Mr. Sawa reviewed the staff report and stated the applicant is requesting Condition No. 5, undergrounding the utility poles, be waived because the poles would also service adjacent properties. Staff recommends that if the undergrounding is waived, a requirement or condition be added to relocate the poles if found necessary by staff and a future undergrounding agreement be signed by the applicant. (General Commercial, Scenic Preservation Overlay) for property located on the east side of Highway 74, approximately 120 feet south of El Paseo. APPLICANT: CITY OF PALM DESERT I. BACKGROUND: A. DESCRIPTION OF SITE: . The property in question consists of 16 parcels under two ownerships. The northerly 10 parcels, under one ownership, are developed with the Adobe Garden Hotel and Iron Gate Restaurant, with 3 of the 10 parcels vacant. The southerly 6 parcels are developed with the Carousel Resort Hotel and Lord and Lady Inn. One of the 6 parcels is vacant. The property in question fronts on Highway 74 and Ocotillo Drive to the east. There is a 10 foot wide pedestrian way indicated on maps between the ownerships. However, it has not yet been installed. Most of the construction is older and could use some rehabilitation. B. ADJACENT ZONING AND LAND USE: North: C-1/Commercial South: R-3 189000 (3) S.P./Multiple Family East: R-3 20,000 (3) S.P./Multiple Family and Vacant West: PR-6/Multiple Family C. GENERAL PLAN LAND USE DESIGNATION: Core Area Commercial and Related Use IL PROJECTION DESCRIPTION: The current General Plan adopted in 1981, indicated the property as Core Area Commercial and Related Uses. This is a departure from the previous General Plan Designation which was residential. Therefore, this Change of Zone has been initiated by the City of Palm Desert, in order to bring the property into consistency with the General Plan as required by State Law. The properties as described earlier are developed with hotels and restaurants. These uses would not have to be abated if the zone change is approved since both uses are permitted with a Conditional Use Permit. The uses may still be nonconforming with regard to parking, density or the CUP requirement. However, the uses can be continued and under certain conditions altered or enlarged. It appears that there will probably be upgrading of the facilities in the future. The condition of some of the facilities and the fact that there is vacant land supports this. Additionally, the owner of the Adobe and Iron Gate has shown staff -1- preliminary remodeling plans. Thus, rezoning of the properties to C-1, S.P. will provide an incentive to upgrade the land since the abatement would not be necessary. With the proposed rezoning, staff is recommending retention of the Scenic Preservation (S.P.) Overlay since Highway 74 is a designated state and local scenic highway. in. ANALYSIS: A. REASONS FOR REZONING: 1. Will bring zoning into consistency with General Plan. 2. Will eliminate need to abate current uses and provide incentive to upgrade facilities. B. ENVIRONMENTAL REVIEW: The Director of Environmental Services has determined that the proposed project will not have a significant adverse impact on the environment and a Negative Declaration of Environmental Impact has been prepared. IV. STAFF RECOMMENDATION: Based on reasons contained in this report, staff recommends approval of Resolution No. "A Resolution of the Planning Commission of the City of Palm Desert, California, recommending to the City Council approval of a Change of Zone from R-3, 180000 (3) S.P. to C-1, S.P. for property on the east side of Highway 74, approximately 120 feet south of El Paseo."
