REQUEST FOR AUTHORIZATION of the use of Lowe’s Home Centers, Inc., Home Depot U.S.A., Inc., and HD Supply Facilities Maintenance for Purchase of Materials, Supplies and Appliances for Palm Desert Housing Authority Properties for Fiscal Year 2021/2022 (Contract Nos. HA41460A-C) (HA). REQUEST FOR AUTHORIZATION to streamline the use of named vendors for the Palm Desert Housing Authority by granting an exception to the bidding requirements and approving the Authority Vendor List (HA). Rec: By Minute Motion, that the Authority Board: a) Grant an exception to the bidding requirements, as provided for by Section 3.30.160(K) of the Palm Desert Municipal Code; b) Approve the Authority Vendor List pursuant to Section 3.30.160(K) for purposes of providing recurring, routine contractual services, including maintenance work, and materials, supplies, and equipment effective July 1, 2021, not to exceed $25,000 or as noted on the vendor list, for each named vendor per property (in a 12 month period). 17. REQUEST FOR DECLARATION of surplus property and authorization of disposal – electronics, office furniture, and miscellaneous equipment (CC). Rec: By Minute Motion, declare items listed in the accompanying staff report’s Exhibit A as surplus and authorize disposal as appropriate. REQUEST FOR APPROVAL OF A COOPERATIVE AGREEMENT WITH THE RIVERSIDE COUNTY FIRE DEPARTMENT TO PROVIDE FIRE PROTECTION, FIRE PREVENTION, RESCUE, AND MEDICAL EMERGENCY SERVICES FOR THE CITY OF PALM DESERT (CONTRACT NO. C41470) (CC). Rec: By Minute Motion, approve a Cooperative Agreement with the Riverside County Fire Department to provide fire protection, fire prevention, rescue, and medical emergency services for the City of Palm Desert, as approved to final form by the City Attorney, and authorize the Mayor to execute said agreement. 19. RESOLUTION NO. 2021-12 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, RESCINDING AND REPLACING RESOLUTION NO. 2021-08, ADOPTING AUTHORIZED CLASSIFICATIONS, ALLOCATED POSITIONS, SALARY SCHEDULE AND SALARY RANGES INCLUDED HEREIN AND ATTACHED AS “EXHIBIT A” EFFECTIVE WITH PAY PERIODS ENDING AFTER MAY 1, 2021 (CC). RESOLUTION NOS. 2021-22 AND 2021-23: A) A RESOLUTION CALLING A SPECIAL ELECTION WITHIN CITY OF PALM DESERT COMMUNITY FACILITIES DISTRICT NO. 2021-1 (UNIVERSITY PARK), AND B) A RESOLUTION DECLARING THE RESULTS OF A SPECIAL ELECTION IN CITY OF PALM DESERT COMMUNITY FACILITIES DISTRICT NO. 2021-1 (UNIVERSITY PARK) AND DIRECTING THE RECORDING OF A NOTICE OF SPECIAL TAX LIEN; AND C) CONDUCT THE FIRST READING OF ORDINANCE NO. 1365, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT ACTING IN ITS CAPACITY AS THE LEGISLATIVE BODY OF CITY OF PALM DESERT COMMUNITY FACILITIES DISTRICT NO. 2021-1 (UNIVERSITY PARK) AUTHORIZING THE LEVY OF A SPECIAL TAX WITHIN THAT DISTRICT (CC). Rec: That the City Council: a) Waive further reading and adopt Resolution No. 2021-22, a resolution of the City Council of the City of Palm Desert calling a special election within City of Palm Desert Community Facilities District No. 2021-1 (University Park). i) That the City Clerk, who has received from the sole qualified landowner elector within CFD 2021-1 a Consent and Waiver waiving the timelines under the California Elections Code (among other things) and consenting to a special election to be held on any date on or after the close of the April 22, 2021 public hearing, conduct an election in connection with CFD 2021-1. A qualified elector within the district receives one vote per acre or portion thereof that it owns within CFD 2021-1. ii) That if more than a 2/3 vote in favor of the ballot propositions is received, following the results of the election, Council makes a finding and declaration of the results of the special election by approving the following resolution. b) Waive further reading and adopt Resolution No. 2021-23, a resolution of the City Council of the City of Palm Desert declaring the results of a special election in City of Palm Desert Community Facilities District No. 2021-1 (University Park) and directing the recording of a notice of special tax lien. c) That City Council introduce and conduct its first reading of Ordinance No. 1365, authorizing the levy of the special tax within City of Palm Desert Community Facilities District No. 2021-1 (University Park). Rec: By Minute Motion: a) Direct staff to seek professional services for design concepts to convert Lupine Lane into a permanent outdoor public gathering space. OR b) Direct staff to remove the furnishings and restore Lupine Lane, and return to a public street. 26. REQUEST FOR DIRECTION REGARDING DRIVE-THROUGH RESTAURANTS IN THE CITY OF PALM DESERT (CC). Rec: By Minute Motion, a) Direct staff to initiate a Zoning Ordinance Amendment (ZOA) to Section 25.16 Commercial and Industrial Districts to develop standards and criteria for drive- through restaurants in the Regional Commercial Center (PC-3) zones, subject to a Conditional Use Permit. OR b) Provide staff direction to research additional items related to drive-through restaurants for further City Council consideration. REQUEST FOR COMMENCEMENT OF THE FISCAL YEAR 2021/22 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM APPLICATION PROCESS AND SUBMISSION OF THE FISCAL YEAR 2021/22 ACTION PLAN (CC). Rec: By Minute Motion: a) Open the public hearing and receive comments regarding the Fiscal Year 2021-22 Action Plan, including funding recommendations for the Community Development Block Grant (CDBG) Program. b) Approve submission of the Fiscal Year 2021-22 Action Plan to the U.S. Department of Housing and Urban Development (HUD). 28. CONSIDERATION OF ZONING ORDINANCE AMENDMENT TO AMEND THE PALM DESERT MUNICIPAL CODE AND ADD SECTION 25.28.045 “SAN PABLO OVERLAY DISTRICT” TO ESTABLISH AN OVERLAY DISTRICT, WHICH WILL REGULATE COMMERCIAL LAND USES ALONG THE SAN PABLO CORRIDOR, AND APPLY SAID OVERLAY DISTRICT TO ALL COMMERCIAL PROPERTIES ALONG SAN PABLO AVENUE BETWEEN HIGHWAY 111 AND MAGNESIA FALLS; AND ADOPTION OF A NOTICE OF EXEMPTION IN ACCORDANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA), Case No. ZOA 20-0002 (City of Palm Desert, Applicant) (CC).
