GENERAL PLAN LAND USE DESIGNATION: Medium Density Residential , Lot consolidation, Scenic Preservation; 7-12 d.u./ac. (COD Specific Plan) C. ENVIRONMENTAL ASSESSMENT: The Director of Environmental Services has determined that the proposed project will not have a significant adverse impact on the environment and a Negative Declaration has been prepared. D. DESCRIPTION OF PROPERTY PROPOSED FOR REZONING: The lots proposed for rezoning are all the lots which front on the west side of Monterey Avenue, between Park View Drive and Rancho Grande (now vacated at Monterey Avenue) . The majority of the lots are STAFF REPORT C/Z 10-80 November 19, 1980 Page Two vacant with the exception of 8 lots. The five lots immediately south of Arboleda Avenue are developed with a 64 unit apartment complex. Three lots between Sonora Avenue and Rancho Grande are developed with a duplex, triplex, and 5-unit apartment on individual lots. Additionally, the southwest corner of Park View Drive and Monterey Avenue is developed with a Coachella Valley Water District well site. E. EXISTING ZONE AND DENSITY: The subject property is zoned R-2, S.P. which permits one (1) dwelling unit for every 4000 sq.ft. of lot area or 10.89 d.u./ac. F. RELATIONSHIP TO GENERAL PLAN: The property was designated 5-7 d.u./ac. by the 1975 General Plan. The COD Specific Plan redesignated the property 7-12 d.u./ac. which is in concert with the existing zoning of R-2, S.P. (10.89 d.u./ac. ) . The proposed General Plan Update may allow a higher density yet. Any, rezoning of the properties is required by State Law to be consistent with the adopted General Plan. G. PROPOSED REZONING: The proposal is to rezone the property to R-3, S. P. or other zone deemed appropriate. If rezoning occurs at this time, the permitted density must be between 7-12 d.u./ac. R-3 (4) , S.P. (Multi family Residential , one dwelling unit per 4000 sq.ft. of lot area, Scenic Preservation Overlay) would allow 10.89 d.u./ac. and thus be consistent with the General Plan. R-3 (3) , S.P. (14.52 d.u./ac. ) or any higher density would exceed the 7-12 d.u./ac. currently designated by the General Plan. III. DISCUSSION: Should the Planning Commission rezone the property to R-3, the density must be one dwelling unit per 4000 sq.ft. of lot area or R-3 (4) to comply with the 7-12 d.u./ac. designated by the General Plan (COD Specific Plan). It should be noted that the allowable density under R-3 (4), S.P. would be the same as the existing R-2, S.P. The major difference would be in permitted and conditional uses, and development standards. An option to rezoning at this time would be to continue this until the General Plan Update is completed since the subject property may be designated at a higher density and have to be rezoned again. IV. STAFF RECOMMENDATION: Based on the justification and findings contained in the draft Resolution: Recommend to the City Council , approval of a Change of Zone from R-2,-S.P. to R-3 (4) , S.P. by adoption of Planning Commission Resolution No. i PLANNING COMMISSION RESOLUTION NO. Mr. Diaz noted a petition was submitted by Mr. William Wilson, objecting to this zone change. There was a brief discussion on the matter of office/professional zones being considered during the General Plan Update. DISCUSSION AND JUSTIFICATION: Staff is recommending the Commission withdraw this zone change for the following reasons: 1. Staff is recommending a modification to the proposed ZOA 01-80 which would not require the subject property be R-3 to conditionally permit professional office uses. 2. The proposed rezoning would not result in a different density than is now permitted by the R-2, S.P. zone. 3. The General Plan Update may result in a higher density designation than either the existing or proposed R-3 (4) , S.P. zone allows, and therefore, necessitate a second rezoning. PUBLIC HEARINGS (cont. ) MR. GEORGE SWEET, 46-370 Ocotillo, Representative of the Palm Desert Property Owner's Association, explained that the lots on Verba Santa and Ocotillo are under the 18 foot height limit. He was concerned about the .grading and density. He also felt that the ordinance clearly defined that 2-story structures are not allowed. Chairman Miller asked the applicant for a rebuttal . Mrs. Stadelman briefly explained the grade change and pad heights and stated that they felt this project would be a positive contribution to the neighborhood. Chairman Miller closed the Public Hearing. Commissioner Kryder did not agree that there was an exceptional circumstance to this project. Commissioner Berkey agreed with Commissioner Kryder and noted that he did listen to the tape of this case from the meeting of September 30th, in which he was not present. He did not feel there were any justifications for granting a variance. Commissioner Richards felt that if the applicant was within the 18' height limitation and there was no invasion of privacy that this project or any similar project should be approved. Commissioner McLachlan agreed with Commissioner Richards but felt that a second floor or loft should be clearly defined before this is approved. Motion was made by Commissioner Berkey, seconded by Commissioner Kryder, to - deny this case by adoption of Planning Commission Resolution No. 651. Chairman Miller opened the Public Hearing asking if anyone present wished to speak in FAVOR or OPPOSITION to this case. Commissioner Berkey felt that the Commission had the right to act on this and did not agree to delay it. He stated that a number of people 'were concerned and it should be pursued. He added that if legal advise is_necessary than it should be obtained. Commissioner Richards felt that there were legalities involved as to whether the Commission can act on this or wait until the General Plan Update is completed. He, therefore, felt that it should be necessary to contact the City Attorney. CALL TO ORDER The regularly scheduled meeting of the Palm Desert Planning Commission was called to order at 1:02 P.M. by Chairman Miller in the City Hall Council Chambers after a one hour study session. APPROVAL OF MINUTES A. Minutes of regular meeting of August 5, 1980 Motion was made by Commissioner Berkey, seconded by Commissioner Richards to approve the minutes as submitted. Carried unanimously (4-0). V. WRITTEN COMMUNICATIONS - NONE VI. PUBLIC HEARINGS - NONE VII. OLD BUSINESS - NONE VIII. NEW BUSINESS None at this point of the meeting - refer to following minutes for items subsequently considered under New Business. IX. DESIGN REVIEW BOARD ITEMS Prior to the Commission's consideration of cases acted on by the Design Review Board at their meeting of August 12, 1980, Mr. Crump informed the Commission that the City has been contacted by adjacent property owners regarding Case No. 217 MF. Mr. Crump briefly described the project and the property owner's objections. He informed the Commission that the applicant initially contacted the City to deter- mine whether or not a Conditional Use Permit would be required; the City decided to process the item as a design review case since communications have been received. Mr. Crump suggested that the Commission, by minute motion, continue this case and require a Conditional Use Permit. With these opening remarks Mr. Sawa presented the Design Review Board cases for Commission's consideration. 217 MF - Preliminary plans for landscaping of entry for condominium project in Indian e s located on the south side of Fairway Drive at Cook Street for INDIAN WELLS ASSOCIATES. Mr. Sawa described the project and stated that the DRB granted preliminary approval of landscape plans subject to final plans being submitted for review. He indicated that the property owner's main objection is that the original plans showed more landscaping and greater separation between the service entry lane and residential structures. y r ' MINUTES PALM DESERT PLANNING COMMISSION MEETING AUGUST 20, 1980 Page Two IX. DESIGN REVIEW BOARD ITEMS (continued) Commissioner Berkey suggested that instead of requiring the applicant to apply for a Conditional Use Permit the Commission should continue this case and invite the affected property owners to the next Commission meeting. Chairman Miller invited the applicant to speak before the Commission. JIM PIERCE, Vintage Properties, briefly explained the scope of the project that is located in Palm Desert. He stated that he supported a continuance to the September 2, 1980, Commission meeting to allow adjacent property owners to provide input. 218 MF - Mr. Sawa presented this case explaining that carport structures were required as a part of the approval for the conversion to co-op ownership. He described the project and indicated that the Design Review Board approved the case with some revisions. He reviewed those revisions. Motion was made by Commissioner Richards, seconded by Commissioner Kryder to approve the Design Review Board's actions by adoption of Planning Commission Reso- lution No. 625, as amended. Carried unanimously (4-0); and, By minute motion, Case No. 217 MF was continued to the meeting of September 2, 1980. Carried unanimously (4-0). Chairman Miller called for Item XI, ORAL COMMUNICATIONS, before the Commis- sion proceeded to their Discussion Items. XI. ORAL COMMUNICATIONS 1. MS. PAT .MARTIN, Ballew-McFarland: Comments relative to proposed development project at the northeast corner of Monterey Avenue and Country Club Drive. Ms. Martin asked if final working drawings could be processed while the park design is still being reviewed. The Planning Commission agreed to such a processing proce- dure. 2. CLYDE BEEBE, Director of Public Works: Commented that this was his last Planning Commission meeting and expressed his appreciation for the past cooperation he received from the Commission during his tenure with the City. There being no other persons wishing to address the Commission, Chairman Miller requested that the Commission return to Item X. X. DISCUSSION ITEMS A. Consideration of Alternative Land Uses for Specific Areas of the City. The Commission originally discussed this matter during the study session which preceded the meeting. At that time, Mr. Crump reviewed the options and various sites for Commission consideration. After a brief discussion the Commission decided to initiate a Change of Zone for specific areas on the west side of Monterey Avenue from R-2, S. P. to R-3 S.P. and to expand conditional use permissable in a R-3 zone. Chairman Miller returned the meeting to Item VIII, NEW BUSINESS, for intro- duction of motions and voting. VIII. NEW BUSINESS A. Consideration for initiation of a Public Hearing relative to Zoning Ordinance Text Amendment, expansion of the conditionally permitted uses in the R-3 zone district. Motion was made by Commissioner Richards, seconded by Commissioner Kryder to initiate a Public Hearing on October 28, 1980, for Zoning Ordinance Text Amendment (Municipal Code, Section 25.20.030) by adoption of Planning Commission Resolution No. 626. Mr. Dos Santos stated that the General Plan Update document is being prepared for public review. He informed the Commission that the first public hearing will be on October 28, 1980, although this date was never formalized. The Commission returned to New Business to take the appropriate action. VIII. NEW BUSINESS C. Consideration for initiation of a Public Hearing on General Plan Update and related Draft EIR. Motion was made by Commissioner Kryder, seconded by Commissioner Richards, to initiate October 28, 1980, as the first Public Hearing on the General Plan Update and related Draft EIR by adoption of Planning Commission Resolution No. 628. Carried unanimously (4-0). Concluding with Discussion and New Business matters, Chairman Miller called for the next item on the agenda. XII. COMMENTS A. City Staff MURREL CRUMP: Relative to administrative problems concerning the recent adoption of Zoning Text Amendment regarding the permissable number of real estate open house signs.
