26.REQUEST FOR DIRECTION REGARDING DRIVE-THROUGH RESTAURANTS
IN THE CITY OF PALM DESERT
Dear Honorable Council Members,
Regarding the above referenced Agenda Item, I would like to share some new ideas andcomments for your consideration.
I have previously commented on my opposition of the general idea of allowing drive-through restaurants along Highway 111. In the published Staff Report for this agenda I waspleased to read that Staff is recommending continued prohibition of drive-through uses inthe City’s “Downtown District”, the District Commercial Center (PC2), and the ResortCommercial Centers (PC4) Zoning Districts.
I am in full agreement with Staff’s discussions and explanations for this recommendedposition.
However, in addition to those locations, I would like to suggest for your consideration theprohibition of any drive-through uses in a few other locations that are listed in the RegionalCommercial Centers (PC3) Zoning District.
These locations are:
• Town Center Plaza shopping center (Trader Joes) at the southeast corner of Fred WaringDrive and Town Center Way.
• Palms to Pines West shopping center (McDonalds and Smart & Final) at the southeastcorner of Highway 111 and El Paseo.
• Plaza Way shopping center (Staples) at the southeast corner of Highway 111 and PlazaWay.
• 111 Town Center shopping center (Whole Foods) at the southwest corner of Fred WaringDrive and Town Center Way.
The primary reason I recommend prohibition of drive-through uses at these locations ismostly due to the parking lot situations and current street traffic. These particular parkinglots are not at all conducive for adding drive-through uses, as they currently barely functionproperly for the uses that are existing there now.
These locations could be excluded and yet remain in the PC3 zone. I am also inagreement with Staff that the existing FCOD should continue to allow drive-through uses. In addition, the following locations could offer some potential for drive-through uses.
• The Desert Crossings shopping center (Target)
• Westfield Mall.
• Waring Plaza shopping center (Outback, PGA Superstore)
• Walmart Neighborhood Market shopping center
Staff has correctly recommended “continuing to use the Conditional Use Permit (CUP)process to evaluate drive-through restaurant proposals for adherence to the City’s goalsand objective related to operations, screening, and design. Drive-through restaurantsshould continue to require a CUP that must be approved by the City’s Architectural ReviewCommission (ARC) and the Planning Commission for design, land use compatibly, parking,
and location.” This is a critical process in any consideration of additional drive-throughuses anywhere in the City.
The list of various Development Standards and Design Guidelines should be given carefulconsideration, as many of them would be of utmost importance to any new drive-throughdevelopment. The requirement to create outdoor dining areas is an excellent suggestion. Off-site improvements are also a serious consideration, especially as our sewage disposaland storm drainage could be negatively impacted easily. Lighting considerations are alsoimportant to the City and the Valley as a whole.
One particular Development Standard listed seems much less than a minimum however. The item: “Drive-through restaurants cannot be located within 200 feet of a residentialzoned property (excluding mixed-use). Certain shopping centers within the PC3 zone arenear residential neighborhoods. Creating a 200-foot buffer would help alleviate anypotential impacts such as noise from the ordering board/speakers, lighting, idling of cars,and trash.” This would indicate that 200 feet could serve as a buffer, in all reality, 200 feetrepresents barely enough distance to be across the street from nearby residential uses. This “buffer” should be considered carefully if any less than 500-1,000 feet is suggested.The trash alone would pose an enormous problem with added clean up required in nearbyresidential neighborhoods, as well as the ever-present environmental problem with crows inthe trash. Loitering activity is also a major security consideration near family homes.
City Council is offered two recommendations for action regarding drive-through changes. Itwould seem that with this discussion only in the initial consideration stages, that the Staff’srecommendation of “Provide staff direction to research additional items related to drive-through restaurants for further City Council consideration.” would be the prudent action atthis time. Traffic studies, infrastructure research, and environmental considerations shouldall be given more serious attention prior to moving ahead toward Public participation or anychanges in the City’s Zoning Ordinance Agreement.

Council members:
A couple of months ago, I registered my objections to relaxing the ban on drive-thru restaurants anywhere in Palm Desert
except for the I-10 corridor where they are established. That’s the only location a city that cares about the quality of life
should permit such noisy, traffic-inducing, effluent-spewing establishments to do business.
Many of us moved here expressly to avoid the welcome intrusion such expedient businesses present. I understand the
appeal of the revenue the city would realize. Many of us moved here because some things are more important than
money. Less traffic/congestion (how can you tolerate the clustersuck that is the intersection of Fred Waring and 111 even
now???). Less noise. Less carbon and other harmful constituents of our seriously compromised air quality. We can’t do
much about the wind and dust, but we can do something about exacerbating its deleterious effects.
None of the “proposed” sites enumerated by “staff” (below) is acceptable except for the one adjacent to the I-10. And
please don’t fall for typical developer crap about the pandemic inspiring greater interest in drive-thru establishments. Even
if it were a legitimate claim, it’s a transitory one. Restaurants here provide curb service, food delivery services abound.
You should be supporting small, unique businesses that give Palm Desert character instead of the generic fast-food joints
that cheapen it. Please stop catering to the lowest common denominator of development lust. It’s mercenary, unhealthful,
and well beneath the kind of civic leadership we residents deserve.

A Discussion on Intentional, Responsible, Legacy Planning in Palm Desert
In Support of Distinctive, Local Businesses
The Desert Restaurant Association in conjunction with the Palm Desert Area Chamber of
Commerce offers the following analysis in regards to Drive-Thru Restaurants along the
Hwy 111 corridor in Palm Desert.
1) Initial discussions and outreach resulted in varying opinions among Residents,
Restaurateurs, fellow Business owners and Civic Leaders.
2) Below are Primary reasons identified thus far in favor of amending the 40 year
restriction on Drive-Thru restaurant efforts in Palm Desert:
A) Customer convenience
B) A Sense of Progress or a Community Growing Up
C) A Cool or Sizzle factor perceived in bringing contemporary “Hot Concepts”.
D) Additional or Enhanced Income for Commercial Property Owners
E) A sense of Palm Desert being “left behind”.
Full Discussions however often led to a deeper understanding and consensus with why
The Desert Restaurant Associations recommends continued support of keeping the Palm
Desert Hwy 111 corridor free of Drive-Thru Restaurant Efforts.
In stewarding a desirable and unique lifestyle, we favor decades of Palm Desert
Leadership working cooperatively and clearly with developers on appropriate locations,
while patiently Preserving Space for distinctive future local efforts.
1) A Healthy Lifestyle Checkmates modest convenience.
Traffic Ease, including Active Transportation (Walking, Biking,
Skating, Golf Cars) are long identified goals to enhance both Resident
Lifestyles and the Visitor/Guest experience. Promoting more idling
Car experiences along 111 has precisely the opposite effect.
2) Palm Desert currently offers a stunning array of dining options, including Fast
Food, Curbside Pick-up and Low Cost Super Market Deli Options.
.
3) Palm Desert has and continues to welcome Drive Thru efforts to
alternate areas deemed more appropriate than our primary corridor.
Example: a major chain denied access to the protected 111 area
threatened to “never do business in Palm Desert”, yet has now opted
to open in an alternate area of PD. The tail should not wag the dog.
4) Significant Investment in the San Pablo corridor with the stated goal of developing
Local Cafes and a Walking/Biking connection between Civic Center and 111/
El Paseo is an effort directly opposed to new Cookie Cutter Fast Food efforts.
We must recognize the seasonality of our Restaurant economy and new
Drive Thru’s developed within blocks of San Pablo threaten our Community
Investment, as well as the efforts of small local operators staking livelihoods
on historical support of local efforts in Civic Planning and Development.
5) Existing Fast Food and Easy/Low Cost local efforts have adapted to the goal
of keeping an ease to the Palm Desert lifestyle. To change the rules on long
time community supporters is a betrayal of some of our finest local residents
and supporters, who understood how to keep Palm Desert special.
6) Commitments have been made by The City of Palm Desert to those developing
off the protected Hwy 111 corridor in line with decades of guidance. Most recently
to the Monterey Crossing Development, but additionally to established
developments who proceeded and thrive in line with historical guidance.
7) Finally, even one exception will open the floodgates. We will end up looking
and feeling like every other town. There is a reason we live here and a reason
our guests love visiting. We must vigilantly maintain our unique community.
We ask that our Council continue to maintain the Hwy 111 corridor standard of a Drive
Thru free zone, and continue to encourage distinctive and unique dining in Palm Desert.

Always avoid exercising near high-traffic areas.
Ground level ozone pollution endangers everyone’s health, but some are at an even
higher risk. These group include children, older adults and people who work outside.

For every 10 minutes of idling you cut from your life, you’ll save one pound of carbon dioxide —
a harmful greenhouse gas — from being released into the atmosphere.
It makes us healthier: Idling is linked to increases in asthma, allergies, heart and lung disease
and cancer. Kids are especially vulnerable because they inhale more air per pound of body
weight.
Idling cars generate around 30 million tons of CO2 per year. Just 10 minutes of idling produces
one pound of CO2. Children are particularly at risk from this pollution, since they breathe 50%
more air per pound of body weight than adults. Fine particles from exhaust can cause lung
damage, aggravate asthma and bronchitis, increase heart disease, and lead to cancer and
premature death.
The Department of Energy has four primary recommendations for idle reduction, and one is:
“Avoid using drive-thru. Shut off your engine, and walk inside.”
Strong Towns –
No doubt there will be strong pressure from chains on city planning departments to approve their
new, drive-through-heavy, template designs even in urban environments where they’re not
appropriate. Cities should be prepared to resist that pressure. But will they be? Or will they buy
into the simplistic notion that the drive-through, thanks to COVID-19, is now the future?
If they do buy into it, it’ll be because of the natural human tendency to overreact to temporary
circumstances with far-reaching solutions—typically the first solution that comes to mind, feels
good, and is politically or practically feasible in a hurry.
A drive-through is a markedly low-returning land use, in terms of the tax revenue it brings in
versus other uses of the same land. It just so happens that the article that first brought Strong
Towns to many readers' attention way back in 2012 was a proof of exactly this concept: a brand
new Taco John's in Brainerd, Minnesota, when you actually do the math, is significantly less
valuable than even a fairly drab, run-down strip of small local storefronts. Total value of the
“Old and Blighted” block: $1,104,000. Total value of the “Shiny and New” drive-through Taco
John’s block: $618,000.
The reason is simple: the amount of non-place a drive-through restaurant requires is massive, and
this drives the value down. It's not just the driving lanes and parking lot; it's things like
stormwater buffers that end up being required to make up for all that asphalt.
The drive-through just happens to be the tool that a certain set of corporate chains have already
adapted to their needs and business model. It’s one that comes with heavy downsides for cities,
so don’t let COVID be the reason your town thinks twice about limiting or banning new ones.
You’ll be fine without them.
The most common argument against restricting drive-throughs—other than the simple "Some
people like them," which shouldn't hold water against the obvious harm them do to the
surrounding environment and your city's finances—concerns people with unique needs that are
served by a drive-through arrangement.
Maybe you have a disability and going inside the business is a significant hassle, unsafe,
or impossible for you.
Maybe you are high risk for COVID complications for one or more reasons, and so you
are really are not comfortable going in, even just to stand in line for take-out.
Maybe you are a parent with a young child, who is spared by the drive-through from the
need to unbuckle your kid from a car seat and get them into a stroller all while averting
any meltdowns.
What I would say here is don't fall into the trap—or let your local leaders and advocates fall into
the trap—of conflating "Solving Problem X is necessary" with "Solution Y is one way to solve
Problem X, and therefore Solution Y is necessary."
There are a lot of ways to meet these needs, when we start to get creative. Establishments are doing
creative things with take-out windows, or similar makeshift solutions such as putting a table at your
restaurant or coffee shop’s front door and letting it serve as the take-out station. Curbside pickup is now
common at many stores, so that you can wait for your order in a nearby parking space without leaving
your vehicle (or unbuckling that car seat).
There are few things that can more quickly sap a street's appeal as a walkable commercial destination than
a drive-through or two.

Subject:Drive-thru restaurants
I would like to state that I am opposed to drive-thru restaurants in Palm
Desert unless they are located right off the I-10 highway. I do not believe
drive-thru restaurants belong in a city where a priority has been to look at
environmental impact and quality of life. As our city's vision looks to
providing a healthy and welcoming environment, where walking and bike
riding is encouraged, the thought of idling vehicles in nearby shopping
areas does not make sense. I do believe it will impact nearby stores and
sit-in restaurants with pollution and noise.
Please reconsider this proposal and only allow drive-thru restaurants near
the highway. Let us all be stewards of our city and keep Palm Desert as
pristine as possible.

As I am unable to attend this meeting, I would appreciate if you would read my comments aloud in your
meeting today.
I have attached a link to an article with facts about the environmental impact of drive-thru businesses. Some
areas in California have already banned these Drive-thru businesses.
Whether you agree or not with climate change facts. Drive through businesses cause excessive idling cars to
produce excess emissions.
This is not something I want or expect a modern town like Palm Desert to even consider.
I know a lot of people move to the desert to enjoy the fresh air and sunshine that we are blessed with.
I have heard from a few people that have complained it's too hot here to get out of your car. If you're unhappy
about not being able to drive through I would highly recommend food delivery services. If you can afford idling
your car and wasting that much gas it would be much cheaper to call Doordash or Uber eats etc..

Dear Council,
Palm Desert is an oasis with a unique and classy culture in this valley. Please do not overturn the ordinance
banning drive thru fast food places. I will increase pollution and drive business away from our local specialty
restaurant owners. It will crowd parking lots and entrances and exits with idling cars. Our culture and motto
is slowing the pace and enjoying the beautiful place we call home. Drive ‐thru fast food does not fit our
culture, which many of us would like too retain as the valley's population grows.
Please consider. We don't need this to prosper. Let those people driving through stop somewhere else. We
have more to offer to those driving through who want to stop and have a bite and meet the beautiful people
serving them at a local place and take a short time with their loved ones to take in the mountain view after a
hike or before they go to a show or hit the road to go home.

Palm Desert City Council Members,
I am commenting on agenda item 26 the Drive‐Thru ordinance should be lifted from the city of Palm Desert as it imposes
on people with disabilities and elderly communities. This ordinance discriminates and prevents folks from accessing
businesses. I feel strongly that this ordinance also hurts local economy, preventing new businesses from coming to Palm
Desert and sending the constituents to other cities in the Coachella Valley to spend money.
I would also like to comment on Agenda item 28. Although I support the zoning and districting of an overlay district in
the San Pablo and University Park areas, I feel strongly that Palm Desert should add the creation of voting districts to this
special election. The city has ignored the pleas of the citizens for too long. To serve the unheard and marginalized voices
of the city, Palm Desert needs to create voting districts and offer the citizens the chance to elect people that look like
them and hold their same values.

Hello!
I would love to see drive‐thrus popping up in Palm Desert. I spend a lot of time in my car during the heat of the day. I try
to avoid being in your city during lunchtime due to your lack of vehicle access to fast foods. Quite frankly, being an older,
heat‐sensitive guy (why oh why do I live in the desert?), I prefer to remain in my air conditioned car in a drive‐thru
versus parking in the blazing sun, walking in the heat, standing in line, then returning to a sweltering car. I know…First
World problems. Financially, PD will benefit from the tons of money I’ll now spend, rather than considering Palm Desert
a city that I simply must “drive through”!

Honorable Mayor Kelly, Mayor Pro Tem Harnik & Council Members,
As you deliberate lifting the ban on drive‐thru restaurants, please consider that there is a sector of the our population
who would appreciate and benefit from the convenience of getting food at a drive thru restaurant….from young
families with kids, college student with budgets and healthy appetites, workers on the go, people who have limited
resources and/or limited time to do inside dining, etc.
A quick poll our “Nextdoor” online group regarding how they felt about drive thru restaurants quickly received eighty
replies both for and against with varying reasons. You may be able to access the comments by googling “Nextdoor
South of Haystack”
The staff report did a very good job of addressing potential location solutions and zoning so the aesthetics of Hwy 111
can be maintained which is a desire of many.

Council members:
A couple of months ago, I registered my objections to relaxing the ban on drive-thru restaurants anywhere in Palm Desert
except for the I-10 corridor where they are established. That’s the only location a city that cares about the quality of life
should permit such noisy, traffic-inducing, effluent-spewing establishments to do business.
Many of us moved here expressly to avoid the welcome intrusion such expedient businesses present. I understand the
appeal of the revenue the city would realize. Many of us moved here because some things are more important than
money. Less traffic/congestion (how can you tolerate the clustersuck that is the intersection of Fred Waring and 111 even
now???). Less noise. Less carbon and other harmful constituents of our seriously compromised air quality. We can’t do
much about the wind and dust, but we can do something about exacerbating its deleterious effects.
None of the “proposed” sites enumerated by “staff” (below) is acceptable except for the one adjacent to the I-10. And
please don’t fall for typical developer crap about the pandemic inspiring greater interest in drive-thru establishments. Even
if it were a legitimate claim, it’s a transitory one. Restaurants here provide curb service, food delivery services abound.
You should be supporting small, unique businesses that give Palm Desert character instead of the generic fast-food joints
that cheapen it. Please stop catering to the lowest common denominator of development lust. It’s mercenary, unhealthful,
and well beneath the kind of civic leadership we residents deserve.
