REQUEST: Open public hearing, take public comment regarding establishing solid
waste charges and the collection of residential solid waste charges on
the property tax roll, and close public hearing.
Adopt Resolution No. 2021-32 approving solid waste rates for Burrtec
Waste and Recycling Services, LLC (Burrtec) under Contract No.
C27411; and requesting the County of Riverside to collect the
associated charges for individually billed residences on the Tax
Assessor's Property Tax Roll for Fiscal Year (FY) 2021-22.
Recommendation
By Minute Motion:
1. Open public hearing and accept public comment related to the collection of the
solid waste charges for individually billed residences for FY 21-22 on the
County of Riverside Assessor's Property Tax Roll, and related items stipulated
therein;
2. Close public hearing; and,
3. If majority protests are not received prior to the conclusion of the public hearing,
proceed to:
A. Waive further reading and adopt Resolution No. 2021-32 approving rates in
Exhibits 3A, 3B, 3C, and 3D for Burrtec under Contract No. C27411; and
requesting the County of Riverside to collect the associated costs for
individually billed residences on the Tax Assessor's Property Tax Roll for
FY 21-22.
B. Authorize the City Manager to execute any documents necessary to
effectuate the actions taken herewith.

Background Analysis
The City of Palm Desert contracts with Burrtec for integrated solid waste management
services through a Franchise Agreement (C27411) dated May 28, 2015. Each year this
agreement allows Burrtec to request a rate adjustment for their services based on an
increase in the Producer's Price Index (PPI) for Furnished Goods, and pass through
increases in disposal costs. The PPI change was negative this year and Burrtec did not
request a rate increase for disposal cost increases. The proposed rates for FY 21-22 will
remain the same as the rates in FY 20-21. The Rate Sheets for residential, commercial,
roll -off and food waste rates are included in Attachment 3.
On April 23, 2015, the City Council approved the implementation of billing residential
services for all individually billed (non -master billed) residences through the County of
Riverside Tax Assessor's Property Tax Rolls. This does not include any master billed
residences, where a homeowner association pays the costs for its residents. A copy of
the written report containing the listing of all the parcels included in this billing and the
associated charges is available for public review in the Office of the City Clerk.
In order to continue this process, the County Tax Assessor requires the City Council to
adopt a resolution annually requesting the solid waste charges to be placed on the tax
roll. The City is also required to hold a public hearing each year to allow impacted
residential property owners an opportunity to voice their concerns regarding the
placement of this billing on the tax roll.
Staff recommends adopting the attached resolution approving solid waste charges for FY
21-22 and authorizing residential tax roll billing.
Fiscal Analysis
Since the rates will not change, approval of them will not directly impact the City's General
Fund. Authorizing tax roll billing for individually billed residences allows the City to
continue to collect revenue per the Franchise Agreement, through a tax roll billing credit
of $1.06 per customer enrolled ($0.73 to the Recycle Fund and $0.33 to the General
Fund). This amounts to approximately $55,000 a year to the General Fund.

PUBLIC HEARING ON ESTABLISHING SOLID WASTE CHARGES
AND ORDERING RESIDENTIAL SOLID WASTE CHARGES
COLLECTED ON THE TAX ROLL
NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Desert, will hold a virtual public
hearing on Thursday, June 10, 2021, at 4:00 p.m., or as soon thereafter as practical, in order to
receive public comments, hear and consider all public testimony of all interested parties for the purpose
of ADOPTING A RESOLUTION ESTABLISHING SOLID WASTE CHARGES AND ORDERING
RESIDENTIAL SOLID WASTE CHARGES COLLECTED ON THE TAX ROLL
The hearing will be conducted in accordance with the City's emergency protocols and options.
Instructions for remote participation will be listed on the Posted Agenda for the meeting at:

NOTICE IS FURTHER GIVEN that the City has prepared and filed with the City Clerk a report
containing a description of each parcel of real property receiving solid waste service that is subject to
collection of the solid waste charge on the property tax roll, and the amount of the charge for each
parcel for the year, computed in conformance with the schedule of rates in the proposed resolution. A
copy is available upon request. The proposed rate schedule is also available for review on the City's
website www.palmdesertrecycles.org.

RESOLUTION NO. 2021-32
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING THE RATES IN EXHIBITS 3A, 3B,
3C, AND 3D FOR BURRTEC WASTE AND RECYCLING SERVICES
UNDER CONTRACT NO. C27411 FOR SOLID WASTE MANAGEMENT
SERVICES; AND REQUESTING THE COUNTY OF RIVERSIDE
COLLECT THE ASSOCIATED COSTS FOR INDIVIDUALLY BILLED
RESIDENCES ON THE TAX ASSESSOR'S TAX ROLL FOR FISCAL
YEAR 2021-22.
THE CITY COUNCIL OF THE CITY OF PALM DESERT HEREBY FINDS,
DETERMINES, RESOLVES AND ORDERS AS FOLLOWS:
WHEREAS, on May 28, 2015, the City Council approved an Amended Franchise
Agreement with Burrtec Waste and Recycling, LLC to provide solid waste collection and
recycling services to the residents and businesses within Palm Desert. The term of this
agreement is June 1, 2015, through May 31, 2023; and
WHEREAS, the Franchise Agreement establishes rates for solid waste and recycling
services within the City of Palm Desert. These rates may be adjusted annually, as set
forth in the agreement, commencing on the second year of said agreement. Rates
adjustments may be applied at 100% of the PPI with a 5% cap, unless otherwise
approved, and to become effective July 1st of each year; and
WHEREAS, the City Council approved the implementation of the Vehicle Impact/Road
Maintenance Fee effective July 1, 2016; and
WHEREAS, the City Council approved the implementation of the Recycle Fee effective
July 1, 2017; and
WHEREAS, the City Council approved the implementation of a Commercial
Foodwaste/Organics Recycle Program effective July 1, 2017; and
WHEREAS, the collection of refuse service fees for single-family residential properties
may be collected through the County of Riverside Tax Assessor's Tax Rolls in compliance
with all laws pertaining to the levy of the assessment, and as authorized by City of Palm
Desert Code Section 8.16.110. These charges are levied without regard to the property
valuation; and
WHEREAS, commencing July 1, 2015, the City Council approved the County of Riverside
to collect fees for solid waste and recycling management for individually billed residences
on the Tax Assessor's Tax Rolls, until such time as rescinded; and

WHEREAS, a copy of the written report containing the parcel listing of all residences
included in tax roll billing and the charges assessed is available for public review by
contacting the City Clerk's Office.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF PALM DESERT,
CALIFORNIA AS FOLLOWS:
1. The foregoing recitals are true and correct.
2. The proposed service rates for solid waste and recycling management services
provided by Burrtec Waste and Recycling Services, LLC, as reflected in Exhibit
3A, 3B, 3C, and 3D, are hereby approved to continue to be in effect in FY 21-22.
All other rates, fees, services, remain in accordance with the Franchise Agreement
currently in effect.
3. The City Council hereby requests the Riverside County Tax Assessor to place the
collection of charges for solid waste services for individually billed residences on
the County's tax rolls.
4. Burrtec will pay to the City $1.06 per parcel per month in a tax roll billing credit to
the City, to be divided $0.73 to the Recycle Fund and $0.33 to the General Fund.
