STAFF RECOMMENDATION: Waive further reading and pass to second reading. B. DISCUSSION: This request is the first rezoning pursuant to tie recommendation of the Palma Villaae Specific Plan. Of the 19 lots, 6 are presently zoned R-3, 7 are vacant, 10 are developed at R-3 densities and 2 are single family. The rezoning is designed to encourage upgraded multi-family and senior housina at densities compatible with the existing development. The planning commission unanimously recommended approval . This case is a revision of an application originally heard by the planning commission on January 15 which involved three parcels on San Rafael- Avenue. At that hearing, a petition of opposition was submitted. signecl" by many of the remaining R-2 property owners In the block. There was some concern the remaining R-2 lot would become a buffer between San Rafael and San Pablo. ' -f The hearing was continued pendina completion of the Palma Village Specific Plan, Since the specific plan recommended that the entire block be rezoned to R-3, the original application was expanded to include the remainino R-2 parcels. At the August 6th hearing there was no opposition to the revised proposal . In a letter, Michael Fife, who testified at the January 15th hearing and submitted the opposition petitions has indicated that the expanded Proposal including the senior housing overlay is acceptable. Roy Wilson Council Member c/o Phil Drell CITY OF PALM DESERT 73-510 Fred Waring Drive Palm Desert , CA 92260 Dear Mayor & City Council Members : Earlier this year , I circulated a petition to fellow property owners on Catalina Way regarding the change in zoning for some vacant land located on San Rafael . After reviewing some of the Palma Village specific plan recom- mendations and after conversations with Phil Drell , the concerns that I expressed in the previously submitted petition had been satisfied . Specifically , I had been concerned that my property located at the corner of San Rafael and Catalina Way would remain in R2 zoning while the property immediately adjacent to the property would be zoned R3. With the revised boundaries for the zone change , I ' m satisfied with all properties now being zoned R3 on Catalina Way between San Rafael and San Pablo . Sincerely , 5 e MICHAEL E . Chairman Crites opened the public testimony and asked if anyone wished to speak in FAVOR or OPPOSITION. MR. TOM STARR spoke in favor of the amendment. Commissioner Richards requested that exhibit "B" regarding the height maximums and flat versus pitched roofs be sent to the architectural commission for review. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, approving the findings as presented by staff. Carried 5-0. Moved by Commissioner Richards, seconded by Commissioner Downs, adopting Planning Commission Resolution No. 1063, Exhibit "A", recommending approval of ZOA 85-3 to city council . Carried 5-0. Moved by Commissioner Richards, seconded by Commissioner Downs, to continue Exhibit "B" to the August 20, 1985 meeting. Carried 5-0. 8. Mr. Drell explained that the next three public hearing items were zone changes from recommendations of the Palm Valley Specific Plan Committee. He showed a video presentation of the sites. Chairman Crites opened the public testimony and asked if anyone present wished to speak in FAVOR or OPPOSITION to the request. There being no one, the public testimony was closed. Chairman Crites asked for a motion by the commission. Actions Moved by Commissioner Wood, seconded by Commissioner Richards, approving the findings as presented by staff. Carried 5-0. BACKGROUND: The application for change of zone to R-3 was originally heard by the planning commission on January 15, 1985. It was continued until adoption of the Palma Village Specific Plan. Since the specific plan recommends that the entire block be rezoned to R-3 50, the original application has been expanded to include all remaining R-2 parcels in the block. Of the 13 R-2 lots, 6 are vacant, 5 are developed with multi-family units and 2 are single family. The remaining 6 lots in the bl ock are already zoned R-3 and would only receive the Senior Housing designation. 11.
