REQUEST: Accept Contract No. C35520C with Granite Construction Company,
of Indio, California for the San Pablo Streetscape Improvement
Project Phase I and Authorize the City Clerk to file the Notice of
Completion (Project No. 691-16)

Recommendation
By Minute Motion:
1. Accept Contract No. C35520C with Granite Construction Company, of Indio,
California for the San Pablo Streetscape Improvements Phase I Project
(Project No. 691-16); and
2. Authorize the City Clerk to file the Notice of Completion.
Strategic Plan
The improvements to the San Pablo Corridor fulfilled priorities identified in the City’s
Strategic Plan, including the following:
• Tourism and Marketing – Priority 1: “Improve access to Palm Desert and its
attractions to enhance the ease of lifestyle.”
• Transportation – Priority 1: “Create walkable neighborhoods and areas within Palm
Desert that would include residential, retail, services and employment centers, and
parks, recreation and open space to reduce the use of low occupancy vehicles.”
• Transportation – Priority 3: “De-emphasize single/low-occupancy vehicles and
optimize modes of travel (bus, carpool, golf-cart, bicycle and pedestrian).”
• Land Use - Priority 4: “Create a mixed-use city core integrating shopping, dining,
lodging, and housing.”
Background Analysis
On April 25, 2019, the City Council awarded Contract No. C35520C for the San Pablo
Streetscape Improvements Phase I to Granite Construction Company, of Indio, California,
in the amount of $7,941,158. At that time, the City Council authorized a twenty percent
(20%) contingency and authorized the City Manager to approve such changes up to that
amount. A total of $748,597.07 for Change Orders have been approved, bringing the
total contract amount to $8,689,755.07. The following table summarizes the Change
Orders that have been approved:

The work performed by Granite Construction Company has been inspected and found to
be in compliance with the contract requirements. The City and Granite Construction
Company are negotiating two claims related to the project. Once the negotiations are
concluded, the City Council will be presented with the settlement and a contract
amendment for the construction manager for additional services being rendered for claim

NOTICE IS HEREBY GIVEN:
1. That the interest or estate stated in paragraph 3 herein in the real property herein described is SOLELY
OWNED by the CITY OF PALM DESERT, A MUNICIPAL CORPORATION, a political subdivision of the State
of California, and whose address is 73-510 FRED WARING DRIVE, PALM DESERT, CALIFORNIA, 92260.
2. That the full name and address of the owner of said interest or estate is set forth in the preceding
paragraph.
3. That the nature of the title of the stated owner, as set forth in paragraph 1, is FEE.
4. That on the 13th day May of 2021, the work of improvement described as the San Pablo Streetscape
Improvement Project, Project No. 691-16 Contract No. C35520C, on the real property herein described was
completed.
5. That the name of the original contractor, if any, for said work of improvement was: Granite Construction
Company, 38000 Monroe Street, Indio, California, 92203.
6. That the real property herein referred to is situated in the City of Palm Desert, County of Riverside,
State of California, and is described as 44000 – 45000 San Pablo Avenue, Palm Desert, California 92260.
7. I, Kathleen Kelly, Mayor of the City of Palm Desert, am authorized to execute and file this Notice of
Completion with the County Recorder of the County of Riverside on behalf of the City of Palm Desert. I have
read the Notice of Completion and know the contents thereof; the same is true of my own knowledge. I
declare under penalty of perjury under the laws of the State of California that the foregoing is true and correct.
