OF PALM DESERT, CALIFORNIA, AMENDING
ORDINANCE NO. 107, THE PALM DESERT ZONING MAP
BY CHANGING THE ZONE FROM R-3 (3) TO O.P. FOR
PROPERTY LOCATED AT THE SOUTHWEST CORNER OF
LARREA STREET AND LANTANA AVENUE.

The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN,
as follows:
SECTION 1: That a portion of Ordinance No. 107 referencing Section 25.46.1 of
the Zoning Ordinance, the Zoning Map (Chapter 35.46 of the Palm Desert Municipal Code)
is hereby amended to read as shown on the attached Exhibit "A".
SECTION 2: That a Negative Declaration of Environmental Impact is hereby
approved.
SECTION 3: The City Clerk of the City of Palm Desert, California, is hereby
directed to publish this Ordinance in the Palm Desert Post, a newspaper of general
circulation, published and circulated in the City of Palm Desert, California, and shall be
in full force and effect thirty (30) days after its adoption.

WHEREAS, the Planning Commission of the City of Palm Desert, California, did )n
the 18th day of May, 1982, hold a duly noticed public hearing to consider a r,Yplest by
CHORAL C. PEPPER for approval of a Change of Zone from R-3 (3) (Multiple family
residential, one d.u. per 3000 sq.ft. of lot area) to O.P. (Office Professional) and a
Negative Declaration of Environmental Impact for property lo,:ated at the southwest
corner of Larrea street and Lantana Avenue, more particularly described as:

WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the California Environmental Quality Act,
Resolution No. 80-89", in that the Director of Environmental Services lias determined that
the project will not have a significant adverse impact on the environment and a Negative
Declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
did find the following facts to justify their actions, as described below:
1. That the proposed Change of Zone would be compatible with and implement
the ado•pt.,d P.tl;n Desert General Plan.
2. The land use resulting from the Change of Zone would be compatible with
adjacent proposed and existing land uses.
3. The existing residential use is no longer appropriate for the site due to
impact of commercial uses to north and west.
4. Office use of the site will provide a buffer between the commercial and
residential uses and will be a good transitional land use.
5. The property has been used for commercial/office purposes and has not been
detrimental to the surrounding properties.
NOW, THEREFORE, BE IT RESOLVE;) by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the findings
of the Commission in these cases;
2. That the Planning Commission does hereby recommend to the City Council
approval of a Change of Zone from R-3 (3) (Multiple family residential, one
d.u. per 3000 sq.ft. of lot area) to O.P. (Office professional) as shown on
Exhibit "A" attached.
3. That a Negative Declaration of Environmental Impact is hereby
recommended for approval.

A. DP 06-81 AND TT 17794 - ALEX ADAMEK - Request for approval of a one
year and 18 month time extension, respectively, for a 62 unit condominium
project on the south side of Hovley Lane, 500 feet west of Portola Avenue.

VII. PUBLIC HEARINGS

Request for approval of a Change of Zone from R-3 (3)
(Multiple Family Residential, 1 d.u. per 3000 sq.ft. of lot
area) to O.P. (Office Professional) and a Negative
Declaration of Environmental Impact for property located
at the southwest corner of Larrea Street and Lantana
Avenue.
Mr. Sawa reviewed the staff report and stated that this building had previously
been occupied by the City's Public Works Department, but because it was a government

entity use did not require the rezoning of the site. Staff recommended approval.
Commissioner Wood felt that the building should have to be brought up to the
Office Use standards and asked staff if this would be a requirement. Mr. Sawa replied
that building code requirements might have to be implemented.
Chairman Kryder opened the public hearing and asked if anyone wished to speak in
FAVOR or OPPOSITION to this case. There being none, the public hearing was closed.
Moved by Commissioner Richards, seconded by Commissioner Wood, to adopt
reasons for approving this Change of Zone. Carried unanimously 4-0 (Commissioner
Crites was not present at this time)
Moved by Commissioner Richards, seconded by Commissioner Miller, to waive
further reading and adopt Planning Commission Resolution No. 802, recommending
approval of C/Z 05-82. Carried unanimously 4-0.
VIII. DESIGN REVIEW BOARD ITEMS
Preliminary plan approvals by the Design Review Board at its meeting of May 11,
1982 requiring Planning Commission confirmation.
A. Case No. 233 MF - SILVER SPUR ASSOCIATES - Preliminary design
approval for an addition/remodel to the tennis clubhouse at Ironwood
Country Club and an addition to the housekeeping service area on Mariposa
Drive.
B. Case No. 234 MF - OSCAR A. WIGGINS - Preliminary approval for a 10 unit
apartment on the west side of San Rafael Avenue, 125 feet south of
Catalina Way.
C. Case No. 169 C - HARRY M. BLACKFIELD, M.D. - Preliminary approval of
plans for the remodeling of existing commercial buildings with a 2,064
square foot addition at 73-960 and 73-970 El Paseo.
Rec: Approve by minute motion as presented.
Mr. Smith described the cases indicating that the Design Review Board approved
each case with conditions. He recommended approval.

Design Review Board's actions by minute motion. Carried unanimously 4-0 (Commissioner
Crites was not present at this time).

I. BACKGROUND:
A. DESCRIPTION OF SITE:
The 23,917 sq.ft. site is a lot currently zoned R-1 and developed with an
older single family residence. Until recently the site was used by the City
Public Works Department. The site is relatively flat and relatively well
landscaped. In the rear yard is a dirt filled spa and swimming pool. There
are no curbs or sidewalks existing adjacent to the property.
B. ADJACENT ZONING AND LAND USE:
North: C-1; Commercial
South: R-3 (3); Single family residential
East: R-1; Single family residential
West: R-3; Church, multifamily residential
C. GENERAL PLAN LAND USE DESIGNATION:
The site is designated in the General Plan as office professional. Therefore,
the request to O.P. zoninng is in conformance with the General Plan.
H. PROJECT DESCRIPTION:
A. GENERAL:
The applicant wishes to have the property rezoned from R-3 (3) to Office
Professional (O.P.) in order to use the existing structure for office use.
Until recently the building was used by the City Public Works Department.
The Public Works Department, being a government entity, did not need to
rezone the property for their use. Prior to the Public Works Department
use, the building was used for other commercial/office uses starting with
the editorial offices for Desert Magazine in 1964.
The existing building contains approximately 3700 sq.ft. of floor space which
requires 15 parking spaces for office use. There appears to be adequate
area to the rear of the building to provide the spaces. Ingress and egress is
possible to Lantana Avenue with a one way driveway possible to Larrea
Street.
Staff feels that the site would be acceptable with modifications to use as an
office. If this request is approved, the applicant will have to file a precise
plan and meet the standards of the O.P. zone to utilize the property for
office uses.
III. ANALYSIS:
A. REASON FOR CHANGE OF ZONE:
1. That proposed Change of Zone would be compatible with and
implement the adopted Palm Desert General Plan.
2. The land use resulting from the Change of Zone would be compatible
with adjacent proposed and existing land uses.
3. The existing residential use is no longer appropriate for the site due
to impact of commercial uses to north and west.
4. Office use of the site will provide a buffer between the commercial
and residential uses and will be a good transitional land use.
5. The property has been used for commercial/office purposes and has
not been detrimental to the surrounding properties.
B. ENVIRONMENTAL REVIEW:
The Director of Environmental Services has determined that the proposed
project will not have a significant adverse impact on the environment and a
Negative Declaration has been prepared.
IV. STAFF RECOMMENDATION:
Staff feels the proposed change of zone will be acceptable. The O.P. zones purpose
is to allow relatively low intensity office uses that are compatible with adjacent
residential uses. This request complies with that purpose, therefore, staff
recommends:
1. Approval of the reasons for the change of zone;
2. Approval of Planning Commission Resolution No. , recommending a
change of zone from R-3 (3) to O.P.

the above named project is proposed. Gas service to the project could be pro-
vided from an existing mein without any significant impact on the environment.

The availability of natural gas service, as set forth in this letter, is based
upon present conditions of gas supply and regulatory policies. As a public
utility, the Southern California Gas Company is under the jurisdiction of the
California Public Utilities Commission. We can also be affected by actions of
