the Director of En-
vironmental Services for approval.
14. All requirements of any applicable law, ordinance or regulation_
of the State of California, City of Palm .Desert , and any other
applicable governmental entity shall be complied with as part
of construction.

I . REQUEST: That the Planning Commission approve the
tentative map for the final phase of the MARRAKESH
planned residential development . This phase would con-
tain 100 condominium units (104 lots) on 27 acres.
The other phases consisted of 266 dwelling units.
II . STAFF RECOMMENDATIONS: That it be moved by Resolution
No. that the Planning Commission recommend
to the City Council the approval of the tentative map
subject to the attached conditions :
Justification is based upon :
1. Conformance of the proposed development to all re-
quirements of the Palm Desert Subdivision Ordin-
ance, the adopted General Plan, and the State of
California Subdivision Map Act .
2. The proposed development does insure the protection
of the public health, safety, and general welfare.
3. Compatibility of the proposed development to the ex-
isting and proposed development in the area.
III . BACKGROUND:
A. Description - The subject property is known as
Tract No. 6229, and is a portion of
the SW4, NE4 and NW4, SE-4- of Section
29, T5S, R6E, S.B.B.&M.
B. Location - The subject tract is located approximately
1500 feet west of Portola and is bounded
by Grapevine Street on the north and Hay-
stack Road 160 feet to the south.
C. Size - Approximately 27 acres .
D. Total Number of Units - 100 units.
E. Density - 3. 7 units per acre.
F. Coverage - 23% of the_ are_a_ will be covered by structure
or paving.
G. EIR Finding - Project was initiated prior to the ef-

IV. DISCUSSION OF TENTATIVE TRACT MAP ELEMENTS
The subject tract contains approximately 27 acres and is
proposed to have 100 dwelling units and 104 lots. This is the
final phase of a total development of 366 units covering 155 acres.
The interior road system will consist entirely of private
streets, some of which, such as Marrakesh Drive and Emir Drive,
will be wide enough to permit street parking on at least one side
and which will be maintained by the homeowners association.
Water and sewer service will be supplied to this project
by the Coachella Valley County Water District . All utilities
will be underground.
Parking will be provided by two covered spaces per unit ,
0_28 uncovered spaces per unit , and 0. 74 street spaces per unit -
a total of more than 3 spaces for each dwelling unit .
Because of the topography of the project site , the
County Road Department has recommended that the surfact storm
water runoff impact on Grapevine and Portola should be minimized
by the use of retention basins or dry wells located in the open
space areas of the project .
The Staff was proposing that , if technically feasible ,
the overhead utility lines be undergrounded from Haystack Road
extending north along the western edge of the project site . How-
ever, due to the cost and the fact that the services to property-
owners to the west would also have to be undergrounded and their
cost , Staff does not believe that this would be feasible .
