Approval of a Change of Zone, upon annexation from R-2 12,000 (County of Riverside)
to PR-5 (Planned,,Residential , 5 d.u./acre) and a Negative Declaration of Environmental
Impact for 161 acres located between 36th Avenue (future) and Frank Sinatra Drive
(future) , 1,300 feet west of Portola Avenue (future) .

I. ANALYSIS:
A. ADJACENT ZONING/LAND USE:
North: PR-5 (UA)/Vacant
South: R-T and R-1 12,000 (Riverside Co)/Residential
East: W-2-20 (Riverside Co)/Vacant
West: W-2-20 (Riverside Co)/Vacant
B. GENERAL PLAN LAND USE DESIGNATION:
Low Density Residential , 3-5 d.u./acre
C. ENVIRONMENTAL ASSESSMENT:
The Director of Environmental Services has determined that the proposed
project will not have a significant adverse impact on the environment
and a Negative Declaration has been prepared.
D. DISCUSSION:
The property in question is within the County of Riverside jurisdiction.
The property abuts the Steinberg property (C/Z 03-81 (U.A. )) on the north.
On the south, the site abuts the Palm Desert Greens Country Club and Santa
Rosa Country Club, both of which are in the County area. Therefore, annex-
ation of this property is contingent upon the Steinberg property being
annexed.
The property consists of 161 acres of vacant land (1321± feet by 5333±
feet) . Based on the proposed density of 5 d.u./acre (PR-5), the maximum
number of units possible would be 805.
The ro osal ,,.as requested, is in compliance with the General Plan which

indicates low density residential (375 d::u,!/acre) for the subject site.
A specific plan will be done for the North Sphere area which includes
the subject site. At that time, precise land uses, densities and circu-
lation patterns will be established. The north and south boundaries.of
the site coincide with the future extensions of 36th Avenue and Frank
Sinatra Drive, respectively.
No plans for development of the property have yet to be prepared. However,
it can be assumed development will be a Country Club type of project.

In order to recommend a Change of Zone to the City Council , it is
necessary for the Planning Commission to develop reasons for the
recommendation and determine compliance with the General Plan. The
reasons for this Change of Zone are as follows:
1. Prezoning is necessary to complete annexation of the property.
2. Existing zoning (R-2 12,000 Riverside County) is not deemed
appropriate for the site.
3. The proposed Change of Zone is in compliance with the General
Plan as previously discussed in this report.
II. RECOMMENDATION:
Based on findings contained above and in draft Resolution, adopt findings as
noted above and adopt Planning Commission Resolution No.
"A Resolution of the Planning Commission of the City of
Palm Desert, California, recommending to the City Council
approval of a preannexation Change of Zone from R-2
12,000 (Riverside County) to PR-5, upon annexation, and
a . Negative Declaration of Environmental impact for property
located between. 36th Avenue (future) and Frank Sinatra Dr.
(future) approximately 1300 ft. west of Portola Ave. (future) .

COUNTY) TO PR-5, UPON ANNEXATION, AND A NEGATIVE DECLARATION
OF ENVIRONMENTAL IMPACT FOR PROPERTY LOCATED BETWEEN 36TH
AVENUE (FUTURE) AND FRANK SINATRA DRIVE (FUTURE) APPROXIMATELY
1300 FEET WEST OF PORTOLA AVENUE (FUTURE) .

WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 4th day of August, 1981, hold a duly noticed Public Hearing to consider
a request by ELLESMERE PROPERTIES, INC. for approval of a Change of Zone, upon annexa-
tion from R-2 12,000 (County of Riverside) to PR-5 (Planned Residential , 5 d.u./acre)
and a Negative Declaration of Environmental Impact for 161 acres located between 36th

WHEREAS said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental Quality
Act, Resolution No. 80-89", in that the Director of Environmental Services has deter-
mined that the project will not have a significant adverse impact on the environment
and a Negative Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts to justify their actions, as described below:
1. The land use resulting from the Change of Zone would be
compatible with adjacent proposed land uses.
2. The density resulting from the Change of Zone would be
compatible with densities permitted in the adjacent areas.
3. The proposed Change of Zone would be compatible with the
adopted Palm Desert General Plan..
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in these cases;
2. That the Planning Commission does hereby recommend to the
City Council approval of a Change of Zone from R-2 12,000
(Riverside County) to PR-5 (Upon Annexation) as shown on
attached Exhibit "A".
3. That a Negative Declaration of Environmental Impact is hereby
recommended for certification.
