Case No. CUP 11-78 - ROMITTI 'S WINE CELLAR, Applicant Request for an Amendment to a Conditional Use Permit and Associated Parking Variance to allow a restaurant to expand its eating area, 400 sq.ft. into an outdoor patio without providing additional required parking located at the northeast corner of El Paseo and Lark- spur Lane. Mr. Sawa advised the Planning Commission that the E1 Paseo Sandwich Shop request for outdoor seating was continued to the meeting of July 15, 1981, in order to allow further study of the ramifications of outdoor seating for various types of restaurants. Staff felt it would be appropriate to continue this request to July 15, 1981, so that it can be considered concurrently with the E1 Paseo Sandwich Shop request and outdoor seating policy. Motion was made by Commissioner Richards, seconded by Commissioner Berkey, to continue this case to July 15, 1981. Carried unanimously (4-0) . Mr. Sawa reviewed the main points from the staff report and concluded by advising the Commission that this rezoning will complete the prezoning process in the north sphere area. Commissioner Kryder opened the Public Hearing and asked if anyone wished to speak in FAVOR or OPPOSITION to this case. There being none, the Public Hearing was closed. Minute motion was made by Commissioner Richards, seconded by Commissioner Berkey, to adopt findings as recommended by staff. ENVIRONMENTAL ASSESSMENT: The Director of Environmental Services has determined that the proposed project will not have a significant adverse impact on the environment and a Negative Declaration has been prepared. 4 STAFF REPORT PAGE TWO CASE NO. C/Z 05-81 JUNE 17, 1981 II. BACKGROUND (Cont. ) D. PREVIOUS PERTINENT CASES: Annexation No. 13 - subject sites are a part of annexation of north sphere area; prezoning°of sites are necessary for application to LAFCO. E. DESCRIPTION OF PROPOSAL: Parcel "A" - 38.6 acres. Parcel "B" - 20 acres. Parcel "C" - 9.3 acres. III. DISCUSSION: The proposed Change of Zone was initiated by the City of Palm Desert in order to complete prezoning of a proposed annexation north of Country Club Drive. All the other parcels of land have been prezoned through applications from property owners actively pursuing annexation. Parcels "A" and "C" are indicated on the General Plan as Low Density Residential (3-5 d.u./acre maximum) . The proposed Change of Zone would zone the properties 5 d.u./acres, which is the maximum permissible by the General Plan. Parcel "B" is in an area dual designated as a future park site or Low Density Residential (3-5 d. u./acre maximum) . During the initiation proceeding on May 20, 1981 , Staff recommended that this parcel be considered for Open Space zoning. The Planning Commission, at that time, felt since the property is dual designated that it should be zoned residential . Should the City wish to develop a park on this site or any nearby site, future rezoning to Open Space and acquisition of the land will be necessary. A north sphere specific plan is also proposed for the area north of Country Club Drive. This plan will further refine proposed land uses including this park. In order to recommend a Change of Zone to the City Council , it is neces- sary for the Planning Commission to develop reasons for the recommendation and determine compliance with the General Plan. The reasons for this Change of Zone are as follows: 1 . Prezoning is necessary to complete annexation of the properties. 2. Existing zoning (R-1 12,000 Riverside County) is not deemed appropriate for the sites. The proposed Change of Zone is in compliance with the General Plan as previously discussed in this report. IV. The proposal will result in a change in the natural topography by virtue of grading, building and paving activities associated with development. Compliance with applicable Municipal Codes at time of construction, will mitigate any adverse impacts. e. The proposal may result in temporary construction impacts related to wind erosion of soils, but City requirements for watering during grading activities should reduce any impact to an insignificant level . Development of the site would tend to stabilize soils to eliminate future wind erosion of blowing sand. 3. WATER The proposal will pose an incremental increase for domestic water supply, but will not result in an over-draft condition. b. The proposal will result in a change in absorption rates, drainage patterns, and the rate and amount of surface water runoff by virtue of development. Compliance with applicable grading ordinances at time of development will mitigate adverse impacts. 5. ANIMAL LIFE The proposal may involve maintaining domestic animals by project occupants. Existing mammals and rodents and reptiles on the site will probably be displaced. Landscaping on the site will probably provide a new habitat for birds and insects. b.& d. The proposal is within the habitat range of the Fringe-toed Lizard (a threatened species). The Palm Desert General Plan makes specific provision for maintenance of a defined natural habitat area (Sand Dunes Park) as a partial mitigation of the impact of urbanized uses. Additionally, provisions are being made to provide a permanent habitat for them north of Inter- state 10. 11 .& 12. The 20 acre site located approximately 1 ,330 feet north of Country Club Drive and 1 ,660 feet west of Cook Street is generally dual designated on the General Plan as Low Density Residential 3-5 d.u./ac. and open space (park site) . With the proposed change of zone the site would be zoned Residential . In order to provide a park site in the area as designated in the General Plan, the City will have to initiate future action on the subject site or on a nearby site. 14. EMPLOYMENT As property is developed new jobs may be created. No mitigation measures are necessary. 15. HOUSING The proposal may result in new dwelling units of varying types, prices, occupancies. No mitigation measures are necessary. 16. TRANSPORTATION/CIRCULATION a. The proposal will result in the generation of additional vehicular P P movements , as a result of new residential development. TRANSPORTATION/CIRCULATION (cont. ) New vehicle trips depending on seasonal occupancy fluctuations and resident characteristics, plus non-resident recreation users will be generated. The site is served by various road types which are adequate in design capacity to handle the anticipated traffic volumes. 17. PUBLIC SERVICES The area under consideration is presently undeveloped and under juris- diction of the County of Riverside. As such, the present need for public services (fire protection, police protection, schools, parks, public facility maintenance and other governmental services) is very minimal . The subject properties are outside the 5 minute response area for fire protection and as such will be required to pay a fee for provisions of fire facilities as a condition of approval or as determined by Ordinance.
