HomeMy WebLinkAbout10 C37870A - KOA Corporation - Haystack Road Traffic - Project No. 667-21Contract No. C37870A STAFF REPORT CITY OF PALM DESERT PUBLIC WORKS DEPARTMENT MEETING DATE: May 13, 2021 PREPARED BY: Randy Bowman, Senior Project Manager REQUEST: Approve Amendment No. 1 to Contract C37870A with KOA Corporation of Monterey Park, California, for engineering design services in an amount not to exceed $99,897 for Haystack Road Traffic Calming and Safety Improvements (Project No. 667-21). ___________________________________________________________________________ Recommendation By Minute Motion: 1) Approve Amendment No. 1 to Contract C37870A with KOA Corporation of Monterey Park, California, for design services in an amount not to exceed $99,897; 2) Reprogram $150,000 from the Cook Street Widening Project to a Measure A account for the Haystack Road Traffic Calming and Safety Improvements project; and, 3) Authorize the Mayor to execute the agreement. Upon approval of the actions above, funds will be available from the designated Measure A account. Strategic Plan While the Traffic Operations and Capacity Improvements project is an on-going maintenance activity and is not a specific objective of the Strategic Plan, maintaining the City’s roadways by making necessary adjustments to traffic operations and intersection capacity improvem ents is an essential function of the City for safety and roadway connectivity. Background Analysis At its May 28, 2020 meeting, the City Council awarded Contractor No. C37870A in an amount of $720,431.00 to KOA Corporation of Monterey Park, California, for professional engineering, landscape architecture and design services for the CV Link Painters Path Spur Improvement (Bump and Grind to El Paseo) Project. The project has since been renamed to CV Link Connectors. May 13, 2021 - Staff Report Authorize Amendment No. 1 to Contract No. C37870A Page 2 of 3 Following an April 2, 2021 automobile collision at the intersection of Haystack Road and Heliotrope Drive, the City Manager directed the Public Works Department to develop a strategy to address community concerns over motorist speeding, and safety for all roadway users along Haystack Road. Reviewing available information, City staff proposed to the City Manager that engineering design services be obtained for a traffic calming and safety project for Haystack Road, which would include community engagement, data collection, engineering analysis, and recommendations for improvements to address speeding and safety issues. The engineering design services will provide to the City Council information needed to then prioritize, budget, and implement changes to the roadway. City staff propose amending the contract with KOA for the Haystack Road Traffic Calming and Safety Improvements project for these reasons: • The consultant has followed a methodology for the CV Link Connectors project that will serve as an appropriate template for conducting the Haystack Road project. • The consultant is following an effective community engagement strategy for CV Link Connectors project, and has established relationships within the Palm Desert community. • Strategies to improve roadways with the CV Link Connectors project mirror aspects of community concerns being heard regarding Haystack Road, including improvements to lower motorist travel speeds, increasing pedestrian and bicycle safety, and expanding multi-modal connections within Palm Desert. • Amending the existing contract with KOA Corporation is an expedient alternative to commence the Haystack Road project. On April 11, 2021, KOA Corporation submitted a detailed proposal for design services with a proposed cost of $99,897, and with a time to completion of five months. As of the preparation of this staff report, the City has scheduled an introductory community meeting to occur on May 4. An update to the City Council will be provided during the presentation of this staff report. Fiscal Analysis An amendment to add this project in the City’s Measure A CIP List was submitted to the Riverside County Transportation Commission (RCTC). On April 9, 2021, RCTC approved the amendment in the amount of $150,000 in Fiscal Year 20/21; therefore, there will be no impact to the City’s general fund for the project. The requested design services will provide cost estimates for design and construction of recommended improvements, which will be presented to the City Council in further budgeting decisions. The remaining balance will be expended on the purchase of traffic equipment related to this project. C37870A Page 1 of 7 72500.00001\32445060.1 (Revised 10-06-20) AMENDMENT NO. 1 TO THE PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF PALM DESERT AND KOA CORPORATION Contract No. C37870A 1. Parties and Date. This Amendment No. 1 to the PROFESSIONAL SERVICES AGREEMENT is made and entered into as of this 13TH day of May, 2021, by and between the City of Palm Desert (“City”) and KOA CORPORATION, a California Corporation with its principal place of business at 1100 Corporate Center Drive Suite 201, Monterey Park, CA 91754 (“Consultant”). City and Consultant are sometimes individually referred to as “Party” and collectively as “Parties.” 2. Recitals. 2.1 Agreement. The City and KOA Corporation have entered into an agreement entitled “PROFESSIONAL SERVICES AGREEMENT” dated May 28, 2020 (“Agreement” or “Contract”) for the purpose of retaining the services of Consultant to provide certain professional services. 2.2 Amendment. The City and KOA Corporation desire to amend the Agreement for additional professional services related to the Haystack Road Traffic Calming and Safety Improvements project in the amount of $99,897. 2.3 Amendment Authority. This Amendment No. 1 is authorized pursuant to Section 3.6.14 of the Agreement. 3. Terms. 3.1 Schedule of Services. Section 3.2.2 of the Agreement is hereby amended in its entirety to read as follows: “Consultant shall perform the Services in a prompt and timely manner in accordance with the Schedule of Services set forth in Exhibit “A” and Exhibit “B” attached hereto and incorporated here by reference. Consultant represents that it has the professional and technical personnel required to perform the Services expeditiously. Upon request of City, Consultant shall provide a more detailed schedule of anticipated performance to meet the Schedule of Services.” 3.2 Compensation. Section 3.3.1 of the Agreement is hereby amended in its entirety to read as follows: “Consultant shall receive compensation, including authorized reimbursements, for all Services rendered under this Agreement at the rates set forth in Exhibit “A” and Exhibit “B” attached hereto and incorporated here by reference. The total compensation shall not exceed Eight Hundred Twenty Thousand Three Hundred Twenty-Eight and 00/100 Dollars ($820,328.00) without written approval of the City Council or City Manager, as applicable.” 3.3 Continuing Effect of Agreement. Except as amended by this Amendment No. 1, all other provisions of the Agreement remain in full force and effect and shall govern the actions of the CONTRACT NO. From and after the date of this Amendment No. 1, whenever the term “Agreement” or “Contract” appears in the Agreement, it shall mean the Agreement as amended by this Amendment No. 1. 3.4 Adequate Consideration. The Parties hereto irrevocably stipulate and agree that they have each received adequate and independent consideration for the performance of the obligations they have undertaken pursuant to this Amendment No. 1. 3.5 Severability. If any portion of this Amendment No. 1 is declared invalid, illegal, or otherwise unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. 3.6 Counterparts. This Amendment No. 1 may be executed in duplicate originals, each of which is deemed to be an original, but when taken together shall constitute but one and the same instrument. STUDY OVERVIEW • Study Limits 0 0 0 Haystack Road between Highway 74 and Portola Avenue (1.3-mile-long segment). Five intersections including Alamo Drive, Chia Drive, Heliotrope Drive, Moon Lane, and Portola Avenue. Haystack and Highway 74 will be addressed by a separate effort starting soon. Data Collection o Incorporate traffic data and findings from the recently enacted speed study and the final draft of the Local Roadway Safety Plan. o The study will include additional crash data for crash reports filed since data was collected for the LRSP and E&TS. o Summarize the existing characteristics of the roadway - speeds, safety, current geometry, drainage characteristics, function, etc. o Engage stakeholders for subjective input Analysis o Conduct and present results of field visits to determine identifiable roadway deficiencies such as intersection corner sight clearance (e.g., overgrown landscaping, etc.), non-compliant markings and signage, opportunities or needs for pedestrian/bike crossing, intersection enhancements, etc. o Observe and recommend if any intersections along the roadway should be studied for changes in traffic control (e.g., multi-way stop analysis). o Summarize deficiencies and synthesize a purpose and need for improvements for Council confirmation. • Recommendations o Referencing national and state best management practices (BMPs), provide recommendations to lower motorist speeds, improve safety, and mitigate other deficiencies. o Illustrate and present concept-level improvements using the BMPs. PROJECT APPROACH AND SCOPE OF SERVICES KOA proposes the following Approach and Scope of Services to achieve the critical elements identified in the Study Overview. TASK 1 — PROJECT MANAGEMENT A. Project Coordination KOA will coordinate meetings with City staff, manage the project schedule, track items, organize and document meetings, prepare agendas, meeting minutes, presentations, action items, and the overall planning and organization of the project. Project meetings will include: • One kick-off ineeting to discuss project objectives, project schedule and the City's expectations. • Monthly project progress meetings or conference calls to discuss the identified safety issues and emphasis areas, with meetings by conference. • Calls to provide updates and discuss any project item as the project is being completed. • Coordination of community input and discussion of project findings. B. QA/QC KOA will utilize a Quality Assurance Plan to ensure that the project is consistent with city design guidelines and complete streets best practices. KOA has an established QA/QC program in place and is familiar with Caltrans QC checklists and other similar checklists used by other agencies. The customized QA/QC list that we will prepare for this project will include the relevant elements of KOA's standards that have been developed over the years through the incorporation of client feedback and industry standards. Deliverables: • Meeting agenda and minutes, presentations • Monthly invoices with progress reports • Scope, schedule and project budget TASK 2 - DATA GOLLECTION Data will be obtained to describe the roadway and operating characteristics of the project corridor. TASK 3 —COMMUNITY OUTREACH The consultant will strategize with the City staff to contact community members for participation in the study. Communication with the community will include preparing information flyers advertising meetings, to be hosted in-person or virtually. The consultant will develop a project web site that can be accessed by the public to view project information and obtain input through a questionnaire. We propose that three outreach opportunities be provided for the public to receive information and give input: Meeting 1: Provide an overview of the perceived purpose of the study and an opportunity for the public to express their concerns. A set of project goals will be drafted based on the community input that will measure the success of the project. Meeting 2: Present findings of the existing conditions and alternative concepts for improvements. Meeting 3: Present the recommended strategies for immediate benefit and mid-term/long-term solutions. Deliverables: • Meeting flyers. • Website content. • Meeting Power Point presentations. • Questionnaire. • Participants contact information (if provided). • List of project goals. TASK 4_ ROAD SAFETY AUDIT KOA staff will conduct a Road Safety Audit (RSA) of the Haystack Road corridor consistent with the Federal Highway Administration (FHWA) guidelines for conducting RSAs which considers the safety of the total transportation system. This will involve KOA staff doing a walkthrough of the corridor and noting deficiencies in the roadway, traffic, pedestrian, transit, and bikeway environments as per the FHWA check list for RSAs. Features that will be considered include lighting, ADA compliance, driveway density, pavement condition, drainage, pedestrian crossings, signing and markings, transit stops, sight distance, lane geometry, and numerous other factors. KOA staff will document typical and specific deficiencies with photographs. The RSA results will be documented in a written narrative supported by illustrative photos. Deliverables: • RSA report. Through the crash history we will identify any predominate crash patterns along with probable causes. The MUTCD identifies several factors in addition to 85 percentile speed for an engineering study of appropriate speeds on a roadway: • Road characteristics, shoulder condition, grade, alignment, and sight distance. • The pace. • Roadside development and environment. • Parking practices and pedestrian activity. • Reported crash experience for at least a 12-month period. KOA will utilize historical traffic counts provided by the City, or if not available, will authorize peak hour and daily traffic counts as a basis for warrant analysis at the five intersections. The warrant analysis will be used to determine if the appropriate traffic control is currently in place. Capacity analysis will be performed at the intersections to determine the existing level of service and level of service for alternative traffic control, including all way stop control and roundabouts. Based on the work performed in the previous tasks, KOA will draft a statement of purpose and need for the project. We will prepare an interim report that will include the initial public input, the results of the RSA and traffic analysis and the statement of purpose and need. KOA will prepare a Power Point presentation for briefing the Council on the project. Deliverables: • Crash analysis. • Speed analysis. • Operations analysis. • Statement of purpose and need. • Interim report on existing conditions. • Power point presentation. TASK 6— ALTERNATIVE IMPROVEMENT CONCEPT DEVELOPMENT KOA will assemble a toolbox of best management practice (BMP) strategies appropriate to addressing the deficiencies and achieving the goals identified in the first 5 tasks. We will collaborate with City staff on the selection of strategies to apply to Haystack Road. We will prepare conceptual layouts of alternative improvements on Haystack Road. We will prepare graphic illustrations of the concepts for presentation to the community. These will include both plan and perspective illustration. We anticipate that some improvements will be suitable for immediate implementation, and others for mid-term/long-term development. We will prepare opinions of probable construction cost for each of the alternatives. Deliverables: • BMP toolbox. Conceptual layouts and illustrations. Opinions of probable construction costs. As a basis for developing an implementation program, it will be important to first develop criteria by which the alternatives can be compared. We propose that factors to consider should measure how well the improvements achieve the goals for the project and meet the statement of purpose and need. These may include speed reduction, improved safety, pedestrian accessibility, parking, and other factors, all of which can be measured or estimated. Other factors to consider may be cost of construction and maintenance, aesthetics, utility impacts, funding opportunities, public endorsement, and more. KOA will prepare a list of evaluation criteria and a rating system for measuring each criterion. We will also prepare recommendation for the weighting of each criteria in the decision-making analysis. We will review the criteria, rating, and weighting recommendations with City staff. The alternative projects will be put into the decision matrix and the results reviewed with City staff. Staff will have the opportunity to fine tune the criteria, rating, and weighting assumptions. It anticipated that the decision matrix will be used by City staff and the Council to establish priorities for implementation. Deliverables: • Decision Matrix TASK 8 — RECOMMENDATIONS The previous tasks will result in a study that identifies the public concerns, safety and operations needs for the corridor, and a slate of possible improvements to address the concerns. Base on the outcome of the previous tasks, KOA will prepare recommendations for improvement of the corridor. We will document the public input, analysis, and recommendations in a study report, supported by graphic illustrations and technical appendices. We will prepare an executive summary, and a Power Point presentation of the study for community and Council presentations. Deliverables: • Study report. • Executive Summary. • Technical appendices. • Project Power Point presentations. FEE KOA proposes a fee not to exceed $99,897.00 to be invoiced at our contract rates.
