Honorable Mayor and Councilmembers:     This request is submitted on behalf of the Encore Series Community Inc., (Encore HOA) located on two cul‐de‐sacs ‐ Encore and Anastacia Lanes, off of Shepherd Lane.      Encore HOA does not oppose GHA's Montage development, but it is requesting the imposition of a condition of the development – the installation a streetlight at the southeast corner of Julie and Shepherd Lanes.   During the planning commission meeting re Encore HOA on July 16, 2013, Mr. Berryhill noted that “there is a lot of traffic on Shepherd Lane and out to Julie Lane.” See attached planning commission minutes from 7/16/13). GHA’s Encore and Signature Developments have increased the traffic on Shepherd and Julie Lanes.      Shepherd is well over a half mile long and is well lit for public safety on the east side from Frank Sinatra through Academy Lane.  However, it appears there was a lighting oversight when  the Encore HOA was developed. There are no streetlights for Encore HOA (from Anastacia to Julie Lanes); therefore, it is the only area on Shephard without any streetlights.  There are no streetlights on Julie Lane.     At night, particularly on the southeast side of Shepherd and at the southeast corner of Shephard and Julie Lanes, it is very dark, dangerous and invites crime.  Someone walking down the street at night, walking a dog, jogging, riding a bike, etc., could easily dart out in front of a car undetected ‐ until it is too late. The addition of the Montage development will increase the  traffic and the need for lighting in that area as the lack of lighting will cause increased dangerous conditions for both the existing and new residents.     Therefore, if not already in the plans, Encore HOA is requesting the installation of a  streetlight at the southeast corner of Shepherd and Julie Lanes be added as a condition for approval for the GHA Montage Development.   2   Respectfully submitted,     Karen J. Riess, Esq.  74202 Anastacia Lane   Palm Desert, CA 92211  Telephone: (760) 895‐4066  Toll free Facsimile: (866) 502‐6009   This e‐mail transmission, and any attachment(s), is intended only for the person or entity to  whom this e‐mail is addressed. This e‐mail may contain confidential, private proprietary or  legally privileged information.  No confidentiality or privilege is waived or lost by any mis‐ transmission. If you are not the intended recipient, you are hereby notified that any disclosure,  copying, distribution or use of any of the information contained in or attached to this  transmission is strictly prohibited. If you have received this transmission in error, please  immediately notify us by forwarding it to Karen@krg‐law. com or by telephoning us at (760)  895‐4066. Immediately delete the original transmission in its entirety without reading it and  destroy any hard copies.    MINUTES PALM DESERT PLANNING COMMISSION JULY 16, 2013 the project can continue moving fonvard. He also stated that they have reviewed and are in favor of the conditions of approval. He mentioned that John Rodriguez from Heitec Engineering is also present to answer any questions. He offered to answer any questions. Commissioner Stendell asked if the stucco will be painted or colored stucco. MR. GONZALEZ responded that they will use acrylic paint for the stucco. Chair DeLuna said that in the event the State Department of Finance does not approve of the acquisition, she asked if the lots will become narrower. MR. GONZALEZ replied that they would propose to leave the south section of the noRh tract (Lots 17 through 24) alone, and for the other lots they will modify the plan. MR. JIMMY BERRYHILL, 74098 Academy Lane East, Palm Desert, California, commented that he lives in the home on the corner adjacent to the first property. He mentioned that when they first bought the property, they were told that a Jewish Community Center was going to be built. The community addressed their concern with line of sight, and those issues were resolved. He said that they again have a concern with the line of sight with the proposed homes. He stated that they are requesting that the height elevation on the lots behind them be brought down. He mentioned that there is a lot of traffic on Shepherd Lane and out to Julie Lane. He said there is a vault on the north corner of Portola Avenue, which might need to be lined up. He asked if that has been discussed with the Planning Department. Mr. Swartz interjected that it has been discussed, and a Southern California Edison pole will have to be moved. MR. BERRYHILL expressed that the road will have to be wide enough and well maintained due to traffic. He inquired if there is a landscape agreement with the applicant. Mr. Swartz replied that there will be an agreement, and that the applicant is proposing a homeowners' association. MR. BERRYHILL said that his community wants to make sure the applicant will maintain their rights-of-way because it can become a problem. He also would like to make sure that during the development of the homes, the appiicant complies with the City's noise ordinance. MR. JOHN RODRIGUEZ, 42575 Melanie Place, Palm Desert, California, remarked that the natural contour of the land falls to the northeast and drops off significantly to that point. He noted that the parcels fall towards Portola Avenue and will drain in tha[ direction.
