VII. PUBLIC HEARINGS
A. Continued Case Nos. CUP 84-8 and C/Z 85-1��CITY OF PALM DESERT,
Applicant
Request for approval of a change of zone from R-1 to public and a
conditional use permit to allow construction of a 15,000 square foot youth
center located at the southwest corner of Rutledge Way and Magnesia Falls
Drive.
Mr. Diaz explained that this request had been continued prior to the merging of the
YMCA and Palm Desert Youth Center. He stated that staff was withdrawing the
application with the provision that if any other type of facility for that site is
proposed, discussion would be necessary with the Desert Sands Unified School
District.
B. Case No. DP 01-82 (Amendment A2) - CARVER MANAGEMENT CORP.,
Applicant
Request for approval of an amendment to a previously
approved development plan for a shopping center to permit
deliveries on the west side of the market on Saturdays in
addition to the Monday through Friday deliveries already
approved, for property zoned PC (2) (District Commercial
Center) and located at the southeast corner of Monterey
Avenue and Country Club Drive.
Mr. Sawa reviewed the request and indicated that staff was recommending denial
of the request of seven deliveries on Saturdays between the hours of 8:00 a.m. to
7:00 p.m. He noted that two letters from residents had been received since the
writing of the staff report. The letters indicated that the two residents would
agree to the winter hours of 10:00 a.m. thru 6:00 p.m. with a maximum of five
deliveries during an eight hour period, and the summer hours of 9:00 a.m. thru 7:00
p.m. with a maximum of five deliveries during a ten hour period.
Commission and staff discussed the staff recommendation and staff agreed that if
the property owners and Carver Management find the terms outlined in the
submitted letter acceptable, staff recommendation could be positive and suggested
a trial period.
Chairman Crites opened the public testimony and asked the applicant to address
the commission.
MS. SANDRA YAVITZ, Carver Management, stated that she had met with
the neighbors and reached an agreement. She indicated that the hours in the
letter submitted were acceptable.
Commissioner Erwood asked Ms. Yavitz if the other affected residents were in
favor of the hours. Ms. Yavitz answered that the owner of lot 17 agreed, but that
the owner of lot 16 was opposed to the commercial development.
Chairman Crites asked if anyone present wished to speak in FAVOR or
OPPOSITION to the case.
MR. BOB RITCHEY, 40349 Sugarbush Court, owner of lot 13, stated that the
main concern with Saturday delivery would be noise, which had been
mitigated at a previous meeting. He agreed that a trial period would be
beneficial. Mr. Ritchey stated that the hours listed in his letter were
acceptable.
Commissioner Wood noted that in normal family neighborhoods Saturday is work
day around the house. Mr. Ritchey agreed. Commissioner Wood indicated that
there would be no Sunday deliveries.

Moved by Commissioner Wood, seconded by Commissioner Richards, to suspend the.
agenda to consider Public Hearing Item B-first.
B. Case Nos. CUP 84-8 an C/Z 85-1 CITY OF PALM DESERT, Applicant
Request for approval of a change of zone from R-1 to
public and a conditional use permit to allow construction of
a 15,000 square foot youth center located at the southwest
corner of Rutledge Way and Magnesia Falls Drive.
Mr. Diaz explained that staff was requesting a continuance to address some of the
issues presented by the adjacent residents. He stated that the youth center and
area residents could hold a separate meeting to help resolve any problems prior to
the recommended continuance date of March 5, 1985. Mr. Diaz suggested that the .
residents meet with staff representatives in a separate conference to discuss some
of the issues.
Chairman Crites inquired of counsel if the public hearing needed to be opened at
that time. Mr. Patterson recommended a motion of continuance without opening
the public hearing.
Mr. Diaz indicated that he and Mr. Joy would accompany the residents to the
community services conference room.
Action:
Moved by Commissioner Wood, seconded by Commissioner Richards, to continue
this item to the meeting of March 5, 1985, at 7:00 p.m. Carried 4-0.
A FIVE MINUTE RECESS WAS CALLED AT 7:16 P.M.
Chairman Crites indicated that Pubic Hearing Item C would be addressed second.
C. Case No. PP 85-1 - M. B. JOHNSON, Applicant
Request for approval of a negative declaration of
environmental impact and a precise plan of design to allow
construction of an industrial building (two story) with 7,930
square feet in the S.I., S.P. (service industrial with a scenic
preservation overlay) zone on .56 acres located on the
north side of St. Charles Place.
Mr. Smith reviewed the salient points of the staff report and recommended
approval.
Chairman Crites opened the public testimony and asked if the applicant wished to
address the commission.
Chairman Crites asked if anyone wished to speak in FAVOR or OPPOSITION to this
case. There being none, the public testimony was closed.
Action:
Moved by Commissioner Richards, seconded by Commissioner Erwood, to approve
the findings as presented by staff. Carried 4-0. .

permit to allow construction of a 15,000 square foot youth center located at
the southwest corner of Rutledge Way and Magnesia Falls Drive.
APPLICANT:

I. BACKGROUND:
A. SITE DESCRIPTION:
The 2.57 acre site belongs to the city as a result of a park dedication and
measures 167 feet of depth and 760 feet in width. Currently the area is all
grass and is improved with curb and gutter along both street frontages.
There are also a few backstops on the site while a row of oleanders
separates it from the community park.
B. ADJACENT ZONING AND LAND USE:
NORTH: PR-5/VACANT
SOUTH: R-1/SINGLE FAMILY RESIDENCES
EAST: R-1/SINGLE FAMILY RESIDENCES
WEST: P/COMMUNITY PARK AND INTERMEDIATE SCHOOL
C. GENERAL PLAN LAND USE DESIGNATION:
Park.
Il. PROJECT DESCRIPTION:
A. SITE PLAN:
The proposed building is a free form curvilinear structure which is generally
a maximum of 100 feet wide and has a length of 300 feet. The setbacks are
as follows:
From Rutledge Way 25' minimum
55' average
From Magnesia Falls Dr. 120' minimum
140' average
From Community Park 25' minimum
35' average
B. ELEVATIONS:
The building is proposed to be energy efficient in its orientation in that it
opens up to an outdoor amphitheatre on the north side. The structure is also
proposed to be sunk into the ground eight feet with nine foot berms built
against the structure.
The building is designed with a slight pitched roof with the largest room
inside to be a gymnasium with a floor to ceiling height at that point to be 33
feet with overall building height to be 25 feet from existing grade.
The parking requirements for a youth center are not specified. The closest
standards would be that for possibly a health club which is space for each 150
square feet of floor area but do to the nature of the use, this standard which
would require 100 parking spaces, is probably too high. The standards would

appear to be too high since the uses provided are strictly for youths. None
the less, the city is scheduled to begin construction shortly to pave and
stripe the parking area at the adjacent community park which will provide
197 spaces which should be plenty for all uses in the vicinity.
C. POTENTIAL IMPACTS:
During the conditional use permit process the commission/council
determines if the site is appropriate for the type of use proposed, etc.
Those most impacted by the proposed development would be the single
family residences across the street from the site on Rutledge Way. The
potential impacts would be traffic and noise.
The design of the building minimizes these impacts through its orientation.
There will be no entrance to the site from Rutledge so that parents dropping
off children or children arriving by bicycle, etc., would do so from the park
parking lot. The outdoor amphitheatre should also be noted will also be sunk
in the ground eight feet in addition to a seven foot berm, so little noise
spillover is expected to occur.
The parking lot plan for the park, which is attached, shows curb installations
as solid lines and future installations as dashed lines. Staff would feel that
the future installations be installed at the time the center is constructed if
not earlier along with the landscaping. Other improvements necessary
would be extending sidewalk to the entrance from Magnesia Falls and
Rutledge.
D. ZONE CHANGE ISSUE:
The requirement for a zone change is that it is consistent with the city's
general plan. The general plan map for this area clearly designates the site
as park since it is west of Rutledge Avenue, which is also clearly shown.
Recreational facilities that the center contains, such as the gymnasium and
games room, easily indicate that the facility will become part of the
adjacent community park.
The current R-1 zoning was on the property when the adjacent subdivision
was created and the park dedication was made, which is now the project
site. Although the property was dedicated as park space, the R-1 zoning
remained. In other words, the proposed zone change is one which could have
logically occurred when the subdivision was created. The change of zone is
requested at this time to enable a more practical design of the structure
that is allowed in a "P" zone rather than the R-1 zone.
III. ANALYSIS:
A. REASONS FOR APPROVAL OF CHANGE OF ZONE:
1. The land use resulting from the change of zone would be compatible
with adjacent proposed land uses as determined through the
conditional use permit process.
2. The proposed change of znne would he compatible with the adopted
Palm Desert General Plan since the area is designated as park by the
placement of Rutledge Way.
3. There are changed conditions presently from when original zoning
was adopted to warrant additional zoning of this type since the land
was dedicated for public use when the lot was created.
B. REASONS FOR APPROVAL OF CONDITIONAL USE PERMIT:
1. That the proposed location of the conditional use is in accord with
the objectives of the zoning ordinance and the purpose of the district
in which the site is located.

Justification:
A youth center is an approved conditional use within the P zone.
2. That the proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be
detrimental to the public health, safety, or welfare, or be materially
injurious to properties or improvements in the vicinity.
Justification:
The conditional use permit process and the review which has taken
place assures that the permit, if granted, will foster a harmonious,
convenient and workable relationship among land uses, as well as
ensuring adequate consideration for urban design in the development
process so that new development will enhance the city as it matures.
3. That the proposed conditional use will comply with each of the
applicable provisions of the zoning ordinance, except for approved
variances or adjustments.
Justification:
No variances are being requested and all provisions of the municipal
code have been met.
4. That the proposed conditional use complies with the goals, objectives,
and policies of the city's general plan.
Justification:
The youth center is being designed so that it will be compatible with
the community park and surrounding residential neighborhoods.
C. ENVIRONMENTAL REVIEW:
The director of environmental services has determined that the project will
not have a significant environmental impact and a Negative Declaration of
Environmental Impat has been prepared.
IV. RECOMMENDATION:
Recommend to the city council approval of CUP 84-8 and C/Z 85-1 by:
1. Adoption of findings.
2. Adoption of Planning Commission Resolution No.

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA,
RECOMMENDING TO THE CITY COUNCIL APPROVAL
OF A CHANGE OF ZONE FROM "R-1" TO "P" AND A
CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION
OF A 15,000 SQUARE FOOT YOUTH CENTER AT THE
SOUTHWEST CORNER OF MAGNESIA FALLS DRIVE AND
RUTLEDGE WAY, ALSO DESCRIBED AS A.P.N. 624-172-
038.
CASE NOS. CUP 84-8 and C/Z 85-1
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 5th day of February, 1985, hold a duly noticed public hearing to consider a request of
the CITY OF PALM DESERT for the above mentioned project.
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have a significant affect on the environment and a Negative
Declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said conditional use permit:
1. The proposed location of the conditional use is in accord with the objectives
of the zoning ordinance and the purpose of the district in which the site is
located.
2. The proposed location of the conditional use and the conditions under which
it will be operated and maintained will not be detrimental to the public
health, safety or general welfare, or be materially injurious to properties or
improvements in the vicinity.
3. The proposed conditional use will comply with each of the applicable
provisions of this title, except for approved variances or adjustments.
4. The proposed conditional use complies with the goals, objectives, and
policies of the city's adopted general plan.
5. The land use resulting from the change of zone would be compatible with
adjacent proposed land uses.
6. The proposed change of zone would be compatible with the adopted Palm
Desert General Plan.
7. There are changed conditions presently existing from when original zoning
was adopted to warrant additional zoning of this type.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That commission does hereby recommend approval of the conditional use
permit and change of zone for reasons subject to the attached conditions.

CONDITIONS OF APPROVAL
Case No. CUP 84-S
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the following
conditions.
2. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to allow
municipal ordinances and state and federal statutes now in force, or which
hereafter may be in force.
3. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Coachella Valley Water District
City Fire Marshal
5. Sidewalk along Rutledge to be extended from southerly terminus at middle school
northerly to Magnesia Falls and along Magnesia Falls westerly to parking lot.
6. Parking lot improvements to be installed as determined by planning commission or
the director of environmental services.
7. Maximum height of structure to be 25 feet above existing grade.
Department of Public Works:
8. Storm drain construction shall be based upon study done by project engineer.
9. Complete grading plans and specifications shall be submitted, as required by
ordinance, to the city engineer for checking and approval prior to issuance of any
permits.
City Fire Marshal:
10. Install a water system capable of delivering 3000 GPM fire flow from any fire
hydrant for a three (3) hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating pressure in
the supply main from which the flow is measured at the time of measurement.
Fire flow requirements will depend on built-in fire protection provisions of
buildings.
11. Install Riverside County super fire hydrants so that no point of any building is more
than 200 feet from a fire hydrant measured along approved vehicular travel ways.
a. Exterior surface of hydrant barrels and heads shall be painted chrome yellow
and the tops and nozzle caps shall be painted green.
b. Curbs shall be painted red 15 feet in either direction from each hydrant.
C. Hydrants shall not be located closer than 25 feet to any building.
12. Prior to issuance of a building permit, the developer shall furnish the original and
three copies of the water system plan to the fire marshal for review. Upon
approval, one copy will be sent to the building department, and the original will be
returned to the developer.

13. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the design
of the water system in CUP 84-8 is in accordance with the requirements prescribed
by the fire marshal."
14. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.
15. Additional fire protection requirements may be necessary when the applicant
submits specific plans for consideration and approval.
16. Install N.F.P.A. 13 sprinkler system.
