DISCUSSION: This request was heard by the planning commission at the meetings of June 5, and June 19, 1984. At the June 5, 1984, hearing, staff recommended denial without prejudice. This was because the property is in an area staff believes needs study. The area, being in an older part of the city, contains a mixture of land uses in varying conditions. Staff, as we have noted in the past, felt a specific plan should be prepared to determine guidelines for future development and rezoning in the north Highway I I I area. Furthermore, the property is not clearly in an area that is high density residential, 7-19 d.u./acre, on the general plan. The property borders an area designation of 5-7 d.u./acre and 7-18 d.u./acre. The planning commission did not agree with staff and asked that the item be continued to allow further study of the request. At the meeting of June 19, 1984, staff explained that the North Highway III Specific Plan would be coordinated with the Year 2000 Strategic Plan and could be started within 2-3 weeks. After considerable discussion, the commission made findings which they felt would support a change of zone. Those findings are noted in the adopted Planning Commission Resolution which is attached. The findings made indicated the request is consistent with the general plan and compatible with the surrounding area, the site is physically suitable for the type of development and the proposed density is suitable, and the project would not be detrimental to the public health, safety, and general welfare. Commissioner Downs then moved, seconded by Commissioner Wood that staff prepare a resolution recommending approval of a change of zone from R-2 to R-3. That motion carried on a unanimous 5-0 vote. That resolution was adopted by the planning commission at the meeting of July 3, 1984, on a 4-0 vote with Chairman Crites absent. -1- ORDINANCE NO. Mr. Diaz explained why this item was continued from the last meeting and staff continued to recommend denial. Commissioner Richards asked when the North Highway Ill Specific Plan would be . completed in order to recommend approval of this project. Mr. Diaz replied that staff is presently working on the problems and specific areas to be studied, and correlating this study with the Strategic Plan 2000. Mr. Diaz noted he would be discussing the matter with the city manager and hoped to get started within 2 to 3 weeks. Commissioner Richards asked if staff could give Mr. Little an idea when he could reapply for this project. Mr. Diaz explained that studies could show a need in that area other than R-3, but would not know that until staff has opportunity to talk to people who live in the area to see what their feels are, and pointed out that this was the only applicant who has expressed interest in this particular area. Commissioner Richards felt that it was unusual for staff to recommend denial and believed they had been fair to the applicant in their decision. MINUTES PALM DESERT PLANNING COMMISSION TUNE 19, 1984 Commissioner Downs did not see a problem with going ahead with this project. He felt the project would be compatible to the area and if there was an individual who was willing to improve and build on that property, he should be allowed to. Chairman Crites asked staff to give an example of what might be appropriate for that area other than R-3 zoning. Mr. Diaz pointed out that an open space buffer such as a linear park could be appropriate and there were other sorts of possibilities. Chairman Crites asked staff again if they could give the applicant a specific time on when this study would be completed. Mr. Diaz replied about six months; he explained that staff can prioritize the areas and this can be on the top of the list. Commissioner Wood asked if the existing buildings would be effected by this study. Mr. Diaz explained that a linear park would be about 100 feet wide, not necessitating any condemning out of existing adjacent properties. He added that this may not be done but should not make that decision tougher by rezoning at this time. Chairman Crites reopened the public hearing and asked if the applicant wished to make a presentation. MR. STAN LITTLE, asked to show the commission his proposal. He referred to some exhibits and explained the design of the project, pointing out they would also include upgrading of the existing apartments. Commissioner Richards asked Mr. Little how long he had owned the property. Mr. Little replied since prior to 1950. Commissioner Wood asked Mr. Little if it would affect him financially if he did not start on this project for six months. Mr. Little replied that it would delay the project for a year, but not currently financially bound. Commissioner Richards asked why staff had not prepared a resolution for approval. Mr. Diaz explained that findings for approval were not made by staff and if commission wished, staff could have a resolution for approval, based on the findings described by the commission for the next meeting. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. Commissioner Downs noted a finding was: 1. LITTLE, Applicant Request for approval of a change of zone from R-2 (single family, maximum one unit per 4000 sq. ft. of lot area) to R-3 (multiple family, one unit per 2500 sq. ft. of lot area) for 2 lots on the west side of San Rafael Avenue, approximately 220 feet north of San Gorgonio Way. Mr. Sawa gave the staff report and explained that because the city would be completing a study of the north side of Hwy 111, which would indicate the city's needs, staff is recommending denial without prejudice to allow the applicant to reapply within one year, when the study is completed. Commissioner Downs felt that the applicant was willing to improve this property with his own money and did not understand why the staff would be recommending that he wait. Mr. Diaz pointed out that a change of zone would not do anything. Staff anticipates the study to begin very soon. This matter was fully discussed and it was understood that the study had not begun but would be a matter of months before it did. The study would determine if this change of zone request would fit into the general plan and needs of the city. Chairman Crites opened the public hearing and asked if the applicant wished to make a presentation. MR. STAN LITTLE, 72-668 Bel Air Road, explained that they are proposing one more duplex to existing duplexes. He felt they are improving and upgrading the property and the existing buildings. He requested approval. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. Moved by Commissioner Richards, seconded by Commissioner Crites, to continue this matter to June 19, at 2:00 p.m. in order to explore the possibility to allow the applicant to proceed with the requested zone change. The northerly lot which contains approximately 20,500 sq. ft. of area is owned by the applicant and is developed with six older multiple family units in 3 single story buildings with substandard parking. The southerly lot is presently vacant. The southerly property owner has agreed to become an applicant in the proposed request to eliminate a possible spot zoning. B. ZONE CHANGE REQUEST: The request to change the zoning from R-2 to R-3 would allow 8 units on the northerly lot which presently contains 6 units. Therefore, two new units and upgrading of the existing six units would occur. Under the existing zoning five units are allowed. The southerly lot (approximately 18,500 sq. ft.), which is owned by the Rector of the Society of Saint Paul who also owns the adjacent property at the corner of San Rafael Avenue and San Gorgonio Way, would permit approximately 7 units instead of 4 units. The property is shown on the general plan land ise element in an area that is medium density residential 5-7 d.u./acre, but bordered on the south by a high density residential 7-18 d.u./acre designation (see attached map). This location on a border is the applicant's justification for the request. The applicant's justification is as follows: "Being on the borderline of designated high density, applicant requests change to R-3 in keeping with surrounding developments. This plan will be available at the meeting. m. ANALYSIS: A. FINDINGS FOR APPROVAL OF CHANGE OF ZONE: In order to recommend approval of'a change of zone to city council, positive findings justifying the action must be made. Staff does not feel supportable findings can be made at this time because the property is in an area staff believes needs study. The area, being in an older part of the city, contains a mixture of land uses in varying condition. Staff, as we have noted in the past, feels a specific plan should be prepared to determine guidelines for future development and rezoning in the north Highway I I I area. Furthermore, the property is not clearly in an area that is high density residential, 7-18 d.u./acre, on the general plan. Therefore, we cannot recommend approval of any change of zone at this time. B. ENVIRONMENTAL REVIEW: From an environmental viewpoint, the approval of a change of zone of this nature will not have a significant impact on the environment. However, since staff is not recommending this change of zone, there is no need to adopt a negative declaration should the planning commission agree with staff. However, a draft negative declaration has been prepared should the planning commission feel findings and justification for a change of zone exist. IV. STAFF RECOMMENDATION: Staff recommends denial without prejudice of this request by adoption of Planning Commission Resolution No. , in order to allow the applicant to reapply within one year if a specific plan is completed within that time. Mr. Diaz explained why this item was continued from the last meeting and staff continued to recommend denial. Commissioner Richards asked when the North Highway Ill Specific Plan would be completed in order to recommend approval of this project. Mr. Diaz replied that staff is presently working on the problems and specific areas to be studied, and correlating this study with the Strategic Plan 2000. Mr. Diaz noted he would be discussing the matter with the city manager and hoped to get started within 2 to .3 weeks. Commissioner Richards asked if staff could give Mr. Little an idea when he could reapply for this project. Mr. Diaz explained that studies could show a need in that area other than R-3, but would not know that until staff has opportunity to talk to people who live in the area to see what their feels are, and pointed out that this was the only applicant who has expressed interest in this particular area. Commissioner Richards felt that it was unusual for staff to recommend denial and believed they had been fair to the applicant in their decision. MINUTES PALM DESERT PLANNING COMMISSION TUNE 19, 1984 Commissioner Downs did not see a problem with going ahead with this project. He felt the project would be compatible to the area and if there was an individual who was willing to improve and build on that property, he should be allowed to. Chairman Crites asked staff to give an example of what might be appropriate for that area other than R-3 zoning. Mr. Diaz pointed out that an open space buffer such as a linear park could be appropriate and there were other sorts of possibilities. Chairman Crites asked staff again if they could give the applicant a specific time on when this study would be completed. Mr. Diaz replied about six months; he explained that staff can prioritize the areas and this can be on the top of the list. Commissioner Wood asked if the existing buildings would be effected by this study. Mr. Diaz explained that a linear park would be about 100 feet wide, not necessitating any condemning out of existing adjacent properties. He added that this may not be done but should not make that decision tougher by rezoning at this time. Chairman Crites reopened the public hearing and asked if the applicant wished to make a presentation. MR. STAN LITTLE, asked to show the commission his proposal. He referred to some exhibits and explained the design of the project, pointing out they would also include upgrading of the existing apartments. Commissioner Richards asked Mr. Little how long he had owned the property. Mr. Little replied since prior to 1950. Commissioner Wood asked Mr. Little if it would affect him financially if he did not start on this project for six months. Mr. Little replied that it would delay the project for a year, but not currently financially bound. Commissioner Richards asked why staff had not prepared a resolution for approval. Mr. Diaz explained that findings for approval were not made by staff and if commission wished, staff could have a resolution for approval, based on the findings described by the commission for the next meeting. Therefore, two new units and upgrading of the existing six units would occur. Under the existing zoning five units are allowed. The southerly lot (approximately 18,500 sq. ft.), which is owned by the Rector of the Society of Saint Paul who also owns the adjacent property at the corner of San Rafael Avenue and San Gorgonio Way, would permit approximately 7 units instead of 4 units. The property is shown on the general plan land use element in an area that is medium density residential 5-7 d.u./acre, but bordered on the south by a high density residential 7-18 d.u./acre designation (see attached map). This location on a border is the applicant's justification for the request. The applicant's justification is as follows: "Being on the borderline of designated high density, applicant requests change to R-3 in keeping with surrounding developments.
