Project Descri tion: Preannexation Change of Zone from W-2-20 (Riverside County) to
PR-5 and PC 2 .
This is to advise that the City of Palm Desert has made the following determinations
regarding the above described project:
1. The project has been approved by the City;
2. The project ( ) will (xx) will not have a significant effect on the environment;
3. An Environmental Impact Report was not prepared in connection with this project;
and,
4. A Negative Declaration was prepared for this project pursuant to the provisions of
CEQA. A copy of the Negative Declaration may be examined at the above City
Hall address.

MR. CARLO VETRANO, 6101 Montecito Circle, Palm Springs , ex-
plained that he wants to provide a place for his customers to sit.
He stated that his City license was issued as an "eating and drinking
place" and not a "restaurant". He did not want to convert to restau-
rant but according to state codes he would have to in order to provide
seating for his customers.
Commissioner Berkey asked staff for a definition of
"restaurant" and "delicatessen" .
Mr. Diaz explained the didfferences between state health and
safety requirements and City zoning standards.
Chairman Miller asked if anyone else would like to speak in
FAVOR or OPPOSITION to this case. There was none; the public
testimony was closed .
Moved by Commissioner Berkey, seconded by Commissioner Kryder,
to adopt findings as recommended by staff. Carried 5-0.
Moved by Commissioner Berkey, seconded by Commissioner Kryder,
to approve this case by adoption of Planning Commission Resolution No.
747 , subject to Conditions. Carried 5-0.

WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 29th day of September, 1981, hold a duly noticed public hearing to consider
a request by DAVID FREEDMAN CIO LIONEL STEINBERG for approval of a preannexation Change
of Zone from W-2-20 (RIVERSIDE COUNTY) To PR-5 (Planned Residential , max. 5 d.u./acre)
and PC (2) (Planned District Commercial Center) and a Negative Declaration of Environ-
mental Impact for 320 acres on property located at the future intersection of Frank
Sinatra Drive and Monterey Avenue, more particularly described as:

WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental Quality
Act, Resolution No. 80-89" , in that the Director of Environmental Services has deter-
mined that the project will not have a significant adverse impact on the environment
and a Negative Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts to justify their actions, as described below:
1. Prezoning is necessary to complete annexation of the property.
2. Existing zoning (W-2-20 Riverside County) is not deemed
appropriate for the site.
3. The proposed Change of Zone would be compatible with the adopted
General Plan.
4. The land use and density resulting from the change of zone would
be compatible with adjacent land uses.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Commission in these cases;
2. That the Planning Commission does hereby recommend to the
City Council approval of a Change of Zone from W-2-20 (Riverside
County) to PR-5 (UA) and PC (2) (UA) as shown on attached
Exhibit A.
3. That a Negative Declaration of Environmental Impact is recommended for
approval .

C. ENVIRONMENTAL ASSESSMENT:
The Director of Environmental Services has determined that the proposed
project will not have a significant adverse impact on the environment
and a Negative Declaration has been prepared.
D. DISCUSSION:
The property in question is within the County of Riverside jurisdiction.
The site partially abuts the Steinberg property (C/Z 03-81(UA) near
the northeast corner. The Ellesmere property (C/Z 06-81(UA) abuts the
site on the east. On the south is the Palm Desert Greens Country Club,
which is in the county area. On the west is property in the City of
Rancho Mirage.
The property consists of approximately 320 acres, of which 300 acres is
proposed PR-5 (5 d. u/acre), and 20 acres is proposed PC (2) (Planned
District Commercial Center) . Based on the proposed density of 5 d.u/acre,
a maximum of 1500 units could be built.
The General Plan indicates the area as Low Density Residential (3-5
d.u/acre) , with some District Commercial at the northwest corner of the
site. The proposal as submitted is in compliance with the General Plan.
A specific plan will be done for the North Sphere area which includes the
subject site. At that time, precise land uses , densities and circulation
patterns will be established. The north and south boundaries of the site
coincide with the probable future extensions of 36th Avenue and Frank
Sinatra Drive, respectively.
No plans for development of the property have yet to be prepared. However,
development will probably be a Country Club type of project.

In order to recommend a Change of Zone to the City Council , it is
necessary for the Planning Commission to develop reasons for the
recommendation and determine compliance with the General Plan. The
reasons for this Change of Zone are as follows:
1. Prezoning is necessary to complete annexation of the property.
2. Existing zoning (W-2-20 Riverside Co. ) is not deemed appropriate
for the site.
3. The proposed Change of Zone would be compatible with the adopted
General Plan.
4. The land use and density resulting from the change of zone would
be compatible with adjacent land uses.
II. RECOMMENDATION:
Based on findings contained above and in draft Resolution, adopt findings as
noted above and adopt Planning Commission Resolution No.
"A Resolution of the Planning Commission of the City of
Palm Desert California, recommending to the City Council
approval of a preannexation Change of Zone from W-2-20
(Riverside Cc) to PR-5 and PC(2) and a Negative Declara-
tion of Environmental Impact on property located at the
future intersection of Frank Sinatra Drive and Monterey
Avenue.

1. EARTH

level . Development of the site would tend to stabilize soils to
eliminate future wind erosion on blowing sand. Mitigation measures

3. WATER
The proposal will pose an incremental increase for domestic water supply,
but will not result in an over-draft condition.
b. The proposal will result in, a change in absorption rates , drainage
patterns, and the rate and amount of surface water runoff by virtue
of development. Compliance with applicable grading ordinances at
time of development will mitigate adverse impacts. Additional
mitigation measures will -be imposed at the time development is
proposed.
5. ANI14AL LIFE
The proposal may involve maintaining domestic animals by project occupants.
Existing mammals and rodents and reptiles on the site will probably be
displaced. Landscaping on the site will probably provide a new habitat
for birds and insects.
b. & d. The proposal is within the habitat range of the Fringe-toed
Lizard (a threatened species). The Palm Desert General Plan
makes specific provision for maintenance of a defined natural
habitat area (Sand Dunes Park) as a partial mitigation of the
impact of urbanized uses. Additionally, provisions are being
made to provide a permanent habitat for them north of Interstate
10.
14. EMPLOYMENT
As property is developed new jobs will probably be created, especially
in commercial areas. No mitigation measures are necessary.
15. HOUSING
The proposal may result in approximately 1 ,500 dwelling units of varying
types, prices, occupancies. No mitigation measures are necessary.
16. TRANSPORTATION/CIRCULATION
Due to the fact that the land is vacant and no streets exist, traffic
will be generated as the property is developed.
New vehicle trips will vary depending on commercial types of businesses,
seasonal occupancy fluctuations and resident characteristics , non-resident
recreation users.

The site will be served by various road types which are adequate in design
capacity to handle the anticipated traffic volumes. Mitigation measures

jurisdiction of the County .of Riverside. As such, the present
need for public services (fire protection, police protection,
schools, parks, public facility maintenance and other govern-

- topographic contours at intervals of not more than two (2) feet.
12. The applicant shall submit a list of all owners of property located within
300 feet of the exterior boundaries of the subject property. The list shall
be keyed to a map showing the location of these properties and shall include
the name and address as shown on the latest available assessment role of the
Riverside County Assessor's Office.
13. The applicant shall submit a completed Environmental Assessment form.
14. The applicant shall provide such additional information as the Director of
Environmental Services may require to determine whether the granting of a
Change of Zone would endanger the public health, safety, or general welfare.
