DISCUSSION: In September of 1981, a petition requesting annexation was received by the city from Robert Stewart for 15 acres on the north side of Country Club Drive, east of Portola Avenue. The property is located in the quarter section excluded from the recently completed Annexation #13. In response to Mr. Stewart's request, it was determined that a logical expansion of the city's boundaries would include the entire quarter section. A letter was sent by the city to each property owner along with an annexation petition. The city has received annexation petitions from 8 property owners covering 55 of the 140 privately owned acres in the quarter section. Twenty acres are under the jurisdiction of the Bureau of Land Management. There has not been any negative response received. The Palm Desert General Plan indicates the property as low density residential, 3-5 d.u./acre. The proposal in this case is to prezone the land to PR-5, the maximum allowed by the general plan and the same as allowed in other similarly designated areas. At the Palm Desert Planning Commission public hearing, no one spoke in favor or in opposition to the proposed change of zone. The commission then adopted its Resolution No. 807 recommending approval of the proposed zone change by the following vote (3- with Commissioner Crites and Commissioner Miller absent. RON GREGORY, Landscape Architect, explained that the design review board denied this request, but aesthetically, in his opinion the sign is attractive. Chairman Kryder asked if anyone wished to speak in OPPOSITION to this case. There being none, the public hearing was closed. Commissioner Wood asked if the sign was so important why was the concern not discussed at the time of the lease. MR. HODGES replied that the matter of the signage was discussed with Great Western and they were assured that there would be no problem. Commissioner Wood expressed his reluctance to grant a variance after working for so long on the sign ordinance and felt that the matter of the signs was not looked into properly. Commissioner Richards explained that he agreed this medical center is greatly needed and felt that many signs presently in the city are not visible. He was in favor of granting a variance only on the basis that there are unusual circumstances. Chairman Kryder agreed that it is difficult to find the medical center but felt that this matter has put the planning commission in a difficult position, and no matter how much the commissioners feel they agree with the problem it is something that should be resolved by the tenant and landlord. Chairman Kryder asked staff if a double face freestanding sign could be used as an alternative. Mr. Diaz replied they could not. After further discussion it was determined that this facility is not for emergency purposes and other alternatives could not be used unless the sign ordinance is revised. APPLICANT: City of Palm Desert I. BACKGROUND: A. DESCRIPTION OF SITE: The property consists of 33 parcels, most of which are 5 acres in size. The land is vacant and relatively flat. B. ADJACENT ZONING AND LAND USE: North: R-1-M/Vacant South: PR-4/Residential and vacant East: PR-5/Vacant West: R-T (Riverside Co)/Residential C. GENERAL PLAN USE DESIGNATION: Low Density Residential 3-5 d.u./acre. IL PROJECT DESCRIPTION: In September of 1981, a petition requesting annexation was received by the City from Robert Stewart for 15 acres on the north side of Country Cub Drive, east of Portola Avenue. The property is located in the quarter section excluded from the recently completed Annexation #13. This quarter section was left out due to the possible complications created by a large number of property owners. In response to Mr. Stewarts request it was determined that a logical expansion of the City's boundaries would include the entire quarter section. A letter was sent to each property owner along with an annexation petition. The City has received annexation petitions from 8 property owners covering 55 of the 140 privately owned acres in the quarter section. Twenty acres are under the jurisdiction of the Bureau of Land Management. There has not been any negative response received. The General Plan indicates the property as Low Density Residential 3-5 d.u/acre. The proposal in this case is to prezone the land to PR-5, the maximum allowed by the General Plan, and the same as allowed in other similarly designated areas. Because of the configuration and size of the lots, it will be necessary to provide some type of street system to serve the interior lots. III. ANALYSIS: A. DATE: MAY 18, 1982 I. BACKGROUND: In September of 1981, a petition requesting annexation was received by the City from Robert Stewart for 15 acres on the north side of Country Club Drive, east of Portola Avenue. The property is located in the quarter section excluded from the recently completed Annexation #13. This quarter section was left out due to the possible complications created by a large number of property owners. In response to Mr. Stewarts request it was determined that a logical expansion of the City's boundaries would include the entire quarter section. A letter (attached) was sent to each property owner discussing the annexation procedure and possible zoning. The City has now received annexation petitions from 8 property owners covering 55 of the 140 privately owned acres in the quarter section. Twenty acres are under the jurisdiction of the Bureau of Land Management. There has not been any negative response received. The first step in the annexation procedure is to prezone the property in conformance with the Palm Desert General Plan. The area is designated Low Density Residential 3-5 d.u./acre. To be consistent with zoning for similar_ property recently annexed, staff will be recommending Planned Residential 5 d.u./acre. U.
