AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, AMENDING
ORDINANCE NO. 107, THE PALM DESERT ZONING MAP
BY CHANGING THE ZONE FROM R-1 (SINGLE FAMILY
RESIDENTIAL) TO O.P. (OFFICE PROFESSIONAL) FOR
PROPERTY LOCATED AT THE NORTHEAST CORNER
OF LARREA AND LANTANA.
CASE NO. C/Z 03-82
The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN,
as follows:
SECTION 1: That a portion of Ordinance No. 107 referencing Section 25.46.1 of
the Zoning Ordinance , the Zoning Map (Chapter 35.46 of the Palm Desert Municipal
Code) is hereby amended to read as shown on the attached Exhibit "A".
SECTION 2: The City Clerk of the City of Palm Desert, California, is hereby
directed to publish this Ordinance in the Palm Desert Post, a newspaper of general
circulation, published and circulated in the City of Palm Desert, California, and shall be
in full force and effect thirty (30) days after its adoption.

A. STAFF RECOMMENDATION:
Waive further reading and pass Ordinance No. to second reading.
B. DISCUSSION:
The applicant is seeking a change of zone from R-1 (Single Family Residential) to
O.P. (Office Professional) in order to convert the existing residence to an office
use.
The General Plan designates the site Office Professional. The request to change
the zoning to O.P. therefore is in conformance with the Land Use element of the
General Plan.
Letters and petitions in favor of the application were received. One letter in
opposition was received. The letters and petition are attached hereto.
There was no one present at the. Public Hearing to speak in favor or opposition to
the application.
The Planning Commission adopted its Resolution No. 791, recommending approval
of the proposed change of zone to the City Council by the following vote: 4-0 with
Miller abstaining.

The applicant was not present.
Chairman Kryder asked if anyone present wished to speak in FAVOR or
OPPOSITION to this case. There being none, the Public Hearing was closed.
Moved by Commissioner Richards, seconded by Commissioner Wood, to adopt
findings as recommended by staff. Carried .unanimously 5-0.
Moved by Commissioner Richards, seconded by Commissioner Wood, to waive
further reading and adopt Planning Commission Resolution No. 790, approving TT 18495,
subject to conditions. Carried unanimously 5-0.

Request for approval of a Change of Zone from R-1 (Single
Family Residential) to O.P. (Office Professional) and a
Negative Declaration of Environrnental Impact for
property located at the northeast corner of Larrea Street
and Lantana Avenue.
Mr. Diaz reviewed the staff report and noted that previously the Planning
Commission denied a request for a Change of Zone to this property because rezoning to
C-1 for an unspecified use was not desirable. The applicant now wishes to have the
property rezoned to O.P. in order to convert the existing residence to an office use.
Letters have been received in favor and one in opposition. Staff recommended approval.
Chairman Kryder opened the Public Hearing and asked if, the applicant wished to
make a presentation. The applicant was present.
Chairman Kryder asked if anyone wished to speak in FAVOR or OPPOSITION to
this case. There being none, the Public Hearing was closed.
Moved by Commissioner Wood, seconded by Commissioner Richards, to adopt
reasons for change of zone as recommended by staff. Carried 4-0, with Commissioner
Miller abstaining.
Moved by Commissioner Richards, seconded by Commissioner Wood, to waive
further reading and adopt Planning Commission Resolution No. 791, recommending
approval of C/Z 03-82 to the City Council. Carried 4-0, with Commissioner Miller
abstaining.

WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 6th day of April, 1982, hold a duly noticed public hearing to consider a request by
CHARLES E. MILLER for approval of a change of zone from R-1 (Single Family
Residential) to O.P. (Office Professional) and a Negative Declaration of Environmental
Impact for property located at the northeast corner of Larrea Street and Lantana Avenue,
more particularly described as:
APN 625-132-004
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the California Environmental Quality Act,
Resolution No. 80-891', in that the Director of Environmental Services has determined that
the project will not have a significant adverse impact on the environment and a Negative
Declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
did find the following facts to justify their actions, as described below:
1. The land use resulting from the Change of Zone would be compatible with
r adjacent proposed land uses.
2. The existing residential use is no longer appropriate for the site due to
impact of commercial uses to north and west.
3. The proposed Change of Zone would be compatible with the adopted Palm
Desert General Plan.
4. Office use of the site will provide a buffer between the commercial and
residential uses and will be a good transitional land use.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the findings
of the Commission in these cases;
2. That the Planning Commission does hereby recommend to the City Council
approval of a Change of Zone from R-1 (Single Family Residential) to O.P.
(Office Professional).
3. That a Negative Declaration of Environmental Impact is hereby
recommended for approval.

Change of Zone from R-1 (Single Family Residential) to O.P. (Office
Professional) and a Negative Declaration of Environmental Impact for
property located at the northeast corner of Larrea Street and Lantana
Avenue.

1. BACKGROUND:
A. DESCRIPTION OF SITE:
The site is a lot currently zoned R-1 and developed with an older single
family residence with an attached two-car carport. The site is relatively
flat and void of any significant landscaping, except for a tall palm tree.
There are no curbs or sidewalks existing adjacent to the property.
B. ADJACENT ZONING AND LAND USE:
North: C-1, S.P; Commercial Office
South: R-1; Single Family Residential
East: R-1; Single Family Residential
West: C-1; Commercial Office
C. GENERAL PLAN LAND USE DESIGNATION:
The site is designated in the General Plan as Office Professional, the
request to O.P. zoning is therefore in conformance with the General Plan
and would be a good transitional use.
11. PROJECT DESCRIPTION:
A. PREVIOUS PERTINENT CASES:
In May 1979, the Planning Commission reviewed and denied a requested
Change of Zone from R-1 to C-1 (C/Z 05-79). The basis for the request was
that the property was located on a corner with commercial buildings to the
north and west. The Planning Commission's reason for denial of the Change
of Zone was that rezoning to C-1 for an unspecified use was not desirable.
Also, the Planning Commission felt it was premature to approve the
rezoning without having a plan to show how the traffic access would be
handled. Both of these concerns have been addressed in this application.
B. PROPOSED REQUEST:
The applicant wishes to have the property rezoned to O.P. in order to
convert the existing residence to an office use.
The applicant has submitted a plot plan indicating 6 off-street parking
spaces. This would comply with the parking requirements. Access is shown
from Lantana Avenue only with the spaces away from the adjoining
residenital land. Adequate land is provided for perimeter landscaping. If
this request is approved, it will be necessary for the applicant to file a
precise plan to use the building.
To date, staff has received 10 signatures (either on a petition or letter)
indicating approval of the zone change. Additionally, we have received one
letter of protest. This correspondence is attached for your review.
III. ANALYSIS:
A. REASONS FOR CHANGE OF ZONE:
1. That proposed Change of Zone would be compatible with the adopted
Palm Desert General Plan.
2. The land use resulting from the Change of Zone would be compatible
with adjacent proposed land uses.
3. The existing residential use is no longer appropriate for the site due
to impact of commercial uses to north and west.
4. Office use of the site will provide a buffer between the commercial
and residential uses and will be a good transitional land use.
B. ENVIRONMENTAL REVIEW:
The Director of Environmental Services has determined that the proposed
project will not have a significant adverse impact on the environment and a
Negative Declaration has been prepared.
IV. STAFF RECOMMENDATION:
Staff feels the proposed change of zone will be acceptable. The O.P. zones purpose
is to allow relatively low intensity office uses that are compatible with adjacent
residential uses. This request complies with that purpose, therefore, staff
recommends:
1. Approval of the reasons for the change of zone;
2. Approval of Planning Commission Resolution No. , recommending a
change of zone from R-1 to O.P.

11. The applicant shall submit a minimum of twelve (12) accurate scale drawings of the
site (one colored) and the surrounding area showing:

- access and utility easements
- topographic contours at intervals of not more than two (2) feet.

300 feet of the exterior boundaries of the subject property. The list shall
be keyed to a map showing the location of these properties and shall include

Riverside County Assessor's Office.
13. The applicant shall submit a completed Environmental Assessment form.
14. The applicant shall provide such additional information as the Director of
Environmental Services may require to determine whether the granting of a
Change of Zone would endanger the public health, safety, or general welfare.
