Ruff Senior Vice President Biddle Group 3848 Campus Drive, Suite 111 Newport Beach, California 92660 Re: Finalization of Somerset Project Dear Bob: With regard to your letter of April 7 , 1980, I have reviewed the plans encompassing this project and the Municipal Code provisions relative to the need for a wall along the northerly property line. Both mandate that a wall be provided in said area. I believe that the Commission was more than generous in relieving you of the requirement along the westerly property line. Therefore, I must continue to require the construction of said wall . r Sincerely, PAUL A. WILLIAMS, AICP Director of Environmental Services PAW/dj N RECEIVED APR 4 1980 45-275 PRICKLY PEAR LANE, PALM DESERT, CALIFORNIA 92260 TELEPHONE (714) 346-0611 April 1, 1980 Biddle Development, Inc. 3348 Campus Drive, Suite 116 Newport Beach, CA 92660 Re: Tract 9377 - Sommerset Project Dear Sirs: Pursuant to your request, we have given a final inspection to the above project with Gary Reynolds, Job Superintendent, and find several corrections necessary to complete the project. They are as follows: 1. Construct 6 foot high masonry wall to connect-with wall along Highway 74; said wall to extend west"to bedinn1_ng of Palm Valley Storm Channel... 2. Remove on-site and off-site subdivision sales signs. 3. Replace all dead trees and other landscaping; especially 011 dead trees at Glenview Circle and Desert Flower Drive, and Sommerset Drive and Desert Flower Drive. Please advise us as to when the above items will be taken care of. Upon receipt and approval of your correction schedule, we will release the final units in the project. Should you have any questions regarding this matter please feel free to contact this office. Very. .truly yours , PAUL A. WILLIAMS, AICP Director of Environmental Services PW/1r City of Palm Desert 45-275 Prickly Pear Lane Palm Desert, CA 92260 Attention: Mr. Paul . A., Williams, AICP Director of Environmental Services April 7, 1980/Letter #1620 Dear Mr. Williams: Please refer to your letter dated April 1 , 1980, concerning the final inspection of the above project. We will take care of those land- scaping items you mentioned and the subdivision sales signs can come down as soon as we can sell our remaining unsold units , hopefully by June 1 , 1980. However, the requirement to construct a six-foot high masonry wall running westward from our present frontage wall comes as a complete surprise. There was no such wall on our plans nor was such a wall a condition of tract approval . Your description "to beginning of Palm Valley Storm Channel " doesn 't establish the termination point of the wall , but if it would terminate beyond the maintenance building, we would be faced with an unfunded expenditure of over $20,000 which is not recoverable from the project at this state of completion. Therefore, we must protest the inclusion of such a wall as a "necessary correction" when it was not a require- ment up front where it could have been funded. We have agreed with the Sommerset Homeowners Association Board of Directors to provide oleander plants for their installation in sufficient quantity to cover the area from the existing frontage wall to termination at a point beyond the maintenance building which will serve as a hedge delineating the property line.
