FACILITIES WHICH WILL BE OPERATED BY AN UNINCORPORATED OWNERS ASSOCIATION,
THE SUN AND STARS PROPERTY OWNERS ASSOCIATION,
THE ASSOCIATION HAS THE RIGHT TO LEVY ASSESSMENTS AGAINST YOU FOR MAINTE-

pletion as defined in civil code section 3093 has been recorded, covering all the
. foregoing areas and facilities.

(b) The statutory period for mechanics liens has expired, or the purchaser is
provided a policy of title insurance with an endorsement insuring the purchaser:,
against unrecorded mechanic liens. (c) Title to Sun and Stars property Owner's
the above mentioned common area lots have been conveyed to the Association
completed and free of liens.
MANAGEMENT AND OPERATION: The Sun and Stars property Owners Association which you
must -join, manages .and operates the common area(s) in accordance with the Restrictions,
Articles of Incorporation and the Bylaws.
MAINTENANCE AND OPERATIONAL EXPENSES: The subdivider has submitted a budget for
maintenance and operation of the common areas. You should obtain a copy of this
budget from the subdivider, Under this budget, the monthly assessments against each
lot/unit will be $109. 11 , of which amount $12.49 is for reserves for .major repairs
and replacements.
IF THE BUDGET FURNISHED TO YOU BY THE DEVELOPER SHOWS A MONTHLY ASSESSMENT
FIGURE WHICH VARIES 10% OR MORE FROM THE ASSESSMENT AMOUNT SHOWN IN THIS
PUBLIC REPORT, YOU SHOULD CONTACT THE DEPARTMENT OF REAL ESTATE BEFORE
ENTERING INTO AN AGREEMENT TO PURCHASE.
The association may increase or decrease assessments at any time in. accordance ith
the procedure prescribed in the CC&R's or Bylaws. In considering the advisability
of a .decrease in assessments, care should be taken not to eliminate amounts attri-
butable to reserves for replacement or major maintenance.
THE INFORMATION INCLUDED IN THIS PUBLIC REPORT IS APPLICABLE AS OF THE
DATE OF ISSUANCE. EXPENSES OF OPERATION ARE DIFFICULT TO PREDICT
ACCURATELY AND EVEN IF ACCURATELY ESTIMATED INITIALLY, MOST EXPENSES
INCREASE WITH THE AGE OF FACILITIES AND WITH INCREASES IN THE COST OF
LIVING.
Monthly assessments will commence on all units during the month following the closing
of the first sale of a unit. From that time, the subdivider is required to pay the
association a monthly assessment for each unit which he owns.
The remedies available to the association against owners who are delinquent in the
payment of assessments are set forth in the CC&R's. These remedies are available
against the subdivider as well as against other owners . The subdivider has posted
a $36.00 assessment bond in escrow, at the United California Bank, 72-811 Highway 111 ,
Palm Desert, California as partial security for his obligation to pay these assessments.
The governing .body of the association should assure itself that the subdivider has
satisfied his obligations to the association with respect to the payment of assessments
before agreeing to a release or exoneration of the security.
EASEMENTS: Easements for public utilities, California Electric Power Company pole
lines, General Telephone underground communication systems, Coachella Water District
water pipes and other purposes are shown on the title report and the subdivision map
recorded on November 8, 1976 in the Office of the Riverside County Recorder, Book 87,
Page 27 of maps.
USES AND ZONING: The City of Palm Desert advises that the adjacent zoning is as
follows:

East - R-3-20,000(3) . S.P.
This tract is zoned R-3-18,000(3) , S.P. The Palm Desert Zoning Ordinance defines
this as a multi -family residential zone, with a minimum lot size of 18,000 square
feet and a maximum density of one ( 1) dwelling unit for each 3,000 square feet of
lot area. The S.P refers to a Secenic Preservation Overlay. Zone, which limits
the building height to one (1) story.
RESTRICTIONS: This subdivision is subject .to restrictions recorded in the Office
of the Riverside County Recorder, Book 782, Page 572, on June 3, 1977 as Instrument
101676 and on August 11 , 1977 Book 1977, Page 155441 , which provides among other
numerous, material and substantial provisions the following:
Each lot owner shall have the exclusive right to use of one carport space. There
are 8 covered carport spaces and 2 open carport spaces, as described in the map
of this project.
TAX ESTIMATES: If the. subdivider is unable to give you the current tax information
you may approximate your taxes as follows:
TAKE 250/. OF THE SALES PRICE, DIVIDE BY 100, AND THEN MULTIPLY BY THE
TOTAL TAX RATE. THE TAX RATE FOR THE 1976/77 FISCAL YEAR IS $10.7300.
THE TAX RATE AND ASSESSED VALUATION MAY .CHANGE IN SUBSEQUENT YEARS.
FOR EXAMPLE, ANY BONDED DEBT OR SPECIAL DISTRICT ASSESSMENT APPROVED
AFTER THE ABOVE..TAX RATE HAD BEEN SET COULD INCREASE THE FUTURE RATE.
CONDITIONS OF SALE: The subdivider advises that it will not be arranging .nor negiotia-
tion real estate loans for purchasers in this project. You will have to obtain any
required real estate financing from loan sources of your own.
PURCHASE MONEY HANDLING: The subdivider must .impound all funds received from you in
escrow depository until legal title is delivered to you. (Refer to Sections 11013,
11013.2(a) of the Business and Professions Code.)
If. the escrow has not closed on your lot within 12 months of the date of your
escrow instructions, you may request return of your deposit.
GEOLOGIC CONDITIONS: THE UNIFORM BUILDING CODE, CHAPTER 70, PROVIDES FOR LOCAL BUILD-
ING OFFICIALS TO EXERCISE PREVENTIVE MEASURES DURING GRADING TO ELIMINATE OR MINIMIZE
DAMAGE FROM GEOLOGIC HAZARDS SUCH AS LANDSLIDES, FAULT MOVEMENTS, EARTHQUAKE SHAKING,
RAPID EROSION OR SUBSIDENCE. THIS SUBDIVISION IS LOCATED IN AN AREA WHERE SOME OF
THESE HAZARDS MAY EXIST. SOME CALIFORNIA COUNTIFc AND CITIES HAVE ADOPTED ORDINANCES
THAT MAYOR MAY NOT BE AS EFFECTIVE IN THE CONTROL OF GRADING AND SITE PREPARATION.
PURCHASERS SHOULD DISCUSS WITH THE DEVELOPER, THE DEVELOPER'S ENGINEER, THE ENGINEERING,
GEOLOGIST, AND THE LOCAL BUILDING OFFICIALS TO DETERMINE IF THE ABOVE-MENTIONED HAZARDS

tract lies on the Dead Indian Canyon and Deep Canyon debris cone. The area is
protected from stormwater flows by a system of channels and dikes built and main-
tained by this District. This tract may be considered safe from stormwater flows
except in rare instances.

C. CASE NO. TT 8071, JOMO DEVELOPMENT COMPANY, Applicant
Request for Approval of a Tentative Tract Map of 5 Lots
with 4 Units , Located on 1/2 Acre on the West Side of
Ocotillo Drive , South of Tumbleweed (R-3-3,000) .
Steve Fleshman presented the staff report on the above request.
Ile indicated that staff recommended approval of the request
based upon the following jusitifications:
1. The Map does meet the requirements of the adopted
Subdivision Ordinance for the City of Palm Desert.
2. The flap meets the requirements of the State Map
Act as amended.
3. The City has received no negative comments from
interested agencies.
Mr. Fleshman further gave a complete background of the request,
including location , size , zoning, etc.
Chairman Wilson asked .if the applicant was present. Being no
one present, he then opened the Public Hearing on Case No. TT
8071. There was no one present who wished to speak in favor of
the project.
HARRY HARDY, 44-597 San Pascual , Palm Desert, California, stated
he had no objections to the project, he just wanted to know the
amount of land involved. Chairman Wilson answered that there
was 1/2 acre of land involved. Mr. Hardy also requested an ex-
planation of the R-3-3,000 S.P. Zoning and Mr. Williams explained
same.
Chairman Wilson then closed the Public Hearing and opened the matter
for discussion among the Commissioners.
Commissioner Berkey made a motion to adopt Planning Commission Reso-
lution No. 159, recommending approval of TT 8071 to the City Council .
Commissioner Van de Mark seconded the motion. Motion carried unani-
wusly.

CORRECTIONS, DELETIONS , AND ADDITIONS TO THE PALM DESERT
7.ONING ORDINANCE.
Paul Williams reviewed the staff report with the Commissioners. This
report included excerpts from the minutes of the May 18, 1976 Planning
Commission meeting pertaining to the proposed amendments to the Zoning
Ordinance. Mr. Williams briefly listed the additions , deletions, and
changes to the Ordinance.
Chairman Wilson opened the Public Hearing on the above case. Being no

one present who wished to speak either in favor of or opposed to Case
No. ZOA 01-76, the Public Hearing was closed.
Commissioner Berkey's suggestions reference additional. changes are
listed as follows :
He felt that a Tire Center should be added to the list of
Conditional Uses under Article 25.16, General Commercial
District (C-1) .
He also felt that the Related Retail Uses and Restaurant Uses
under Conditional Uses (25. 17-3) for Article 25. 17, Professional/
Office District (P-O) should be put under the "Uses Prohibited"
Section (25.17-4) .

V. DISCUSSION:
The conditions of approval for this tentative map will
require curb & gutter installation on the west side of
Ocotillo and the undergrounding of all new & existing
utility lines on the site. The developer will also be
required to meet the standards for fire flow pressure,
domestic water service, and sewer service.
The Design Review Board and Planning Commission have
already given preliminary approval of the grading
plan, floor plan, site plan, and elevations for the condo-
minium units . Approval of this map and the final tract
map will enable the developer to proceed with construction.

6. The District will need additional facilities to provide for the orderly
expansion of its domestic water system. These facilities may include wells,
reservoirs and booster pumping stations. The developer will be required to

7. There may be conflicts with existing District facilities. We request
the appropriate public agency to withhold the issuance of a building permit

Gentlemen:
The applicant shall provide the following fire protection pursuant
to the provisions of Riverside County Fire Ordinance #546 and the
Uniform Fire Code, City of Palm Desert.
1. Install or show there exists a water main system capable of providing
a flow of 2,500 GPM for a two hour duration in addition to domestic or
other supply. The computation shall be based upon a minimum of 20 psi
residual operating pressure in the supply main from which the flow is
measured at the time of measurement.
2. Install Riverside County "super" fire hydrants so that no point of
any building in this development is further than 250'. from a ,hydrant measured
along streets or other vehicular travelways. Hydrants .shall be located
at street intersections wherever possible but no hydrant shall be closer
than 25' to any building.
A. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
B. Curbs shall be painted red.15 feet in either direction from each
hydrant.
3. Prior to recordation of the final map, the developer shall furnish
the original and four copies of the water system plan to the Riverside
County Department of Fire Protection for review.
4. The. water system plan shall be signed by a registered civil engineer
and approved by the water company with the following certification:
"I certify that the design of the water system in.Tract No. 8071 is
in accordance with the requirements prescribed. by the Riverside County
Department of Fire Protection". Upon approval, the original^plan will

V. DISCUSSION:
The conditions of approval for this tentative map will
require curb & gutter installation on the west side of
Ocotillo and the undergrounding of all new & existing
utility lines on the site. The developer will also be
required to meet the standards for fire flow pressure,
domestic water service, and . sewer service.
The Design Review Board- and Planning Commission have
already given preliminary approval of the grading
plan, floor plan, site plan, and elevations for the condo-

Request for Approval of a Tentative Tract Map of 5 Lots
with 4 Units, Located on 1/2 Acre on the West Side of

Steve Fleshman presented the staff report on the above request.
He indicated that staff recommended approval of the request
based upon the following jusitifications:
1. The Map does meet the requirements of the adopted
Subdivision Ordinance for the City of Palm Desert.
2. The Map meets the requirements of the State Map
Act as amended.
3. The City has received no negative comments from
interested agencies.
Mr. Fleshman further gave a complete background of the request,
including location , size, zoning, etc.
Chairman Wilson asked if the applicant was present. Being no
one present, he then opened the Public Hearing on Case No. TT
8071. There was no one present who wished to speak in favor of
the project.
HARRY HARDY, 44-597 San Pascual , Palm Desert, California, stated
he had no objections to the project, he just wanted to know the
amount of land involved. Chairman Wilson answered that there
was 1/2 acre of land involved. Mr. Hardy also requested an ex-
planation of the R-3-3,000 S.P. Zoning and Mr. Williams explained
same.
Chairman Wilson then closed the Public Hearing and opened the matter
for discussion among the Commissioners.
Commissioner Berkey made a motion to adopt Planning Commission Reso-
lution No. 159, recommending approval of TT 8071 'to the City Council .
Commissioner Van de Mark seconded the motion. Motion carried unani-
%ously.
D. SASE NO. ZOA 01-76, CONSIDERATION OF VARIOUS CLARIFICATIONS,
CORRECTIONS, DELETIONS, AND ADDITIONS TO THE PALM DESERT
ZONING ORDINANCE.
Paul Williams reviewed the staff report with the Commissioners. This
report included excerpts from the minutes of the May 18, 1976 Planning
Commission meeting pertaining to the proposed amendments to the Zoning
Ordinance. Mr. Williams briefly listed the additions, deletions, and
changes to the Ordinance.
Chairman Wilson opened the Public Hearing on the above case. Being no
one present who wished to speak either in favor of or opposed to Case
No. ZOA 01-76, the Public Hearing was closed.
Commissioner Berkey's suggestions reference additional. changes are
listed as follows:
He felt that a Tire Center should be added to the list of
Conditional Use Article 25.16, General -Commercial
District (C-1) .
He also felt that the Related Retail Uses and Restaurant Uses
under Conditional Uses (25. 17-3) for Article 25.17, Professional/
Office District (P-0) should be put under the "Uses Prohibited"
Section (25.17-4).

CASE NO. TT 8071
WHEREAS , the Planning Commission of the 'City of Palm
Desert, did recommend approval of an application from JOMO
DEVELOPMENT COMPANY for a tentative tract map for 4-unit condo-
minium project on 0 . 4 acres of land, located in the R-3-18, 000(3)SP
zone and situated on the west side of Ocotillo , between Verba Santa
and Tumbleweed Lane, by Planning Commission Resolution No. 159 ,
more particularly described as :
Lot 27 , Block A
P. D. Unit No. 3
WHEREAS , said application had complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Reso-
lution Number 74-14" , in that a Negative Declaration was made by
the Director of Environmental Services on Case No. CUP-06-76 , and
no further action is necessary, and;
WHEREAS , the City Council did take into consideration the
Tentative Map as submitted, and the reports of the various reviewing
agencies , and;
WHEREAS , the City Council did find that the subject Ten-
tative Map does substantially comply with the City of Palm Desert
Code (County Ordinance Number 460) , and the State of California
Subdivision Map Act , as amended, and;
WHEREAS , the City Council did find that the subject Ten-
tative Map does comply with the adopted General Plan;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Palm Desert as follows : 1) that the above recitations
are true and correct and constitute the findings of the commission
in this case; 2) that it does hereby approve the above described
Tentative Map No. 8071, subject to fulfillment of the following
conditions (copy attached) :

CONDITIONS OF APPROVAL.
CASE NO. TT 8071
1. The development of the property described herein shall 6e subject
to the restrictions and limitations set forth herein which are
in addition to all the requirements , limitations, and restrictions
of- all municipal ordinances, State and Federal statutes now in force.
2. Prior to consideration of the final . map and improvement plans , a
grading plan of the tract shall be submitted to the- City Engineer
�s for approval .
3. The C.C.&R's for this development shall be submitted to the City
Attorney for review and approval prior to the issuance of any
building permits.
4. In order to maintain reasonable fire protection during the con-
struction period, the subdivider shall maintain passable vehicular
access to all buildings and adequate fire hydrants with required
fire flows shall be installed as recommended by the Fire Department.
5. Install a water system capable of delivering 2,500 GP, fire flow
for a two hour duration in addition to domestic.. or other supply.
The computation shall be based upon a minimum of- 20 psi residual
operating pressure in the supply main from which the flow is measured
at the time of measurement.
6. Install . Riverside County super fire hydrants so that no point of any
building is more than 250 feet from a fire hydrant measured along
approved vehicular travelways.
A. Hydrants shall not be located closer than 25 feet to any building.
>. � B. Exterior surfaces of hydrant barrels and heads shall be painted
chrome yellow and the tops and nozzle caps shall- be painted green.
C. Curbs (if installed) shall be painted red 15 feet in either
direction from each hydrant.
7. Prior to issuance of a building permit or recordation of final map,
the developer shall furnish the original and four copies of the water
system plan to the Riverside County Department of Fire Protection for
review. Upon approval , two copies will be sent to the Palm Desert
Department of Building and Safety, Land Use Division, and the original
will be returned to the developer.
8. The .water system plan shall be signed by a registered civil engineer
and approved by the water company, with the following certification :
"I certify the design of the water system in Tract No. 8071 is in
accordance with the requirements prescribed by the Riverside County
Department of Fire Protection".
9. Improvement plans for water and sewer system shall meet the requirements
of the respective service districts.
10. All on-site utilities, including cable TV, shall be placed underground
and shall be completely concealed from view.
11. Complete plans and specifications shall be submitted as required for
checking and approval , before construction of any improvements is com-
menced. The subdivider shall submit the original drawings revised to
reflect as-built conditions, prior to acceptance of the subdivision
improvements by the City.
12. All dedicated land and/or easements. required by this approval shall be
granted to the City of Palm Desert without cost to the City, and free
of all liens and encumbrances.
13. Street numbers shall be assigned by the City.

14. A management company with the unqualified right to assess the owners
of the individual units for reasonable maintenance costs shall be
established and continuously maintained. The management company
shall have the right to lien the twits of the owners who default
in the payment of their assessments. Such lien shall not be
subordinate to any encumbrance other than a first deed of trust
provided such deed of trust is made in. good faith and for value and
is of record prior to the lien of the management company.
a 15. The owner shall execute a futu e r improvement agreement on a form
satisfactory to the City Attorney guaranteeing participation on a
pro-ratio basis in any Assessment District which may be formed for
the undergrounding of the existing overhead utility lines in the
block.
16. All public improvements as required by the City Engineer shall be
installed by the developer in .accordance with the Standards of the
City of Palm Desert.
17. The location and width of all drive approaches shall be subject to
the approval of the City Engineer. Parking shall be provided in
such a way that drivers do not have to back into Ocotillo Drive.
