A. STAFF RECOMMENDATION:
Waive further reading and pass to second reading.
B. DISCUSSION:
This change of zone would complete the Office Professional zoning west of
Monterey south of Fred Waring. It was continued from September 12 due to
the proposed office professional amendments. Those new amendments
requiring as much as a 65 foot setback, will necessitate complete redesign
of the building proposed for the corner lots. The planning commission
also recommended that a policy be added to the Palma Village Specific
Plan requiring at least a 45 foot rear parking easement setback in this
area.
The planning commission unanimously recommended approval of the change of

PALM DESERT, CALIFORNIA APPROVING A CHANGE OF
ZONE FROM R-2 S.P. TO O.P. S.P. FOR 9 LOTS ON THE
WEST SIDE OF MONTEREY AVENUE SOUTH OF FRED
WARING DRIVE.
CASE NO: C/Z 85-6
WHEREAS, the City Council of the City of Palm Desert. California, did on
the 19th day of December. 1985, hold a duly noticed public hearing to consider
a change of zone from R-2 S.P. to O.P. S.P. for 9 lots on the west side of
Monterey Avenue south of Fred Waring Drive.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures of Implementation of the California Environmental
Quality Act. Resolution No. 80-89", in that the director of environmental
services has determined that the proposed changed of zone has been previously
assessed in connection with the Palma Village Specific Plan for which a
negative declaration of environmental impact was approved.
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said city council did find the following facts to justify their actions,
as described below:
1 . The land use resulting from the change of zone would be compatible
with adjacent proposed land uses.
2. The density resulting from the change of zone would be compatible
with densities permitted in the adjacent areas.
3. The change of zone implements recommendation of the Palma Village
Specific Plan.
NOW. THEREFORE, BE IT ORDAINED by the City Council of .the City of Palm
Desert, as follows:
1 . That the above recitations are true and correct and constitute the
findings of the commission in these cases:
2. That C/Z 85-6 Exhibit "A" is approved.
3. The City Clerk of the City of Palm Desert, California. is hereby
directed to publish this ordinance in the Palm Desert Post, a
newspaper of general circulation, published and circulated in the
City of Palm Desert, California. and shall be in full force and

PALM DESERT PLANNING COMMISSION
JUNE 4, 1985
Chairman Crites inquired about landscaping. Mr. Sawa indicated that there would
be sidewalks on Monterey and Highway 111 with landscaping around the building
and spread out in the parking lot.
Chairman Crites opened the public testimony.
MR. ROGER REI.SHER, 74-629 Arroyo Drive, indicated that he had been
working on this project for IW years. He indicated that the first section of
two-way frontage road work would be completed with the project. He noted
that Mr. Sabby Jonathan and Mr. Dick Oliphant were directors, Mr. Joe
Foust the engineer for the frontage road, and Mr. Rick Holden the architect.
MR. RICK HOLDEN, 73-330 El Paseo, indicated that the project would be a
benefit to the city and that the landscaping provided would be nice.
MR. JOE FOUST, I450 N. Tustin Avenue in Santa Ana, indicated that traffic
would be restricted to right turn only - no left onto Highway III would be
allowed.
Chairman Crites expressed concern regarding traffic problems. The commission
and Mr. Foust discussed ingress and egress on to and from Highway I I I and '
potential traffic hazards. They discussed the extension of the median to help
reduce those hazards.
Chairman Crites asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposal.
MR. CHARLIE MILLER, Little Bend Trail, spoke in favor of the project but
was concerned with the proposed landscaping. He felt that trees on that
corner would obstruct visibility to his business. Mr. Holden indicated that
consideration would be given to this request.
Mr. Holden noted that a condition of approval was that a three foot wall surround
the project. He indicated that they would like the option of a wall or berm. Staff
indicated there would be no problem with having the corner bermed.
Chairman Crites closed the public testimony.
Commissioner Richards felt that the project was the best one so far, but was
concerned about the traffic.

Moved by Commissioner Richards, seconded by Commissioner Wood, adopting the
findings as presented by staff. Carried 3-1 (Chairman Crites voting no.)
Moved by Commissioner Richards, seconded by Commissioner Wood, adopting
Planning Commission Resolution No. 1048, approving PP 85-9 and PM 20945,
subject to conditions as amended. Carried 3-1 (Chairman Crites voting no.)
D. Case Nos. PP 85-4- ARTHUR MOSS, Applicant
Request for approval of a precise plan of design and
negative declaration of environmental impact to allow
construction of a 31,700 square foot professional building -
(28,250 square feet rentable) on a 46,000 square foot site
located at the southwest corner of Fred Waring Drive and
Monterey Avenue.
Mr. Drell explained that the approval of the request was contingent upon the
approval of the Palma Village Specific Plan. Staff recommended approval.
Chairman Crites opened the public testimony and asked the applicant to address
the commission.

MR. CHARLES MARTIN, architect, stated that the applicant was MOSS
CENTER ENTERPRISES and described the project and explained the
mitigation measures taken to reduce the concerns of adjacent residents. He
stressed that no windows would overlook into rear yards.
Chairman Crites asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposed project.
MR. PHIL NETTLEY, 44-112 Acasia Drive, expressed concern regarding
landscaping, wall height, and the possibility of trees shedding into his yard
and trees interfering with power poles. Mr. Diaz explained that the
landscaping plan would have to be approved and that the utility poles would
be undergrounded. Mr. Cablay indicated that the applicant would sign an
agreement to join an assessment district. Commission indicated that the
undergrounding should be done as soon as possible.
MR. BILL WILSON, 44-144 Acasia, spoke regarding privacy and line of sight
and amount of fill. Mr. Cablay indicated that three feet was the maximum
level of fill allowed.
Chairman Crites closed the public testimony.
Commissioner Richards felt that this project was acceptable with the utility poles
undergrounded and felt that Mr. Martin did a good job with underground parking.

Moved by Commissioner Richards, seconded by Commissioner Wood, adopting the
findings. Carried 3-1 (Commissioner Erwood voting no.)

Planning Commission Resolution No. 1049, approving PP 85-4, subject to

Request for approval of a negative declaration of
environmental impact and a precise plan of design to allow

Mr. Smith outlined the salient points of the staff report and recommended
approval,
Chairman Crites opened the public testimony and asked if the applicant wished to .
address the commission.
The applicant concurred with staff's report.
Chairman Crites asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposal. There being no one, the public testimony was closed.

Moved by Commissioner Wood, seconded by Commissioner Erwood, adopting the

1. BACKGROUND:
The subjectproperty is proposed to be rezoned office professional as part of the
Palma Village Specific Plan. This precise plan approval will therefore be
contingent upon final approval of the specific plan and associated zoning
amendments. It is being reviewed according to the section 25.25 office
professional standards.
it. PROJECT DESCRIPTION:
The project consists of a 31,700 square foot building (28,000 square feet of
rentable area) on a 45,500 square foot site. The building will be 25 feet in
height with one story ova-r parking.
The 25 foot height, 15 foot rear setback, 6 foot street Ir,m Cage setback and zero
sideyard comply with the office professional zone standards.
The applicant is proposing heavy landscaping along the rear using trees 10 feet on
center. The 112 parking spaces conform to the parking ordinance. Access to
the parking lot will be from Monterey. The contemporary architecture will be
consistent with the office across Fred Waring and with the proposed cultural
center.
III. CONCLUSION AND FINDINGS:
The precise plan conforms to all applicable standards for the office professional
zone.
FINDINGS:
1. The design of the precise plan will not substantially depreciate property
values in the vicinity.
-2. The precise plan will not unreasonably interfere with the use or enjoyment of
property In the vicinity by the occupants thereof for lawful purposes.
3. The precise plan will not endanger the public peace, health, safety or general
welfare.

2. The development of the property shall conform Substantially will, exhibits on file

conditions.
3. The development of the Property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
urdioauces and state and federal statutes now in force, or which hereafter may
be in force.
4. Construction of a partial, of said project shall ronmmence within one year from
the date of firial approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
5. Prior to issuance of a building permit Inc constructiot of any use contemplated
by this approval, the applicant shall first obtain permits and/or clearance Irom
the following agencies: -

City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented
to the department of building and safety at the pure of issuance of a building
permit for the use contemplated herewith.
6. All roof mounted mechanical equipment shall be screened from all sides with
materials similar to building walls.
7. Trash provisions shall be approved by applicable trash company and city prior to
issuance of building permit.
8. The applicant shall underground existing utilities and distribution lilies at rear
of properly as a part of construction; if determined unfeasible, the applicant
shall post a cash bond lot said uodergrounding.
Department of Public Works:
1. Drainage and signalization fund fees, as required by city ordinance , shall be paid
prior to building permit issuance.
2. Drainage facilities shall be provided, per Oi dinauce No. 218 and tine Master
Drainage Plan, to the specifications of file director of public works.
3. Storm drain construction shall'be contingent upon a drainage study by the private
engineer that is approved by the department of public works.
4. Landscaping maintenance on Monterey and Fred Waring shall be provided by the
property owner.
5. Complete grading plans and specifications shall be submitted, as required by
ordinance, to tire city engineer for checking and approval prior to issuance of
any permits.
Fire Marshall Conditions:
I. Install a water system capable of delivering 3500 GPM fire flow front any fire
hydrant for a 3 hour duration in addition to domestic supply. 1'he computation
shall be based upon a minimum of 20 psi residual operating pressure in tine supply
mail, from which the flow is measured at the tittle of measurement. Fire flow

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA RECOMMENDING TO
THE CITY COUNCIL APPROVAL OF A ZONING ORDINANCE
AMENDMENT RELATING TO BUILDING HEIGHTS AND
SETBACKS IN THE OFFICE PROFESSIONAL ZONE.

WHEREAS, the Planning Commission of the City of Palm Desert, California
did on the 15th day of October and continued on November 5, 1985, hold a duly
noticed public hearing to consider amendment to the zoning ordinance chapter
25. 25 increasing building setbacks and reducing buildings heights in the
Office Professional zone.
WHEREAS, said amendment has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89", in that the director of community development has
determined the amendment to be a class 5 categorical exemption.
WHEREAS, at said public hearing, upon hearing and considering all testi-
mony and arguments, if any, of all persons desiring to be heard, said planning
commission did find the following facts and reasons to exist to recommend
approval of a zoning ordinance text amendment:
1 . The proposed amendment would provide for more compatible developments
adjacent to residential zones consistent with the Palma Village
Specific Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
I . That the above recitations are true and correct and constitute the
considerations of the commission in this case.
2. That it does hereby recommend approval of ZOA 85-8 as provided in
the attached exhibit, labeled Exhibit"A".

the 12th day of September. 1985, hold a duly noticed public hearing to consider
a chance of zone from R-2 S.P. to O.P. S.P. for 9 lots on the west side of
Monterey Avenue south of Fred Waring Drive.
WHEREAS. said aoolication has complied with the reouirements of the "City
of Palm Desert Procedures of Implementation of the California Environmental
Duality Act , Resolution No. 80-89", in that the director of environmental
services has determined that the proposed changed of zone has been previously
assessed in connection with the Palma Village Specific Plan for which a
negative declaration of environmental impact was approved.
WHEREAS. at said public hearing, upon hearing and considering all
testimony and arguments. if any. of all interested persons desiring to be
heard. said city council did find the following facts to Justify their actions.
as described below:
1 . The land use resulting from the chance of zone would be compatible
with adjacent Proposed land uses.
2. The density resulting from the change of zone would be compatible
with densities permitted in the adiacent areas.
3. The change of zone implements recommendation of the Palma Village
Specific Plan.
NOW. THEREFORE. BE IT ORDAINED by the City Council of the City of Palm
Desert, as follows:
I . That the above recitations are true and correct and constitute the
findings of the commission in these cases:
