Commissioner Richards commented that because Ehere were not many people in the audience that orally communicated negatively against this zone change, the issue should not be sent to committee. Please be advised that the legal notice sent to the affected property owners states , "If you challenge the proposed actions in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in WRITTEN CORRESPONDENCE delivered to the city council (or planning commission) at, or prior to, the public hearing. " The petition was delivered to the City Council and the Planning Commission prior to the public hearing. Many people have difficulty addressing a public forum and are not as proficient in public speaking as Commissioner Richards . Having attended other Planning Commission meetings, we know they become very detailed and time consuming. The petition spoke in protest and represents all the twenty-three people that signed it instead of having all twenty-three people stand up and state the same feelings. To do so would be redundant and would have expended the committees time and energy. BY SIGNING THE PETITION WE MADE OUR STATEMENT and hereby reaffirm our protest. This letter is submitted as our protest to the proposed change of zoning as prescribed in City of Palm Desert Legal• Notice (not dated) Case #C/Z 85-8. We purchased these R-1 zoned properties for the sole purpose of raising our family and living in a secured, quiet and uncompromised neighborhood. This R-1 zoned neighborhood that we choose to invest our lives was assured us through the planning of responsible founding fathers of this community. It has been mandated to those of us as citizens of this city who elected to live in a pre-designated R-1 residential section to be able to continue to do so. Our objection to this proposed zone change is focused upon the fact that a 22 foot, 2 story structure will be allowed to exist directly across the street and on our immediate southerly property line. Our private patio and swimming pool area is located on the front portion (east) and adjoins San Jacinto Ave and any multiple story building which would be allowed to be built on either side directly incroaches upon our families security and privacy and also de•:aluates our property by as much as 25%. Our objections are also directed at the higher density residential apartments which would be allowed in our now and long existing residential neighborhood. Higher density buildings do not belong in this area and it would be unjust and irresponsible if they were allowed. The environmental impact would be devastating, our families security would be in jeopardy by a more transient population, more traffic would be generated an our very short street, which is already overrun by people using it as a short cut to go to the 7-11 on San Luis Rey. Chairman Crites opened the public testimony and asked if anyone wished to speak in FAVOR or OPPOSITION to the proposed. MS. MARCIA JENKINS, 45-707 Deep Canyon, explained that she owns property next to the triangular shaped parcel . She expressed concern about whether people could build residential on Portola and felt that the other parcels should be zoned office professional also. She stated that three years ago sidewalk was installed and asked about Portola being widened and if the sidewalk would be ripped out and installed again. Mr. Holtz explained the process of how the street would be widened. Ms. Jenkins asked why Alessandro should be zoned different. Mr. Drell explained that it was better to block character along the back property line and noted that the city wished to avoid going Into a residential area and wanted to maintain single family homes on Portola, but that it could be reassessed in the future if no action takes place. MS. IRENE SCHMIDT, 44-794 San Jose, expressed the opinion that the commission felt the single family residences were not important. She stated that it was the one family residents that ihad. made the desert what it is by supporting it all year. She also felt she was being pushed out of the II importance of her home. Chairman Crites asked staff to reassure Mrs. Schmidt that no reproduction of the Martin project that exists on the corner of Monterey and Fred Waring could exist under staff's regulations. Mr. Drell stated that under the proposed office professional zone it could not be repeated. MR. JAMES DURANT, 44-795 San Jose, felt it was a good plan, but did not want to see it go any further. He stated that the area needs sewer lines and curbs. Mr. Drell replied that as part of the Palma Village plan sewers were being studied. Chairman Crites closed the public testimony. I Commissioner Richards stated that after 30 years of deterioration and the lots staying vacant it was time for some action. He felt the area between Fred Waring, Monterey, Highway III , and Deep Canyon provided one of the best of Palm Desert's areas to live. He stated that the city was not trying to encroach on the residential section, but to stop by creating a buffer to protect the single family homes. Commissioner Wood felt that this was the best solution. Commissioner Downs explained that the redevelopment agency was discussing a program to help single family homes refurbish the area. Commissioner Erwood spoke about the petition received and indicated that the commission had discussed sending this matter back to the committee for further study. Commissioner Richards withdrew his earlier opposition. Commissioner Downs felt that since this matter had been discussed extensively, it would not be an advantage to send it to the committee and stated that it would be going before the city council . Mr. Drell outlined the standards in the report and recommended approval . Commissioner Wood clarified that the amendment would allow for recreational vehicle park plans to be submitted to the city for consideration. Chairman Crites asked if it could be required that large canopy shade trees be provided. Mr. Drell replied yes. Mr. Smith suggested this be applied at the architectural review level . Chairman Crites opened the public testimony and asked if anyone present wished to speak in FAVOR or OPPOSITION to the case. There being no one, the Chairman Crites closed the public testimony. Commissioner Wood noted that there was no harm in having this amendment and it also provided safe guards. Commissioner Richards indicated that the committee had a constructive meeting regarding the office professional zoning and felt it was premature to discussion this matter until the changes have been implemented and urged commission to continue this case. DISCUSSION: This proposal originated within Palma Village Plan general policy which states that multi-family and commercial zones be of sufficient depth to allow efficient site plannina and creation of adequate buffer areas adjacent' to single family zones. The present one lot depth of the existing R-3 (4) zone narrows to 54 feet precluding any satisfactory development. The inclusion of the second lot between San Carlos and San Jacinto will increase the minimum depth to 112 feet with a maximum of 270 feet adjacent to the Wise Athletic Club. For projects to be consistent with the specific plan, predominant building would occur in the first row of lots with parking and landscaped buffer areas developed adjacent to the R- I zone. 1 The proposed zoning on Alessandro will allow a mixture of multi-family and office uses. The multi-family density is being increased from 10.9 du/acre to 17. 4 du/acre to allow competition with existing and proposed apartments elsewhere in the city. The San jacinto/Portola triangle is proposed to be changed from R-I to R-2. The widening and traffic increase on Portola make R-I development inappropriate for the lots fronting on that major thoroughfare. The shallowness of the lots on the north half of the triangle make any development difficult unless the Portola lots are combined with the San Jacinto lots. The R-2 zone will encourage this lot consolidation by allowing clustering of units and designs which can mitigate the impacts of Portola and create an acceptable transition for the R-I development on the west side of San Jacinto. At the planning commission public hearing neighboring residents expressed concern regarding the potential for high intensity two story construction. Under the recently amended R-2 and R-3 regulations, two story construction would be prohibited with 120 feet of the R-I zone. The proposed OP zone amendment would require a 65 foot setback for buildings 25 feet in height. The 36 parcels proposed for rezoning include 16 vacant lots, 4 commercial parking lots, 4 small apartment buildings, 10 single family homes and 2 buildings of undetermined use. For Alessandro Drive to develop into something more than a wide service road dominated by empty lots and poorly maintained buildings, zoning must allow viable projects which can be made compatible with both commercial and residential uses. The proposed zone change, followed by careful review of proposed projects, will encourage the consolidation of parcels required for the high quality compatible development. ' Mr. Drell gave and outline of the request. Chairman Crites opened the public testimony and asked if anyone wished to speak in FAVOR or OPPOSITION to the proposed. MS. MARCIA JENKINS, 45-707 Deep Canyon, explained that she owns property next to the triangular shaped parcel . She expressed concern about whether people could build residential on Portola and felt that the other parcels should be zoned office professional also. She stated that three years ago sidewalk was installed and asked about Portola being widened and if the sidewalk would be ripped out and installed again. Mr. Holtz explained the process of how the street would be widened. Ms. Jenkins asked why Alessandro should be zoned different. Mr. Drell explained that it was better to block character along the back property line and noted that the city wished to avoid going into a residential area and wanted to maintain single family homes on Portola, but that it could be reassessed in the future if no action takes place. MS. IRENE SCHMIDT, 44-794 San Jose, expressed the opinion that the commission felt the single family residences were not important. She stated that it was the one family residents that had made the desert what it is by supporting it all year. She also felt she was being pushed out of the importance of her home. Chairman Crites asked staff to reassure Mrs . Schmidt that no reproduction of the Martin project that exists on the corner of Monterey and Fred Waring could exist under staff's regulations. Mr. Drell stated that under the proposed office professional zone it could not be repeated. MR. JAMES DURANT, 44-795 San Jose, felt it was a good plan, but did not want to see it go any further. He stated that the area needs sewer lines and curbs. Mr. Drell replied that as part of the Palma Village plan sewers were being studied. Chairman Crites closed the public testimony. Commissioner Richards stated that after 30 years of deterioration and the lots staying vacant it was time for some action. He felt the area between Fred Waring, .Monterey, Highway 111 , and Deep Canyon provided one of the best of Palm Desert's areas to live. He stated that the city was not trying to encroach on the residential section, but to stop by creating a buffer to protect the single family homes. Commissioner Wood felt that this was the best solution. Commissioner Downs explained that the redevelopment agency was discussing a program to help single family homes refurbish the area. Commissioner Erwood spoke about the petition received and indicated that the commission had discussed sending this matter back to the committee for further study. Commissioner Richards withdrew his earlier opposition. Commissioner Downs felt that since this matter had been discussed extensively, it would not be an advantage to send it to the committee and stated that it would be going before the city council . APPLICANT: CITY OF PALM DESERT 1 . BACKGROUND AND ANALYSIS: This proposal originated within Palma Village Plan general policy which states that multi-family and commercial zones by of sufficient depth to allow efficient site planning and creation of adequate buffer areas adjacent to single family zones. The present one lot depth of the existing R-3 (4) zone narrows to 54 feet precluding any satisfactory development. The inclusion of the second lot between San Carlos and San Jacinto will increase the minimum depth to 112 feet with a maximum of 270 feet adjacent to the Wise Athletic Club. For projects to be consistent with the specific plan, predominant building would occur in the first row of lots with parking and landscaped buffer areas developed adjacent to the R-1 zone. The proposed zoning on Alessandro will allow a mixture of multi -family and office uses. The multi-family density is being increased from 10.9 du/ac to 17.4 du/ac to allow competition with existing and proposed apartments elsewhere in the city. The San Jacinto/Portola triangle is proposed to be changed from R-1 to R-2. The widening and traffic increase on Portola make R-I development inappropriate for the lots fronting on that major thoroughfare. The shallowness of the lots on the north half of the triangle make medium density difficult unless the Portola lots are combined with the San Jacinto lots. The R-2 zone will encourage this lot consolidation by allowing clustering of units and designs which can mitigate the impacts of Portola and create an acceptable transition for the R-1 development on the west side of San Jacinto. STAFF REPORT c/z 85-8 Continued The 36 parcels proposed for rezoning include 16 vacant lots. 4 commercial parking lots, 4 small apartment buildings. 10 single family homes and 2 buildings of undetermined use. For Alessandro Drive to develop into something more than a wide service road dominated by empty lots and poorly maintained buildings, zoning must allow viable projects which can be made compatible with both commercial and residential uses. The proposed zone changes, followed by careful review of proposed projects will encourage the consolidation of parcels required for the high quality compatible development. it. RECOMMENDATION: A special city council /planning commission subcommittee has been formed to consider changes to the office professional zone relative to building height and setbacks. While staff recommends approval of the proposed zone change, action by the planning commission to recommend the OP designation should be delayed until the proposed ordinance amendment is scheduled for public hearing. At that time, all affected property owner's will be in a better position to assess the impact of the. zone change. Therefore, staff recommends that the planning commission open the public hearing, take testimony on the more general issues of zone change, then continue the hearing until November 5. 1985. Our objections are also directed at the higher density residential apartments which would be allowed in our now and long existing residential neighborhood. The environmental impact would be devastating, our families security would be in jeopardy by a more transient population, more traffic would be generated an our very short street, which is already overrun by people using it as a short cut to go to the 7-11 on San Luis Rey.
