northwest corner of Portola Avenue (future) and Frank
Sinatra Drive (future).
Mr. Drell reviewed the staff report and recommended approval.
Chairman Kryder opened the public testimony and asked if anyone wished to speak
in Favor or Opposition.to this case. There being none, the hearing was closed.
Moved by Commissioner Miller, seconded by Commissioner Crites, to adopt
Planning Commission Resolution No. 760, approving C/Z 10-81. Carried unanimously.
VIU. DESIGN REVIEW BOARD ITEMS
Preliminary plan approvals by the Design Review Board at its meeting of October
27, 1981, requiring Planning Commission confirmation.
Case No. 157 C - PALMS TO PINES WEST, PHASE II.
Moved by Commissioner Richards, seconded by Commissioer Wood, to adopt
Planning Commission Resolution No. 761, approving Design Review Board's actions.

A. STAFF RECOMMENDATION:
Waive further reading and pass to second reading.
B. DISCUSSION:
This Change of Zone application was reviewed and unanimously recommended for
approval by the Planning Commission at its November 3, 1981 meeting. During the
hearing, no one spoke in favor or in opposition to the proposed change.
The Department of Environmental Services has received annexation petitions for
23 of 32 5-acre parcels in the subject area.
The Northern three-quarters_ of the proposed zone change is designated Low
Density Residential.
The Southern quarter is dual desginated Low Density Residential/Park. When the
City is not prepared to purchase a dual designated park site, it has been Council
policy to rezone to the residential classification. When a development application
is submitted, the City must then decide whether to acquire the site and rezone to
open space or allow the development.

Declaration of Environmental Impact for 160 acres located at the northwest corner of
Portola Avenue (future) more particularly described as:
EY2 of the EY2, Section 32 T4S R6E
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the California Environmental Quality Act,
Reslution No. 80-89", in that the Director of Environmental Services has determined that
the project will not have a significant adverse impact on the environment and a Negative
Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts to justify their actions, as described below:
1. The land use resulting from the Change of Zone would be
compatible with adjacent proposed land uses.
2. The density resulting from the Change of Zone would be
compatible with densities permitted in the adjacent areas.
3. The proposed Change of Zone would be compatible with the
adopted Palm Desert General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in these cases;
2. That the Planning Commission does hereby recommend to the
City Council approval of a Change of Zone from W-2-20
(Riverside County) to PR-5 (Upon Annexation) as shown on
attached Exhibit "A".
3. That a Negative Declaration of Environmental Impact is hereby
recommended for certification.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 3rd day of November, 1981, by the following vote, to
wit:

B. GENERAL PLAN LAND USE DESIGNATION:
Low Density Residential, 3-5 d.u./acre and Park.
C. ENVIRONMENTAL ASSESSMENT:
The Director of Environmental Services has determined that the proposed
project will not have a significant adverse impact
on the environment and a
Negative Declaration has been prepared.
D. DISCUSSION:
The Department of Environmental Services has received annexation
petitions for 23 of 32 5-acre parcels in the subject area.
The Northern three-quarters of the proposed zone change is designated Low
Density Residential.
The Southern quarter is dual designated Low Density Residential/Park. When
the City is not prepared to purchase a dual designated park site, it has been
Council policy to rezone to the residential classification. When a
development application is submitted, the City must then decide whether to
acquire the site and rezone to open space or allow the development.
This property will become part of Annexation #14, which will include all of
Section 32 T4S R6E, Section 5 T5S R6E, and the southwest quarter of
Section 4 T5S R6E.
The following justifications can be made in support of the Change of Zone:
1. Prezoning is necessary to complete annexation of the property.
2. The existing zoning (W-2-20 Riverside County), allows a mixture of
residential, light industrial and agricultural and is not deemed
appropriate for the site.
3. The proposed Change of Zone would be compatible with the adopted
General Plan.
4. The land use and density resulting from the change of zone would be
compatible with adjacent land uses.

III. RECOMMENDATION:
Based on findings contained above and in draft Resolution, adopt findings as noted
above and adopt Planning Commission Resolution No.
"A Resolution of the Planning Commission of the City of Palm
Desert California, recommending to the City Council approval of
a preannexation Change of Zone from W-2-20 (Riverside County) to
PR-5 and certification of a Negative Declaration of Environmental
Impact on property located at the Northwest corner of Portola Avenue
(future) and Frank Sinatra Drive (future).
