VI. PUBLIC HEARINGS
A. CASE NO. DP 02-76 (continued)
At this. time, Chairman Wilson opened the Public Hearing on Cuse
No. DP 02-76. Being no one present who wished to speak to the
Commission either in favor of or opposed. to said project, Chair-
man Wilson asked if there were any questions prior to the closing
of the Public Hearing.
Commissioner Berkey stated he couldn 't see why the staff was
justifying recommendation for approval when there were so many
objections to the Conditions of Approval . He further stated
that the access problem could pose a potentially dangerous
situation, He also felt that the project was not innovative
and that it was in his opinion not ready to be presented to the
Planning Commission.
Chairman Wilson summarized the two primary issues: Number one
being the disagreement between staff and the applicant reference
the Conditions of Approval , and Number Two being whether or not
this project did indeed meet the intent and purpose of the "PR"
Zoning District.
Commissioner Van de Mark felt that' the project did not meet thV
intent and purpose of the "PR" Zoning District. She also fel.t
that if the Commission approved the Development Plan, that it
would be setting a precedent for that particular area.
Commissioner Mills agreed with Commissioner Van de Mark and also
with Commissioner Berkey. Commissioner Kelly also agreed with
the above.
Chairman Wilson then stated that it seemed to be the general con-
sensus of the Commission at this time not to set a precedent for
the area and that a motion would be in order.
Paul Williams gave the Commission the new wording for Resolution
No. 158, which is as follows :
"A resolution of the Planning Commission of the City of Palm
Desert, California, announcing findings and denying a Develop-
ment Plan for a 5-acre residential subdivision on property
generally located east of Highway 74, and south of Mesa View
Drive. Case No. DP 02-76"
Commissioner Kelly made a motion to adopt Planning Commission Reso-
lution No. 158, with the above noted revisions reference denial of
the Development Plan. Commissioner Berkey seconded the motion.
Motion carried unanimously.
B.. CASE NO. TT 8082, COVE CONSTRUCTION COMPANY, Applicant
Request for Approval 'of a Tentative Tract Map of 20 Lots on
' 5 Acres Located on the South Side of Mesa View Drive, East of
Highway 74 (PR-5) .
Mr. Ed Wright withdrew his request for approval of the above case
due to the denial actions of the Commission on Case No. DP 02-76.
Chairman Wilson aknowledged the withdrawal and stated no further
action was required.

I . REQUEST:
That the Planning Commission approve a Tentative Tract Map for 20 lots
on 5 acres located' on the south side of Mesa View Drive, east of Highway
74.
II . RECOMMENDATION:
By Planning Commission Resolution No. approve the Tentative Tract
Map, subject to conditions, and recommend adoption to the City Council .
Justification :
1. The Map does meet the requirements of the adopted Subdivision
Ordinance for the •City of Palm Desert.
2. The Map meets the requirements of the State Map Act as_:amended_. ]
3. The City has received no negative comments from interested agencies.
III. BACKGROUND:
Size: 5 acres gross
Location: South side of Mesa View Drive, east of Highway 74
Zone: PR-5 and PR-5 S.P.
Terrain : Sloping 4 to 6% south to north
Vegetation: Desert plants only

IV. DISCUSSION:
This project consists of 20 single family lots ranging in size from 8,193
to 8,438 square feet. While this lot size is not a problem in itself,.the
slope on the site reduces the actual buildable/useable square footage.
The Development Plan Process can add some new features to the project, and
improve the development above its conventional nature.

Reference Case No. TT 8082
The General Telephone Company will provide the telephone distribution
facilities to and within the subject tract in accordance with its cur-
rent tariffs as approved by the California Public Utilities Commission.
The developer will be required to deposit the full cost of these facili-
ties under certain conditions as outlined in the above mentioned tariffs.
These facilities will be underground unless extreme or unusual conditions
arise. No single subdivision will affect the telephone rates as rates are
developed over a large base. We have no expertise on the asthetic impact
of trenching and cannot comment on this subject except to state that the
distribution facilities will be placed in a joint trench with other utili-
ties wherever possible.

Gentlemen :
The above tract Pies on the Dead Indian Canyon and Deep Canyon debris cone.
This area is protected from stormwater flows by a system of channels and dikes
built and maintained by this District. This tract may be considered safe from
stormwater flows except is rare instances.
The District will furnish domestic water and sanitation service to said tract
in accordance with the currently prevailing regulations of this District.
The estimated service pressure within this tract is expected to be from 80 to
95 pounds per square inch. The recommended size of water meter is:
Single units 3/4" inch. Irrigation 1 " inch.
The District requests that the attached Conditions of Approval be included
with the recommendations to be made to the Planning Commission.

the Coachella Valley County Water District for sanitation service.
X 3. Area shall be annexed to the Coachella Valley Stormwater District.
.4. Plans for stormwater protection shall be submitted to the Coachella
Valley County Water District for review.
X 5. The interior drainage shall conform to the provisions of the "Comprehensive
Plan for Surface Water Drainage for Palm Desert" approved by the Board of
Supervisors in 1968.
6 The District will need additional facilities to provide for the orderly
.expansion of its domestic water system. These facilities may include welts, .
reservoirs and bac-ster pumping stations. The developer will be required to
provide land on which some of these facilities will be located. These sites
shall be shown on the tract map as lots to be deeded to the District for such
purpose.
7. There may be conflicts with existing District facilities. We request
the appropriate public agency to withhold the issuance of a building permit
until arrangements have been .made with the District for the relocation of
these facilities.

This letter is not to be interpreted as a contractual commitment to
serve the proposed project; but only as an infoi-imation service. Its
intent Is to notify .you that the Southern California Gas Company has
facilities in the area where the above named project is proposed. Gas
service to the project could be provided from an existing main without
any significant impact on the environment. The service would be in
accordance with the Company's policies and extension rules -on file with
the California Public Utilities Commission at the time contractual
arrangements are made.
The availability of natural gas service, as set forth in this letter,
is based upon present conditions of gas supply and regulatory policies.
As a public utility, the Southern California Gas Company is under the
jurisdiction of tie California Public Utilities Commission. We can
also be affected by actions of federal regulatory agencies. Should
these agencies take an action which affects gas supply or thF. condition
under which service is available, gas service will be provided in accordance
with revised conditions.
We have developed several programs which are available, upon request, to
provide assistance in selecting the most effective applications of energy
conservation techniques for a particular project. If you desire further
information on any of our energy conservation programs , please contact
this office for assistance.

Gentlemen:
Provide the following fire protection in accordance with the
provisions of Ordinances 546 and the Uniform Fire: D de, City of
Palm Desert.
1. Install a water system capable of delivering 500 GPM fire flow from
any fire hydrant for a two hour duration in addition to domestic
supply. The computation shall be based upon a minimum of 20 psi
residual operating pressure in the supply main from which the flow
is measured at the time of measurement.
2. Install Riverside County standard fire hydrants located at street
intersections, but not greater than 500 feet apart in any direction.
a. Exterior surface of hydrant barrels and heads shall be painted
chrome yellow, and -the tops and nozzle caps shall be painted
orange.
b. Curbs shall be painted red 15 feet in either direction from each
hydrant.
3. Prior to recordation .of the final map, the developer shall furnish the
original and four copies of the water system plan to the Riverside County
Department of Fire Protection for review.
4. The water system plan shall be signed by a registered civil engineer and
approved by the water company, with the following certification:
"I certify that the design of the water system in Tract No. 8082 is in
accordance with the requirements prescribed by the Riverside County
Department of Fire Protection." Upon approval, the original plan will
be returned to the developer.

Environmental Impact Report
Gentlemen:
This is to advise that the subject property is located within the service terri-
tory of the Southern California Edison Company and that the electric loads of
the project are within parameters of projected load growth which Edison is plann-
ing to m,.-.et in this area.
Unless Lhe demand for electrical generating capacity exceeds our estimates, and
provided that there are no unexpecred outa es to major sources of electrical
supply, we expect to ate-Et our electrical load requirements during 1976-1973.
Our total -system demand is expected to continue to increase annually; and, if
our plans to proceed with future construction of new generating facilities con-
tinue to be delayed, our ability to serve all customer loads during peak demand
periods could .become marginal by 1979.
In addition, the major fuel used in Edison's generating facilities is low sulfur
fuel oil. Because of the extraordinary availability of alternate sources of
energy,- in addition to our customer's conservation efforts, we now believe that
our low sulfur fuel oil inventory, together with our contractual commitments for
delivery, will permit us to meet the forecasted demand for electricity during
1976.
It is our intention to continue to do everything that can reasonably be accomplish-
ed to provide our customers with a continuous and sufficient supply of electricity.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMEND-
ING TO THE CITY COUNCIL, APPROVAL OF A TENTATIVE MAP TO ALLOW
FOR DEVELOPMENT OF A 20-UNIT RESIDENTIAL SUBDIVISION ON 5 ACRES
OF LAND, GENERALLY LOCATED EAST OF HIGHWAY 74 AND SOUTH OF MESA
VIEW DRIVE. CASE NO. TRACT 8082
WHEREAS, the Planning Commission of the City of Palm Desert, did receive
a verified application from Cove Construction requesting approval of a 20-unit
residential subdivision on 5 acres of land, located in the PR-5 and PR-5, S.P.
zone and situated east of Highway 74 and south of Mesa View Drive, more par-
ticularly described as:
the north 1/2 of the northwest 1/4
of the southwest 1/4 of the north-
east 1/4 of Section 31 , T.5S, R.6E,
S.B.B. & M.
WHEREAS, said application is exempt from the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution Number 74-14" in .
that an Environmental Assessment form was submitted for Development Plan -01-76
and a Negative Declaration was made by the Director of Environmental Services
on June 15, 1976, and the appeal period has expired; and
WHEREAS, the Planning Commission did take into consideration the Tentative
Map as submitted, and the reports of the various reviewing agencies; and
WHEREAS, the Planning Commission did find that the subject Tentative Map
does substantially comply with the City of Palm Desert Code (County Ordinance
Number 460) , and the State of California Subdivision Map Act, as amended; and
WHEREAS, the Planning Commission did find that the subject Tentative Map
does comply with the adopted General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows: 1 ) that the above recitations are true
and correct and constitute the findings of the Commission in this case; 2) that
it does hereby recommend approval to the City Council of the City of Palm
Desert of the above described Tentative Map No. 8082, subject to fulfillment
of the following conditions (copy attached) .

CONDITIONS OF APPROVAL
CASE NO. TT 8082
1. The development of the property described herein. shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements , limitations, and restrictions
of all municipal ordinances, State and Federal statutes now in
force.
2. Prior to consideration of the final map and improvement plans, a
grading plan of the tract shall be submitted to the City Engineer
for approval .
3. The C.C.&R's for this development shall be submitted to the City
Attorney for review and approval prior to the issuance of any
building permits.
4. If requested by the City Engineer, an amended tentative map shall
be submitted for approval by the City Engineer prior to preparation
of the final map to assure compliance to all conditions of approval .
5. In order to maintain reasonable fire protection during the con-
struction period, the subdivider shall maintain passable vehicular
access to all buildings and adequate fire hydrants with required
fire flows shall be installed as recommended by the Fire Department.
6. Install a .water system capable of delivering 500 GPM fire flow for
a two hour duration in addition to domestic or other supply. The
computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at the
time of measurement.
7. Install Riverside County super fire hydrants so that no point of any
building is more than 250 feet from a fire hydrant measured along
approved vehicular travelways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted
chrome yellow and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) shall be painted red fifteen (15) feet in
either direction from each hydrant.
8:f Prior to issuance of a building permit or recordation of final map,
the developer shall furnish the original and four copies of the water
system plan to the Riverside County Department of Fire Protection for
review. Upon approval , two copies will be sent to the Palm Desert
Department of Building and Safety, Land Use Division , and the original
will be returned to the developer.
9. The water system plan shall be signed by a registered civil engineer
and approved by the water company, with the following certification:
"I certify the design of the water system in Tract No. 8082 is in
accordance with the requirements prescribed by the Riverside County
Department of Fire Protection".
10. All public improvements shall be designed and constructed in conformity
to Standards of the City of Palm Desert.
11. Improvement plans. for water and sewer systems shall meet the require-
ments of the respective service districts.
12. All on-site utilities, including cable TV, shall be placed underground
and shall be completely concealed from view; including all existing
lines along the site boundary.

13. Complete plans and specifications shall be submitted as required
for checking and approval , before construction of any improvements
is commenced. The subdivider shall submit the original drawings
revised to reflect as-built conditions, prior to acceptance of the
-subdivision improvements by the City.
14. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert without cost to the City, and
free of all liens and encumbrances.
15. Street names and numbers shall be established by the City.
16. A management-:company with the unqualified right to assess the owners
of the individual units for reasonable maintenance costs shall be
established and continuously maintained. The management company shall
have the right to lien the units of the owners who default in the
payment of.their assessments. . Such lien shall not be subordinate
to any encumbrance other than a first deed of trust provided such
deed of trust is made in good faith and for value and.is of record
prior to the lien of the management company.
17. The subdivider shall offer for dedication all streets within the project.
18. The subdivider shall install full public improvements as required by the
City Engineer.
19. All direct access rights to Mesa View Drive from the abutting lots
shall be dedicated to the City.
20. Right-of-way dedication and roadway transition details of Mesa View
Drive to be subject to approval of the City Engineer.
21. Mesa View Drive and easterly street to be improved with twenty-eight
(28) foot paved travelled way.
22. Developer shall provide a street light satisfactory to the City
Engineer at the intersection of Mesa View Drive and Highway 74.
23; Property line return radii shall be fifteen (15) feet minimum on
local streets and twenty-five (25) feet minimum at Highway 74.
24. Developer shall provide turnaround on easterly street satisfactory
to the City Engineer.
25. Right-of-way width of cul -de-sac streets shall be forty-eight (48)
feet minimum. An additional dedication of four (4) feet on each
side (total- fifty-six (56) feet) shall be offered for dedication.
The City will not accept additional offer until specifically needed
for public purposes.
26. Developer shall provide method of disposal -of storm water satisfactory
to the City Engineer.

I . CALL TO ORDER
The regularly scheduled meeting of the Palm Desert Planning Commission
was called to order by Chairman Wilson at 7:00 p.m. on June 29, 1976,
in the Council Chambers of the Palm Desert City Hall .

A. Minutes of Planning Commission Meeting of June 1, 1976.
Steve Fleshman noted two minor corrections to the minutes of the
above meeting. . They are as follows:
/ Page 3, paragraph 2, add the word minimum after 65 year.
Page 3, paragraph 5, add the word area after the word
particular in the last line.
j Commissioner Berkey made a motion to approve the minutes of the
I June 1, 1976 meeting, with the noted corrections. Commissioner

V. WRITTEN COMMUNICATIONS
A. CASE NO. GPA-60-756-CC-8
County Referral of a Requested General Plan Amendment from
Very Low Density Residential to Industrial Park on 40 Acres
on the' North Side of Country Club Drive, West of Washington
Street.
Steve Fleshman reviewed the above request from the County to comment
on a General Plan Amendment for property located within the City of
Palm Desert's Sphere of Influence.
Commissioner Van de Mark made a motion to approve Planning Commission
Resolution No. 157, finding that the above request is in conformance
with the adopted Palm Desert General Plan. Commissioner Kelly seconded
the motion. Motion carried unanimously.
VI . PUBLIC HEARINGS
A. CASE NO. DP 02-76, COVE CONSTRUCTION COMPANY, Applicant
Request for Development Plan Approval of 20 Single Family Detached
Units on 5 Acres Located on the South Side of Mesa View Drive,
East of Highway 74 (PR-5 Zone) .
Steve Fleshman reviewed the above request with the Commission. Mr.
Fleshman listed the following staff justifications for approval of
the Development Plan.
1. The project conforms to the Palm Desert General Plan.
2. The project meets the requirements of the Palm Desert
Zoning Ordinance.

Mr. Fleshman further reviewed the request by giving a background
of the Development Plan in terms of location , size, number of
units, zoning, etc. Mr. Fleshman pointed out that staff felt
the lot sizes in general were not a problem; however, the dwelling
unit size should be increased to a minimum of 1,500 square feet.
Mr. Fleshman also stated that staff felt the design of the pro-
ject needed further analysis. He stated that the key to approval
of the project was whether 'or not the project meets the intent and
purpose of the Planned Residential Zone District, Section 25.14-1
of the Palm Desert Zoning Ordinance, which reads as follows:
"25.14-1 Intent and Purpose
It is the intent and purpose of the "PR" District to provide
for flexibility in development, creative and imaginative de-
sign, and the development of parcels of land as co-ordinated
projects involving a mixture of residential densities and
housing types, and community facilities, both public and
private. The "PR" District is further intended to provide
for the optimum integration of urban and natural amenities
within developments. The "PR" District is also established
to give a land developer assurance that innovative and unique
land development techniques .wi.11 be given reasonable con-
sideration for approval and to provide the City of Palm Desert
with assurances that the completed project will contain the
character envisioned at the time of approval . "
Mr. Fleshman explained that while .the project in general was not
creative, imaginative, etc. , it would be possible to "dress-up"
the project through special treatment to the houses, appearance
from Mesa View Drive, and landscaping of the cul-de-sacs. Mr.
Fleshman further stated that staff felt that through the Design
Review Process, the above problems could be- solved to meet the
intent and purpose of the "PR" Zone.
Chairman Wilson asked the Commissioners if they had any questions
of staff at this time. Being none, he asked if the applicant was
present.
ED WRIGHT, President of Cove Construction Company, 78-106 Avenue 52,
La Quinta, California , spoke to the Commission and voiced several
objections to the Conditions of Approval . His first objection was
to Special Condition No. 3, which requires a minimum of 1,500 square
feet of living area for each dwelling. Mr: Wright felt that the
proposed square footage of 1,200 and 1,400 square feet was more ap-
propriate. He also objected to Special Condition No. 6, which re-
quires the installation of a masonry wall along the full frontage
of the west property line. He stated that he would prefer redwood
fencing for economic reasons.
Mr. Wright's third objection was to Special Condition No. 7, which
requires that the C.C.&R's for the project contain provisions for
the maintenance of landscaped areas along Mesa View Drive and within
the center of the cul-de-sacs. He felt that the landscaping of the
cul-de-sacs would present a hazard both to vehicles and children in
the area. His next objection was to Special Condition No. 4, which
"requires that Mesa View Drive be connected to the existing street
to the east.

At this time, Chairman Wilson opened the Public Hearing on Case
No, DP 02-76. Being no one present who wished to speak to the
Commission either in favor of or opposed to said project, Chair-
man Wilson asked if there were any questions prior to the closing
of the Public Hearing.
Commissioner Berkey stated he couldn't see why the staff was
justifying recommendation for approval when there were so many
objections to the Conditions of Approval . He further stated
that the access problem could pose a potentially dangerous
situation. He also felt that .the project was not innovative
and that it was in his opinion not ready to be presented to the
Planning Commission.
Chairman Wilson summarized the two primary issues: Number one
being the disagreement between staff and the applicant reference
the Conditions of Approval , and Number Two being whether or not
this project did indeed meet the intent and purpose of the "PR"
Zoning District.
Commissioner Van de Mark felt that the project did not meet the
intent and purpose of the "PR" Zoning District. She also felt
that if the Commission approved the Development Plan, that it
would be setting a precedent for that particular area.
Commissioner Mills agreed with Commissioner Van de Mark and also
4 with Commissioner Berkey. Commissioner Kelly also agreed with
(� the above.
t Chairman Wilson then stated that it seemed to be the general con-
sensus of the Commission at this time not to set a precedent for
the area and that a motion would be in order.
Paul Williams gave the Commission the new wording for Resolution
No. 158, which is as follows:
"A resolution of the Planning Commission of the City of Palm
Desert, California, announcing findings and denying a Develop-
ment Plan for a 5-acre residential subdivision on property
generally located east of Highway 74, and south of Mesa View
Drive. Case No. DP 02-76"
Commissioner Kelly made a motion to adopt Planning Commission Reso-
lution No. 158, with the above noted revisions reference denial of
the Development Plan. Commissioner Berkey seconded the motion.
Motion carried unanimously.
B. CASE NO. TT 8082, COVE CONSTRUCTION COMPANY, Applicant
Request for Approval of a Tentative Tract Map of 20 Lots on
5 Acres Located on the South Side of Mesa View Drive, East of
Highway 74 (PR-5) .
Mr. Ed Wright withdrew his request. for approval of the above case
due to the denial actions of the Commission on Case No. DP 02-76.
Chairman Wilson aknowledged the withdrawal and stated no further
action was required.

C. CASE N0. TT 8071, JOMO DEVELOPMENT COMPANY, Applicant
Request for Approval of a Tentative. Tract Map of 5 Lots
with 4 Units, Located on 1/2 Acre on the West Side of
Ocotillo Drive, South of Tumbleweed (R-3-3,000) .
Steve Fleshman presented the staff report on the above request.
He indicated that staff recommended approval of the request
based upon the following jusitifications: .
1.. The Map does meet the requirements of the adopted
Subdivision Ordinance' for the City of Palm Desert.
2. The Map meets the requirements of the State Map
Act as amended.
3. The City has received no negative comments from
interested agencies.
Mr. Fleshman further gave a complete. background of the request,
including location, size, zoning, etc.
Chairman Wilson asked if the applicant was present. Being no
one present, he then opened the Public Hearing on Case No. TT
8071. There was no one present who wished to speak in favor of
the project.
HARRY HARDY, 44-597 San Pascual , Palm Desert, California, stated
he had no objections to the project, he just wanted to know the
I amount of land involved. Chairman Wilson answered that there
� . . was 1/2 acre of land involved. Mr. 'Hardy also requested an ex-
planation of the R-3-3,000. S.P. Zoning and Mr. Williams explained
same. '
Chairman Wilson then closed the Public Hearing and opened the matter
for discussion among the Commissioners.
Commissioner Berkey made a motion to adopt Planning Commission Reso-
lution No. 159, recommending approval of TT 8071 'to the City Council .
Commissioner Van de Mark seconded the motion. Motion carried unani-
vously.
D. CASE NO. ZOA 01-76, CONSIDERATION OF VARIOUS CLARIFICATIONS,
CORRECTIONS, DELETIONS, AND ADDITIONS TO THE PALM DESERT
ZONING ORDINANCE.
Paul Williams reviewed the staff report with the Commissioners. This
report included excerpts from the minutes of the May 18, 1976 Planning
Commission meeting pertaining to the proposed amendments to the Zoning
Ordinance. Mr. Williams briefly listed the additions, deletions, and
changes to the Ordinance.
Chairman Wilson opened the Public Hearing on the above case. Being no
one present who wished to speak either in favor of or opposed to Case
No. ZOA 01-76, the Public Hearing was closed.
Commissioner Berkey's suggestions reference additional changes are
listed as follows:
He felt that a Tire Center should be added to the list of
Conditional Uses under Article 25.16, General Commercial
District (C-1) .
He also felt that the Related Retail Uses and Restaurant Uses
under Conditional Uses (25.17-3) for Article 25. 17, Professional/
Office District (P-0) should be put under the "Uses Prohibited"
Section (25.17-4) .

Paul Williams agreed with Commissioner Berkey's suggestions.
Commissioner Mills disagreed with Commissioner Berkey on the change
of the Related Retail and Restaurant uses.
Commissioner Berkey made a minute motion to delete the "Related
Retail " and the "Restaurant" uses from Article 25. 17. Commissioner
Van de Mark seconded the motion. The motion was carried 4-1, with
the following vote:
AYES: BERKEY, KELLY, VAN DE MARK, WILSON
NOES: MILLS
Commissioner Berkey further suggested that .Subsection (5) under
Section 25.32-6.02 (Development Subject to Undergrounding Provisions)
be reworded in order to tie in with Section 25.32-6.03. Chairman.
Wi.lson agreed with Commissioner Berkey.
Mr. Williams advised the Commissioners that the above suggestions,
etc. would be added to Exhibit "B".
Commissioner Van de Mark made. a motion to adopt -Planning Commission
Resolution No. 160, recommending approval to the City Council , with
the noted corrections as listed in Exhibit"B". Commissioner Mills
seconded the motion. _Motion carried unanimously.
VII. OLD BUSINESS
A. Report to the Planning Commission on the Time Necessary for
Staff Study of the North Side of.Catalina'Way, East of San
Pablo.
Paul Williams reviewed the staff report reference the above, stating
that staff felt it would be a wiser approach to look at the total
area as opposed to a separate study.
Chairman Wilson stated that even though this was not a Public Hearing,
the Commission would take comments from any interested persons.
DICK KITE, .73-757 Highway 111, Palm Desert, California, spoke to the
Commission objecting to the staff recommendation.
JACK MOOREHOUSE, 44-555 San Pascual , Palm Desert, California, spoke
to the Commission stating he did not agree with Mr. Kite's views.
HARRY HARDY, 44-597 San Pascual , Palm Desert, California, spoke to ,
the Commission stating that he agreed with the staff's recommendation.
DWIGHT BABCOCK, 73-200 Tumbleweed Lane, Palm Desert, California, spoke
to the Commission and voiced his objection to a separate study of
the area. He felt multi-family zoning should be considered for the
Catalina Way area.
At this time, Chairman Wilson stated that the Commission had before
them the question of whether or not to accept the staff recommendation
that the Catalina Way area be studied as a part of the total C.O.D.
Specific Plan.
Commissioner Berkey stated that his intent had apparently been min-
interpreted, what he really wanted was for staff to place the review
of the area on a top priority basis.
Commissioner Kelly and Commissioner Mills agreed with .the staff's
recommendation.

-Commissioner Van de Mark made a minute motion to approve the staff
recommendation that the area not be studied separately but be reviewed
as a part of the total C.O.D. Specific Plan. She further added that
this study should be a top priority item and be completed as soon as
possible. Commissioner Mills seconded the motion. Motion carried unani- .
mously.
VIII. NEW BUSINESS
A. CASE NO. ZOC 04-76, COLT, INC. , Applicant
Request from'B. .D. HUNTER of COLT, INC. that the Planning Com-
mission determine which ,zones would be acceptable for the sale,
distribution , and assembly of Solar Energy Systems.
Steve Fleshman presented the staff report reference the above request
and stated that staff-recommended -that the above mentioned use would
be allowable in the C-1 and S-I Zones by right and in the PC(3) and
P-I Zones by Development Plan approval.
BILL HUNTER, 72-685 Bel Air Road, Palm Desert, California, spoke to
the Commission. reference the above request.
After a short discussion among the Commissioners and Mr. Hunter
reference what areas of the City would be appropriate. for such a
use, Commissioner Kelly made a motion to approve Planning .Commission
Resolution No. 161, .finding that the use would be allowable in the
above mentioned zones. Commissioner Berkey seconded the motion.
Motion carried unanimously.
IX. DESIGN REVIEW BOARD ITEMS
A.. Review of Cases presented .to the Design Review Board at their
meeting of June 22, 1976.
Steve Fleshman presented the Design Review Board items. The first
case reviewed with the Commission was Case No. 31MF. The applicant,
Mr. Babcock was present and questioned the wording of Condition No.
SO) reference undergrounding. Mr. Fleshman suggested rewording
Condition No. 5(b) as follows:
"The applicant shall comply with the intent of the undergrounding
ordinance to the satisfaction of the City staff. "
Commissioner Van de Mark agreed with Mr. Fleshman 's rewording.
The second case reviewed was Case No. 33C. It was decided that Con-
ditions No. 12 and No. 13 should be added to the existing 11 Conditions
of Approval and should read as follows:
"12. The applicant shall grant an easement on a portion of the
property to the City for access and parking purposes in a
form acceptable to the City Attorney. " I -
"13. The applicant shall agree in writing to join any assessment
district formed that includes the subject property within
its boundaries. "

The next two cases presented were No. 37MF and 32C. It was decided
that no changes should be made to these cases.
Commissioner Berkey made a motion to adopt Planning Commission Re-
solution No. 162, approving the actions of the Design Review Board
meeting of June 22, 1976, with the above noted-modifications and
additions to the Conditions of Approval. for Cases No. 31MF and 33C.
Commissioner Van de Mark seconded the motion. Motion carried unani-
mously.

Chairman Wilson stated that it would be in order to nominate a
Vice-Chairman for the Planning Commission since this item was
overlooked when the Chairman was appointed.
Commissioner Mills nominated George Berkey for the position 'of
Vice-Chairman of the Planning Commission. Commissioner Van de
Mark seconded the nomination. . The nomination was carried with
the following vote:
AYES: Kelly, Mills , Van de Mark, Wilson
ABSTAIN.: Berkey
There was a short discussion among the Commissioners reference the
reactions to the joint City Council/Planning Commission. study ses-
sion. The Commissioners directed staff to notify the City Council
that the above mentioned study sessions should be conducted on a
quarterly basis.
XII . ADJOURNMENT
Commissioner Van de Mark moved to adjourn the meeting at 9:16 p.m.
Commissioner Mills seconded the motion. Motion carried unanimously.

.Gentlemen;
This letter is written to comply with your requirements under
tentative map check list (Sec. 5.1 , ord. 460) Supplementary inform-
ation C.1.
The proposed tract is a conventional single family detached
subdivision consisting of twenty lots of approximately 8000 sq. ft.
each. The 'basic plot consists of lots of varying widths , depths
and orientation, all facing and gaining access from short, cut de
sac streets off . of Mesa View extended. No lot in the proposed tract
shall face , 'or have its access from, a through street or highway.
The plot has been designed to maximize view potentials for as
many lots as possible and at the same time to create none-linear
street scenes through the use of varying set backs, side yards and
directional orientation.
The homes to 'be constructed there-on shall be single story,:°,
three bedroom and two baths , varying from twelve hundred to fourteen
hundred square feet of living area. Each home will have a two car
garage plus front or rear covered patio or atrium cover. Lot line
fencing and front yard landscaping with shrubs , ground cover and
at least one significant street tree per lot will 'be included. All
possible consideration will be given to solar orientation through
the utilization of overhangs , patio covers, garage placements and
house plan orientation. Energy conservation considerations will
be size , proper design of HVAC systems , insulation, colors of sun
lit surfaces , overhangs , glass size and placement and location of
accessary structures in relation to the dwelling. Many of •the homes
will have expansion potential and many of the lots -will 'be of ade-
quate size and configuration for swimming pools . To the extent that
it is practical; structures will be sited to permit future pools ,
side yard driveways for campers , 'boats , etc.
In conclusion, the proposed tract will make good use of its
site and will create an attractive , safe and pleasant addition to
a neighborhood of mixed residential types. It will also provide
some much needed moderately priced, single family, detached homes
suitable for either families, retirees or second homeowners who would
prefer not to purchase condominiums but want to live in the South
Palm Desert area.
