The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN,
as follows:

SECTION 1: That a portion of Ordinance No. 107 referencing Section 25.46.1 of
the Zoning Ordinance, the Zoning Map (Chapter 35.46 of the Palm Desert Municipal Code)
is hereby amended to read as shown on the attached Exhibit "A".
SECTION 2: That a Negative Declaration of Environmental Impact is hereby
approved.
SECTION 3: The City Clerk of the City of Palm Desert, California, is hereby
directed to publish this ordinance in the Palm Desert Post, a newspaper of general
circulation, published and circulated in the City of Palm Desert, California, and shall be
in full force and effect thirty (30) days after its adoption.

MINUTES
PALM DESERT PLANNING COMMISSION
MAY 4, 1982
in the R-1, 10,000 zone located at 74-637 Peppertree
Drive.
Mr. Joy reviewed the staff report and recommended approval.
Vice Chairman Richards asked for a clarification on what hardships this has
created for the applicant. Mr. Diaz explained most of the homes in the neighborhood
were built prior to these setback requirements with a 5' minimum side yard setbacks.
Therefore, the requested variance could be justified.
Vice Chairman Richards opened the public hearing and asked if the applicant cared
to make a presentation.
MR. STEVE SULLIVAN, Architect, 73-730 Hwy 111, stated he was present for any
questions the Commission might have.
Commissioner Miller asked what the setbacks in front of the property would be.
Mr. Sullivan replied they would be the same as required in the R-1 10,000 zone.
Vice Chairman Richards asked if anyone present wished to speak in FAVOR or
OPPOSITION to this case. There being none, the public hearing was closed.
Moved by Commissioner Miller, seconded by Commissioner Crites, to adopt the
findings as recommended by staff. Carried unanimously 4-0.
Moved by Commissioner Wood, seconded by Commissioner Crites, to waive further
reading and adopt Planning Commission Resolution No. 799, approving VAR 01-82. Carried
unanimously 4-0.
D. Case No. C/Z 02-82 - CITY OF PALM DESERT, Applicant
Consideration of a Change of Zone from R-2 8,000 to R-1
8,000 (Single Family Residential, 8,000 sq.ft. minimum lot
size) for property located south of Skyward Way, between
Chia Drive and the easterly end of Bel Air Road.
Mr. Smith reviewed the staff report and stated that this property had previously
been rezoned from R-1 10,000 to R-2 8,000, which presently is inconsistent with the
General Plan. Staff is recommending approval.
Vice Chairman Richards opened the public hearing and asked if anyone present
wished to speak in FAVOR or OPPOSITION to this case. There being none, the public
hearing was closed.
Moved by Commissioner Crites, seconded by Commissioner Miller, to adopt
findings as recommended by staff. Carried unanimously 4-0.
Commissioner Wood, at this time, explained to the audience that this matter was
brought up at the study session prior to the meeting and Commissioners thoroughly
weighed the pros and cons of this act.

reading and adopt Planning Commission Resolution No. 800, recommending approval of
C/Z 02-82. Carried unanimously 4-0.

Consideration of a Zoning Ordinance Amendment relating
to nonconforming lots, buildings, uses and land.
Mr. Diaz stated that because staff would need to contact property owners that
would be impacted by this request, he is recommending a continuance to June 1st.'

WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 4th day of May, 1982, hold a duly noticed public hearing to consider a Change of Zone
from R-2 (8,000) to R-1 (8,000), Single Family, 8,000 square foot minimum lot size for

Road, more particularly described as:

WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the California Environmental Quality Act,
Resolution No. 80-89", in that the Director of Environmental Services has determined that
the project will not have a significant adverse impact on the environment and a Negative
Declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning Commission
did find the following facts to justify their actions, as described below:
1. The land use resulting from the Change of Zone would be compatible with
adjacent proposed land uses.
2. The density resulting from the Change of Zone would be compatible with
densities permitted in the adjacent areas.
3. The proposed Change of Zone would be compatible with the adopted Palm
Desert General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of

1. That the above recitations are true and correct and constitute the findings

residential development located south of Skyward Way, west of Chia Road
at the easterly end of Be] Air Road.

I. BACKGROUND:
A. HISTORY:
In 1979 a project calling for the construction of 36 single family residences
was presented to the City. Tentative Tract Map 14999 was prepared and
eventually approved. The Tentative Tract Map provided for 36 lots on which
a single family dwelling would be placed on each. Two additional lots were
delineated on the Tentative Tract Map on which recreational facilities and a
Private street were proposed. In order to have the common recreational
facilities a Conditional Use Permit was required. The applicant was also
required to file an application to rezone the property from R-1, 10,000 to
R-2 8,000.
Why the change of zone to R-2 8,000 was required is not known but
recreational facilities are a permitted use in an R-1 zone subject to the
issuance of a Conditional Use Permit. Ordinance 214 changing the zoning of
the subject property was adopted by City Council October 25, 1979.
B. ADJACENT ZONING AND LAND USE:
North - R-1 - 13,000/Single Family Dwellings
South - P.R-3/Vacant
East - R-1 - 10,000/Vacant
West - R-1 - 13,000/Single Family Dwellings
C. GENERAL PLAN LAND USE DESIGNATION:
Residential - Low Density, 3-5 units/acre.
II. ANALYSIS.-
A. FINDINGS:
The R-2 8,000 zoning permits the creation of minimum 8,000 square foot
lots and permits one unit for every 4,000 square feet of net lot area. A
Development of this type and density would be inconsistent with the General
Plan Land Use Element which designates this area Residential Low Density
(ie: 3 to 5 units per acre). The R-2 zone, allowing one unit for every 4,000
square feet of lot area would net a maximum of 9 units per acre after
streets are established. The nine (9) unit per acre maximum is well in excess
of the maximum permitted by General Plan (ie: 5 unit maximum/acre).

A. FINDINGS (CONTINUED):
At this time any development of the property is controlled by the
Conditional Use Permit which limits the property to be developed with a
single family dwelling. However, should the owner choose to let the
Conditional Use Permit and Tentative Map expire, then he would be left
with a parcel of land (some 11.2 acres) zoned R-2, 8,000 permitting one unit
for every 4,000 square feet of net lot area which could result in up to 103
units on the site.
B. PROPOSED ZONING:
In order to comply with the state law requiring consistency between the
General Plan and the Zoning Ordinance and in order that the City does not
in the future have to process a multifamily development plan for 103 units
on this site, it is suggested that the property be rezoned from R-2 8,000 to
R-1 8,000, which would limit the development to single family residences on
minimum lot sizes of 8,000 square feet. The 8,000 square foot minimum lot
size would mean that all the lots created by Tentative Map 14999, should it
be finaled, would continue to comply.
Zoning the site R-1 8,000 would also be consistent with the General Plan
designation of Low Density (3-5 units per acre).
C. ENVIRONMENTAL REVIEW:
The Director of Environmental Services has determined that the proposed
zone change will not have a significant adverse impact on the environment
and a Negative Declaration of Environmental Impact has been prepared.
III. STAFF RECOMMENDATION:
Based on reasons delineated in the report, staff recommends approval of
Resolution No.
" A resolution of the Planning Commission of the City of Palm Desert,
California, recommending to the City Council approval of a Change
of Zone from R-2 8,000 to R-1 8,000 for property located south of
Skyward Place west of Chia Road at the easterly end of Bel Air Road".

SUBJECT: REQUEST FOR A ONE YEAR TIME DATE: APRIL 6, 1982
EXTENSION AND INITIATION OF A CHANGE
OF ZONE FROM R-2, 8,000 TO R-1,
FOR CASE NO. TT 14999 (WESTSIDE ENTERPRISES),
ALSO KNOWN AS SKYWARD PLACE.
Tentative Map 14999 calls for the creation of 36 single family dwelling lots. In addition
two more lots; one for common recreation facilities and the other for the street are
delineated on the map. The property is located at the easterly end of Bel Air Road
between Skyward Way and Homestead Road and is zoned R-2 - 8,000.
The subject map was originally approved October 11, 1979. In January, 1981, an 18 month
time extension was granted which expires April 12, 1982, ( the 18 month time extension
was retroactively effective to October 12, 1980).
Pursuant to the recent revisions to the Subdivision Ordinance, the applicant is requesting
an additional one year extension to the tentative map.
As noted previously the property is zoned R-2 8,000. This zoning permits one unit for
every 4,000 square feet of lot area and requires a minimum lot size of 8,000 square feet.
Considering that the intent was to create a single family subdivision, staff feels that the
zoning is in error and a change of zone should be processed.
STAFF RECOMMENDATION:
That Planning Commission continue the request for a one year time extension to TT 14999
and direct staff to process a Change of Zone for the subject property from R-2, 8,000 to
R-1 8,000.
